Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

    Mine was AD/RP/CSC. Employer was outside the country. Today early morning, got an email ( after repeated followup) with my receipt #. My OPT expires May 31st- so I consider myself lucky. Thanks for all the help/update- this forun has been pretty helpful.

  3. Is he mail received by both attorney and employer or it can be received by either of the two?
    If both of them get it, is it in some particular order.

    My HR is on leave for entire month of May and the attorney is not much responsive. Hence the question.

    I applied for H1B in RC/RP/California. Out of 42 people 31 got receipt. But still i did not receive any updates. Please let me know how to long to wait for getting receipt ???

    • No update on my status. Still it is ready for printing..Not sure what the IM guys are doing by sitting on receipt numbers..will it change the situation if they keep us waiting ?

  6. Ok, now that we are at the fag end of this journey, here’s my story.

    Background:

    Senior Consultant in a Big 4 firm, based out of Chicago, earning a decent 6-figure salary. MBA from top-20 US b-school on full scholarship. 6 years of solid pre-MBA experience in India at MNC bank and MNC consulting firm. Popular writer on technology with 300 published articles, some of them referenced in trade journals and academic dissertations.

    Result of H1B lottery:

    Filed under Premium Processing, so pretty sure that I didn’t make it. Attorneys for employer mistakenly filed under Regular Quota, and I didn’t realize it until it was too late.

    Current status:

    On F-1 OPT which expires at the end of this month.

    Actions taken:

    Parents were visiting. Had to cut their trip short and rescheduled return flight. Employer has assured relocation to another country. Australia, Canada and the UK on the radar. Searching for buyers for my car, a 97 Corolla.

    Questions for knowledgeable responders:

    1. Can I relocate to another country directly from the US, without having to visit India for visa stamping?
    2. Of the three locations I mentioned earlier, which one looks better, and why?
    3. I believe that at each of these locations, my wife will be able to work, unlike on a H4. Comments?

    • Oh man could things get any unfortunate? On AD quota you’d gotten two shots at the lottery. Someone’s head there needs to roll..
      On the bright side though, your resume might benefit from the international work experience. On that front, UK is the best choice. Canadian and Australian jobs don’t carry the same weight as American or European assignments. Particularly if you are returning to the US at some point. Also think of all the european sight seeing 🙂
      Unless you can get the visa stamped at a embassy/remote consulate, you will have to return to India before the relocation. This might be an unintended family reunion 🙂

      • I agree with your assessment of UK work experience over Australian or Canadian work experience. However, I’m concerned about high UK taxes. Considering the long run, maybe UK would be better. At the same time, I may grow to love Australia if I move there, and then decide not to return to the US. I will see what my firm offers by way of salary and relocation package.

        97 Corolla suits me just fine :)…nice pickup, gives me more than 30 mpg.

        • True on the ridiculous European taxes. Australia does have a lot to offer and if you are open to settling elsewhere other than the US, then AUS is a good bet. So cool that you have these amazing options. Am sure you worked hard to get where you are. Good luck!

          • Yeah, Australia seems a nice place to live in and raise a family. I was quite amazed at how expensive Australia is – Sydney and Melbourne are considered more expensive than New York!! My firm has promised salary adjustment – let’s see what that amounts to 🙂

            UK taxes are a killer – I think they work out to something around 36%, while Australia would be around 28%.

            This has been an extremely difficult experience. I canceled a contract to buy a condo on which we were thinking of moving in on 20 May, losing $500 on the inspection fee, cut short my parents’ 5-month trip to 1 month, again incurring expenses, and many other problems.

            Hopefully, this works out well in the long run!

            Maybe some of us are meant to be where we are (or go somewhere else) to build a happier life 🙂

      I understand, as how difficult it would be to leave US at this moment.

      But i feel, u can wait till u get your package back.

      A small suggestion, why don’t you ask your employer to apply for L1 visa (please excuse me if i am wrong, i don’t have much idea on H1 or L1 visa). But i thought this could help you.

      • L1 can be applied for applicant who has worked for at least 1 yr outside the US for the same employer. Doesn’t apply to me.

        I don’t think there’s any legal way I can stay and work in the US, and no, I’m not interested in going the CPT route. Sounds a bit dodgy to me.

        • Before leaving US try for any opportunities in non-profit organizations like universities because they can sponsor for H1 during any time of year irrespective of quota.

      If your work is impactful enough, you might qualify for an O-1 visa (and relatedly, the EB-1 green card). Unlike H1-B those are unlimited.

    • It is unfortunate to hear your case but you sound confident which will rocket you to heights. I did my PhD from Canada, based on that experience, It is not a bad idea to work in Toronto or Vancouver, which are on par with US standards and much beautiful cities. I’m sure you will have great career out there for your credentials. Only down side will be to counter bit cold winters, which will not matter over the time.

      Alternatively, since you have professional degree from USA & over whelming articles in reputed journals, I think you should give a shot for O1 visa in USA (will get the result in 45 days), I think you have a good chance in that category. Best

  7. I see only people who are waiting are from the IT giants the regular one small employers are almost done getting there recipt numbers…looks a like the game is completely over for the h4..s ….I still wish for a miracle to happen….:)… As of now sad 🙁

  9. My H1b has been filed under Regular quota from Infy. Still waiting for updates but have been following this forum. I have a question if someone can guide. What is RQ/ PP/ CSC or RQ/RP or AD/RP/CSC. What do these shortnames mean? Which category do I fall in?

      You should be falling under RQ/RP/CSC. Im also from infy and was filed with the same details. RQ – Regular Quota, RP – Regular Processing, CSC – California Service Center.. Still waiting for the update, there is no update yet for any infy guys as far as i know.. Lets hope for the best…

    • AD – Advanced Degree a.k.a Masters Quota
      RQ – Regular Quota – non masters

      RP – Regular Processing
      PP – Premium Processing

      While AD and RQ are related to the quota one applies for, RP/PP applies to the processing type. Typically, PP will be processed within 15 working days upon receipt.

      So both AD and RQ can apply under any processing types. Hope this helps.

        VSC – Vermont Service Center – Receipt number starting with EAC.

        Typically, the service centers are based on your employer’s location.

    Can you please advise on my below query?
    I have received receipt number for my H1B petition and my wife’s H4.
    I am RQ/RQ.
    If I have to convert the application from Regular to premium processing, do I need to covert both only mine. If I convert only my application to premium, will H4 also get approved upon approval of my H1B?

    • From Premium Processing FAQs from USCIS website. Read the last paragraph.

      Are there any additional benefits to the program?

      Yes. USCIS has also established a special phone number and e-mail address for each of the Service Centers. These special communication channels will be available only to Premium Processing Service customers.

      Additionally, USCIS collects your phone number, fax number and e-mail address on the Form I-907 so that we can send you (the petitioner or attorney or representative) an automatic e-mail notifying you of the receipt of your Form I-907. If the underlying form for which you requested Premium Processing Service is approved, we will send an automatic e-mail notifying you of the approval. It is important that you provide this information so that USCIS may correspond with you in the most appropriate manner.

      In addition and at no additional cost, USCIS will strive to provide faster processing of Form I-539 applications filed by dependents of the principal beneficiary of a petition for which Premium Processing Service has been requested if the Form I-539 is filed at the same time. USCIS provides this service as a courtesy. Consequently, it cannot guarantee faster processing of the Form I-539.

  11. Guys for people in RP who thier cases is approved can you mention your notice date & approval date? To find how long it,may take to know the decision.

    For who still waiting to recive reciept I know it is so hard for you specialy this days as hope goes,with each day. I hope you receive your reciept soon and if you unfortunately didnt, be faithful that there is some thing else is better for you out of US till you get your visa next year.

    If you think it is easy for me to say that as i received my reciept, I would like to say that I have been waiting for my visa for almost 2 years now and missed last year qouta by ONLY 1 day. So I know exactly the feelings you may have if you must wait for the next year or after!!! And I belived that God always do the best for me and after waiting 2 years i found that really it was for the best to wait as some great thngs happened to me during the past 2 years, that it may never happened if i am in the US that tims.

    So be super positive what ever happens and if you dont believe in God, believe in your self and only your self not US not H1B not anything else. Believe that you can make out the best of any thing and any situation even if it is the HILL it self. F*** any thing because you are better than it WHAT EVER IT IS.

You will find out how much pain and depression real perople get throughout thier lifes to achive what they want. After whatching this movies i promise you will feel like the H1B and US is nothing and you are much more powerful than that.

      This movies is real stories for real living persons. Not just a motivitional story like other movies.

    • I was not selected on the lottery back in 2007. Tried it again the year after, that time the application did get selected but because of the company it got rejected later. I gave up trying it for a few years as I found another great job. I tried it last year and missed the quota just like you, by exactly 1 day. I was quite frustrated when I learned that there was going to be a lottery this year as well. Fortunately, my application got selected and now I’m waiting for the approval (this time with a genuine American company, and a not a filthy outsourcing, underpaying body shopping consultancy firm, so I’m hoping for the best).

      • Looks to be regular processing. The word email v mail is how you differentiate between PP and regular processing.

Only the receipt intimation is email for pp. + there were cases in this and other forum where even receipt intimation itself was mail for pp. + if USCIS has approved within 15 days then it has to be surely pp only. For regular they even haven’t finished informing about receipt

            If the receipt notification is mail for PP, then there is an issue w/ USCIS processing. Sending through mail delays the notification to employer/attorney. By rule, they are supposed to send the receipt number through email and can then continue to send paper receipt notice.

  14. Does anyone know the potential rejection rate this year? What are the chances of an application being on waitlist? And if an application is on waitlist, when will the applicant be notified? Has anyone received a waitlist notification? I am RQ/PP/CSC, have very little hope left

    • I think the rejection rate last year was about 17%. I read somewhere about there being a rejection rate of about 60% for the four major IT giants from india. So we will see. All the best.

    • How did you receive H4 reciept for your wife before yours get approves?

      As i know that for new h1b out side US the h1b must be accepted before applying for h4 for your wife?

      Most likely you have also made through the cap. Your receipt number may be on its way. You can convert yours to premium only after you know your own receipt number. Also, wife’s petition will be upgraded to PP automatically only if both applications were filed together.

    I have been a silent reader in these forums and I just got my receipt a couple of days back. I called my lawyer to see if there’s any hope left at all, and she told me that my check was just cashed. I’m a Master’s student here on the East Coast and I will be on F-1 OPT until October. (AD/RP/VSC)

    Accepted- 8th April
    Processed Receipt- 29th April
    Received Notice- 2nd May

  20. My Employer called me last Wednesday 1-May-2013, that my petition cheq is en cashed, but till now did not receive the receipt number. In case my center is Vermont, and employer is in New Jersey, how much possible long it can take to receive a receipt.

    Is there any other cases, in which petition cheq is en cashed, and has not received the receipts?

    My case specs are Regular Processing, Regular Quota, Possibly Center is Vermont

  21. @ Saurabh can you tell me how about the pp fees . I understand that the employer bears all expenses for h1 filing petition but how about upgrading to pp. legally who is liable to pay the pp charges . I would appreciate if anyone can answer to this one .

    • saurabh can confirm. but i believe even the applicant can pay for pp fees legally. other fees should be taken care by the employer.

    what about immigration bill? if the h1b cap is increased throu this bill now, will it be applicable this year? hope this will happen and lottery system wud be scrapped from this yearonwards

    • Not this year, it will be applicable from next year (H1B filling starting April 1st 2014) given the the bill passes.

  28. USCIS started returning the packages…My employer got 4 packages returned….even in that mine was not there…i did not got my receipt nor the returned package….He said they are still processing the selected ones……

      • yes its true…i confirmed with my employer twice….I can understand others feelings and will not be so cheap to spam and hurt…..I am also undergoing the same situation…I did not get my receipt nor the returned package…this wait is killing me….I cnat explain how this job is important to me and my family…

          I wasnt doubting you but just wanted to double confirm… I understand a lot is riding on H1b for almost every applicant.. But i am not sure if i am happy or sad by this news.. Even i have been waiting and now i just want to end this wait some how… This wait has made my life come to a stand still..

      Maybe a long shot, but is it possible for your employer to upload a scan copy of the rejection letter that accompanies the package. He can mask the personal details, I am just interested in the text used by USCIS.

  29. Omg… this wait and uncertainty is killing me…
    I have worked here in NY for almost a year now. In one month I may have to go home to Europe with no job, simply because I was unlucky in a lottery 🙁

    I wich they would increase the cap. What harm will that do?

    First I was angry that there may be people here applying for H-1b without really being in the states, and without a project, who will get the visa, and not me. But I figure this anger is useless and who am I to talk about what is fair. Life sometimes is not fair. I have had 7 great years here in America and perhaps it is time for me to go home and take care of my parents.

    I do not believe in any God, but I like the beliefs of the old Buddha: sufferings come from our own desires. Therefore, it is important as well in this age controlling our desires. I truly wish that I could stay here in the U.S longer, making a successful career. But if I have to go home, that is ok. Things will work out. Life is about attitude. I still have my friends and family. We will see where faith takes me.

    Therefore, I truly wish that everybody who receive the H1-b all the best. Make sure that you don’t let small matters affect whether to utilize the visa in full. Stay in your position and work hard! Whenever in doubt, think of the people who did not receive the visa. Make the best of it!

    • 7 years, I assume you did your bachelors (4 years) followed by masters (2 years) and OPT (1 year). Since you have a masters degree why don’t you ask your employer to file an EB-2 Green Card for you. Since, you are from Europe your date will be current.

    • You story is same as mine. Same 7 years, sad thing is I have done PhD and my dissertation has made significant contribution to saving human life. My PhD is on health issue. They rolled a dice and said you have to leave this country. I know that many people who don’t deserve H-1 B are picked up. Never knows your destiny.

    Got the receipt yesterday. I sent it on 2nd Apr. RQ/RP/Vermont. Status is H4. In the receipt it says received date is 8th Apr. Notice date 26th Apr. Happy that I got it.. But I am really worried that people are still waiting for their results..

  31. My case number changed to Approved today. Wow that was quick. Didn’t pay for PP, but still got approval within 3 weeks. So happy right now.

    AD/RP/VSC – EAC13136XXXXX

    Package delivered on April 1
    Package accepted on April 8
    Notification sent on April 15
    Petition approval on May 3

      • Ever since I got the receipt it was showing Initial Review (I received my snail-mailed copy around April 22).

        I created an account and signed up for USCIS email case updates using the receipt number. Today I received the first and only email notifying me of the change from “Initial Review” directly to “Post Decision Activity” with the following description:

        On May 3, 2013, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

  32. I have a req here to the people who know that their cheks are not encashed but have received the receipt number. Can you guys please call on 18003755283 OPt 1,1,1,1,2,1 you would be asked the date of filing. and you would be redirected to L2. Please call and check weather your name is in their DB or not. That can help many of us to whom they are saying that the name does not appear in the DB. they are talkking to the direct applicant also and sharing the status

    Also My OPT expires in dec 14th 2013, and i live in Pittsburgh, Pa. Any Universities near by that gives that gives CPT from day 1. Pleas do share this info. looking at Plan B

  34. I havent received my receipt and my HR/attorney are unresponsive. HR always says “i dono” and attroney never picks the phone or returns emails. Only when they need any detail from me will be respond or talk to me.

    So even if I’m selected I wont know :/

    My question is, when would they require my input again, if I had been selected? like for filling any forms or attending interview etc.. Im RQ/RP. How long woud it take? Till Oct or while they need my input soon?

  35. My company filed for 28 cap-subject petitions out of which 23 have been selected and 5 are outstanding (including mine). My HR contact called USCIS and the representative said that they are still not done with data entry. My company has not received any petitions back either (it is located in the Mid-West if you are wondering about how long it takes to deliver mail).

    My case is RQ/RP/CSC

    tl;dr There is still a small chance for people who are waiting and petitions haven’t been sent back by USCIS yet.

    • You still can wait for 1 -2 more weeks. In 2008, it took till the end of May to send out the receipt or to encash the check.

  36. After a seemingly endless wait, I finally got my receipt no from my attorney.
    I am RQ/RP/VSC.
    The attorney got it on 26th April, dont know what took him so long to update his system.

    This forum has given me great support throughout my wait period.
    Would like to thank you all for that.

      You can start working on the basis of GC once your EAD has been issued. This can take few weeks (EB-1) to several years (EB-2 India/China) to > decade (EB-3 India).

        • If your highest degree is Bachelors and you want to apply for EB-2 then you need 5 years of exp. Further the exp has to be progressive i.e. from another employer or from a different job from the current employer.

  38. I dont understand why USCIS is taking this much time to tell who are all not selected in the lottery.Its really very painful to wait this long & get no result.

    I really dont undestand their intention & logic in making 40,000 people wait unneccesarily ..They can atleast make a statement that this the deadline to wait..

    • They are not mad, but you need to show some patience, which is the key here.

      The fact is not all the 85000 application they have selected in the lottery will be approved. There might be few which are withdrawn too.

      So what they do is say 10000 of those application are not approved, than they will once again do a lottery from that left out 40000 application.

      Hope it make sense.

      • Correct. Just because you got selected in the lottery it does not mean that your Visa will be approved. Besides, it seems to me that many people were sending multple application. I guess it take some time figuring that out as well.

        It make sense that it is taking time. The cap needs to be filled and all those application must be valid and approved before they can send out rejection notices. I’ve seen some comments here that people have been receiving packages back. However, don’t expect that to happen very soon.

    • Are the USCIS People mad,
      Wait until you have to deal w/ US consulates and then USCIS will seem like super efficient. They have no tracking and will put applications in administrative processing and just sit on it for months/years.

      The whole immigration process, right from petition filing to GC approval is a test of patience.

    I am RQ/PP/CSC. I am not sure but i feel CSC is still processing PP receipts. the last PP # generated is WAC1315050099. Can someone please confirm is this means this a new PP receipt and not an upgrade of a regular petition?
