Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

    Could some one please help on this.Mine is WAC13136524XX.Still it is initial review.Please suggest me,Can I wait for some more time or Shall I request my employee to process in premium.I feel like most of application in day 135 are done.So I am expecting some status change from 2 weeks but my application was not touched.Please suggest me shall I go for premium at this stage.

    My case status has been RFE response review for the past two months. It was a documentation error that called for RFE and it was responded to within a week. Since then the case status hasn’t changed from RFE response review. Should I talk to my employer now about upgrading it to PP? Will upgrading it to PP have any adverse effect on the decision.

    My case was a straightforward petition for COS from F1 to H1B and neither the employer or attorney initially expected RFE. It was also AD/RP/VSC.

    • RFE-help,
      If you want to know the result ASAP, then go for PP. It will not have impact on the final decision, but it will move from one officer to another who may issue another RFE based on his/her review.

  4. Hi Saurabh,

    Currently I am having valid H-1B and I would like to take my wife on H4 VISA (on extended leave since she is working for company A). Also, I would like to apply for H-1B for her in 2014 through some other employer/ consultancy.

    So, my question is “will it be legal to apply for h-1B by some other employer when she is under the employement of company A (she will be on extended leave)?”

      Yes, it is ok from US laws. I don’t know how A will react to this, but she can always resign from them as she is not employed by them in US.

    I have applied for COS H4 to H1 this year and got approved.

    I am in a kind of situation thatI had worked for Company A in India and then i came here on H4 and applied for H1 through consultancy B.

    Now my question is , Company A is willing to offer me job in US ( US branch) and they are asking for the H1 Approval copy.
    Is that legal and secure to share the H1 approval copy with my old employer who is in India?
    (I am willing to join my old employer in US as a permanent employee)

    Could you please suggest pros and cons for the same…. Thanks in Advance…….

      Yes, you can share that copy w/ A so that they can initiate H-1 transfer for you. There is no harm unless you fear that A will tell B about the transfer.

    My H1B Petition got approved btw L1 has been initiated for my wife in her company
    I am confused now on the proceeding step, can i take her with me during my stamping process so tat she will be getting H4 or based on the L1 Status of my wife do i need to decide for H4…..
    or
    H4 & L1 are allowed at the same time? Please confirm..

    • I feel it is better process both of you individually(h1 for you and L1 for your wife) if you both want to work in US.In other case u can ask to stop processing of L1 for your wife as she will get H4 status by default if u get H1.Please note that H4 ple can’t work in US.

            COS -> Change of Status

            This application can be filed when an applicant wants to move from one status to another status while continuing to stay in US. You can search about it online (COS or I-539 form).

  7. Hi everybody,

    I am following this forum from last few months, found very useful. There is one question i want to ask other than H1B visa. We have applied for our one year daughter passport through the current process by filling form online by taking appointment and submitted the documents on 12th March 2013, still the current status showing in the website is “Passport is under review process”. I am worried because its already 3 months and still no progress. What to do ?

    • You need to go to PSK to check with them, what happened. Unfortunately this is how they process the passports. Even for minors they do police verification. If you have not paid to police, they will not send report back or will send incorrect verification report. However not to discourage you, meet PSK officer, s/he should be able to tell you exact reason.

        Thanks for your reply. I know this is very unfortunate that they do police verification for minors also even after submitting a copy of valid passport of parents. I think the police verification report has been submitted because in initial stage the message appears that “Waiting for police verification report” and after than it moved to “Under review process”. I wanted to know that if there is anybody who have same experience or any information.

        • We applied for my nephew’s passport, but that was in tatkal category, and the passport was issued next day of application. I hope somebody who might have faced this issue respond, or else PSK is the only option.

    I have applied for H1-B and currently holding L1. My H1 is approved so mine will be with a COS effective Oct 1st. Thanks to this forum was following as a salient observer and one of the nice forum I have come across.

    I need your advice.

    I can’t switch over to new job on Oct 1st as I have a notice with my existing company for few months. This came up recently not when I applied for my H1. I can’t put down my papers before Oct 1st as I am risking my H1 COS status before.

    Is there a way push my COS to later date then Oct 1st say Dec 1st.
    Some people suggesting that I shld travel to Canada on 1st Oct on L1 and come back be with Company A and quit. Get the stamping done and travel back to US.

    Not sure which option I should take. I don’t want to risk doing something

    • H1-seek,
      So you want to continue working on L-1 even after Oct 1. For this you need to go for leap-frog option, which is what others have suggested to you – travel out of US before Oct 1 and return on stamped L-1 visa. Later, file COS from L-1 to H-1 when you are ready to move to H-1, or enter on stamped H-1 visa.

        Though I would like to work with my new employer, I need to serve notice period so I am forced to work on L1 though I have a valid H1 approval, so bit confused.
        Since I am in US, I have to consider travel to Canada and get a stamping done from there.
        Is there any chances of rejection of visa since I am not doing
        in my home country? My documents are all file. Just want to explore my options.

        Secondly, I have a notice period for Company A, if I put my papers with them and agree to serve my notice till Oct 10, is there a risk? I am more worried if they ask me to return to my home country before Oct 1st

          As this is your 1st H-1 stamping and you haven’t done Masters in US, I would suggest going to home country for the stamping. If you resign from L-1 employer and they ask you to return to home country before Oct 1, then you will have to comply w/ that (as you are on L-1 until Oct 1). You can later return to US w/ stamped H-1 visa.

          If you work for L-1 employer until Oct 10, then that would mean 10 days of L-1 work while on H-1 status. Although legally you should be working for H-1 employer from Oct 1, this 10 day may not cause an issue in the long run. Still check w/ your H-1 attorney as this falls into gray area (USCIS officer’s discretion).

  10. Hi Saurabh,

    My wife is currently in H4 and applied for H1b 2014.The status now is Initial Review.
    When She applied for H1b on April 1,her H4 expiry date was July 31,2013 and she was waiting for extension approval.In May she got h4 extenison till Jan,2016.
    Then as per the discussion with attorney we sent the new H4 extension notice to attorney and he forwarded that to USCIS to process along with the H1B application we already applied.
    So now the question is whether USCIS can consider the new H4 expiry date and give her a COS along with H1b approval ? Or will USCIS consider her old H4 expiry date(The H4 notice we shared with H1B filing on April 1) and send to India consulate for COS and H1b stamping.
    Can you please clarify our doubt?

      I assume the original H-1 petition was filed w/ COS. In that case, they should approve the COS based on newly submitted H-4 extension document. In worst case scenario, they will issue RFE to ask for that extended I-94 again, which the attorney already has for submission.

  11. Hello- need info!

    applied for L1 to H1 transfer on 30th may with PP and got receipt number on 31st may. and on Jun 6th it says STOP CLOCK message which was RFE and employer have responded back and on June 14th 15 DAY PP clock started.

    But as of now it says INITIAL REVIEW and cany one pls explain did go through this? if so how long does it take to know the status?? any thoughts on this or info is appreciated.

      It has not been 15 calendar days since the PP clock restarted. Why the anxiousness? They will adjudicate it within 15 calendar days. Whether it happens on day 1 or day 15 is anyone’s guess.

      • Yeah, wait time is too much. Just saw the chart of WAC center, it has totally 56k receipts, and only 21k got processed so far. in the below using link.

  13. My H1 application was upgraded to premium processing, and the 15 day clock started yesterday. Today it went into Acceptance Stage.
    Has anyone got a similar response? Wonder what it means!

      This is normal. It has lot its place in RP queue and moved to the end of PP queue, and hence the status update. Unless 15 calendar days have passed and its not adjudicated, you should not be worried.

    Is it possibel to attend VISA Stamping here in Singapore instead of going to India for stamping?

      Different consulates have different rules around Third Country Nationals (i.e. you don’t belong to Singapore or US). So its best to call the consulate there and ask them. In general you should be able to attend it there, but still better to confirm w/ the consulate.

    What is the average approval rate for H1 visa?
    Considering big (US product based company UHG) company, and I am working since last more than 5 years in it on business analyst profile now, overall exp 7.5 years. Have been to US on B1 in 2010 for 8 weeks. what are my chances, I know it varies case to case, but it is tough to focus on work, want to hear from people on this forum. I received RFE on 13th June, by 20th USCIS received the response, attorney never told me the reason of RFE, they responded by themselves. Hoping to get the approval soon.

    • Pankaj,
      RFEs or denials can either be related to the employer or the employee. As the attorney didn’t ask anything from you w/ regard to the RFE, it may have been related to the employer. This is a good sign that they didn’t ask anything from you. Having said that, they may still have asked something relate to you or your eligibility and attorney may already have the details to submit.

      You can go to other sites which have historical H-1 approval data and see the success rate for this company. If they have a good success rate, then you should feel more confident. Big companies hire good attorneys who file cases only when they are confident about the approval.

    I am currently on L1 and had applied H1. Got selected through the lottery this year and last week I received a RFE to show evidence on my current L1 status and asked recent pay stubs. My employer had responded and provided all related documents. Is this a normal question? Please suggest and provide your feedback on this…

      It is a normal RFE as they want to ascertain that you are maintaining L-1 status. Are you getting paid in US or in your home country for the L-1 work?

          • Thanks Saurabh. My employer had sent the response through fax any idea how long does it take to change the status (response received) and know the decision. He sent all the docs on the same day but until now the status is still showing as clock stopped message.

            So yours is a PP case. The status should get flipped in a day or two, and then it should take 15 calendar days from that date. In some cases, the online status doesn’t flip but they continue to process in the b/g. Better for your attorney to follow-up w/ USCIS if the status doesn’t change.

    • I got RFE on 6 June , my employer mailed me confirmation on 20 jun, assuming , lawyer got it on 19 June, still it took almost 12-13 bus days.. Though it differs from case to case I have noticed.

        • @jj, this is first RFE I got. I am hoping its responded last week itself by my employer. Still the status is RFE not changed to RFE Response review as well. Hoping to change it to RFE Review this week .

            Mine also went RFE on june 19th.. Till now my employer didnt get any update onw hat the rewuired information is. WAC1313651###. Hope they recieve soona nd respond back at the earliest… Even if they respond quickly , dont know how much time USCIS will take to reprocess it 🙁

    • My case status changed to RFE issued on 13th June, my case status changed (on internal portal) that RFE received on 15th-16th, and on 20th June I got email from USCIS case status page that they have received the RFE response. I never got to know what the RFE question was. SO in my case it was pretty fast. I was WAC1313654***. RQ/RP.

      • pankaj, that was pretty fast. So you never got to Know RFE?? so I am assuming that is was something simple and your lawyer took care of it ?

        • @jj, no, not yet. I read it on this blog that it might take anywhere from 2 weeks to 2 months from the time they received our REF response. However I am praying that the approval come soon.

          I am suspecting the delay for 138 , 139 series could be as these petitions are for east coast locations , the numbers may be high or may be they might be subjected to extensive checks, as Newyork New Jersey areas have a lot of shady consultants. Just my guess .

    • i got rfe on may 15th in the uscis site. and my attorney received packet on may 30th.
      so almost 15 days.
      employer said that they will respond by this week end.
      have to see what happens , and i donno on what are list of docs requested.

  19. I got RFE last friday, according to UPS it will take 3 to 4 business days to get the letter explaining what they want. Now my employer and I want to know as soon as possible what they want to have it ready and send it back as soon as we can. The question will be: can the employer call USCIS and ask them what is that they need ? Anybody has done that, do they disclosure that information over the phone?

    My son applied for an upgrading from regular to premium processing last june 17/13 of his h1b through my agent/company to facilitate the quickest decision in his case. But according to my agent, they have already applied to the uscis on the same day. But i wonder now its already june 24, but the status of my son is still ” Initial Review”. Can you give me some ideas, is it possible that when you applied for upgrading of your case, it will take 1 or 2 weeks or more for the uscis to recieved ur application for upgrading? Im already worried because the expiry date of my son’s tourist visa (i94) is already this august 2. After that date, when there was no decision in his case from uscis, he is automatically return back to our country to avoid him illegal staying here in america. So another expenses in our part. Please help me suarab or advise us what to do. Thanks in advance and god bless.

    • Any case, your son should return to home country by Aug 2.

      The reason is: H1B even if its approved after premium processing, the effective date for H1B will be: October 1st, 2013.

      He should return to home country on Aug 2. Get it stamped in embassy in home country to come to USA again.

      PP – Ask the employer when PP upgrade was done and the employer should follow-up w/ USCIS to see where it is.

      Like mentioned by H1B Guy, the better option is to leave US and return after getting H-1 visa stamped. H-1 COS may not be approved b/c of the break in I-94 continuity and staying in US on B-1 for a long time (more than 2-3 months) can cause issues in future stampings.

    don’t know how they are processing. in same series i can see many people have got approval or RFE…

  25. Currently my company stated that they have upgraded my case from regular processing to premium processing.

    I have few doubts regarding the same.

    1) I cross checked my case status,its still showing initial review.

    How will i come to know..whether USCIS has picked up my case.and they are considering my case for premium processing.

    2)I checked on redbus2us forums..few ppl were stating about clock start n clock stopped.

    Where can i see this??

    3)when under Premium Processing results are out in 15 no of days or 15 working days[mon -fri(5 days)so 3 weeks approx]

      1. There will be an update like “we received PP upgrade request”. How long ago was the PP upgrade application sent to USCIS?
      2. Same as (1) on USCIS site against your receipt number
      3. Like Nh mentioned, its 15 calendar days. So if it starts on 1st, it will end by 15th.

      I believe it will take another 2 weeks minimum to start processing. You are from which DC?

Iam from the Philippines, and my mother is a green card holder, she filed a petition (I130) before I turned 21, but now Im turning 23 this year. and recently when i checked my case at USCIS I saw that my case is now at Post-decision activity.. what does it mean? would it take more years before i can have my visa?

      Post decision activity status comes up after they have reached their decision. You should be informed within 30 days of the status update date.

  28. the day no 138,139 and even the April 8th date seems to be under curse of some thing, even after 2 months of receiving the receipts, there is no word from USCIS to process the applications from series 138 and 139.
    My guess is they will take one more month to come to series 138 and 139.
    dont know hoe they process, but from 140 series they are processing it faster.

  29. I am from RQ/RP/IT. I was from WAC1313654*** series, got a RFE on 13th June, I did not get to know the reason behind it. My attorny responded to it, and told me that nothing is needed from my side. I received an email on 20th from USCIS case status update feature, that USCIS has received the response of my RFE. My question here is approximately how many days will it take now to get the decision? Will I have to wait for another 2 months? Please suggest if anybody has faced such a similar situation.

    • There are no fix SLAs for reviewing RFE response in case or regular processing. Normally it should be done in 2 weeks but may take upto 2 months..

        • No, its the same for PP, typically 90 days to respond. they will tell decision once they receive RFE response within 15 days.

  30. I just did random check and in WAC131375 series most of the petitions were showing the below message..

    “At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information.”

  31. I am on H4 and have received and RFE for my H1B. My company has to respond by Sep 3rd for H1 RFE.

    My H4 Visa expires on Dec 31st and my spouse will soon have to initiate his H1 and mine H4 extension. There is a case that USCIS will have 2 applications for me in process. H1B RFE Response and processing and H4 extension. What happens in this case? What if H1B is approved first and then H4 extension is approved? OR what if H4 extension is approved first and processing of H1B RFE response is longer and that gets approved later.

    • You do not have to file your H4 immediately. Let your husband file extension for his H1. You file your H4 only if your H1 is rejected.
      I am in similar boat and did the same for my wife. She has applied for her H1 and my H1 is expiring on 30th Sep so I have already filed extension. If my wife’s H1 is rejected, I will file her H4 extension before 30th Sep.

      I agree w/ NH. You have lot of time in hand as H-4 expires in Dec 2013. Your H-1 should be processed by that date. So you can delay H-4 filing until you receive H-1 denial. Let your husband’s attorney know about this, so that they are aware of possible H-4 extension filing later.

    When i applied for h1b ,my experience was just 7 months.I am working in a big MNC.I got selected in lottery. Anyone got the approval with less IT experience? Whether it will cause any problem during stamping for less experienced candidates? What are my chances of getting H1B?

  36. For a very long time my case was in initial review, today it shows below message when i check my case status. Why does this message occurs? Any reason behind this.. Please let me know at your earliest.

    ” At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information. ”

    I applied for H1 this year and got selected in lottery. I am in US on H4. I have got the RFE asking for more evidence under the heading “In House Employment”. Basically the evidences they have listed can be a combination of below items: My offer letter, employee-employer relationship, contracts, SOWs etc. Co. has been given rougly80 days to respond. Is this a common RFE? and what are the chances for it?

    • Yeap this is pretty common RFE for ‘In house projects’ shown by desi IT consultancy companies.. I would say your chances of approval are 50-50 depending upon how your company is able to prove that they have genuine need for you…

      • I am from India, In a typical IT profession. I somehow did not take the pain to register in their website. I used to check it everyday. I saw the approval today morning around 8:30 am IST. Had seen it at around 0530 am but at that time it was still in IR.

        My approval date is 19th June.

          • Nop… Ias already told earlier it directly moved to approval from rife within a matter of 3 hours. At 530 it was IR and then at 0830 it was post decision activity.
