USCIS H1B Visa 2014 Regular Processing Time? Premium Processing ? FAQs ?

Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

  1. Hey guys,

    On 4/26 .. my case status said “RFE” but this morning, it shows “Initial Review” – I’m confused cos this seems a step backwards. In both cases, it said my clock has stopped and action is required from my side.

    When I called WAC PP Service Center, the rep’s exact words were – “There’s nothing wrong with your case” and “You have nothing to be worried about” (he couldn’t tell me more cos I’m the beneficiary, but the cryptic answer is still freaking me out)

    Anyone know why the status could change from RFE to Initial Review?

    • @DG: Did your lawyer/employer ever received a letter explained the reason for RFE?? My lawyer got an email saying that USCIS has mail a letter with RFE on April 22nd. Today I checked my status and now it said they letter was mailed pn April 26th. Before it said April 22nd. For your case, maybe they don’t need extra evidence anymore and that is why it went to initial review again.

    • Don’t stress about it. Sometimes cases go into RFE because more data is needed. If the data has been submitted properly and/or they have found the answer they were looking for (maybe they didn’t look throught the file properly), they will move it back to “Initial Review.” I wouldn’t worry about your case moving backwards. As long as it isn’t being rejected/denied, you should be fine. Relax and things will work out 🙂

        Appreciate the response! I believe for PP cases, faxes are sent not letters (and lawyer has confirmed that they haven’t recd anything). I hope the status change is not due to a system error but rather that they have found the info they need.

  2. Hi everybody ! Do I need to still have hopes on my application ? I am AD/PP/CSC. I havent heard from any body so far (either attorney or DSO or employer ) and also my application packet hasnt been returned back yet !! So I am just wondering If i can keep my hopes still???

    • I am in same boat as u. AD/PP/VSC

      Of course its a Done deal for Us-we were NOT selected. Plan B is what we should be looking at Now.

      It now a question of when the packets are getting Back IF we are not on waiting list.

        • The company here may be willing to take me to their office outside. Alternatively, if by end of year when my status expires the immigration bill is going ok, i will opt to become illegal then get status then i can work my options from there. my employer will keep me through all this. i have exhausted my opt stem extension

  3. I GOT MY RECEIPT NUMBER FROM MY LAWYER JUST NOW..IT WAS GENERATED ON 141ST DAY..CSC…
    i was glad that my name was picked in th lottery but trust me at the same time i was thinking about u all who are waiting and losing hope :(.i wish i really could do sumthing for u all..the least i can do is pray…
    once i was in the same boat..reading comments like *hang in there guys **dont lose hope*and bla bla never gave me hope,it use to annoy me…noone can ever feel the pain we use 2 at that time..i always wanted to comment n say ”Easier said than done” but neways i just did not want anybody to see how weak i have become and lost all my hope

    i can only pray is all u friends get through this very tough time with flying colors ,if not H1 then u guys shoulD be thrown with so many other better options that h1 shouldnt make much of a difference iA:)

  4. Anybody who previously called USCIS and they couldnt find you in the system, anybody got receipt number afterwards ???? or everybody who’s employer called uscis and your name was not in the system got out of lottery?

    For non PP guys … Don’t worry you have plenty of time…
    PP guys look for another options too.. like extend your OPT .. Take admission or marry whatever..
    Non PP guys .. chill and wait for your turn..you will get your receipts soon.

  7. Hi Got my reciept number today – Regular Quota / Normal Processing / Vermont Center.

    EAC131385****

    Since its normal processing the receipt is sent through snail mail and it takes time to reach.

  9. Ok for guys who are still waiting for their receipts.
    Its not over yet, people are still receiving their receipts from Day 143 and today is 148. So if USCIS is done sending all receipts say by May 2nd (Friday) day 153, keep your hopes up until May 10th and pray hard. Good luck all.

      I think your H1B petition for AD/RP/VSC has been approved. Right? Since you have been quite active in this forum, do you have any idea if most of them under AD/RP/VSC have started to get their approvals. My petition was also filed under AD/RP/VSC with my receipt date being April 12. Thanks for your time!

      • Employer received notification that the petition has been approved. This means the Vermont Service Center is already approving Regular Processing, Advanced Degree petitions. Approval was 04/25/13.

          Anybody sign up for automatic status updates by email/text? Since with RP the lawyer is notified by regular mail, seems you can find out before the lawyer this way…

  12. Though the receipts are getting generated my lawyer said the chances for AD/RP are very low now as they are just sending the RD/RP receipts. So if any AD guys getting receipts kindly update. I am going to wait till may 10th as per lawyer instructions and then take some action.

            oh man.. I have been reading every single post since day 1…

            I may seem patient but I can only tell how stressed I am since the beginning and how this stress affected and still affecting my whole life… I have those teenager spots on my face.. super sweaty hands every hour… super strong headaches… erectile dysfunction in bed.. already lost 9 pounds… I’m not gonna mention about the decrease of my work performance in the office..

            I really cannot explain this stress coz I don’t wanna get in to a real of fake marriage.. Can’t live on a knife for the next 2-3 years with the fear of breaking up the marriage… shoot.. hard to trust people in the fookin us of a..

            this week I got a good job offer and can’t take it…

            spend so much money time energy on my MBA here..

            was working at Microsoft in my country before coming to US of A..

            really dunno what to do.. this wait is being a killer one for me..

            All I do is praying to god… I shouldn’t be that unlucky to loose this thing where I have about 90% chance of winning..

    • AD/RP/WAC still waiting. I’m going to wait until the 10th too. Apparently there are people who have received receipts and their checks have not been cashed nor SEVIS updated. Did you check with your DOS Phoenix ?

    • Yes I checked with DSO in the morning and my employer checked with USCIS on Thursday. There was no record. He is going to check again on 1st may and 10th May with USCIS or whenever they stop processong in VSC as well and I will check on 10th may with DSO again.

    They are still printing the receipts. I have got email from my employer last week that my petition has been picked and he will update me about the status but my receipt has not come yet. This means, they are not done with the printing.

    Will confirm with my employer about it. But you guys keep the hope alive.

      • We don’t know how many are left.. but the receipts are still being generated.. So today on MONDAY – 8:30Am EST they have already processed 657 receipts.. But these recipts have other applications as well like permanent resident, etc.. but this is to keep the hope alive as many receipts are for h1b and the date on it says received on 8th April – meaning they are still processing lottery receipts..

  20. Both myself and my husband applied for H1B on the same day by the same Employer. But myself got the receipt (i.e WAC13138****). But for him No Updates. Is there any possibility to get the receipt from USCIS ??

            @DanceWithWolves, if you are really so knowledgeable we expect some decency and maturity from you. And, if you have the ability to build your career in any of these countries then why are you so pissed at IT guys?

          • More than being pissed off at IT guys, I’m pissed off at the IT companies and their reprehensible practices. They use H1Bs to bring people into the US, pay far below market rate (I’m sure you guys would be getting around 50k in the US when the market rate is 75k at least) to do mundane work (nowhere near the “specialized” occupations the H1B visa is meant for). And worst, many of these visas are not utilized for 3 yrs (6 yrs with extension) and often, not at all. Even on this forum I’ve read of people lamenting that their earlier visas expired before they had the opportunity to come to the US, and now they are stuck in lottery.

            And yeah, sorry for the bad language; just venting my frustration behind the veil of anonymity the Internet provides. I’m not such a bad guy in real life. But think of the problems I have to face in uprooting a settled life with wife and a kid to go and make a life in another country. All that you have to lose is a year of deferred dollar income.

But I know now, how this system is really balanced and best, so as to get rid of people like u who are “Wolves” with human body, just think others inferios and urself superior.           • I have no personal grudges against anyone in this forum…That being said, the implementation of a lottery system to allocate H1B visas is utter bullshit. Equating people who have invested time, money and effort into earning advanced degrees to an average Joe could be the most demeaning thing USCIS could do to a person’s career.
            Priority should be given to persons with advanced degrees from US, then persons with regular degrees from US, then people who have other working status in the US (L1, TN etc), then people who are here on dependent visas and if there are still H1B’s remaining, it could be allocated to people applying from out of the country.

      For L1 you should be
      – on company’s payroll.
      – for atleast 1 year out of last 3 years.
      – you should have worked in the company’s office located outside US.

      All the above conditions are must.

  24. I just now came across a receipt number -EAC-13-041-51XXX, this is for I129 form.
    It says ” On 19 April 2013 we got correspondence of I129 application..” but day it was entered is ‘014’ .
    What this could be? any idea?

  25. I believe processing of premium cases are almost done. Regular processing petitions should be still pending. I have not received my receipt and still waiting 🙁 🙁
    The below is the info sent to me attorney. Hopefully, I will hear something next week. As of now, fulto tension, lets see how it goes.

    Update on Receipt Notices for FY2014 H-1B Cap Cases
    Cite as “AILA InfoNet Doc. No. 13041600 (posted Apr. 16, 2013)”

    USCIS has started the data entry process for H-1B petitions selected in the lottery. Premium processing cases are being handled first and data entry for those cases should be completed by April 15. USCIS announced on March 15, 2013, that the 15-day premium processing clock will start on April 15. (AILA Doc. No. 13031549)
    At the AILA Spring CLE conference on April 12, 2013, Donald Neufeld, Associate Director of the Service Center Operations (SCOPS) Directorate, informed the audience that data entry for non-premium processing cases will begin after the premium processing cases are entered. Data entry for non-premium cases will likely not be completed until sometime in May, and rejection notices for petitions not selected in the lottery will be sent out after that. Please note that when the cap was reached on the first day in 2008, USCIS did not complete data entry and issue receipt notices until late in May. (AILA Doc. No. 08061261)
    Non-premium processing cases can only be converted to premium processing after a receipt notice is issued.

For FY2008, the entire quota was exhausted before the end of the first day that applications were accepted, April 2.[19] Under USCIS rules, the 123,480 petitions received on April 2 and April 3 that were subject to the cap were pooled, and then 65,000 of these were selected at random for further processing.[20] The additional 20,000 Advanced Degree H-1B visas for FY2008 was exhausted on April 30. In FY2008, a total of 276,252 visa applications (109,335 initial, 166,917 renewals and extensions) were approved, and 129,464 new initial visas were issued through consular offices.

  29. Guys, I have lost hope now. I had the opportunity last year to apply, decided not to; and applied this time. Never thought, will land in no man’s land. Since my employer confirmed no cheque cashed till today, I think, I lost in the lottery process. I have been to US on L1, and just loved the work culture, so wanted to continue. Looks like HE has other’s plan. Any thing now, will be a surprise, but so far seeing the trend and after applying some logic, looks like I am done. My center is CSC, and action is already minimal now in CSC. So No cheque cashed till now, and CSC as center… feeling very disappointed right now. But looks like all rejections fails the same ..dishearting 🙁 I wish you all luck winners a great luck, and it will be an amazing experience for all of you.

    • What the f*** are you whining about? You can still come to the US on a L1. Unless you are in a shitty fraudulent company, there’s no reason why it will be rejected. Since your employer applied for H1B, they should be willing to sponsor L1 as well. Unless, of course, you are in one of those fraud consultancies who have no work in hand but pimp you out for third-party work. Then no chance of L1.

      • Please refrain from rude language 🙂 You say DanceWithThe Wolves?? I am with one of the most premium employer in US, but H1 gives lot of flexibility. Also L1 is getting expired, in late 2013 and I am sure, you must be aware of rejection possibility of L1 nowadays. Hope this will ease you a bit. Good Luck!!

        • Flexibility as in the ability to change employers? If you are with a “premium” employer, there’s little risk of L1 rejection.

        • L1 is max 5 years, h1b – 6 years. L1 and H1b are counted together, meaning even if you would get h1b, you will have the extra 1 year compared to l1.

          also if you really worked on l1 in states, natural path would be green card, not h1b
