USCIS H1B Visa 2014 Regular Processing Time? Premium Processing ? FAQs ?

Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

        • Yes. I had also submitted final year and degree certificates. I guess they want all the marksheets. I have sent all college marksheet to my employer now.

  2. anyone still waiting for the Lottery results ? My consultancy still says it has not heard anything on my case from USCIS still. I have not head my application either got selected in lottery not they received my package back. I see lot of people have already moved to next phase of either interview or waiting with their receipts

        i went to us for my masters and got my h1 approved also i worked for 3 years on h1b later when i applied for extension my petion got rejected then in 2010 i came back to india currently my employer filed my case for cap excemption and i received rfe on june 11th but rfe asked about the financial position of consultance so could u please tell me what are my chances of getting my visa approved
        any earlier answers would be appreciated

    I am working for a company A on OPT and my H1B got approved through company A this year, but my employment start date for H1b is on October 1st. If I got a job with company B, is it possible to transfer my H1B to company B before October.

    My status is not showing anything. It says at this moment cannot provide you information. We check with USCIS, they says due to technical problem. Previously it was showing in initial review.
    Can anybody comment on this based on your experiences?

    • Everybody has commented on it, Most probably it is RFE. Many a users have faced this situation. But I am not 100% sure for this.

  9. Hi Saurabh,
    I attended my visa interview in Jun 10th(Petition filed in 2012). They issued 221g seeking project related information. After submitting that they sent a response as “Dear Applicant, This is in reference to your visa application. Please submit your tax documents and list of previous clients documents at OFC or VFS office for further processing of your case.” I have SSN number but I didnt filed any tax in US. Are they asking for US tax filing information since I have SSN or Petitioner tax documents or My tax filing details of India. What about previous clients? I need to submit the list of projects I handled till now in the current or previous companies?
    After receiving this response I sent a mail to support stating that I dont have any US tax filing, Do I need to submit the tax documents that I filed in India. They opened a service case and closed by stating “Your case has been updated, please log back into your account to view the details” When I checked my Visa status with my application id only last update date is changed to Yesterday.
    I am not sure I need to submit my tax details and the project related client details at OFC or not.
    Can you please advise me on this.

      You said you have an SSN.
      Were you on H1 or L1 or B1 when you last visited USA? And for how long were you there?
      If it is an either or option submit either India tax documents or your clients tax documents provided by the client who has filed your application.

        I was on L1 when I got my SSN. But that stay was under three months. So my payroll didnt transferred to US. Same I informed to support. I am planning to submit my tax details to them next week if I dont get any response from them by Mon.

      I am not sure what taxes they are referring to. AFAIK, it is ok to get paid in home country when on L-1. Talk to your H-1 attorney about it and if this indeed is true then frame your response accordingly.

  11. Here is my story. First of all thanks to Saurabh for this blog, it was helpful to read comments from people who are in same position as mine.
    Applied in RP/RQ/IT from IT, got selected in lottery, got to know about it on 23rd April. WAC13136540**. Then petition remained in Intial Review until 13th June. I had also applied for case status update on USCIS site. And this feature of email alert actually work. Although I daily used to check my email for any notification from USCIS as well as USCIS case status page, thinking that there might be some glitch. However in my case, whenever case status changed on USCIS site, I was getting email alert almost immediately. My attorney’s case status portal got updated, that they have received on 15-16 June, and before I could have asked for what was the reason for RFE, they responded to USCIS questions on 19th June, and case status on USCIS site changed to RFE response review on 20th June. Pretty fast though.
    I keep on bugging my attorney as well as mobility team in my office to let me know the RFE reason, but they did not tell me.
    I read on this blog, that after getting response they generally take 2 weeks to 8 weeks of time to decide on petition. But I was excited and nevous both to see the decision as soon as possible. Finally on 3rd July I received an email alert at 3.30 AM IST, which is 3 PM PST, that the petition is approved, and we have mailed you the decision.
    Finally happy. I want to wish good luck to all.
    Would have to follow another thread now which talk about interview process.

      • Wrong, they can denied even after they received all the RFE, is up to the person who is reviewing your documents. Some are more picky than others

  13. Waiting for more than 13 days after responding to RFE in PP case, Today status shows as 15 day PP clock stooped for your case. Its more than 4 hrs, status is still under Initial review. Don’t know how much more time have to wait to get it moved further either on Post decision or RFE. Any idea.

    Attorney/ employer haven’t received anything yet

    My recipt number is WAC1313850*** . It was shoing Status as Initial Review till yesterday when i checked .

    Now when i tried checking status it shows as below:

    At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.
    To view the status of a case, please enter the corresponding application receipt number. The 13-character application receipt number can be found on application notices you have received from the USCIS. It begins with three letters such as (EAC, WAC, LIN, or SRC). Dashes (“-“) should be omitted when entering a receipt number. However, all other characters, including asterisks (“*”), can be included if listed on your notice as part of the receipt number.

    Listed above are the possible steps an application or petition may go through during processing. Not every application or petition will spend time in each of these steps. Once you enter your receipt number you will see the steps that will always be required for that particular application or petition. The step in the process where your case is currently located will be highlighted. Other steps will appear if your case requires that particular step.

      • For the cases were the above message showed up , generally they will issue a RFE.
        When I was following some cases , the cases were this message showed up , the case status was updated to RFE after a week or two.
        This is just my observation , hope it helps u ..

      • IT, Big US company with more than 3000 employees and less than 5% on H1B, with permanent position and history of applying for GC after H1B, what i mean is that this credentials really make it so easy to get your approval, even if you have low years of experience (-2 years for me). If your company is like mine or similar dont worry at all they do things right, who should be afraid of RFE is who thier sponsor is small company or with no/bad history of applying for H1B or for sure the big IT indian companies or some thing wrong with his file.

    • I can understand your pain. I am on the same boat as you. My application is on the 131 day WAC. The status has been on initial review since 25 April. Waiting for the case officer to revisit the applications.

    I have booked an H4 appointment for my spouse on coming Monday @Kolkata. My employer told that NOC is mandatory since she is working. Earlier her management is ready to give that and now they are denying the same.

    Is it really mandatory to have NOC to attend the H4 interview?

    • I appeared for H4 interview in chennai in jan 2013. I was not asked any NOC that time even though i was working. Although it is a document that is good to have. I don’t think it is mandatory.

      I am also on H4(Working, currently on long leaves) and i was not asked for NOC.
      On the safer side, it is good to have this doc in place, though i had it with me at my interview time but they didn’t asked for it.

      Like others mentioned, NOC is not mandatory for H-4 interview. He may be asked what he is doing currently in India and what he plans to do in US. His answer should be truthful i.e. he is currently working in India for XXX company, but plans to not work in US.

  26. applicants who got RFEs, please share when you received ur RFE and how long it took USCIS ( please specify WAC or EAC) to process your RFE. i got my RFE today, havent received it in the mail yet. i applied for a Masters program which starts end of Aug, i would like to know if i know the final decision from USCIS by then, so that i can apply for F-1.

    Currently I am on H4 visa in US. I have applied for H1 and got approved.

    But my H4 is valid till July 31 2013 and my H1 start date is from Oct 1 2013.

    Hence my lawyer suggested me “that I must apply for an H4 extension from the expiry to 09/30/2013 as my H1 will start from 10/01/2013.”

    So my Spouse employer has filed my H4 extension form I539 but got the rejection letter from USCIS saying, “you have already filed for I129 for this person dont need to file I539″.”

    What is this meaning, what to do now?

      That’s strange. She needs to have a valid I-94 for the in-between period and that’s what H-4 extension would give her.

      May be file it again w/ more information like why it needs to be filed for the smaller period i.e. to get I-94 continuity.

        Why these USCIS people are so dumb. I129 is valid from 1st Oct only , then what is there problem to extend H4 till Sept 30.

        My spouse employer has applied H4 extension for me, have to check with them weather they can re-file that form or not?

        Is there any option do I have now?

        After doing all the hard work to get the H1 with luck now this is the situation…….. :(:(

            : My H4 is valid till July 31 2013. H1 starts from Oct 1 2013.
            So I have applied for H4 extension Aug 1st to Sep 30, which got denied saying already I129 filed for this persion do not need to file I539 (H4 extension form) .
            Is H4 extension can be re-applied??
            So I am checking what I can do to stay here for these 2 months :(:(

            I dont want to go India for H1 stamping , it involves lot of risk :(:(

            Please advise what I can do in this situation ..

          You should discuss w/ your attorney on what kind of information to submit when reapplying so that it doesn’t get rejected again.

          • @saurabh : h4 extension was applied by my spouse ‘s employer. They are saying that once USCIS rejects any pettition , it’s not going to approve and they cant reapply. Is that posssible h4 extension can filed myself or is there any possible ways to get my H1 stamping in canada ( i m just guessing about this option) . Thanks saurabh

            I am not sure if H-4 extension can be filed by yourself. It is recommended not to go to CA for stamping as you have not done Masters in US and this is your first H-1 stamping.

            How about this – your spouse’s petition is filed w/ PP, so that it gets processed within 15 days. You take a copy of that petition, travel overseas and return to US before your visa stamp in the passport expires. At the PoE, you will be issued an extended I-94 based on new petition and you are all set. Your previously approved COS will still go into effect from Oct 1.

            Run this through your H-1 attorney as well.

            If I come back before my H4 visa expires with my spouse H1 petition , how do i get new I94?
            (Little confusion here)

            I assumed you already have H-4 visa stamp in your passport valid until your current H-4 expiration date i.e. July 31. Is that not the case? When is your H-4 visa stamp expiring?

          • I have valid H4 visa which is expiring 31st Jul 2013.

            But how i will get new I94 , if i come back on that visa with my spouse H1 petition?

            Things you need at PoE are:
            – valid visa stamp (which you already have)
            – valid H-1 petition of the spouse (which you will have)
            – other spouse related documents like employment letter etc (which you can collect)

            You will be granted entry and issued a new I-94. When you first entered US on H-4, what else did you have?

            Ok, I see where the confusion is. The expiration date of I-94 you will receive at PoE will be determined by 797 and not the visa stamp. It is never driven off visa stamp.

            Think about it. Your spouse is filing H-1 extension and will get new 797 and new I-94. The H-1 visa stamp probably expires on July 31. However, the new I-94 will have date same as new 797 and not only until July 31.

            To my knowledge, we can apply for change of status only with valid i94 . And for h1 we need valid i94 till sep 30 as h1 kicks off on oct 1st

  28. My application is EAC1314050xxx and today i got an update that its moved to RFE. My employer is yet to receive the mail for the reason. Customer service 1-800-375-5283 do not have an update on what are the specific evidence requested.
    Do you guys know where i can find the requested? Or do i need to wait for the snail mail to reach my employer?

      Sorry no I am not Marketing or sales related. But this was related to your RFE – When did the status change and when did you receive the RFE in mail? THanks. I got an RFE on 18th of June but not heard of anything from my lawyer or office.

      • I was in initial review for 2 moths 1/2 i believe.

        My RFE was issued 21 june and we got it the 30th of june, So it took almost 10 days.

        My lawyer also is not the best at communicating, he is always on the go, but with my receipt number i checked USCIS website and knew that RFE was issued, so I sent my lawyer an email. On the 30th he replied acknowledging the letter on the mail.

        Is weird you have not receive yours, make a call to your lawyer and ask him.

        • Yeah I will. I am hoping its something related to the company and not directly to my job at the moment.

          I mean if the RFE is not something that we can respond to, or don’t require the beneficiary’s response and sufficient if the lawyer or company responds then would they even let us know?

          • Is snail mail the only way to know the reason for RFE? Is there any other way to know the reason, while waiting for the mail?

          • They dont have to let you know, but in my case I wanted to know what was in the letter, but yeah if is something related to the company more likely they are not going to contact you. I think they should regardless so that you know the status of your application and latest status.

        I am EAC for 148 series as well. they send a letter stating that i need more evidence to demonstrate that my position needs a minimum of bachelors degree, Even tho that position need a minimum of bachelors degree. So the lawyer is working on proving the point to USCIS.

        What is your case, You got RFE? What position did you apply for?

        • My application is still in ‘Initial Review’ and have applied for Marketing Director.

          Even though my domain (marketing) is same as yours and have the same series 148….you’ve received RFE on 21st June while mine is still in Initial review.

          Have you upgraded to PP by any chance ??

  29. Read in the article that the visa goes immediately high of 65000 to 110000. As per the bill passed by the sanate and voted as 68-32 which won to a higher margin and moved on to the next house, as of 07/01/2013. From which year it will come to existince.

        I can see some change on 2nd July.Wac1313750098 is approved on July 2, 2013 and wac1313750097 moved to RFC on 2nd July.
        Hope for the best. We will here some good news for ours.

    • It might not be an IT related job. I read from some discussions in this forum that the other job related visas get to a decision quickly than IT related jobs.

      • Not really, actually IT is easier than other positions, because is more define, than business for instance. My case is Market research analyst, they sent me RFE and is a lot of stuff that i need to put together and hope they will approved

    I had filed H1 for my wife through a desi consultancy.They had told me that they do not give out the Receipt number to the candidate as it is there policy.I spoke to them recently and they said the status is initial review.

    I know the employer since a few of my friends work here and for them also the receipt number was not given but they had their H1 done.

    Could you please help me and let me know how can I get the receipt number through USCIS customer center??

      You cannot get the number from USCIS directly. Only your employer/attorney can provide you w/ that.

  33. Saurabh, Why the processing speed at WAC is dead slow. Last 1 month they processed only 137th day. Will they speed up or will continue to process at dead pace .???

    Now, started to feel RFE is much better than IR.

    • RFE better than Initial Review,
      It slows down in b/w as there are lot of petitions to process. However, as the backlog clears up, it picks up speed again. In years when lottery is conducted, normal processing time is 2-6 months.

    • My RFEwas also something similar. They might ask for 1) Employment Agreement between petitioner and Beneficiary detailing terms and conditions 2)Performance Evaluation of Beneficiarys work performance 3) Companys’ health insurance copy, health insurance card or waiver. I got approved once we replied for the RFE. Thanks.

      As per H-1 rules, employee’s duties and taks should be actively managed by the employer and not a client or 3rd party. In consulting companies, when the employer places you at the client site, they still need to have some sort of oversight to discuss your daily/weekly progress and give new tasks/activities etc.

      When USCIS raises query on EER, they want to know how employer plans to do this. Typically this involves someone from employer going to the client site frequently to meet you and discuss progress and give tasks etc.

    MY H1 petition filed by a new employer is still in Initial Review. In my current organization, I am required to go for a project in UAE, which would be for another 4+ months.

    I don’t want to risk my H1 by applying for visa interview in UAE, can you please confirm, if approval on my petition is given by Jul end or August, by what time should I appear for Interview, as I would only be back to India in Nov.

    Is it justified that even after receiving approval, If I delay for interview for upto 3 months.

    Secondly will my recent trip to UAE, would require more clarification to VO?

      You can appear for stamping even after you return to home country in Nov. Traveling to UAE will not impact the outcome of the stamping. They may ask what you did there, but I don’t think it should cause major issues.

    Few days earlier i raised a question regarding my daughter’s passport. We checked the status with PSK they told us that in police verification report police officer objected that mothers name in documents doesn’t match. My documents before marriage has different surname and after marriage my surname is different. To support we have documents like marriage certificate, aadhar card, voter id but i think police man want something else. So my question is that if we try to get a affidavit declaring that the person with both the names are same, does it solve my problem? Are they going to consider that document.

        I don’t know the answer. May be the policeman is looking for something “else” or maybe he will be ok w/ the affidavit. It is normal for mothers to have different name before and after marriage. You can ask the officer what kind of document should you submit to address his concerns and then work towards it.

        Affidavit should do, seeing the status message, it seems that your daughter’s verification report has reached passport office. My suggestion is to go along with affidavit, and voterID/Aadhar card and tell them that both the person are same. Before going there, you might want to check it with local police station (or the police man who came to your house for verification), he will let you know that report has been sent, and next step would be the PSK. Go and meet passport officer, you need not take an appointment. You would have to have patience, they would for sure listen to your request.

    I contacted my employer yesretday to check did he got my approval documents, But he ahs not received them yet.
    So my question is, instead of asking him to contact USCIS, can i call the customer service to track the documents?
    Please let me know, so that i will act accordingly.

    I am working with one of the biggest employers in India. due to circumstance, I was released from the project, during stampimg will they ask for previous client letter with which the h1b was applied. what if the previous client rejects to give a letter?

      If you change clients, then employer should file new LCA for the new client location followed by H-1 amendment. You should then attend the interview w/ updated petition and new client’s documents.

    Just want to know, can a status of H1B change from “Initial Review” to “Post Decision Activity” directly ?

    My status until few days back was at “Initial Review”. On June 28, it directly changed to “Post Decision Activity” with a positive approval. Please note I am yet to go for stamping.
