USCIS H1B Visa 2014 Regular Processing Time? Premium Processing ? FAQs ?

Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

  1. Is there any one from Deebecon got their H1b approved?. I was told that my petition was approved but they not giving the petition papers now. It look like they will send the approved papers only after I join/be on their payroll. Is this normal way of doing it?

    I just found out that my H1B was approved. However, the notice date said June 25th 2013. Apparently my lawyer thought he had informed me but he hadn’t I emailed him today and that is how he sent me a scanned copy of the approval notice. My question is what will be my next steps?

    I was on OPT that ended January 2013. I had to leave the US in February but my employer kept their word and filed for my visa. I know that I have to go to Barbados to do my interview but I don’t see any experiences being shard on this site for that consulate.

    Is it the same process for each consulate? Also, what am I to receive from my lawyer before I make an appointment or go to Barbados?

    • Approved…Yay,
      The process is more of less same, but you should check out the consulate website in Barbados to be sure. You will need employment related documents, 797, copy of LCA, I-129 from your employer. They will be able to provide employer related documents as well (if required).

    I am not sure if my earlier query is visible to everyone.

    Issue:
    I am in a situation where my H1B Petition was Approved last year but not yet stampped thru Company A in India. Now I have resigned Company A and moving to Company B. I do NOT have the receipt number nor the copy of the approval notice with me. I will be joining the new company next month – unfortunately, without getting the Approved H1B petition details from the current employer.

    Now, my questions are ..
    1. Can the new employer be able to file cap exempt petition for me in this situation?
    2. Is there any way to find out the receipt number from USCIS/some other source to facilitate the new H1B cap exempt petition with the new employer?

    My case number is WAC131395**** and it was in IR , from past 4-5 days site is showing some other message it says
    “At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.”

    Any Idea ??

    My H1 petition was filled in 2007 and got approval till May-2010.I travelled to US and returned before 2010 staying for only one year. I have changed employer and now my new employer is trying to use old expired H1 petition to get H1 visa again for me to go and work in US. Can a h1 application filed in May-2007 be renewed in June-2013. How long is H1 visa valid. Please help me understand this

    • An H1b petition is usually valid for 6 years. So ur current employer can file a cap exempt petition if you have not used up all the 6 years. The clock starts at the time you start working in US on H1b.

    Has anyone from KPMG or the Big 4 got their approval decision just yet?

    My work is supposed to start on October 7th and I have a 1-month resignation notice.
    Any idea when I should approximately get a decision?

    • If this gives you any comfort, mine is wac131435****, and is in IR since Apr 8. I will suggest upgrade to PP if you are time bound to start, resign etc.

  9. To those people who ask the processing time and complain the pain of waiting,
    I just want to say. If you don’t want to suffer, please upgrade to premium process and pay the money. I hate waiting, so I pay it and I got my approval after 8 days upgrade.
    If you want to save money and complain again and again, I would say 3 words to you: YOU DESERVE IT!!

  11. Got RFE on June 25 th. don’t know what the RFE was and if it has it been responded..
    The wait is killing me… Don’t know how long it’s gono take… I hav also registered for masters and hav to pay my tuition in a few days. Should I do premium processing now or wait for a little longer? Hope I get to know the desicion before my classes start…

    I need clarification on below question.
    My H1 was approved on 16th July and I have H4 extension application is with USCIS now. If I get H4 extension approval after 1st October. Will H1 petition be invalidated or do I need to convert back from H4 to H1 COS.

      It will not become invalid. Your status will change to H-4. You can move back to H-1 either through COS or entering US on stamped H-1 visa.

      You can withdraw your H-4 extension after Oct 1. When is your current H-4 I-94 expiring?

        My H4 I-94 is expiring on 10th Aug.

        As mentioned earlier – my H1 was approved on 16th July and I applied for H4 extension on 9th July.

        I have two options left with me now to remain in H1 status , I need your help in choosing best one –

        1. Withdraw H4 application after 30th Sep if its not approved by then.
        2. Send an H4 amendment letter to USCIS to extend my H4 only till 30th September

    I am filling DS-160 application right now.
    I am travelling with my wife and one kid. I filled one DS-160 for myself.
    On “Thank you” page there was option for filling “Family Application”. Should I use it? Or should I complete separate DS-160 for my wife and another one for the kid.

    I am planning for VISA stamping along with my family (wife & kid).
    Question is –
    We have registered & taken a marriage certificate at village panchayt where marriage taken place. They had given in a A4 size printed form certificate where we usually get it in xerox shops. They Panchayth officer wrote the names and dates with pen and sealed it with govermet stamps and added in their books as the marrige held in that village.

    Will it be a problem while in visa interview as it is manully written by hand in a normal printer form?
    Please advise whether i can proceed with this or not?

  20. My friends have started getting approvals. I am still on Initial Review, Apr 8th submission. I have not submitted client letter, since I changed my client just before I filed H1B. I have been working on L2-EAD since last 2 years. Will I get a RFE for client letter?

      They may ask for the client letter or approve it w/o it. There is no set formula and depends upon the adjudicating officer’r review.

    My H1b was applied through a US based company and it got approved. When i see documents sent by my company, i could see that my year of passing of graduation is mentioned as 2011 where the actual is 2007.

    Will it cause any issue in my H1b Stamping?

      It shouldn’t. Which document exactly contains that information? AFAIK, 797 doesn’t have graduation year. Is it I-129?

    I have received RFE for offer Letter and or Contract letter.
    I am not sure how complex this RFE is .
    I am not sure how should i reply.
    Does it it necessary to mention the period for the employment or contract.
    Not sure how my attorney will reply to it.

      The contract usually contains start and end dates. Do you have a client? If yes, then they would have issued a client letter.

    My H1 filed by company A has been approved, is it possible to transfer my H1 to company B and start working for it from Oct 1st.

    I got mixed feedback, some suggest that i should be working for atleast 2-3 months before we can transfer H1 to another company.

      The new employer can file a cap-exempt petition for you even prior to Oct and mention a start date of Oct or later. It it not mandatory to have 2-3 months payslips when it has been filed prior to Oct 1.

        Thanks for this valuable info. Just wanted to clarify a few things on this same topic:

        1. Company B can file the cap-exempt petition only after H1B petition from Company A has been approved by USCIS
        2. If the above is correct, what documents does the Company B need to file for the cap-exempt petition:
        a) Original Approval notice from USCIS
        b) Copy of Approval Notice
        c) Just the Receipt number of the filed petition

        Can you please advise on the above queries?

        The reason I am asking because I am not sure if employer A will share the original approval notice with the applicant fearing that they can apply elsewhere.

          Yes, only after A’s petition has been approved.

          Its best to have a copy of A’s approval notice. If not, you can still try w/ A’s receipt number and print out of online status showing it as approved.

  26. Hey I know this has been asked before and a lot of ppl get angry if they see the same question again. But this is different.
    Since 19th June. the status of my case is “At this time USCIS cannot provide info”
    As i understand, an RFE or approval will be the end result. But it has been one month and the status has not moved. Is there anyone else with the same issue? Just wanted to make sure that this is a one-off case. Attorney has not received any documentation.

    Please let me know guys what u think might be the problem here.

    • I do not think that you need to be worried for what other people think. Mostly it will be RFE. I think you will have to just wait for the status to be changed.

      • The attorney checked and they said that there is a problem in the system. Some status are not showing any status. My question here is, if an RFE was issued, shouldn’t it have reached the attorney by now? And a friend of mine got his approval papers but the site still shows initial review… There are a few people who got approval notice after seeing this message. Do you think upgrading to premium processing will help in getting the status?

          If the papers have been dispatched thay must reach withing 5-7 days to attorney.
          Upgrade to PP ,may help as yourattorney can directly call to the helpline and you can get the details of RFE on mail if any .Hope for the best.

          • So it can be that the actual status is still initial review. Next week my employer will upgrade that status to PP. How long will it take to know anything at all. This is getting ridiculous

    just wanted to give some assurance and calm some nerves, i know i was the same until today. Finally got the application approved. It was on Initial review since April 25, got picked up on 17th and approved the same day.
    My understanding is, they have just completed the IR for the date of 25th April. If your IR or PP stopped date is after 25th April, expect some activity within the week.

    RFE and IR – 25th April
    Employer submission – 4th May
    PP restarted 17th July
    Approved – 17th July

      • im IR since April 8th, I read someone wrote that to this date , they’ve have checked all the documents once, who got RFE had the chance to submitt an RFE, those who didnt that mean their documents are ok and they are waiting for the processing.

        moreover all the acceptance are for IT and engineer so far, so business is for last , as I remember it was the same in lottery selection

      U can go for stamping 90 days before 0ct 1st, i.e., July 1st.. July 1st is already passed, U can appear for stamping now
      Also U can enter US only before 10 days of oct 1st… i.e., sep 21st i guess

      Normal Processing is 2 to 6 months…
      Lucky ones even get approval before 2 months…
      Hope U r in US and ur visa is valid till november, So u have ample time… Wait till september end and then u can think of ur current visa extension…
      However I feel that ur H1B might be approved before september or in september max

  31. No news for H1 lottery result for long … Lost all hopes .. stop looking at this forum which I used to see 10 times a day since march till end June. Suddenly I got news my H1 is approved.
    I am numb now .. Don’t know how to react … No reciept number with me but it is confrmed.

  32. My H1 was approved on 16th July 2013 and valid from 1st October 2013 .As of now I’m on H4 which is expiring on 30th July hence I applied for H4 extension. My employer says that since H1 comes into picture only from 1st October so even if my H4 is approved before 1st October then also H1 will be my latest status. Is this true ?

      Is the H-1 approved w/ COS? Your employer is right if H-1 is approved w/ COS and H-4 extension gets approved before Oct 1. However, you will be on H-4 status if H-1 was approved w/o COS or your H-4 gets approved after Oct 1.

          You don’t lose H-1 completely. You can go to H-1 status either by filing COS from H-4 to H-1, or enter US on stamped H-1 visa.

    I have one very important question.

    I came to US on 30th March,2013 on H4.
    My H1B petition was approved on 16th July,2013 but my H4 is expiring on 30th July so I applied for extension well before and is currently in process.

    Since I have H1 approved now…Can I withdraw H4 now. If yes, what will be my status from 30th July to 1st October,2013. If i cannot withdraw H4..what are my options to retain H1 status.

    Please respond ASAP if anyone have an answer for this.

        • H1 & H4 Question,
          Do NOT withdraw H-4 extension as you don’t have any I-94 b/w Aug and Oct. So let it remain in process and withdraw it after Oct 1. If it gets approved before Oct 1, you are still ok as your H-1 will kick in from Oct 1.

            My employer says apply for H4 extn and withdraw it on or after 30th Sep in case i dont get approval by then. My question is if I withdraw say on 30th Sep. Is the stay between 3-th july and 30th sep legal.

    Then there are morons who ask what is a ZIP CODE, WTF man, I cant believe this crap.

    • I agree partially. There are a lot of repeated questions that people can easily find the answer to from the index page but either really don’t know about them or are too lazy to look up.

      Regarding certain technical things though, like ZIP code and stuff, that is understandable. Because people who come from different countries have different systems there. For example we dont say ZIP code we say PIN for postal zone codes. I know that sounds similar to a credit card pin for its a different purpose there entirely. Just FYI.

      • It has to be the attitude mixed with lazy ass! Most are ignorant and do not care about others who take out time and take efforts in answering these stupid questions. They do not respect others time and efforts.
        IMPO, I think this has more to do with culture, ignorance and insensitivity towards other’s efforts. Just coz its free we have all rights to seek help till we piss off the person helping us.

        Take “At this time USCIS cannot…” status message for example. countless times people have asked what does the status mean. Come on, it means exactly same what it meant for the other guy. You will not get any special treatment.

        Another classic example is “I got my approval, what now” ? what now? I tell you what now; you are ready to go to US, kick your managers ass, book a ticket and get on the flight god damn it. This forum is full of such posts.

        Dude! How is zip code technical? A person who will be in US in few months has not heard about ZIP code? Hard to believe.
        Google search “what is zip code” will give you the best result. Forums are no good, I was successfully able to troll him right here. I don’t usually troll but I felt he deserved it for his laziness or ignorance. Not judging the individual but his act! (irony is that your acts define who you are).

        • Questions posted here are open for anyone to answer and if you don’t want to for whatever reason, then don’t mate! Its not like they are forcing you to answer till you are pissed of now is it?

          Yeah some might be lazy and like I will state again, some might just be wanting to ensure that the info they got from other sources is confirmed. Yeah there are a lot of repeated posts related to “USCIS at this time..” Maybe they don’t logon as often as you and I, maybe where they are connecting from doesn’t always have a decent connection and they can only do it for a few while at work or something? There is more to this world and life than you will ever experience and know. And there is ALWAYS something you are ignorant about that the other person may have knowledge of or is better at.

          Tolerance is the way to progress. With peace and respect. If these posts bother you so much there is absolutely no effort in not logging on here at all or even going to some specific page. And yeah by judging the individual’s act and declaring laziness and ignorance you are by default also judging them and their circumstances from a mere 100 words posted here.

          I don’t know where you are from, but it seems that clearly you are very annoyed by these posts. My suggestion is ignore them or don’t interact and only interact with those that are genuine. Have a good day.

Look below, many hv msged tht theirs receipt is EAC WAC 1313 smthing..others in 1314 smthing are approved…still some morons keep on repeating the same ques..is it random..is it random or is it in series….mine is 1314 smthing..so I shud get my approval in 2 days…how the heck man..

    • I don’t know how many of you are aware of this or from where you are, but for a lot of these people H1B is a life change. Their future depends on this, along with their family’s. Their life savings are put inline here to fund the consultancy or PP or whatever. Not ALL are entitled lazy young buggers posting here without a second thought.

      If you don’t want to interact or answer them, just keep scrolling guys. Hardly takes a second more. You will only see more and more of such questions being repeated as more petitions are picked up. The nature of posts here is not going to change any sooner. But what can change is how we respond to it.

      If you help somebody today, genuinely, tomorrow they may extend the same courtesy to others remembering how once they were in the dark and now they know better. Simple as that.

    my receipt no is WAC1313951* got RFE 2 days back but dont know which additional info they want. USCIS just sent mail with status as RFE and no more info.
    My companyz system also it is not updated.

    How can i check what all documents are required for RFE??

    • usually RFE mail should have the information what additonal docs they are asking for. Your employer or lawyer will get mail with the RFE, have to wait if it is a regular processing. Will not know what docs they are asking for untill you see the RFE.

  36. Hey Saurabh/Readers, quick question for all of you.

    When my petition got selected for lottery my employer and attorney both got receipt copies. When my RFE was sent only my attorney got a copy. My petition has now been approved will both get receipts once again or only attorney?

    My attorney is out of town a couple of weeks so was curious.

    My H1B got approved last week, but yet to be stamped. My employer told me that petition is valid for 3 years I need a US project, othervise the Visa will not be stamped (I need to wait for a US project now).
    I have received an offer from one of the Big4s for a US project (because of my H1B). My question is can I change the employer now understanding that H1B is yet to be stamped. Do I have any legal bonding with the employer.

      • Technically speaking if you have approved petition, you are eligible to change your employer, and they will file cap exempt petition and visa once again. However you might run in an issue at the time of visa interview, because of this recent switch. If you have not signed any contract with your employer for H1B, you are allowed to move out without any restriction.

          I am almost in the same situation as Dinesh (Situation: H1B Petition Approved but not yet stampped thru Company A – Moving to Company B). Only difference was, my petition was approved last year . I do NOT have the receipt number nor the copy of the approval notice with me. I will be joining the new company next month – unfortunately, without getting the Approved H1B petition details from the current employer.

          Now, my questions are ..
          1. Can the new employer be able to file cap exempt petition for me in this situation?
          2. Is there any way to find out the receipt number from USCIS/some other source to facilitate the new H1B cap exempt petition with the new employer?
