Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

    My work authorization under OPT expires on 1 June. Have already initiated process to move to my firm’s overseas offices, either in the UK or Australia.

    I know it’s a difficult time for many, but as someone told me, “if this is the worst thing that happens in your life, you’re a very lucky man.”

      • If you’ve already got ur visa, you’re in no position to comment. And if you’re one of those whom I commented on, you definitely shouldn’t comment. I can still understand IT giants applying for thousands of visas – while morally reprehensible, it’s still legal. Buying a visa is definitely illegal.

        • I am not one of those buying visas.. FYI.. i hold same positions (SCON) as yours in one of the big 4 .. have all eligibility to become lead con..

          assume you are in H4 but with very good skills.. after trying for all legitimate ways, if no one sponsors your visa, what will you do ? i am able to understand what they are going thru but you are not.. will you say these words if ur wife/sister/friend is applying for one ..

          What’s the use in all these titles if there is no character..

            If you really had the skills a US company needed, then you wouldn’t need to pay for an H1B yourself. A US company would sponsor a visa for you because you are truly worthy. In short, “very good skills” and “no one sponsors your visa” can’t be the same person.

            Besides, a company asking you to pay for your H1B is not seriously looking for a skilled worker, which is why it is illegal for them to do so. H1B is meant to help US companies fill positions whenever there is a shortage of domestic talent, not to help foreigners find jobs.

            So I agree with Seanconneryfan. F*** the people who bought their visas.

            Thanks to your company and other IT consultant company, we have lottery this year. I wish they will aprove the new law like “starting in fiscal year 2014, companies with more than 75 percent of their workforce made up of H1B visa holders will be banned from bringing another worker”. There will be no buying H1B visa and it will be fair for everybody.

    • If your work authorization under OPT expires on June 1st, then why did you not ask your employer to file under the Advanced Degree quota. By applying under Regular Quota you missed out on higher chance of getting picked in the lottery as Advanced Degree folks get 2 chances of being picked in the lottery.

      • I didn’t decide on that. The attorney firm decided to file under RQ because they felt my role had “greater alignment” with my undergrad computer engineering degree. I didn’t realize they hadn’t filed under AD until it was too late; else, I could have tried to convince them otherwise. Whether it’s the attorney’s fault or not, I got affected. My MBA is from a top-20 school and my major was Consulting. Strange, ain’t it?

      But best thing would be to focus on the next 10-11 months after which you can apply again 🙂
      10 months is really not that long, especially if you chooseAustralia, as you will spend a few months getting there and back 🙂 Just kidding to lighten up the mood.

    USCIS updated my status today which is the following:

    On May 13, 2013, the 15-day Premium Processing clock stopped on your I129, PETITION FOR A NONIMMIGRANT WORKER. A notice was sent on this date explaining the specific reason for stopping the premium processing of your case. This notice will contain detailed information on further action required by you. Your premium processing receipt notice contains contact information for direct inquiries on your case.

    During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant’s/petitioner’s criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

    If you have filed an I-485, I-589, I-751, N-400, I-90, I-821, I-131 or I-765, you can expect to receive an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. We try to schedule biometric appointments as quickly as possible and in most cases you will receive your appointment notice within 30 days of submitting your application. We will send your appointment notice approximately 14 days ahead of your scheduled appointment. It is important that you keep this appointment. If absolutely necessary, you can request that your appointment be rescheduled however, please be aware that rescheduling may delay the processing of your application. Please follow the instructions on your appointment notice if you need to reschedule. Occasionally, you may receive an appointment notice to appear at an Application Support Center to have your fingerprints taken when you have filed a form other than those listed above. In these situations, you may receive your appointment notice more than 30 days after submitting your application or petition.

      • I am a Project Manager.. Nothing to do with IT… But my Company is one of the Market Leaders.. I suppose they didnt even see my petition because i dont think if they saw it they will decline it..

    I applied for H1 in AD quota, my cheque didn’t get cashed and I do not have a receipt number yet. My employer is saying he has no update yet.Can any one tell me how to find out my status?

      • I read some where that we can call USCIS or our DSO at the university , can any one let me know that process in detail.

        • u can surely call ur DSO and ask to check if there are any sevis updates on your I20… if your application was picked in the lottery… sevis update on your I20 will show change of status to H1B pending and also the receipt number.

          USCIS .. only ur employer/attorney can call to enquire about your application, as they filed the application on your behalf. Even if you call, USCIS will not provide any information.

        • Your employer must call USCIS, not you.

          As for SEVIS, you can ask your DSO to check for any status changes in the system.

      • I have Masters degree, but unfortunately my attorney filed under regular processing stating that I dont have the prevailing wage for advanced degree quota. I never knew about this until May 29th, I did nt had much time to file the labor again, so went ahead with regular quota. My service center was California. They got the package on Apr 1st. Attorney got the rejection letter today, stating my application was not picked in the lottery.

        I applied for another Masters degree in a university now, currently waiting for i20

        @sunny, I have two options, I can move on to h4 or apply for a university in my town.
        I have chosen to go for a university as in the worst case I can get cpt in 6 months, so that I can start work again roughly about next January. If I go for h4, I have to wait until oct for sure…and I have to search for generous employer who can sponsor with out a job, which is kind of gloomy…

    I found out today that my employer’s check has been cashed. Unfortunately, I couldn’t find out the receipt number (from the back of the check). They haven’t received a receipt notice yet.

    • Is it possible that check gets cashed without a receipt number on the back?
      I have seen copies of the checks sent with my application… uscis prints the receipt number on the back where it says endorse here

      • Yes, my understanding it that USCIS puts a receipt number at the back of the check. I am saying that I could not find out what the receipt number is from the person who informed me about the check’s cashing. The check got cashed last week (I wish I knew the date). When I get a receipt number, I’ll post the first 5 digits.

  8. I been a watchers for this website in the past few months.. I would like to share my though that I read through an article about Indian comanies abusing H1B visas.. I strongly agree with the points there, I work in an account in Chennai Infy and I got my H1b approved and stamped 2 years ago with my other few friends for the FY2012.. But so far we all are not send to the USA, then I don’t know what the F**K Infy is still applying thousands of H1bs this year.. I’m sure out of 7K H1b Application only 4 to 5K candidates will be send to the USA… Literally Infy is wasting almost 2K application every year (then think about other companies) which can be used by anyone who needs it desperately… USCIS should take some actions against them…

    • They retained you for 2 yrs by applying a H1. What else they need. If that “project” needs you, you will be sent otherwise not. You are just a head count for them. Sorry if I have hurt you but I think that’s what it is.

    • It’s great that you have even admitted the H1-B abuse that occurs in your company. Most Indian companies are completely to be blamed for this abuse and that is one of the primary reasons why there is an explosion of H1-B applications leading to this uncertain Lottery where genuine candidates’ future hangs in a limbo.. they might as well try their luck at PowerBall Lottery! Shame on such abusers!! Sadly, unless USCIS stipulates any regulations this abuse will go unhindered and unchecked my friends..

    Not to break anyone heart but It is now reasonable to assume that reports of returned packages are true given that we have very many first hand reports.

    It also appears that both advanced degree and Regular are getting packages back.

    We know that some will be put in waiting list.

    When can we expect to conclude that someone is in waiting list by virtue of NOT getting back package?

    • Not to break your heart, but most of the packages will be returned at the end of may/first half of June. The ones already returned are just early. What I mean is, it’s too early to assume you’re on the wait list.

    At this time USCIS cannot provide you with information for your case.

    • @HS As per notification from USCIS their server is under maintenance , so RFE status are not being fetched. Reference some comment in this forum, check USCIS site for more details.

    I received my H1B petition number(2014) 2 weeks back and till early last week status on uscis site was “Initial Review”. Today I checked and it shows “Post_Decision Activity” with contents as below. What does it mean?

    “Post Decision Activity

    On May 9, 2013, your notice I129, PETITION FOR A NONIMMIGRANT WORKER was processed and mailed to the address on record. If you have not received it within 30 days of May 9, 2013, contact customer service at 1-800-375-5283. If you move while your case is pending, please call our customer service center at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.”

    • Thats mean that yours is approved or denied, wait for mail and find out.

      What is the date of your reciept notice date?
      Are you RP or PP and AD or RQ?

      • Thanks. My employer applied for it and this is my first H1B process. WAC-13-143-xxxxx is my petition no. and notice date is 26th April, 2013.

    • It is either denial or RFE. Probably the second one. In case if petition is approved, they clearly state , that it was approved.

  14. How come so many Indians want to leave their country, but are the first ones to show nationalist sentiment whenever someone criticizes India? If it is so great, why don’t people want to stay there?

          • I’m from Tanzania and I don’t get offended when people criticize it. The US has better universities than my home country so I came here for undergrad. I am working as an actuary, which is a field that doesn’t exist in my home country so I’m building a career where there is a big market for actuaries.

            I will criticize my country for you before you google where it is and find out what issues it faces. It is one of the poorest countries in the world in terms of GDP, it has limited access to healthcare, education isn’t of the highest quality and corruption can be found at all levels.

            Now you tell me why do you want to come the US when you think India is the best and get offended when someone criticizes it?

    • Hi buddy,
      Great question. One that i have pondered myself. I knew from an early age I wanted to come to US for education but have shown the same nationalist sentiments on occasion myself.

      Perhaps this might help: To begin with no country is perfect. We have a messed up political system that by their corrupt tendencies, scandals, power hunger, etc. keeps the country from truly progressing. This is true for many countries. Plus our population is tremendous and creates a lot of competition for all.

      We gained our independence pretty recently in Global Timeline relation, 1947 from the UK. Our freedom struggle was a big one and full of ideals and great role models. But unfortunately some of the people that came into power after that misused our sentiments and trust in their leadership for our downfall. So we have a hard working populace that understand that our government is not doing so well, thus affecting the growth.

      Current generation hopes to, educate and work abroad for a while to learn a better system and when they eventually do go back to enhance our fellow country mens lives with that information which is slowing starting to show itself in our IT development and global exposure. Hope this helps.

        I certainly hope that people like you will bring change that India needs in order to develop and make lives better for the rest of the population.

        If the government is the problem, do you think a shift away from democracy to communism be the answer? A communist system with an open economy like China certainly seems to be one that works. China has a bigger population than India and competition seems to be just as high, but its system is letting more and more people get above the poverty line.

        • Hi Asd, thanks for responding and genuinely trying to understand why the way we are. 🙂

          Do I think my country is good? Yes! It has a lot of potential with a lot of willing people and the same nationalist sentiment can be used to bring about a change for the good. Do I think my country is great/best? No! We are far from perfect. Majority of our population lives in poverty in rural areas. We follow the rules like a sheep with blinders on. Illiteracy and crime are rampant, especially towards our women and children. But I am still hopeful. The first step in solving any problem is recognizing there is one. 🙂

          I do want to do my part, my whole family works with the government and I almost went the same way but I realized that I could bring a change by using IT to our advantage instead.

          China essentially is a technocracy behind the communist guise. They are not truly communist, with unregulated credit policy and assembly line business towns with poor condition for workers they have made a mockery of communism. Its a Capitalist Wolf in the skin of a lamb. A balanced system might be a solution, democracy only fails because we dont inform ourselves well or dont participate where we need to. I don’t think we should ditch democracy, but should rather educate ourselves and create a balanced economy that emphasises on resources.

        If you want to help your country, you can do it by staying in India. You have all the resources available there. Politics might be corrupt, facilities might be limited, things might be hard, but that’s where one has to bring the change.

        My opinion: Everyone wants an easy way out. They like the lifestyle in US and the respect they get.

        • Well we don’t know how many of them do want to go back. If you are from India then you may have noticed that current issues sustain precisely due to lack of exposure on a global level. When we learn how successful systems work world wide, we can go back an emulate them. No not all resources are available there. I would love to hear your concise solution to that. I believe the biggest helps come from educating people on the rural level, and not just basic education but rather a technology focused ethical education. Politics isn’t corrupt, politicians are- they need to be changed. Thus facilities are limited because they are not willing to uplift the infrastructure. And well things are hard everywhere.

          Yes everyone wants an easy way out, just like you and me. And people may like the lifestyle in the US and respect for the merit of their work,etc. But that is not where the buck stops. Eventually, we need to change people’s philosophies on life, work and society.

          • I am from Tanzania, which is a country that is blessed with natural resources but has not been able to use those for development. It has some of the same problems as India except for population growth, but there is a problem with extreme urbanization nowadays.

            My experience abroad has taught me that there needs to be a system in place that cannot be taken advantage of. I don’t believe in free handouts to help people, rather people should be taught how to help themselves and they will end up helping others.

            I was fortunate enough to have received a quality education, but I am waiting for the time and resources I will need to bring some changes back home.

        If a straight person supports homosexuals through their words then they better support their rights through their actions. If a man supports gender equality, then his actions better back that up. If you are not involved in politics, but want to voice support for a politician then you are a walking contradiction. Every citizen has the right to be involved in politics, but is not required to be involved.

    • In a way patriotism is similar to religion. You are born with it. You are expected to believe that it is the best. You ardently hate others who criticize it. Both are used as fuels to instigate the extremists. You even go on wars thinking you are protecting it from the ‘infidels’.

      Not saying everyone should stop believing in their Nations or Gods. But this intense love might be blinding your ability to think clearly.

  15. I am RQ/RP in Vermont. I got receipt on 04/19 and it was initial review. On 05/09 it changed to RFE when I checked the status online but my lawyer did not receive mail yet. Today I checked it again and it said “At this time, USCIS cannot provide you any info in your case. Please contact the NCSI at xxx phone number”. Does anyone know what happened? I am kind of worried about it. Thank you.

    • The same thing happened with me. Initial review>RFE> and now this message – “At this time, USCIS cannot provide you any info in your case. Please contact the NCSI at xxx phone number”. As I can see from the post below even Srinivas and Tinker are get the same message displayed. The difference is that they say that they got this message straight after the initial review phase and did not get an RFE. Can anyone (Saurabh) please throw some light on this subject what is happened. Kind of worried now.

        I am a RQ/Premium processing as of May 2nd and is Vermont Service Center. Yesteday night it was at Initial Review. Does this mean denial, change of status, or RFE? fingers crossed.

  16. My employer told my cheque is cleared on 30th April.but they have not received my receipt notice yet.is there anyone in the same situation?.Any idea on this?

    To view the status of a case, please enter the corresponding application receipt number. The 13-character application receipt number can be found on application notices you have received from the USCIS. It begins with three letters such as (EAC, WAC, LIN, or SRC). Dashes (“-“) should be omitted when entering a receipt number. However, all other characters, including asterisks (“*”), can be included if listed on your notice as part of the receipt number.

      I guess it would automated system which will ask you to dial your application number.

    • I am also asking the same question from myself. Am on H4, in India with my kids decided to stay back in India and continue my job here till the time I get good job in US. See my luck still waiting for the receipt. I hope H4 should be allowed to work in US.

  20. Are petitions processed in the order of their receipt numbers? I’m AD/RP/CSC, receipt number WAC13132XXXXX, receipt date April 12, still in Initial Review. It sounds like a lot of other ADs already got approval/RFE?

    • Yes. You are right. AD’s are being given priority over Reg over H1b processing. I think you will get to know soon.

  21. Hi Saurabh,

    My status changed to RFE on May 7th. My lawyer had not received the RFE letter in mail by Friday.
    Today when I checked my status again (for no reason), I saw that it has changed to ‘Aprroval’ on 10th May.
    I am not sure which update to believe. Either one of them could be a mistake????
    I am not sure if I should start celebrating already.
    Please please advice.
    I cant even speak with my lawyer until Monday. This is gonna be stuck in my head until then.

      • 2 questions to you James. Can you read english? If yes, did you read article posted above in this page? If you had read then you wud know it says it takes 2 to 6 MONTHS to process. And you are worried it is 2 WEEKS?

        USCIS has generated receipts on Sat but not sure if they process petitions on Sat.

          • No need to get angry James. I can tell you that I haven’t seen any action on Regualar Processing and Non AD being processed right now. I think USCIS is processing the AD H1B and rightly so as they are in the country and also their verification is simpler.

            I dont think there s a specific order in processing. I was told that I was picked up in lottery on May 2nd. I received my receipt no from employer on May 11th, When I checked the status on USCIS, i could see that my petition has already been approved on May 9th. I’m from RQ/RP my receipt # EAC13146…. hope this helps…

            @In Sanity: You are still living by Wren & Martin, the rules have changed. The quotation marks are correct, I was highlighting not quoting. A comma would have been preferable but is not mandatory.

But, when a foul mouthed Britisher with poor spelling decides to mock people for their poor English, it becomes a day at Disneyland for me.

      Today I got a call from my consultancy saying my H1B petition got approved from USCIS but as of now they did not receive original confirmation document from USCIS it will take about one month time to get that after words they will process for Visa.

    I am from one of the Big4 indian IT companies. Our company sent a list and said…..6 are selected out of 30 odd applications while the rest of the applicant status is “Pending with USCIS”.
    Could you please confirm if the complete lottery process is done for regular quota and regular process….I mean the data entry and informing the attorneys….is it completed or yet in progress by USCIS/ .

      I would say to wait for some more time . The reason for the same :
      a) Big4 mostly files in RP and the result for RP are still flowing in via snail mail.
      b) Also , petitions receipts were being sent as late as 5 May(or may be later also).

      Unless you get your package back there is hope. So cheer up !

    • Yup mate many others like us are still waiting. Though I am a very positive person in thoughts, now being a bit practical I think it’s over. My lawyer told me that if anything will have to come it should reach by Friday and after that start working on your plan b. so I did :)…Tc relax n b happy…as they say if success enjoy with your frens and if its failure take it as a lesson and share it with your friends.

    i’ve prayed so bad but it didnt work.
    i’ve been spent my 3 years trying to building my life here, making friends, working so hard and just bought a new car recently.
    and now, it’s all over.
    i guess the only option i have is going back to my country with my broken dreams.
    so so sad.

    • There is lottery this year …And yes few of us will be left out hanging .But I think it so unfair for the people with real jobs here and now they have to wrap up their lives and start something new .

    • Your consultant didn’t discuss this part with you did s/he? They don’t want you changing employers as soon as you know your application has been approved.

      • Even my employer did not give the receipt and he gave stupid reason for that.. I have applied H4 along with my H1 but did not receive my receipt for that too. Do we get the receipt for H4 or it will go to employer address? Is it possible to find out the H4 receipt number by calling USCIS? Check cashed on 04/23 but employer has the receipt for H1.. He is not giving any Hint about H4 and I suspect whether H4 applied along with H1 or not. But employer is telling me that he will do premium processing next week…Hope everything should go well…

        • H1B and H4 are two totally different VISAS.
          H1B is a work which allows to work in united states and and only a employer can file this visa for you.
          H4 is dependent VISA which would be filed for dependent of people who are in US on work permit like spouse and children of H1B visa holder gets H4 visa.
          you or your spouse’s employer both can apply for H4 visa,document you need
          1. Primary person’s (who is on work permit in US or is travelling to US on valid H1B work permit) I129 which H1B petition.
          2. Documents to support the beneficiary relationship with the primary person, like marriage certificate or birth certificate in case of child.

          I am not sure why your employer is not giving you the file number, insist for you file number and do let us know on what grounds employer is not providing the receipt#.

          • @Rajeev, thanks for your input…Employer is ready to file my case as premium and he will share me the receipt once it is approved. He thinks that I may change my employer as soon as my petition approved. I think that is the only reason he is not sharing the receipt. He did not share the receipt to other employees too.. Also, to my previous question, is there any way to find out whether H4 had filed along with my H1?

          • For the first part not sharing your receipt# is totally unjustified but again it is between you and your employer,
            For H4 i am confused here:
            so the H1B was applied for you and H4 for your dependent, correct?

            If yes then as i said approval or rejection of H4 totally depends on your H1B approval and H4 is dependent of H1B and there won’t be any H4 if there is no H1B.
            Hope this makes your doubt clear.

  36. Finally I heard something from My HR, that she received the receipt, but she couldn’t mail me the detail as she is Traveling and I might get some info at weekend or by Monday. I asked her twice if my petition is picked up in Lottery and she said yes, otherwise we wouldn’t have receipt for you, hopefully she understood who I am and she must be sure of my name and hopefully there are no other person with my name. Hoping for the best and hope to get the confirmed confirmation, All the best to the guys who are waiting just like me and my wishes are with you all and expect the same from you guys as well.. I will put my details once I have confirmed information…

      • Today yes, Delhi had a bad day…I agree Agarkar is a sheer bad luck guy. Have not seen him perform for a decade now i believe. The last tym he played good was in 2004 when he performed against australia..But the whole team comes sitting on sehwags shoulder for the batting and thats is really expecting too much :)..

  37. AD/RP/CSC, Yesterday my employer mailed me saying that my application was picked in the lottery. He might have got the notification earlier from our attorney but only notified me yesterday. I don’t have the receipt number yet though. Will post the first few digits of the receipt when I get it.

    If you do not have a current on site project requirement when do you expect to get one?
