Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

  1. I was selected in the lottery and received the case # on April 20.

    Checking the USCIS website, found out that my application has already been approved on May 3rd.

    That was REALLY fast application process.

      Can you if possible put down the dates here? Like petition sent, received, Notice date and then approval date? Those essential breakdowns will give us a better look at processing times.

      It seems like USCIS is processing faster this year.

  3. I am on H4 and still waiting for receipt…its really very painful.
    I never thought my life would be a hell without my job… I took the decision of resigning my job and came here on H4 (last year). I thought one year would pass away happily with my husband. But last year was the worst year of my life…I cant express how tough my life is…going through lot of personal problems…no one around me I have no support…keep waiting the whole day just for a call from my employer. Thought that I will get my job here and there will be end to my problems, atleast I will have my own life ,independence. But unfortunately we have lottery this year.
    Tears are rolling out of my eyes while typing each letter…I just wanted to vent out …
    I have lost all hopes and nothing good can happen with me…so its better I accept my fate.

      • My husband’s visa will expire next year.. so MS option would be too expensive. Also, I cant sit idle at home till next year…I will have a gap of 2 years…and it will be difficult for me to find a job and also frustration will mount up….
        Our culture does’nt allow me to go back to my country and work alone…

          In that case, you can see if you are eligible for L-1 or like others mentioned go the cap-exempt route. Bit difficult but not impossible.

          • I am also on H4 and applied for H1 this year. I decided to stay back in India (with my child) and continuing my job here till I get H1. I haven;t received any response from my attorney. 🙁
            After reading you frustration, I am seriously thinking whether I should go there without job or not…life is not easy for spouses in US.

      I really wish you all the best. I understand the pain that one goes through when things go beyond our control. My personal life also is in a great turmoil now-a-days. There Were several days when I have probably cried all day long. What I can say is try being strong, I really wish that you get your H1b this year

      Feel free to vent out all your frustrations on this forum. This forum being annonumous, it gives you the full freedom to say whatever you feel like without anyone knowing who you are. It might not solve your problem but might make you feel lighter atleast for some time.

      Also go out make friends, and if possible apply for a job in a university or non profit organisation.

        I am trying to be strong..no other option….I have made few friends here..but I feel so lonely even when people are around me…I am just not happy.. The job and h1b thing is always on my mind…I feel I have no identity of my own.Right now H1b is my only hope to end my problems ….

        • Have you ever thought of doing a One Year Masters. I am sure there could be some university who might even give you a scholorship. Then you will be better prepared to get a Job also. Think in every possible angle. You will surely find a way for happiness.

    • Ok, I agree with Saurabh, My wife is also in the same boat, like, she was working with Amazon in India ( Imagine !!) and we thought we could come over here and experience the change in life here, of course we thought she could get a visa easily, which turned out to be a disappointment so far. So, we decided to go ahead the belief that “Everything happens for a reason”, which isnt that bad.
      I know its easier to say than do , regarding higher studies with the cost incurred and etc, but I think its worth it if you could get through a good university here.
      I am assuming your husband is working at a place where its easy to find good university around.

      • I thought I was alone in such kind of situation, didn’t want to tell the story to underestimate myself. I am on H4 too and still waiting to get something called positive. I am trying find some universities where I can utilize my time here in US, location doesn’t matter so hope I will get admission with small investment which I can afford.

        • Here is my wife’s story which may resonate with few H-4 holders here. She missed out of lotteries in both 2007 and 2008. In 2008 itself, she joined a state university for 2 years masters. These were the hard years in US economy and she didn’t get any CPT or pre-completion OPT. However, by the time she graduated in 2010, economy was already picking up and she got an OPT with a start-up. Later a top biotech company filed her H-1 in 2011.

          So, although going back to school is a longer route, but it may be worth the investment. It opens up avenues like big US companies rather than one’s dependency on shady consulting companies.

          When on H-4, you need to be strategic about your future. At times, people come to US on H-4 thinking they would file H-1 and start working in few months. Well, it doesn’t always work that ways and sometimes you have to take the longer route to reach your destination. One can either sit back and hope cap is increased next year or H-4s get the EADs (even now its not sure if all H-4s will get the EADs or only those who satisfy certain criteria), or you can take your destiny in your own hands and try to do something about it.

            Yes you’re right, we cannot simply sit at home hoping to get EAD, even if the bill is passed, that may not be for all H4’s.
            Now it’s high time to wait for this year H1. Need to ready with plan B ASAP.
            Better we should do something like Saurabh’s wife did.
            I’m still searching for good colleges and trying to clear the requirements.

  4. I don’t know if Deb is still around but she had made a list of people who were still waiting for a receipt and what their category was: eg RC/PP/VSC

    To follow on from that list I am interested in finding out how many:
    RC/PP/VSC &
    RC/PP/WAC
    are still waiting to get a receipt as of today May 8, 2013?

    The reason for asking the above questions is, as I have stated before, when you look at the categories of people still waiting to receive a receipt that were on Deb’s list, there seems to be an unusually large proportion of people who applied for PREMIUM PROCESSING and through VSC!

    I somehow have this feeling that something ‘unusual’ happened regarding many of the premium processed applications but this is just my own personal hunch based on what I have seen from the people still waiting.

    Please be kind enough to respond to this post by stating:
    1. Which category did you apply in: eg. RC/PP/VSC etc
    2. Is it a 1st time H1B application that you filed?
    3. Are you currently in the USA?
    4. If you are in the USA what status are you currently on?

    It says:

    Initial Review
    On April 24, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case…

    To my understanding that case is from today. But why the date April 24? plz help me to understand that.

  6. My employer told me i’m selected in the lottery..but even after asking for multiple times, they are not sharing the receipt number. Not sure what to do? could there be any reason? anybody else facing this issue?

      • Seems like shady business to me… If they have received a receipt number indeed, there is no need for them t0 keep this number from you. Perhaps they want to wait until the petition is approved completely… Or perhaps they are trying to evade your questioning…

      Lot of employers fear that you will change employers once you know the receipt and the petition gets approved. So they tend to hold on to the receipt number as long as possible for them.

  8. Is USCIS still generating receipts for the Cap subject petitions? Today I don’t see many for h1b…and even if it says “we received this I129 petition” for some receipts they are dated after May 1st. So are these the cap exempt petitions that uscis is working on right now? Are they done with lottery petitions? 🙁

  9. First of all, I would like to thank Saurabh and his team for providing a platform for all us, H1B 2014 aspirants, to share and receive updates on the ongoing processes. A million thanks to this website.

    Today, I have received an update from my employer that my application has been picked up in the lottery. I have been trying for this visa since the last 2 years (missed applying for UK Visa (PSW), then H1B 2013 and then rejected L1B once). No wonder I named myself ‘H1BPositive’ on this forum 🙂 Haha

    Also, I would like to answer some queries or clear some misconceptions that people have on big MNCs from India.

    * AFAIK, there is a heavy demand of resources having H1B visas in our organization for this fiscal year. There are many onsite opportunities within our projects but there are not enough resources with the right skill set. As for myself, my client is eagerly waiting for me to land in US to get the job done. Also, there are heavy budget cuts every year and there is no way that organizations are ready to waste budgets on getting unnecessary H1Bs approved. By stating this, I would like to clear that not all MNCs are body shops and there is no intention what so ever to abuse the H1B process.

    * All major MNCs (Infy, Wipro, TCS, IBM etc) apply H1Bs in bulk, for the sole reason that they need as many H1Bs to ensure that the job is done as per the project demands. I don’t see anything wrong with this. I feel sorry for the disgruntled people on this forum, who accuse us for not getting through lottery.

    I would like to wish all the people, who were not selected in the lottery, the very best in their future endeavors. I know its hard to accept the fact, but I wish you all the success ahead. Thank you.

      +1 for a very respectfully, well written post here. Thanks for giving the perspective of the other side.

      While I agree with most of what you have said, the issue of MNCs bulk applying is definitely wrong. H1bs need to be applied for as needed, specifically targeted for specialized needs. And every decent, well managed project will foresee most usual project resource demands beforehand. If more is needed then they need to remote work, be on site for temporary visit or if longer time is required then apply with the following years process.

      By bulk applying, and unnecessary demand is created for the visas. It would be like hoarding a resource even though it might be initially available in plenty. Then the USCIS panicked this year and declared the lottery, which is not merit based process.

    • I just wanted to say that experts in policy and economics have pointed out so many things wrong with what you said in terms of proper H1B use. There is a reason why H1B reform is imminent and it has everything to do with laying the gauntlet on these body shops.

  10. Hi, I have a question, got receipt from lawyer on 29th and they have not shared receipt notice date. My receipt no starts with EAC13140XXXXX. Any idea what is the receipt notice date?

      • You can sign up for case updates and as soon as you add your case number, it will say alst modified date – which if in Initial Review state will tell notice date. This is true in my case

        143 – Apr 25th
        so check yours.

  11. Still waiting for my lottery result. Is there a time-frame for the lottery result?
    Can my employer call the USCIS and learn it? I read something about 30 days after you can call…

    I’m tired of it. I just want to get the result and get it over with. Win or loose, doesn’t matter anymore. I wish I hadn’t go all this trouble, it doesn’t worth it.

  12. Just being curious….

    I’m not from IT but majority of my UG and PG friends & collegemates work in IT. Based on their inputs, though many get H1b, not everybody travels. And that too travels immediately i.e. oct of the year. There are case where the entire period H1b is unused.
    Moreover, large IT companies don’t sponsor GC. So its max 5 ~ 6 yrs. So it is not life altering, but a phase in one’s life

    So I’m not sure why lot of IT guys are being so fretted about getting H1b and how this is bringing them lot of hardships. For one, whether they get it or not, a sizeable chunk is not going to travel anytime soon. Which means H1b is not life altering thing for them in the near future…

    For AD guys already in OPT it is…

    Or am I missing something?

    • To live in shared apartments, buy in bulk and eat homecooked food, and save dollars even if being paid 60% the normal US rate – didn’t you know that?

            As long as the city code allows 4 people to live in 1 room apartment, it is fine. If the city code allows at most 2 people to live in a 1 room apartment, it is an issue irrespective of whether the person is on H-1, or American citizen or GC holder.

            Buying food from WalMart is buying in bulk and that deserves its own notable mention? Didn’t get the relation.

        But AD guys in US in OPT they are the poor souls. Their current life will be completely changed if they are not selected..

      • It does not matter what someone’s eating or where they are buying stuff from. They are ‘blocking’ opportunities for others. Everyone knows ‘some’ H1B applicants from IT industry are not qualified enough, they lied on their resume, paid USCIS fees to get in, did all the wrong things for a project that doesn’t even exist yet. Why does it hurt them so bad when it is said openly that ‘some’ of them don’t deserve it?! Truth is bitter but you got to accept it.

          • I know. I actually came to know about this malpractice just a few weeks ago and I was astonished that USCIS is letting people misuse visas like this. International students as well as workers are important part of the US economy. They have such well framed set of rules for everything else but the H1B? Hard to believe! There might be big lobbies which is not letting the reforms happen.

          The way people put that in their passionate comments doesn’t come across as ‘some’ but rather all. Either way, I think whats at fault is the system.

          You will always find cheaters, frauds,etc of varying degree in ANY field and profession. I don’t understand how that surprises people so much? You leave an open door at night, an intruder who is intent to enter will get through then.

          What needs to be rectified is the system itself. Which I think is along the way in the upcoming Immigration Bill. For which I encourage everyone to learn about it and participate appropriately such as petition signing, promotion,etc. That will eventually help make the system better for present and the future.

          • That is given. Noone is loving the lottery. I do not think anyone here disagrees that the system is at fault. Yes. But the problem is people think its okay to take advantage of the broken system as long as it benefits them under the name of ‘business strategy’. (Ref: comment in the same forum by H1Positive. Looks like he thinks its fine to use H1Bs for cheap labor.)

            Extending your metaphor, the intruder will still be found guilty and cursed by people who suffered (may they be dumb to leave the doors open). Its the lack of morals that is being judged so bitterly.
            The sexual abuse law in India was not strict enough, it let people misuse it and get away. Even there the system was at fault but that does not justify what I read in the news almost every other day. I am sorry to digress but it feels so horrible when these incidences are being discussed on international forums now and have reached newspapers and talkshows even in the US.

            But one way to also disuade crime, besides punishing the criminal is also covering the loopholes through which they slip by.

            I think you and I are both on the same essential value. Its a circle or people being immoral and the system with the loopholes. Eventually both need to be dealt with.

Coz unlike AD, you can’t leave US as ur spouse it there and if you are UG or AD guy/gal you have had great ambitions from an young age to get that level. And hence it wud be maddening to sit in home not working….

        I don’t want to get into the debate on who deserves H-1 more, but if the spouse of H-4 candidate didn’t do Masters in US, then as per your comment the spouse didn’t deserve the H-1 in the first place. Or you prefer to discriminate among H-4 saying that spouses of H-1s w/ ADs are more deserving than spouses of H-1 w/o non-AD?

            Couple of questions:
            – why leave out L-1, L-2 or other visa holders in US
            – this would mean giving preference to someone in US filing through desi consulting companies over Google India filing H-1 for their Indian employee

            What the program needs a serious overhaul instead of coming up with a priority list. This means, tighter norms around petition approval process for all companies. Most of the desi consulting companies will fail in this as they don’t have projects/clients lined-up, ask for H-1 filing money, don’t pay regular salary etc.

            They should also come-up w/ a point system for the companies. Start everyone on same level and then deduct some points when they file H-1s and not use it, don’t pay salaries etc. And then preference is given to companies w/ higher points.

            I prefer to see a priority order of companies and not candidates, but then that can easily be seen as big time discrimination against Indian companies.

            I would advice you to stay away from commenting on any side. These debates are getting murkier day by day. Everyone here is cursing each other and getting their own list of preference and reasons of why only they should be given the visa and other not. I guess no other group has been bashed more that the average IT guy from a consultancy. People might forget my comments or every other comments., but most will surely remember your comments. Also anyways our thinking or fighting will surely not have any impact on anything except that it might lead to hatred. Thats just a suggestion from my side, you are anyways free to follow whatever you feel like.

            Just curious of one thing, Since when are you in the US? You seem to be very knowledgable on the H1b matters

            Thanks for the feedback. I usually tend to stay away from such debates as I am bored w/ them now 🙂 I have seen such debates for several years now, and nothing new comes out of it. I prefer not to take sides but at times it may come out that way.

            To answer your other question, I am in US for almost 6 years now.

            6 years, that’s a loooong time. Which part of US are you in? I will be going to palo alto, california, if everything goes well and I do the my H1b.

          • I saw similar discussion after 2007 and 2008 lotteries. Over the next few years, cap remained open for several months and so everyone was happy. Last year, there was another online storm after June-11 lottery and this year its back like 2007-08. Guess, when US is in recession, people stop fighting 🙂

        I guess everyone made an informed choice. h4 made a informed choice that going to USA on h4 will mean that he or she has to sit at home and no job.

        AD guys also made a informed choice that he or she might have to come back to his or her native country if there is no job or no Visa. Moreover all the AD candidates this year, whose opt or cpt is expiring could have got a visa last year also as there was not such a big rush last year.

        So why are they cribbing now. AD guys had 2 chances in the lottery. Yes I agree it is painful but why do you think any other guy will should leave an opportunity to work I the US for some AD or h4 person

          • Btw, I just realized that NITs had some local state quota (Not sure about IITs). Universities in the US also have in-state v. out-of-state fee difference. Not saying this is how they should do it. But there must be some logic behind it.

            But I think the ultimate solution is a merit based system for a job. Education and degrees may have quotas. But once you have got your degree I believe you have come to the level playing field and then it should be based purely on your qualifications for your job and not some luck based lottery system or quotas that predetermine your entitlement to something.

      You have almost got the right picture there. While there are some H1b cases that never get actually sent to US but are on ‘reserve’ depending on client demands, a lot of them do get sent. But yes its not a life altering decision for them because if their petition is denied they will continue working/studying where they are.

      The other thing is, there has been a steady rise of Undergrad Student population applying for H1b. They may not fall in the AD category but they too have spent money on education and if got a sponsor/ job position apply for OPT/H1b. So I think we should differentiate on the parameter of those with lives already established here studying/working/researching etc. versus those who have yet to arrive here in the first place without which they continue where they are.

      But yeah a significant chance of future related worry falls more for people already here on OPT, etc. who may have to go back otherwise.

      • Guys , i belive instead of bring ppl on h1 from other countries , preference must first be given to those u are in US already,Offcourse qualified and who do justice to the positions… there are soo may of H4’s accompanying their spouse here in the US with double master degree’s and OPT students who have spent a lot of their parents saving in getting a degree here..Ihave seen soo many ppl here getting H1 who are not even aware of the rules and regulations or on what visa their spouse will be travelling..I mean common guys WTF !!!!

        • First of all, I’m totally neutral in this “who deservers the visa more” debate, I’d just like to add my comments. I’d also like to point out that I totally understand the frustration of the unlucky AD applicants (*), but…

          It’s not like AD holders are not preferred by the system. On the contrary, they are preferred over applicants falling under the regular quota: it’s the 20k AD cap exemption. And even if they miss it, they have another shot in the regular quota. I think it’s a huge advantage, and instead of pointing at the faults of the system they should be grateful that they were given the opportunity to graduate from a US university, which – as long as the H-1b visa is available (and its rules don’t change) – will always give them a bigger chance. I admit, however, that if there were no fraudulent cases, the work visa was a bit more regulated, and the visa cap was revised in the light of current demand we shouldn’t talk about chances, because everybody would get the visa and genuine employers were also more willing to sponsor a foreign worker for they wouldn’t need to spend their money on gambling (and wait long months until the employee can start). Unfortunately, however, this is not the case and you just have to accept it.

          It also occurs to me that foreigners tend to forget that:

          a.) Nobody forced them to take a huge loan and then graduate from a US university. Judging the system because it’s more difficult to pay back the debt from a salary earned in a less developed country (in case one didn’t get the H-1b and had to go home) is not fair. It was an investment which, just like stock options or mortgage, may or may not work out. I also understand that people studying in the US for years already established their life here – and the unlucky H-1b applicants may have to give it up -, but correct me if I’m wrong: this was the deal anyway when they applied for the student visa.

          b.) Having a US degree does not automatically grant employment.

          c.) The rules of the H-1b game were (or should have been) known to them when they decided to invest time, money and effort into their US education (in the hope of US employment). People graduating now probably started their US studies 4-6 or less years ago. The H-1b regulations didn’t change for a longer time than that, so they should have include this factor (the possibility of not getting the H-1b) in their calculations.

          d.) The H-1b is also temporary. Now they say their life depends on it but what are they going to say when their H-1b is about to expire and no extension or GC is on the horizon? Blame the system / other applicants again?

          Just my 2 cents.

    There have been some cases where the AD RP was processed really fast after Lottery selection and some people started to get their Approvals. This week I have noticed couple of RQ RP cases mention the same. I am wondering if these cases were turned to PP later or still were processed so quickly under the RP?

    Also Hi Saurabh, is there a place on this forum where Post Lottery selection people discuss? I am not aware, if there is it would be great to know so that the RFE,post selection queries are not mixed up in the pre-selection queries. I think some people are confused with the pre-selection, post selection and then post approval flow of procedure. Thank you!

    • @PKaiser: I am AD\RP\VSC. I received my notice on 19th, My # 13134xxxxx. I got my H1B approved on 29th of April. They processed mine under regular processing only. It was just luck. I think, they wanted to approve few of the petitions and offload few applications, that is why they initially processed few regular applications.

  14. AD/RP…still waiting for receipt. For me, H-1 B is life. I am a PhD degree holder. Does any one has legit information on what is going with reciept generation process ? Is the game over ??

          • I am already working for my employer and I will know the second he hears anything, but after a long long waiting, not a single word!
            I check every morning and the fees is not cleared as usual. I spent huge amount of money and time for a US degree, I went through all the job searching ,interviewing with lots of pressures and finally got ettled at this job. Now because of this lottery thing, all the efforts will gone. My employer is not giving me any new project to do cause he is afraid I might not able to follow through. 12 more days to wait, if the 20th deadline is true, Sweet!

            By the way were you able to check with your International Advisor about Sevis update?

            I hope May20th date should be a legit date, it was given by CIS officer.

            And for worst case scenario always keep a plan B. I kept one just in case…

          • My OPT expires June 30. I emailed international center earlier, they said they not able to help with that, that I have to hear from my employer. You know what, I am gonna give them a call, right now. Thanks Sunny!

          • I called in and I was told that they are not able to check it for me at this point and I am welcome to send them a email with sevis number in couple weeks and check update but the ucsis not updating it until the h1b application is approved. She also nicely told me that only 50% of AD got selected. Things just got better and better!

          • There are also some AD/RP folks on h1b wiki on facebook who have reported getting their receipts in the past couple of days. Keep trusting in God.

          and in top of that CIS just gave total number of applications (124,000). if they would have given how many AD they received we should have been able to see our chances in making to AD quota…

          • hmm, I assumed if your OPT is expiring before Oct 2013 your Sevis will be updated if a application is picked in Lottery.
            For me my International Advisor was not able to check because of some BS policy. I mean they should be what difference does it make to check our Sevis.

            Sorry didn’t get your last statement 50% of AD Selected? does it mean that AD applications were rejected ?

  15. My husband is currently on L1 visa and am on L2 visa. We are currently in US.

    One of the american campany (not the company in which he is currently working) has sponsored H1 for my husband and his H1 is through in lottery.
    Current status of H1 is initial review. His H1 category is RQ/RP

    Here are my questions

    1.) Generally how long will it take for H1 to be approved?

    2.) We don’t have plans to traval to India this year. But My husband has to quit from his current company inorder to join the America company (which sponsored H1).
    Is it possible to quit his current company without coming to India?
    Once H1 visa is approved, can he start working for American company with H1 without being stamped in India

      Depends on premium / regular, former 15 days latter 3 months. H1 approved person can start working from 1st Oct of the current year.

      Ofcourse, no need to go back to India, the new employer would give you a I94 on the day of joining.

          • Yes, they should accept his resignation in US. He may have to go as per his company notice period,etc.
            Lot of people move from L1(Indian company) to H1(US company) without going to India.
            Your husband can start working on H1b starting 1stOct. Whenever in future you go to India, you have to get your H1b stamped in US embassy before re-entry to US.

          • It depends on what you signed and gave while leaving India. Some employers don’t agree (even though there is no law to stop an employee) to give proper letters if you don’t agree to their terms. Talk with the HR and see.

    Just curious about one thing…. If you guys applying for H1B from India(i.e. in RQ) the you should have to pay for your H1B fees or your Company pays for it?
    I mean if you are working in TCS, WIPRO, INFY, etc, then they pays H1B fees or its You who pays h1b fees?
    and if you guys are paying then how much?

      • There are companies that might want the applicant to pay for the lawyer fees!, is only required from the company to pay the fees for USCIS, however lawyer fees could be paid by the employee or employee. That is something you will talk to your employer.

        Generally the employer will also take care of that, but not always.

      • This lottery has made me realize that When u think that things are in your control ..the case might be just opposite and bitter reality of Life. All we are thinking of lotery and calculating that there might be a rejection percentage so that even if we are not selected in lottery we might come in a wait List.

        Who knows I m waiting for lottery today and might be there is some mistake from the side of Employer or Attorney and my petition gets rejected coz of false documentation for which I cant do anything.

        Who knows Even if I am selected on lottery and gets Hit by something or an accident happens tommorow and I am not able to go through later. Anything can happen and so now I have started to believe that whatever happens must be for some specific cause .

        Whatever happens has to happen and will be for our good. So lets keep ourself Encouraged for whatever be the outcome of this lottery.

          • really depressed.. Have been sitting idle for more than 2 years on H4… when i applied for H1 i was really thrilled.. Thought that i will have a new future… But all my efforts are gone with the wind.. Still am not able to believe that its over… A ray of hope somewhere in the corner of my heart. Every morning i get up and expect a positive call from my employer but things are not gonna change for another 1 year for me…. Thought if i write it down it will be a great relief for me… Sure it is.. feeling much more relieved….

          I am telling all this because, few years back i met with a big accident it was almost close to death, so many fractures, broken bones, knees and all that pain i had to go thru.. Now if i look back i have recovered, got placed, got my promotions, got married and now a one year kid. So if you are destined to live, you will. The same applies here, if you destined to end up in US, you will make it. If otherwise, look forward for better things in life waiting for you.

    • I think you need to search for information about H1B visas before you ask, what you ask is the main details about h1b and so easy to find.

      any way Congrats for your reciept, wait for approval then go with your wife for visa stamping after 1st July 2013 H1B for you H4 for her, then cant go to US before 21 Sept 2013, cant start working for your employer before 1st Oct. 2013.

      She cant work on H4 at all, she can try to find a H1B job as you did so she can work for her emplyer.

      Ans: Didn’t you apply for the dependent H4 visa when you filled for your H1B. I guess there is a option for that, check with your employer.
      If H4 dependent visa was not already applied along with H1B petition then you can always apply once your petition is approved and both of you can go for stamping at same time

      2. Is it possible for her work in US?
      H4 dependent visa doesn’t have a work permit in US, only work she can do here is which doesn’t have a monitory benefit like NGO and stuff.
      If she wants to work there are few options:
      Get H1B visa sponsored by her employer but that would be next year
      get L1 visa sponsored by her employer.
      Go a college in here, get a masters.

          1. Yes, that’s what most people do. Attend the interview together but submit separate fees, separate DS-160 forms
          2. Just the visa fees need to be paid which is around 8-10K INR (latest amount can be looked at the US consulate in India’s website)
          3. She cannot work on tourist/visitor visa either. In addition, she needs to show non-immigrant intent for B-1/2 visa and cannot stay for more than 6 months in rolling 365 day period
          4. H-4. All family members (spouse and kids) need to have H-4 visa

        • Still this is very low % of selection. I am planning for release from this account. In future i will never join in any US account.. First it tool 2 years to justify yourself to get H1b initiated and after that this situation . I feel today if i joined any other country account might have there in client site with no tension.

            @TCS_indian… Yes.. got the mail for pending with USCIS from my GL (mail chain from RMG)…. but still only one list is out for our ISU. For some other ISUs there has been another list yesterday.

          • TCS is not the only company doing this.Accenture has Clearly Stated that they will only communicate after mid of may or probabily by End of May. The Difference is they have clearly given this message and not going List by List .

          • Hi TCSers…. I talked to Immigration manager about H1B status and
            He told me that they have received status for 50% cases and have to receive status for remaining 50% cases yet.

            I assume, these 50% are success cases as they did not get any return packages and It will get more 10-15% success cases out of remaining 50% as it is end of H1B processing. So total selection ration in TCS would be around 65% .

            I heard that TCS has filed more than 9000 applications (not sure, but I heard this from SSG team ) , so I guess approx 6000 petition will be selected out of 9000 application from the TCS .

          You guys must be really smart, when you just lack the basic skills of communication, professionalism.
          People like you just hamper the chances of other deserving candidates who have been to good schools and are actually SKILLED workers.
          I will tell you why I deserve it more than you.
          1.) Went to one of the top schools in the country, did my bachelors and masters
          2.) Work for the big 4
          3.) Finished in the top 10% of my graduating class and published research papers

          Let me know when you do all this at 23.
          and I have worked on a TCS project, that’s why I know a lot about you guys and the company.

            I truly appreciate your achievements at a relatively young age. You must(ought to) be a deserving candidate! And i do respect your opinion.Also am DAMN SURE that there are MANY (may be a few, but surely not just you) like you out there hoping to get through this phase successfully. You can be sure of how deserving you are, and NEVER can be sure of others’ caliber and whether they deserve or not!! In the first place you have been lucky (and capable) enough to do both your bachelor’s and masters here. There are people who are almost if not as capable as you are in terms of intelligence but not able to their masters because of their family/financial situation and hence forced to join the BIG 4 of INDIA. They do wait patiently for their employer to apply their H1 or L1 and do work hard in their own way (It still may not be equivalent to your efforts put together ) to apply. And last but not the least it is not you who decide whether they are “DESERVING” or not!, I sincerely hope and pray that you get through this phase successfully!

    My application reached USCIS – VSC on 1st April but nothing yet!! RQ – RP

  27. I want to understand how USCIS is processes H1 B applications as I see receipts generated before 23 April are still at “Initial review” phase but few after 23 April have been approved!. For example I got my receipt on 22 April and it has EAC131395XXXX still it is in initial review stage, it is RP/RQ. While I see people with receipt EAC131435XXXX have got their approval notice also even they are RQ/RP.
    Are they doing it randomly or they have some algorithm for this also?

      • I think that for AD/RP..
        USCIS processes :

        1. AD or RQ /PP first
        2. AD/RP Second
        3. RQ/RP last…

        all these based on receipt generated day like 132/133/— 151

    • If you read the note in USCIS website it will explain. USCIS takes this time to verify the merit of your case, background check, etc. No 2 cases are alike. H1b is for speciality worker that companies can’t find enough ppl in US. So if it is for a highly specialised area then USCIS may readily approve. For others it might need time to figure yes its specialised app and yes h1b has to be issued.
      Again there was a internal study done by uscis in chennai I believe on fraud detention. Try to google that doc. There so many things uscis has to check to ensure there are no frauds.
      So the example you gave might have been for an AD guy staying in US. So USCIS was able to determine pretty fast. Yours might not be such a case so takes time

  30. I received an RFE today. I got to know through the online status update. I hope my lawyer will get the detailed RFE within next few days.
    Could anyone please throw some light on what different reasons are there for an RFE?
    Also what are the chances of getting approval even after receiving an RFE?

    • @RFE: it could be related to your client letter or if you are AD then USCIS wants to understand how your AD is suitable for your job at hand. It is also possible that some documentation is missing and it needs that.

      There can be several reasons for RFE varying from easy ones to the most complex ones. Its better to wait for your actual RFE reason than to start worrying about all the possible reasons.

  31. How weird, and crazy that some of us are still waiting to hear whether we have been selected in the lottery and others (even those with premium processing alications) are already getting their H1Bs approved.

    It’s baffling, unusual and quite frustrating.

  32. Can anybody speculate on a rejection rate for this year? Is it likely to be higher or lower than previous years?

    The average rejection rate has been around 15%. At this point I’m trying to bank on being waitlisted.

    • My guess is around 20 % based on the fact that USCIS created a mini panic and forced lawyers to file last minute petitions. Lots of chance for incorrect filling. Last year, the rejection rate was around 45 %

      Again this number is a speculation. Someone reported that there is a 60% rejection observed this year. I cannot provide the validity of this statement but my assumption is 60% for Indian MNCs (not selected + selected and then rejected). This number seems to be exaggerated as people are still receiveing notices.

    4/24/2013 – 05/06/2013 Initial Review
    05/07/2013 – APPROVED!
    RQ/RP/EAC
    I was on H4 for 2 years. Now I can work…It will be really great to explore new endeavors…

      Becoz I was thinking after accepting application through lottery they conduct interview and after interview they decide for RFE , approval or rejection… isn’t it?

        Here is the quick process for you:
        For everyone who made through the cap: Petition Accepted -> Petition Processed -> RFE or no RFE -> Approval/Denial

        After this, for everyone outside US or w/ petition w/ consular processing: Schedule Interview -> Appear for Interview -> 221g or no 221g -> Visa approval/denial

        • At stage “221g or no 221g -> Visa approval/denial”, if visa is denied, then do they take candidates from lottery waitlist list for filling up the slot? And how much time does it take to reach “Visa approval/denial” stage?

            No, they don’t. For some petitions all this process can take several months. Some 221gs remain pending for more than 1 year. They will not keep petitions in wait-list or limbo for that long.

            I am not well aware of J-1 rules. Here is what I wrote to another post on this topic “I don’t know about J-1 requirements, but they at times carry a 2 year (again not sure about term) return to home country after the internship. Although there is a waiver available for the same. So you will have to do that research and figure out if applying J-1 closes the door for H-1 in near future or not.”

    • Hi Congratulations! One question, after receiving the Notice, did you or your employer by any chance convert the original application into PP? If yes then what date did you receive the Notice and receipt number, and when did you convert the application to PP?

      If not then no problem and infact a hearty congratulations! Amongst the rare case of a RQ/RP being processed speedily.

      I have been seeing some AD/RQ cases being processed really fast like in 2 weeks time with Approval (small number mind you). But just wondering if USCIS is seemingly going through processing really quickly this year. Any thoughts?

    • when I called uscis they won’t respond and asked me to ask my employer to call and my employer wont respond at all.

      • Dont rely on the Customer Service. Even on 1st May they told me I am not in the DB . I got my reciept yesterday and it says issued date 15th April. So these are all false alarms. Every OPT candidate in my company got his H1B lottery slowly one by one. So just dont PANIC and create panic to others. Also my SEVIS didnt update . Mine is California Processing Center.
        THERE is no fixed order they are doing any thing. Just wait patiently . If there is anything you can do is think of alternatives which you will never be able to do if you PANIC.

      • No I asked abt it but they said cheque is not cashed. Even i inquired abt waiting list, the person told me those info will not be with them.

        • @K: my understanding USCIS will not tell about cheque cashing. Cheque cashed or not will be known only to ur employer/attorney. I know this because my attorney had to request the bank for the cheque copies to see if they were cashed or not!!! All USCIS will tell [if it is employer] is the status of the employee’s application
