What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?
Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too. Every H1B case is different and the time taken depends on various facts and factors tied with a petition…
Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?
There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time. So, you would just have to wait for USCIS, there is nothing you can do. Unlike, USCIS has SLA for premium processing H1B petitions, but it comes with a cost.
How long will USCIS take for H1B Visa 2014 Premium Processing petitions ?
USCIS has a standard 15 calendar days SLA for premium processing petitions. Typically, it starts from the day USCIS receives the petition and they issue a case number. But for FY 2014, due to expected high volumes they have pushed the premium processing clock for H1B petitions to start from April 15th. How has USCIS done historically with H1B petitions processing times ?
Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time. You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.
Where can I look at USCIS processing times for H1B petitions ?
USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

I am very much worried about my H1 B status. I am currently on OPT extension and in fact it has ended few days ago. I am still working at the client location with out any status.
I am employed in to company A, and working at Client location C thru Vendor B.
Originally,I have got an RFE for ER/EE relation and then my Employer responded with details. the Petition was denied with reasoning about client signed letters are missing.
After lot of pressure on client C, they issued me a letter with some basic details.
Now, my employer is afraid of filing an MTR. He is concerned that USCIS might visit the client location and inquire about me. if so they might know about me working with out status… Is it true? Can USCIS call/visit the client location so regularly?..
My employer has got Vendor letter, client letter and yet he is not sure to file the MTR.
Since i am out of status, i am very much concerned about my situation.

You should stop working as your OPT has expired and H-1 has been denied. Filing MTR doesn’t provide you any status to work. You are currently assumed to be in 60 day grace period which allows you to stay in US but not work.
Talk to your attorney and DSO as well about this.

From my previous post I sent all my docs to the office for review before they send it to USCIS yesterday on the 10th. Today at 6:30 i got a Text Message from the My Case Tracker that my case status has changed. With anxious fear and joy I went to check the website but there was no change? And also no email of the same did I receive?
So should I just chuck this under a freak tech incident? Thanks!
Regarding text and email updates, there is a clear mention about this in the USCIS page at the bottom of the page where you add your case.. The text goes like this,

So it means there was some action on your case, may be they received the documents, but it did not necessarily result in the update of the status..
That was my thoughts exactly dude! i saw that little notice as well and am hoping that is it. It s hard to get a clear confirmation from my HR if they sent the RFE or not since they are slow and I have been emailing them all week anyways and dont want to come across as bothersome if oyu know what I mean.

I have received an RFE stating request for client letter having details on my contract period. The client has refused to give with dates. In the intial petition client had given a generic letter stating about my Job duties and begining date which was early ths year. I still continue to work with same client. My paystubs were included too with petition.
What could be other options for submission in absence of the new requirement from USCIS. Are any chances of approval. My employer informed me they are going to respond to USCIS about denial from client giving ths letter.

They can say that client is not ready to give an explicit letter but based on the discussions the project is long term for xx duration. USCIS may contact client for verification and the client should be ready to vouch for the same.

April 25th – Notice of Receipt
April 29th – Initial Review Receipt in Hand via mail to attorney (I got a scan copy)
June 18th – REF issued. (Note almost 2 months in IR) Status on Case Tracker. RFE was expected due to nature of position etc.
July 3rd – Receive RFE requirements from Office regarding Project Lists and my duty outline.
July 10th – Collected all documents and sent them back to office.
Hopefully they will sort it out and send it back to USCIS soon. I am on OPT till Dec, so no specific hurry. While I would like to have an approval as early as possible, I am willing to wait it out and let things take their due course properly.
Seeing that I had almost lost hope of even receiving a Receipt number, I have great appreciation for patience and waiting with faith now.

Folks, I am in WAC 131 series PP/RQ went to RFE and took a long time to reply and finally filed response last week. Hoping for an approval.

There is no harm in that if your attorney/ employer have responded RFE with all the details. e.g Client letter is must in this year otherwise there are chances for more RFE

I just want to know when did you applied the premium processing? because my son applied the premium processing last june 17 and the employer/consultant told us that they are already filed the following day. but what really surprise us that until now the status of his h1b on the online is still ‘ INITIAL REVIEW”. Its already almost 23 days to go. but no changes yet in his status. I doubt that my lawyer/consultant pocketed our money and never applied to premium processing.

Sorry to hear that. I just requested my manager to apply my petition in PP and he did the remaining.. I did follow up with lawyer and all but other then that its nothing I did to make it in PP.
But as far as I have seen people applied in PP should get answer in given 15 days by USCIS. I am really not sure why you application is not updated.
May be you can follow up with employer/lawyer

Upgrading to PP doesn’t reduce the chance of approval. It’s a conspiracy theory thrown around when employers/employees start looking for reasons for denial.

Just did a random check and found so many petitions 145, 146,147…. are got their decisions, all must be upgraded to premium processing. So its not that WAC is very slow in processing.
Hopefully once all the premium upgraded petitions are completed, regulars will get processed soon.

I am staying in the US as a tourist and is waiting for the decision of my H1B application.. Is it true that even if the 6month tourist stay that the immigrations gave you expire, you can legally stay in the US as long as the USCIS received your application..
I talked to someone who was given an H1B before and she was in the same situation.. Her tourist stay expired and was just waiting for the H1B approval.. She got approved 2 months after her 6month tourist stay expired.
Im sure though that in F1 visa as long as USCIS received your application before your tourist stay expire you can still stay here in the US legally while waiting for decision.. Is it the same with H1B?

As you are there on a B2 Visa, you cannot stay there more than the date provided in the I-94, unless you get your visa extended.
for H4 / F1 people, they have a valid Visa Status, and they would be looking for a Change of Status, unlike a Tourist Visa under which you are currently in.
It would be better if you get the visa extended or leave when the current visa expires, as it is not Legal for overstaying a Tourist Visa.

Even if your H-1 is approved w/ COS, there will be a break in I-94 continuity as current I-94 expires prior to Oct 1 and H-1 I-94 won’t start until Oct 1.
You may run into issues during stamping if you stay on B-1/2 for a long period. They closely scrutinize folks who stay on tourist visa for more than 2-3 months and can ask for details/explanation.

If filed with COS then your COS application will be rejected, If petition is approved then you have to go back for stamping to start working on your H1b.
If filed without COS then no problem you can travel.

You need to know at least your H-1 receipt number for this cap-exempt petition to be filed. Are you currently inside US? Was the H-1 filed w/ COS?
If yes, then ask the old employer for the bottom I-94 at least as you need to have it. That should contain the receipt number as well.

We had been a set of documents to complete and send it as part of H1 processing. I believe it was filed with COS as I am in US only on L1.
It is communicated that documents related to H1 will be shared during Sept mid or so… so I believe I will come to know any details about this at that time only.

If it has been filed w/ PP, then it will adjudicated in 15 calendar days. It can go directly from A to Decision or can go to IR and then Decision. Until its 15 calendar days, you shouldn’t worry. After that, ask your attorney to follow-up w/ USCIS.

They say data is from April 2013 but I doubt, it looks more recent.
Thanks. I think it may also include people doing their H1B extensions and L1 – H1 conversion also. Just my guess. I don’t think the data is a recent one. It’s reflecting as April.

It will include COS etc but the total should add up. Gross error in the age of sophisticated data mining!
Well I am 146 and tracking 139 onwards. Looks like they have done a kinda first pass till 141. Your documents are definitely on some table sitting in the file stack and my file is definitely still in their vault.

My h1b was filed under regular though I paid for the premium fee intially itself, so I requested the consultant to upgrade or return the fee.
My employer said my application was upgraded to premium about 15 days back , however I do not see any change in my case status on the site. I am not too sure , if he actually did that at all.
Is there a way to check or confirm this on my end?
Can I ask them for copy of original reciept notification or any premium processing related reciept for my application?

They must have filed the I-907 (or something) for PP upgrade. Ask them for a copy of the same. It doesn’t prove it was filed as they may have completed the form but not filed.
Tell your employer, that USCIS is suppose to return the fees if the petition doesn’t get adjudicated within 15 calendar days of filing the PP. So they should get the money back from USCIS.

Yes, they will know your immigration history. Do you have anything to hide? If you maintained valid status and didn’t break any immigration rules, then why worry?

Yes, it can be done using just the copy of 797A. Even if you have the original, the new employer still needs to submit a copy and not the original.

This might be a common case but needed some help here.
I am on H4 currently and my visa/I-94 is expiring on 31-Dec-2013 (end of this year) along with my husband’s H1B. My husband’s company is filing for extension for his H1B and along with that for my H4 as well. I applied for H1b through a consultant this year and got through lottery but got an RFE which will be responded by this week (RFE is for asking for client letter etc.)
My question is Can these two applications be getting processed at the same time? One for extending my H4 along with H1B of my husband and the new H1B for myself on which we got the RFE?

Yes, you can have both in parallel. In such a scenario, “Last Action Rule” comes into picture. As per this, your eventual status will be determined by the I-94 that goes into effect later. You can also withdraw your H-4 extension once H-1 gets approved w/ COS. If H-1 gets approved followed by H-4 (effective date of Dec 31, 2013) then you will again move back to H-4 status from Dec 31.

my h1b visa was approved in 2005 and worked for 3 years later my h1b visa was on processing and the time date till i have to be in us was also finished but still i was in us bcoz i dint know what my case status was i stayed for about 8 months waiting for my h1b approval and as i dint get any i moved back to india and after two years now i have filed my case for cap excemption
so here is my question
so any thing wrong did i break any of the immigration rule what will happen for me currently for my cap excemption i recently received my rfe also so what will happen what are my chances of getting my visa approved

I assume you are the same person “Indian” who has asked the question in another blog page. I have already responded to that question. The RFE is related to company’s financial status and has nothing to do w/ your immigration status.
If they had questions regarding your status, then they would have included that in the RFE. As they have not asked anything about your status, it means all is fine w/ them w/ regard to your immigration status.
You can stay in US waiting for pending H-1 extension petition for at most 240 days beyond I-94 expiration date. How much (in days) did you stay after I-94 expiration day? 8 months?

So you overstayed by 30 days beyond the 240 day limit. Did your attorney know about this when filing the H-1 petition?
The issued RFE is not related to your stay, so they seem to have factored in that fact and didn’t raise any queries. You may still be asked about it in future either during a future petition processing, GC processing or visa stamping.
Clock stopped on 3rd July for PP case and till today status is in Initial review, i have already responded to first RFE. Really worried now, is this 2nd RFE or denial 🙁
July 4 was a holiday but July 5 was a working day but no change in status. No response from attorney/ employer.

I noticed most of RFE are raised in month of May. Does it mean whoever like me is in Initial Review state has passed document verification stage ?
Good observation. could be right. I expect they would have touched each of our files at least once and if they found them with issues, they would rise alarm early. I think the reviews are complete, but the data entry and dispatching the docs is taking time. !!
You know what, it might just be true. My lawyer was asked a few missing things from my company. He provided those.
It might just be the case that, they might be doing a brief overview of the selected lottery packages and making sure that , whatever is mandatory is present in the package. They will look at the details later. That’s just my guess.

Most of premium processing was done in May hence you see a lot of random case # with RFE/Approved/Denied.
Our cases are still being reviewed and will approved once the officer has everything he/she needs or we get RFE and then final decision.
From random checks it looks like they are close to 140 series but guys even in 147 have got approval late last month and some from 136 series are also waiting.
So unless a officer comes out of the closet and shares the process pattern we can only guess 🙂
Alright guys I have a stupid question. Might matter though.
I have all my marksheets right from 10th 12th first year , 2nd, 3rd , and final year. I have submitted all of them in my application.
Unfortunately, in my second year I flunked a subject and have got a remark of Fail but can go to third year. I cannot find the actual one which says passed in second year with first class.
Is this going to be a problem?
My third year and final year, convocation degree certificate are flawless. Except for this one.
My question is :
1) is this going o be a problem?
2) I am trying to figure out as to why they need marksheets other than fraudulent degree certificates.
3) is my second year marksheet going to cause a problem?

This is my opinion – Even if the person who is reviewing your petition would overlook it, you should still have that with you for visa interview. My suggestion, if you are not able to locate it, get a duplicate copy of it.

What i meant was, what are the reasons for asking for marksheets other than making sure that the Degree Certificate is just not made up and is fraudulent.

my application belongs to EAC148 series. current status is still in IR. I was planning to visit USA on my B1 Visa. will this impact in any case my H1B application procedure.
Also is it recommendable that, during my visit in US, if my H1B gets approved, I apply for change of status from B1 stay to h1 stay…is this possible. just to avoid visa stamping.
Also, anybody from 148 series got the approval in regular quota and regular processing, please comment.

It will not impact your journey as well as H1B process. the process will be in background and once your approval has come you have to travel back to India for stamping H1B.

You can travel to US on B-1 while H-1 is under process. If approved, you have the option to file COS from B-1 to H-1. However, you should consult an attorney as at times this can come to bite back in future. An attorney can look at your case and provide a more specific suggestion.
