Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

    Is there really a waiting list this year? If that is so,has the USCIS made an official announcement about the same? The whole thing is so hazy.

    Has anyone come across any such news as to when will the waiting list come into play.
    So many unanswered questions..:(

    • No, there appears to have been no official announcement about a wait list this year. It looks as though they were a lot more communicative and transparent in 2008.

      At this point, all we can do is wait. I doubt they will go as far as to announce anything in regards to a wait list at this point.

      There is always a waiting list. However, I don’t think it is published anywhere. IMO, they select few extra petitions and issue receipt numbers to them. I have not come across anyone who was issued a waiting list number (since 2007).

    I got selected in the lottery.But at the time of applying H1b ,i did not send the degree certificate.After 15 days I submitted the degree certificate to employer.Does this leads to RFE?

  7. Does anyone know what order does the USCIS process RP applications? I understand RP apps are taken up only after PP, but I cant understand the logic in their selection.
    I randomly tried some numbers before and after my receipt no (WAC1313451xxx). Many are approved before and after mine, but mine is still in initial review. I also checked for WAC1313351xxx, (i.e. same no, but entered on the previous day) and it is also in intial review. Are they processing as per last name / first name or randomly picking up? Is it possible that they are bypassing apps they have potential problems with to scrutinize in detail?

  8. I called USCIS today and after waiting for an hour, he checked my status in the system. I was not on the “system”, not sure what exactly it means. So, i asked if it means i am not selected in lottery and the answer was no it does not mean that. He said by 15th may your petitioner would either get the receipt or the package returned. Not sure if he meant that receipt would be generated till 15th or not.

    If someone else also got a similar reply, please share the same

      Did you talk to the USCIS people as employee or employer ? did they say as May15th ot June15th , if it is may 15th , only one more day ?
      I am also waiting for the receipt no.

      • I am under RQ/Rp.

        I called and specifically mentioned i am applicant and not employer, but he still checked the system for me. I was ready to hang up if he said that he would talk to employer or attorney only.

        They said May 15th and this is what is confusing me as well. He mentioned everything by may15th and then in the end he said petitioner should surely get either the receipt or returned package after may 15th

            Also the IVR prompted me for the EIN(employee identification number) before i could talk to the representative.

          • My emlpoyer have filed the H1b for me. I’m doing job in IT in indian company. Can you please tell me whether I need to give company name where I’m working now or company name from where I got client letter. Also tell me what is EIN.

            Even I want to know my visa status as my company will not update me unless they know the results of all the applicants. It may stretch to July August for my company to update coz they will wait till last applicant either get approval/or rejection.

            I don’t have any information, neither my petition number nor anything else. Please tell me will USCIS persons can find my petition number using passport alone??

          • I have also called uscis, but they don’t provide me any information and told me only the employer can get information. Tried again, same with an other representative.
            Which numbers do you use to get through IVR? I don’t get the step to give the EIN, think this is the problem they don’t give any information.

  9. Finally got e-mail from my lawyer saying my petition has been rejected. I was RQ/PP/CSC. They received the notice via mail. It feels really bad, but when all is said and done, the show must go on.

        No what I meant was my package has been returned. My lawyer received the notice and he sent me an e-mail regarding the same. I was never selected in the lottery.

    My employer gave me receipt number last week, when I am checking the status, its in initial review with following message :
    On April 2X, 2013, your Alien Registration Number was changed relating to your I129, PETITION FOR A NONIMMIGRANT WORKER. Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance.

    Can some one please help me to understand what this means ?
    FYI- Last time i traveled out of US was in Feb 2013

  12. Mine (RQ/RP/CSC/WAC13143XXX) also moved to PostDecision Acitivity today with below notice , but w/o any confirmation on acceptance/reject .Any guesses on accept/reject if the status moved to postDecision so soon.

    On May 14, 2013, your notice I129, PETITION FOR A NONIMMIGRANT WORKER was processed and mailed to the address on record. If you have not received it within 30 days of May 14, 2013, contact customer service at 1-800-375-5283. If you move while your case is pending, please call our customer service center at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

          • Intial review means they doing background check and document validation on your application and it vary for each application so don’t worry.

    I’m very sorry for everyone who didn’t get selected in the lottery, especially if you live in the U.S. already.. This sucks!

    My case (AD/RQ/VSC) has a receipt notice of April 15th and though I know that the guideline for processing is two months, I have noticed that the vast majority of cases (~95%) within 2-3 days of my receipt number (EAC131365xxx) have been processed with either approval or RFE. I’m still in initial review. Anyone else in this situation? What could be the reason? They do seem to be adjudicating cases chronologically so not sure why mine is just sitting there.

  16. I lost the H1B lottery in 2008 and went back to school to get a PhD. It’s my 2nd attempt for H1B now, and bingo, there is lottery again, and I am loosing again… screw US!

    • Well what is your PhD in? There are certain things that are meant to and not meant to happen in life. And even if we dont understand the reason why, God has the best plan laid out for us.

      Perhaps a better opportunity waits for you elsewhere. Don’t know if you know this but Gandhi was suppose to be a lawyer in South Africa. He had set up a career and everything, yet left that to follow a better purpose. You never know whats good around the corner.

    • If you get a job at a university (or non-profit) they can apply for cap-exempt H1-B. Then you don’t have to worry about the lottery.

    Can you please clarify one doubt?

    Even though i have selected in lottery process my employer saying that we didn’t receive your receipt. but law firm updated case number in portal. and law firm saying that they have forwarded receipts to employer. but employer not responding on this. what could be the reasons for doing like this? can you please share to me.

    • Some employers do that. They hold on till they receive results of all applications they had filed. Some update every week. all the best. Latter happened to me.

  18. I hava applied for h1b from a company in USA. Out of nowhere today my exsisting company has suddenly decided to send me to the US for A short stint of around 6 weeks to the US, though on. B1 visa. What are rules regarding a b1/b2 visa. Can I legally work in USA on this visa. My primary reason would be to gain some Business knowledge there.

    Will this have any affect on my other petition, just for clarification these are two distinct companies.

    • On a B1/B2 visa you cannot work for and get paid by a US company.

      On B1 you can conduct business for up to 90 days, such as attend a meeting/conference, go to job interviews, meet clients and provide consulting services. All of this must be tied to your company that is based outside of the US, and they are the only ones who are allowed to pay you.

      In short, you cannot be paid by a US company on B1.

      • Only extra money you get is for your day to day expenses like hotel, food and stuff.
        At immigration make sure you don’t say ‘Work’ as your purpose of travel otherwise you’ll be flying back on next flight 🙂

      B1/B2 is a tourist/business visa and by law, you cannot work in US on tourist visa. If found you ll be listed and the prospect of your future visas will be jeopardized. However, on some newspaper, I heard that there is a company called Infosys based in India and they use to send people on B1/B2 to work in US without the knowledge of USCIS. A man from that company blew the whistle after his managers didn’t treat him well and it became a news. I wouldn’t encourage you to do so. Rather, ask your company to wait till your H1 gets active on October 1st and kick the work at that time. Your reputation and profile is more important, if I were you.

    • I agree with both the above answers and another point you need to remember is POE and visa interview for B1 and anytime you enter US.

      Never say you are gonna work (assuming thats true) on B1 to POE officer and VO. It will be direct rejection of B1 visa at the consulate and deporting at POE.

      Your employer will be able to guide you.

    I came to know from my lawyer that there isn’t any wait list cases. All the lottery selected cases were notified and the pending cases should be considered not selected in lottery.

    Anyone who had paid to their company for their H1b filling, what ur employer are saying ?Are they returning you the total money back or 50% or like that.Please help and share.My employer is saying he wont return 2000$ as lawyer fee.

    • They are not going to refund anything. The filling fees that the company was suppose to pay to USCIS will be refunded to the company, now the lawyer fees cant be returned, the lawyer did this part of preparing and sending the paper work, you had bad luck and thats it.

    • Hi Anyone, Most of the employers are charging for Lawyer fees as they get everything back other than the lawyer fees, but the fees should not be more than $700-900. He is charging you too much for lawyer fees.

        • A fee cant not be estimated my friend. Lawyer differ their fees by their own discretion. I paid my lawyer $1,500, it all depends of who your lawyer is. I would call the firm that your company used and ask them directly how much were the lawyer fees. If is different from what your company says then you have a problem.

          Remember to keep all your emails for security purpose.

          • You are an idiot if you paid $1500 for H1B visa petition application… or you do not know what else they have charged for… there are several things involved.. sometimes the lawyer charges for degree evaluation… or from this year, if you are filing from a new employer, employer e-verification etc… the fees for the lawyers are and should be less than $1000 and that includes the reputed lawyers…

        • My employer dint charge me anything for the filing. They said that they have 100% profit terms with the client and would take a small sahre from my salary when ill b employed. Don’t know how can you guys agree to pay to a employer when you have all the right skills and a handsome experience.
          Sorry but paying should not be a option.
          That’s my vision

          • Paying commission to the company from salary is the worst thing that can happen. Get permanent with the client and show your company how a H1 person can be a super man 🙂

      If your employer has taken money for you for lawyer fees and you agreed that it was for lawyer fees then probably you cannot (and probably should not) do much as it was part of your verbal/written contract with them. However, if an employer has taken money from you as a security deposit, you have a right to ask for all of it back.
      If you are in USA, follow up the email with a certified mail asking for the money back and a threat to complain to USCIS and pursue legal options. If you don’t hear from them, you should at least inform USCIS.

      • I totally agree with “In Sanity”. You should consider complaining USCIS through ‘USCIS info pass”. With this option, you can find nearest immigration officer at your place and discuss the issue. You will get your money back or your employer will be under scan from USCIS. Make sure that you do it legally and be honest.

    • If you are not selected in lottery and you dont have any further business to do with employer. Tell him pay my each cent back or I am reporting you to Labor department because its not legal to take any money (Not even attorney fees) from employee related to H1b. He might cough up few extra hundreds. Good luck

      • WRONG, Company is not required to pay lawyer fees, therefore if the applicant verbally agreed to pay for the lawyer the company does not have any responsibility.

          Check page 5 of this case. It says “…..except that the deduction may not recoup a business expense(s) of the employer (including attorney fees and other costs connected to the performance of H-1B program functions which are required to be performed by the employer, e.g., preparation and filing of LCA and H-1B petition)..”

    • What, how much did you pay?
      Ideally it should $2250 for H1B application and around $500 for lawyer.
      you should be getting back money worth all the checks which were sent to USCIS.

    Employer has just been notified by lawyer that my package has been returned.
    Accordig to employer, there was some letter to effect that “not selected for cap”
    I was AD/PP/VSC
    Its a sad day and Emloyer is even more worried.
    My opt extension ends in Dec.

    • Yes, I did get the same message for two days right now, I received an email and a message that my case was changed to RFE, then I tried to check my status it gave me this message “At this time USCIS cannot provide you with information for your case”. I called the USCIS they said there is a glitch in the system and they are fixing it, but the officer told me, wait till you get a letter from the USCIS within one and half week and call us again.

  25. For all those who are waiting.

    We are all aware that pckages are now coming back meaning ALL data entry and receipt generation is over.

    The focus is obviously shifting to the waiting list( about 10,000-15,000). Any new receipt entries are most likely from waiting list.

    One fact is we dont know how they decide who gets to waiting list. If anyone has info, please share.

    Guys please report if you get package back Or otherwise.

    Do they notify if you are in waiting list??

    I am AD/PP- still waiting, No package back ,No waiting list notification??

    • People one the wait list were most likely chosen at the same time that the lottery was conducted. They just kept an additional 15,000 or so applications to account for what they expected the rejection rate would be.

      Either way, it is a completely random selection, a bit like a second lottery among the non-initially selected applications.

      Packages will not be returned before June, so it is still too early to assume you are one the wait list. As far as I know, USCIS has not said they would notify wait listed applicants yet this year, though they did so in 2008. I might have missed such announcement, however.

  26. Is there anyone who themselves or anyone they know got their status changed to RFE and then immediately to Approval within like 3 days?
    It happened to my case. My lawyer did not receive the RFE yet, neither did he receive an Approval in mail.

      • My case id AD/RP/VSC. I saw the status changing to RFE on May 7th and it said that the USCIS sent my representative a detailed RFE notice on the 7th. I checked my status again last Saturday and it said that my case has been approved on May 10th.
        My lawyer never got the RFE notice and obviously never responded to any RFE on my case.

        I remember some PP cases changing to RFE and then immediately to approval on the same day. Do you all remember any examples like this or may be my brain is making stuff up?

  27. Hi, I am is the one who post the question about RFE and it changed to “At this time, USCIS cannot provide you info about your case…”. I am RQ/RP in Vermont. Today (05/14) I checked it again and it changed back to RFE but the date is different “On May 14, 2013 we mailed you a notice abour RFE…” (before it is May 9). May be the system of USCIS is ok now. Hope it helps!

      initial review -> RFE -> message to contact NCSC -> today back to RFE.

      Please correct me if I am wrong.
      Even i am in similar situation. Till yesterday it showed initial review and this morning i checked and happened to get Contact NCSC message.

    • The same thing happened with my case too. On May 9, when I checked my status it said ” On May 9, 2013 we mailed you a notice about Evidence…” On May 10 it changed to “At this time, USCIS cannot provide you info about your case…” and today when I check it says ” “On May 13, 2013 we mailed you a notice about Evidence…” I agree with you that there maybe a glitch in the system and that is why the May 10 message was showing but does it mean that USCIS has sent me 2 RFEs…one on May 9 and then again on May13??? Spoke to my attorney and he has not received a notice yet.

    Anyone from Infy got their AIMS updated today? I am from RCL B’lore.

    I called the GI team last week and they said that “Congratulations your application has been selected in the Lottery”. 5 days prior to my call, i got a mail from GI team that not to call them since they are receiving the receipts and they will updated AIMS in REAL TIME.

    I am confused very much why it takes them so long to update the Receipt number even after confirming me that mince got selected. Is this what they call as REAL TIME??

    Hi, This is Siva from TCS. I got an email saying I am Selected in Lottery.
    They are releasing the Lists on weekly basis it seems.
    Till now 3 lists are announced & 2 more lists are there. Dont worry.
    This is correct information.
    Please wait until the end of June.
    Dont forget that in 2008, when H1s are closed on April 1st only &
    the RQ receipts are generated till June 2nd.
    So, there are more coming. keep up the hope.

    can we still hope on getting the receipts for H1b selection.
    As per previous analysis where the lottery took place in the 2008 the results announced till 2nd of june and the rejections started. So we can expect same in this year as well.

    • I think this time the Uscis has been too quick with their proceedings be it sending the ack receipts… To the approvals. So as per my employer and attorney they are done with their bit of sending acks and have moved a step higher. They are sending the approvals now n no more ack receipts. Somewhere I read the rejection rate would b high n looks like it was this year!!! B practical guys n move on dint just stick to h 1 think create and innovate. All d best god is with each one of us and will help n shoe us the way to move forward. Don’t just stare at the close door divert your vision towards the open one and move forward.

  38. From last few days there are no messages that they got picked. Everyone is reporting that their package got returned. That is discouraging. My attorney said check is not cashed so should wait couple of weeks for a final answer. Is there anyone whose application got picked in the middle? like waiting list?
    I am RQ/RP/CSC and do not know whether to wait or not. Maybe I should get back to work 🙂

  39. My employer told me that they filed 20 received ack for 17, and dint get for 3. I am amoug the three people whose ack dint come. He also said that he believes now there will be no more acks coming in so I better should apply to some university :(.. On the other hand Illinois state university did not accept my form saying that I am Late for this season and should apply again in aug for the Jan term. No good news on career front so I would b starting cooking blogs and would start painting for my house. 🙂
    Just married so I think god wants me to stay at home for some more time :)..

      Anyone who had paid to their company for their H1b filling, what ur employer are saying ?Are they returning you the total money back or 50% or like that.Please help and share.My employer is saying he wont return 2000$ as lawyer fee.

      Lottery is over 🙁 Not selected.

        Is there a way to find out this person’s email address? It is our responsibility to report anyone who is using illegal ways to get the visa.

        • As far as I know only paying for the visa by the beneficiary is illegal, paying for the lawyer is not. Unfortunately companies like Iamonh4’s are “smart”, they know how and where to find the holes in the system…

          • From his post it sounds like he paid the training, petition & fraud detection(ironically) fees as well. All these need to be paid by the employer.

  40. Finally…I got an email from my attorney today saying my H1B is approved for 3 years.

    I haven’t got the receipt till today and i completely lost my hopes and was looking on other options .I am AD/RP/CSC.

    All the best for the folks who are still waiting ,Hope you will get some good news too.
