USCIS H1B Visa 2014 Regular Processing Time? Premium Processing ? FAQs ?

Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

    • Same here.. EAC131485* series. It looks like most of the approved or RFE cases are premium cases. For RP I think it would take another month at least I guess. May be end of september…. who knows…. Hope it comes earlier than that… 🙁 I am just worried that if I get an RFE then I would have to wait that much longer after I respond to it and it is definitely not advisable to respond to RFE and convert to premium… That just ticks em off!! Honestly though, I have not seen too many rejections….. so hopefully it should get through??? Does any one know of any Denial cases?

        Yeah I have seen 2 rejections reported in this site. Can you please let me know is it true that it is not advisable to upgrade to PP after getting an. RFE ? U have been advised by friends or seen any rejections in these cases?

        • Hey Cd. IMO, most H1 cases get approved. The one’s that get RFE are most likely the ones where there is a consultant and they have applied for the beneficiary and they do not have a job yet and they have a 80/20 or a 70/30 split which has been agreed upon with the beneficiary. This is why a client letter would be required to show USCIS that they would not be job hunting after getting the H1B but rather have a job already which needs their prescence in the US. However, since the case is already under the scanner, just forcing them to “do their job quickly” within 15 days by upgrading it to premium by paying 1225 kind of ticks them off (this would be true if you were the person handling the case too). This is purely from what I have seen/heard from others, although there should not be any kind of direct impact and there is no legal advise which tells you not to do it. If you feel that you need it because you need to start working ASAP, no harm in doing it. So, if you have already done it, dont worry about it. You will be fine 🙂 sorry, did not mean to scare you or anything there… Hope things work out… chill 🙂

        • @Priya, I got receipt number before only. Once the petition was submitted i got receipt number. Now using the receipt number given in AIMS i checked at USCIS website and found that it is approved.
          AIMS is still showing “ackw received from uscis”.

          You will get your receipt number in AIMS once you got selected in lottery. So if you are not seeing your receipt number then please contact GI team and ask them about clarity.

  5. Hi , My case is approved just now . case number WAC1314351***. mine is RP/RQ. But due to some problems I don’t want to go US this year. Next year after Jan only I am planning to go. ( I can manage my employer in this). So, Can I go for stamping in Jan-2014? or Is it required to go stamping before this year October?. please suggest me…

    Need help urgently……..pls help.

    My petition is approved, but company doesn’t have any US project currently. I just have the receipt no# and the company denied to provide I-797 docs until I go for Visa stamping. I have an excellent offer from another co in the meanwhile for long term project in California. Not sure if I can use the same petition and do the H1B transfer. If I resign, I am uncertainly not going to get I-797 docs.

    Can somebody please help? Is it really possible to join another co.?

    • Firstly, Force your current employer saying you atleast want to get stamping done and you are willing to wait until you get the opportunity to travel. If that is the case they would give you your 797. Use that doc and immediately send that doc to your future employer and have them process it under premium processing within 2 weeks. Don’t go for stamping with your current employer. wait till you get your i129 with your new employer and go for stamping with that. Good luck. I hope it works out..

      The new employer can file a cap-exempt petition (i.e. H-1 transfer) using the receipt number and print out of online status showing it as approved. If you can get the approval notice, that would be even better.

    but please any 1 can update or share their experience regarding stamping procedure or any updates who face already interview from India or other countries.
    Also it is thankful any 1 can guide that i am working for u.k based company for last 2 years so i have to go for stamping in london or back in India.

    • First of all ur nick on the blog made my day haha. About your question as far as im aware, you can go to interview in the country where your residency is (in case you are in london) and of course if you have a valid proof of residency on that place, but as I think you are a indian national, you can also go to india for the stamping. On my opinion i think in london will be easier and less people (i mean at the moment to make the visa appointment).

      If you are residing in UK, then the general answer is that you can attend the stamping there. However, call US consulate in UK and ask them about it as well to be sure.

    Today I got status update
    On August 7, 2013, the 15-day Premium Processing clock stopped on your I129, PETITION FOR A NONIMMIGRANT WORKER. A notice was sent on this date explaining the specific reason for stopping the premium processing of your case. This notice will contain detailed information on further action required by you. Your premium processing receipt notice contains contact information for direct inquiries.

    After replying for RFE I got this message . Can anyone tell me what does it says
    I’m very much scared now . If already decision is made when they will update ?

        Hopefully, it will change to “Approved” soon, typically after 2-3 Hrs wait or your attorney must have received approval e-mail already from USCIS instantly.

        Contact the attorney if you are can’t wait to hear good news.

        This message is common for PP case after RFE response is submitted. I have already gone through this stage.

        I can see same status since yesterday . My employer have not received any notification yet but they told me it might be again for one more RFE or denial .

        Now I’m feeling rejected 🙁 all my dreams vanishing 🙁 🙁 🙁

          I havent seen any update on my case yet.
          Its almost been 20 days since my employer replied to rfe. But my case status still shows “Intial Review” and the premium clock is not started.

          So not really sure whats going on my case.

      I was in the same case like you. I got RFE and convert in Premium Processing. I got the same message like you got. I was so scared, called and talked to my lawyer and my employer all the time. I could not sleep. I thought it was second RFE or denied. But after 4 days, my status changed and I got approval status. And today I got approval notice hard copy from my employer. You never know, so don’t lose your hope, ok.

        Since August 7th pp clock stopped , my employer dint get any notification I forced them to call uscis they told its denial 🙁
        Is there any hope ?? Should I ask for appeal again ?

            First RFE was for employment hand book and client letter .

            Now my employer dint get any hard copy and also USCIS did not provide the reason for denial .
            I was sr software engineer in Samsung Bangalore, I quite job and came to US on h4 but here I’m jobless now . H4 is curse 🙁

  14. My application WAC1314252**** turned into RFE today. RQ/RP.

    How long it will take USCIS to take decision after receiving RFE response? If i convert my application to premium during RFE response stage will it help as far as time concern?

      I got an RFE on 3rd May 2013. My company responded to the RFE on 25th June. The status changed to RFE response review on 26th June. It got approved today i.e. 7th Aug. It was a long wait. If I were to do it again , I would recommend PP for peace of mind. In my case I had already waited too long.

    My petition was selected in lottery and I got a mail from my employer but after that I did not get any case ID yet . Does it mean, my petition has been rejected or it may come . is there any time limit for it?

    • Hi, If your employer told you that your petition got selected, it means that they would have received the receipt number (which is your I797 – notice which confirms receipt and it would have a number on it). May be your employer would not wish to disclose it to you because you could use that and process your H1 transfer with another employer. If you are outside the USA, then they will have to send you the I129, approved petition when you go for stamping! Hope that helps!

            Yes, you can. However, a better option would be to upgrade H-1 petition to PP to know the quicker result. Discuss w/ your H-1 attorney about it.

    Till now I didn’t get any information from my employer about I-797 (Approved copy).I made a call to my Employer, they said that they are following up with USCIS.

    My father name in my passport is “Nageswara Rao” (1 space is there between first name and last name)
    Now he is applying for his passport. The passport agent wrote the name in the application is as “Nageswararao” (Without any space between the name).
    In Summary –

    My father name in my passport – Nageswara Rao
    My father name in his passport – Nageswararao

    Will it cause any issue in future while applying for his VISA?
    Please advise..

    • the name can be changed when you father visits the PSK for the passport appointment. He should have proof of how his name is actually written and the agent in the PSK can make the change in the application

    My company got in touch with USCIS to try to get some information from them on my application. I’m not too sure what was said, but they have now upgraded me. I suspect this is because they are still some way off processing my series (EAC13145*****).

    I post a tiny statistics, which you can consider in your own estimation on how’s USCIS’s progress.

    Statistics in 138 series.
    Series: EAC1313851***
    Sample: 23 petitions
    Initial Review: 10 petitions
    Decision(Approved): 11 petitions
    RFE: 2 petitions

    Conclusion: 50% petitions in Initial Review in 138 series

    I’m still waiting, of course 😀
    I’m happy to read other statistics from you like this one.

      Here are my results for a sample of 50 in 148 series
      Approved – 16
      Initial Review – 18
      RFE – 6
      conclusion – again i would say a little more than 50% ,as few of them were approved in PP in may and early June.
      At this rate it might take another 2 months to get most of the petitions processed.
      For the guys who are freaking out , i would suggest you to freak out if you dont hear anything untill end of september. Untill then take time to hone your skills rather than getting worried. Best of Luck to everyone and three cheers to Saurabh.

        Honestly, I am not very happy about your conclusions 😀 mostly because I think you’re correct.

        I also see overall 50% completeness for a long time and I am afraid it will take time till September to process everything.

        But on the other hand series 135 and below are much more complete (i think 80-90%), which is a good sign!

        We can’t compare both. I think if you are in 137 series u will be more anxious if ur application is in initial review as most of the other applications are either approved or initial review. If u r in 143 series u will keep praying that your visa directly gets approved instead of going to RFE so that you can mentally prepare to start working. Depends on your perspective.

  26. Based on Vicky’s advice , I have started analyzing 300 petitions from 1313952500 to 1313952800.

    Yesterday evening it was 142(out of 300) still in IR.
    Today 11 were processed out of my sample of 142 still in IR.

    So assuming on an average if they process 10/day in my 300 series then it comes to 50/week and approx 150/3 weeks.
    So hoping that there would be some status update on my case maximum in 3 weeks.
    (The stat would change if #case processed/day changes in the next coming days)

    I am on H1B with company A and H1B is valid till 2016. If I moved to company B with H1B transfer but no extension in the H1B visa validity, with company B also H1B validity is till 2016. Now if I go out of US, should I get stamped before coming back US.

        • As far as I know the rule of thumb is you need a valid stamped visa on your passport to enter US. If you get a transfer within the date of your valid stamped visa date you need not go for stamping but if you get an extension beyond that date you need to go for stamping. Example you have a valid stamped visa till 1 st October 2014 you can go back to any country and come back to US n number of times within 1 st oct. but even if you have an approved petition beyond 1st October say from 9 th October 2014 to 9 th dec 2016 and you want to enter us after 1 st oct 2014 you need to get your visa stamped. Hope this makes it clear.

        Once RFE documents have been submitted, they generally take up to 60 days. However, in some cases it can take even longer.

      You always need a valid petition from the employer you plan to work for, and an unexpired visa stamp (from any employer) whenever entering US. So you can enter on B’s petition and A’s unexpired/uncanceled visa stamp. When A’s visa stamp expires, you can get B’s visa stamp (when you are out of US) and enter using B’s stamp and B’s petition.

  30. Guys, my H1 petition approved on 31st July. My series no is WAC131375XXXXX. I would suggest you all to ask your attorney to send an e-request to know the status of your petition. USCIS will give you the receipt no, which you can quote after one month incase they don’t revert back. Mine was due on 7th August, but before that only they processed mine. Hope it will help

        if you see the link https://egov.uscis.gov/cris/Dashboard/CaseStatus.do, on right side pane, second last link is for e-Request. It is completely free of cost and one should definitely request if expiration date on your petition page is older than current date. In my case, it got expired on 30th June and my attorney sent e-request on 7th July. But i will suggest attorney to raise the e-request

          – qualified for the offered H-1 position
          – have education equivalent to US Bachelors, or at least 3 years of work experience for each missing year of education.

          Did your employer submit education equivalency certificate w/ the filing to show that you satisfy #2?

    I am working from one Indian IT company on L1B which got expired and currently am staying on I-94 which is valid till Dec-14.Company A has filed H1 for me this year which is still in “Initial Review” status. My Indian company wants to file L1A petition for me now.

    1) What could be the complication if L1A petition gets approved along with H1B.
    2) Can I work on L1A and have H1B as well ?

    Would appreciate your help on this.

      1. Both can happen in parallel. Last Action Rule will determine what your eventual status will be. You can do a quick search of this online.
      2. You cannot work for both of them. Depending upon what your status is L-1A or H-1, you will have to work for the corresponding employer.

          • I don’t have population statistics from the times of Abraham Lincoln and JFK, but shame on a country like India for not producing any leaders after Nehru and Gandhi even though its population is more than 3 times that of the US. Life in India has become very binary. When you are in school, you are expected to study every breathing minute and make the choice between science or business at some point. Soon, you have to make a choice between becoming a doctor or an engineer. If you are not either one of the two, you are looked down on by everyone. I am sick and tired of being placed in to different classes whether it’s based on what caste you belong to, what your income is, what you studied or what work you do.

Neither do I see the nation being free from the clutches of politicians and corruption nor do I see a major chunk of public being socially aware as understand their rights as citizen and vote for the right person to rule. I also don’t see social activists like Hazare succeeding. Everything that Ramesh mentioned is true and sadly it is all self inflicted by the people of the nation. Though it is tough to accept, the nation is far far far away from purging itself from the clutches of these problems and any individual who thinks they would be able to is ambitious (and I wish them the best and hope they succeed). Any one who has lived in the US for a while would agree with me that given the current state of affairs, US would be a much better place to live in… 🙂 No disrespect to my country, I love my country and I am proud of its rich and varied Heritage but definitely not the people who ruin it at this juncture and I most certainly do not have the patience nor the proclivity to change the thought process of the millions of uneducated souls who are just so incorrigible!! Just my opinion 🙂 I apologize if I had offended anyone though. I did not intend to!! 🙂

      • Good to hear that you are going with the intention of career growth. You are in the minority because a majority of Indians are going with the intention of becoming permanent residents. Hence, there is a long backlog in EB-2 and EB-3 categories for permanent residence for Indians.

      Your employer knows your receipt number. If you put the number and he happens to stumble upon it, he can do little more research to see what kind of questions you are asking online. I can’t think of any other reason.

  35. Hey Guys,

    I am one of those guys who are left in IR and series after them are getting approvals. For a while I have been trying to find a pattern that can help me figuring out when USCIS will start processing my case.
    My case number is 8th in a series so I checked 200 cases of my series and the next hundred e.g WAC13135 50001 to WAC13135 50100 and WAC13135 50100 to WAC13135 50200.

    I made a list of all the cases that were in IR and checked them on daily basis. You won’t believe what I found out. USCIS was processing 1 case daily from both of these series. Means they are picking a case they left from each 100 cases and processing it.
    Now there are 9 cases left in my series which means in next 9 days I should see some changes in my case status. Hope this help!

        You should go to USCIS website and check status of numbers from EAC1314650800 to EAC1314651000. These will be 200 cases or you can check for 100, its just the more numbers you will do better picture you will get.
        Please make a list in excel of the cases you find with status Initial review. From today onwards you will be checking only these numbers and you will see that the status of a couple of cases will change to either Post Activity or the error “We cannot provide you the status right now” that is the RFE.

        Remove these cases from your list who’s status have been changed to reduce the list on daily basis.

        Tried my best to make myself clear.

          See the below cases approved on same day(July 29th). I hope this shows the pattern is not what u mentioned. Please correct me if I am wrong.

          • Its not true…What John Infy is correct….. Just wait for ur result…engage urself into something else…The result will come when it is supposed to. Just wait and watch…Refreshing the status every 5 mins….looking for some posts on Redbus wont change the outcome or its timing …>So stay calm and do something constructive meanwhile.

      Honestly, I think this USCIS does.

      They go through all serious and resolve the easy cases.
      Easy case means: 1) large company with good reputation. 2) no doubt on beneficiary education. 3) no doubt on employer-employee relationship, etc.

      These case are easy and quick so let’s resolve them first.

      The cases which look more complicated and need a closer look are flagged and reviewed by another more experienced person – and this makes the delays and non-systematic resolving, I think.

      So if your case is a little unique and is not the easy one, then USCIS need little more people to look at your case and do background checks and that’s why it takes longer.

      this is my idea. i am open to discuss it.

      • I dont Agree Boner. What makes u think that? I have seen people who have filed from small companies (15-20) and got approvals while 10K + company candidates are still waiting. So there is nothing like easy or difficult case. Ya I dont know how they do it so no comments on that.

          As a software developer we are bound to make logic and pattern of things. I was not concerned about the time either but when i got left behind and series after were 90% processed I got a bit worried.

          It might not be exactly 1 case in 100 but can be more then that. I myself and some other people are checking it and getting some positive result.

        You can restrict yourself to 700 if your number falls in 500 or 600 series so you won’t have to check these 142 numbers tomorrow ;=)

        Reviewed set: 50 petitions
        Initial Review: 11
        Decision or RFE: 19

        Conclusion: 60% done on 138* series.

      I checked 300 cases in trenches of 100 cases each. I could see around 30 cases processed in each of the 100 cases. So it is confirmed that each 100 cases are handled separately. I checked in EAC1315151*** series.

      Another thing is, In my 100’s series, 11 cases processed in May, 9 cases in June and 7 Cases in July and 1 case in Aug (so far). Worrying thing is, the slowness with which they process the cases. This Includes PP cases also. I am seeing one case whose 15 day PP clock stopped as of Aug-1 (today).

      Form here on, I have to track the “IR” cases alone and see try to find out the pattern.

      Besides doing all this, I could wait for 2 more weeks and check the status again. 🙂

      • For the case, whose 15 day PP clock stopped as of Aug-1, was processed and approved. So 2 Cases processed in 2 days in August. Hope if they process at least a case a day.

    Can I get it stamped in the local US embassy or should I go to US embassy in India?

  37. The focus of this petition is to demand Department of State to streamline the security clearance and provide better tracking for administrative processing visa cases. This will only help retain capable talent contributing towards the growth of the country in areas of technology, medicine and science

    At present the uncertainty of the security check process and the often time-consuming delays can cause a potential visa applicant to wait an unspecified amount of time. Meanwhile, business plans, employment opportunities, major life events and holidays can pass without the issuance of a visa. Applicants can be left in this status indefinitely with no explanation and no legal recourse. There is no one to appeal to and our lives are literally on hold. Most of us are working middle class that have struggled to make our dreams of a future together become a reality.

    Some suggestions for improvement:

    1. Perform the security check proactively when the work petition is filed and only grant I797 for applicants who clear the required security checks
    2. Add more staff – the department might have a backlog with the confines of resource limitations and adding more staff will help improve the turnaround
    3. Review and update of the mechanism popularly referred to as Visa Donkey Checks that are based on a “name hit”
    4. Embrace transparency and provide reasonable turnaround for additional administrative processing cases and in case there is delay share the reason for delay from the required agency

    I request your immediate attention to issues and concerns troubling tons of highly contributing non-immigrants toward the growth in economy. Historically the United States for America has been a land of diversity and opportunities and it will be a loss if diversity and opportunities shrink , lets join hands and support this change
