USCIS Case statuses for H1B Visa – Flow chart / Workflow – Screenshots

Date Updated : May 2015 ; Note : The below article was written in 2014 and the steps described correspond to the same year. Some of the steps are omitted and changed now. Please check USCIS site for latest case status details.

Some of our readers, who were selected in H1B Visa 2015, started to receive the USCIS case receipts and checking their case status online… They have asked questions like

  • What is the entire workflow of the H1B case status on USCIS website?
  • Can we have a flow chart with the H1B case status for our understanding?
  • What are the various USCIS case status by name for H1B visa petitions
  • What happens at each step of USCIS Case status.

This article will focus on the various USCIS case status for H1B petition and give a small flow chart for the same.

What are the various USCIS Case status for H1B Visa ?  Flow chart / Workflow ?

I am NOT trying to draw a very complicated flow chart here with lot of decision boxes and all. The below workflow or flow chart is indicative and gives you a high level view of various statuses of H1B Visa case and the flow changes.  We will look into each of the statuses below in detail with a  screenshot.  For now

  • If everything goes well and there are no questions from USCIS the flow would be like

Acceptance –>Initial Review –> Decision –> Post Decision Activity

  • If USCIS require some information from your petitioner, there will be an RFE issued and it will have couple more steps

Acceptance –>Initial Review –> Request for Evidence( RFE) –>   Request for Evidence Review –>Decision –> Post Decision Activity

Let’s look at various statuses and how they would look on USCIS website with brief description.

USCIS Case Acceptance Status for H1B

Your case would start with acceptance status on USCIS website. This is when your H1B Petitions is checked for basic things like fees, signatures, etc. and ensure that the application is properly filed. If, it is not filed properly, USCIS will reject and return the petition.  It looks like below. USCIS expects that this step would be over in couple of days, but there is no SLA for this. So, if you see your petition in this status for a while, do NOT panic. Sometimes the system update would also take time, with many petitions.  Usually, the premium processing petitions would observe this status because an email notice is sent with the receipt number. If regular processing petition, you are unlikely to see this status as it should be complete by the time you receive your case number in postal mail.  In either case, do NOT panic, just give it some time and call USCIS, if the status is stuck here for more than 30 days.

When your case status shows as initial review, USCIS is doing the background checks, reviewing your credentials, validating information, etc.  This varies by case and the time lines can be painful for regular processing petitions.  It can vary from few weeks to even six months for regular processing petitions.  It can be very painful to keep waiting at times, but you need to wait as there is NO SLA, if you are doing regular processing. You may consider upgrading the petition to premium processing, if the status does not change for few months.  The status on USCIS website looks like below.

USCIS Case Decision Status for H1B

Once the petition has been reviewed fully and the USCIS officer adjudicates the petition with a formal decision, your case moves to Decision status.  It is the formal approval/ denial status. You can be informed via email/ physical mail regarding the decision depending on the type of filing regular or premium.  If USCIS does not require additional information for processing, your petition moves from Initial review to Decision status. If they require more info, a Request for Evident (RFE) is issued and USCIS status reflects the same.  Also, If you petition is withdrawed by your employer, your case will be in Decision status.   It looks like below for various case statuses

USCIS Case Post Decision Activity for H1B

After the decision status, your case moves to Post decision activity. During this status, the physical approval letter for the case is sent to the petitioner, USCIS will update the consular posts, Depart of state and other Govt. agencies regarding the applications. Also, if someone files a motion to re-open or revoke, etc. this status will include the same.  It looks like below.

USCIS Case Request for Evidence ( RFE ) Status for H1B

After USCIS starts to review your application and they realize that some information is missing or they need clarifications like client letters, education certificates, etc., they will issue a Request for Evidence, everyone calls simply RFE, and your case status will be updated on USCIS website with the same.  Your case would move from Initial review to RFE. During this status, your employer/immigration attorney would get the reason for RFE and they will need to respond.  USCIS will not process your petition until they hear back from your employer/attorney.  It looks like below.

USCIS Case Request for Evidence Response Review Status for H1B

Your case status moves from Request  for Evidence to Request for Evidence Response review after your attorney/ employer responds to the RFE issued by USCIS.   Depending on the type of RFE, USCIS can take time and your case can stay here for some time, until the processing is complete. After this status, your case would move to decision status. It looks like below.

    I was patiently waiting for my turn to post the receipt number or any other update from employer/lawyer.

    But ,no luck this year.

    My lawyer sent an email today morning stating that they received my packet back.

    All the best to all of those who were selected and got approval this year.

    And , I am not sure of what my state would be next year.

    My employer gave me the reciept number today
    WAC 14 144 53xxx and said it’s accept and approved.

    But when checked the status it has post decision activity

    Is my petition approved ??? It doesn’t say that any where ??? Can provide your inputs ???

  4. I have received reciept for h1b 2014, on may 1st, status reads Initial review today(6/3/2014) but i paid premium processing, so far they dint charge me for premium amount.
    I am confused what happens next.

  5. I got a RFE for my H4 to H1B petition. And they asked for info about my spouse like paysubs, W2 and employment info. Is this common ? Anyone had the same situation before ? Please advise. Thanks.

    • Yes, in order to prove you are in valid H4 status your spouse should be able to prove he/she is in valid H1 status hence he/she should be able to provide W2 and associated employment info.

  6. Hi, is there any sepcifcs to the numbers like WAC 141 139, does this 139 has any sepcific significance.
    My case status is RFE now. when can i expect a feedback/ update?
    does this 139 plays any role in gettign feedback on RFE in terms of specific date?

    • My receipt number is EAC 14 148 5 xxxx.
      EAC – Eastern Adjudication Center (now called Vermount)
      14 indicates – 2014 year of application.
      148 – indicates the computer working day counted from oct 1st 2013 (fiscal year beginning for USCIS) this falls on 148 falls on 30-April. So, you count your from then.
      5 – is a common for all CAP petitions
      xxxx – last four digits indicate unique on each day that begins from 0001 everyday

      how this helps. 148 just says when the lottery picked petition is entered into the system. Based on other posts, there does not seem to be any pattern in the order of picking for adjudication.

  7. Guys,
    I am on H4 and applied for H1 in US only and my employer has filed. I got a reciept no. but its showing On April 10, 2014, we received this I129 PETITION FOR A NONIMMIGRANT WORKER.

    I am not sure I should have I539 APPLICATION TO EXTEND OR CHANGE NONIMMIGRANT STATUS.

    I am confused that for H4 to H1 it should be filed as I129 or I539.

    And I’m pretty sure mine was a regular processing.. coz my docket my HR gave me had 3 cheques
    325 filing
    1500 training
    500 anti fraud fee

    Please comment on what you think… I still had 2 more years of lottery chances so I’m pretty chilled out 😀

    • Hi. I know this my be stupid but just to make you sure you´re using the system correctly. Enter you receipt number without dashes. For instance:

      EACXXXXXXXXX. No dashes and be sure you´re typing all the number of your receipt. It happened to me on my first try.

  14. Hi,
    My company has applied H1b for me this year through a third party vendor and many of my colleagues has got the email from the vendor that they have been selected and they provided the receipt number for them.
    Is there still time for me to wait to get the response from the vendor,in case if my petition is already got selected ?
    Coz’everybody is saying different views on this and I just want to confirm upto what date I can able to expect the vendor response,in case if I got selected already and they haven’t updated the satus yet.
    Please let me know your suggestions on this.

    • If you are in the PP category, there is basically zero hope. I don’t think anyone has received PP receipts for over a week now. I am in the same category, and have not received anything yet.

      If you are in the non-PP category, there is very little hope, but still more than if you were in PP.

    • Same Here. Mine shows ‘Case Not Found’ …since mine is regular processing, I am expecting them to put up the status after the PP 15 day window, which ends on 19 May 2014. USCIS shoudl start processing our cases post that date and we should be hearing good news soon !!!

      • Finally I see an update in my case status!! Bad news is it is on RFE status! The website shows USCIS mailed out a notice to request for evidence on May 15, 2014.

        • Till y’day I couldn’t find my status, but today I got it. I am glad that they have approved mine on 13 May 14, and it is in post-decision status. I checked with my employers and they are yet to receive any correspondence on the same. Good luck with your RFE.

    • Thread died because our hopes died. I am AD/PP as well, and have not heard anything. The word from employers and lawyers is that ~50% of AD petitions have already been issued receipt notices, and that’s around the total number that were supposed to be issued, given the odds.

  16. I think everyone should have known how to enter the case number on USCIS website. But just a friendly remind just in case someone doesn’t know:

    when you enter the case number, you should put EACxxxxxxxxxx or WACxxxxxxxxxx. Don’t include any dash, but must include the initial.

    This is regarding H1B transfer with Premium processing at Vermont.
    Receipt Date: 30th April 2014
    On 9th May, my employer said, they got approval email from USCIC Vermont.
    But online case status still shows “Acceptance”??
    Is it possible?
    Is my employer playing game?
    Worried..

    • Yes. its possible. not to trust too much on the online status. many times it won’t be updated.

  18. I am PP/CA. My case status in USCIS website shows that my petition got approved on May 1,2014 and it is on “Decision” stage.

    Usually USCIS will send email notice for all approved petition but in my case my employer is saying that they didn’t get any email notice yet and they were not sure why, whereas my friends whose petition on same stage got the email notice.

    Why is it like this? I am little confused. Should I be worried?

  19. My application receipt date was 10th April and it was notified on 16th April. Receipt number was not traceable till 28th April but on 29th April i was able to trace it and the status was “Post Decision Activity” with approved status. But now the status is moved backwards to “Decision” status with the below updates.

    “On May 7, 2014, this I129 PETITION FOR A NONIMMIGRANT WORKER was approved and we sent you an e-mail notice. Please follow any instructions on the notice. ”

    I am little bit worried now.

    • same case for me PD. It moved from “post decision activity” to “decision”. I am little confused too.

      Btw, did your employer get any email notice from USCIS saying that your petition got approved because uscis will usually notify via email when your petition got approved.

      Eventhough my petition is in approved state, when I asked my employer about the email notice, they said that they didn’t receive the email notice yet.

      I am little confused. should I be worried?

      • Same here. On 29th April, the status was at “post decision” and now it is at “decision” saying that the petition was approved on May 7th.
        Is it only EAC center? Is it normal? Can Saurabh or anyone with knowledge comment on it?

    • I got RFE too. From not found to RFE. They sent mail on May 3, but not employer nor attorney did receive any mail from USCIS yet.

          No, I’m still waiting. Checking with employer and attorney daily, but they still didn’t receive any mail. Employer called USCIS service center and were told that mail was out and they will re-send it again.
          I have no idea who should receive that RFE mail? Employer? Attorney? H1B candidate?

    • To all those who are RFE/PP, this was my experience. Got my Receipt that got picked in the lottery on 14th April, but status was “CASE NOT FOUND” until May 1st and then it showed RFE. My lawyer received the email on 1ST May, asking me to submit the copies of I20′s , followed by my submission on Friday to the lawyer and them couriering it on May 2nd and USCIS updated my status to “Initial Review” back from RFE on May 5th. May 9th, Just now got the approval status. Just wanted to show you guys how the process worked in my case until the approval. This might be different for case to case basis though.

  22. Guys I got informed from my employer that my check got encashed today and I am expecting the receipt. Don’t lose hope guys. The below tweet is from Immigration.com and they said PP can expect receipt for next two weeks and Non-PP can expect their receipt till May 3oth. So don’t lose hope and Good luck.

    • I had applied last yr and there was lottery last yr too. Mine got approved around end of august and went to interview in Sept.

      What I found out was that they processing almost based on our case number. I was watching this forum and found out which series of numbers are being approved. Based on that I could whether mine would come now or I would have to wait.

      Another one was to see how many numbers are approved everyday. At the peak around 4000 ~ 5000 was being processed by each centre. Based on that I calculated when I would get it.

    What does a following status means?

    my status is changed from Post-Decision to Decision this evening. Vermont Center-MS/PP.

    what is the difference between these two steps??

    • I do have the same status now. However it came from “your case cannot be found….” to this approval message. Also, I got an email from my attorney w/ the approval notice. CAP/PP.I don’t think you have to worry about it (decision or post decision), you already got your approval.

        • My attorney received the electronic Approval Notice by email which says:
          The Vermont Service Center has approved the following
          I-129 Petition for Nonimmigrant Worker
          that had been filed under the Premium Processing Service:

          Receipt Number: EAC141xxxx
          The form I-797 Approval Notice will follow in the mail.

          The email dates May 05. I guess the approval was in the same date.

  27. Got the notification today for Non-AD / RP / VT. Applied through BAL GLOBAL. EAC1414851xxx.

    It is in “initial review” stage with the following details. What does this mean?

    On May 1, 2014, your Alien Registration Number was changed relating to your I129, PETITION FOR A NONIMMIGRANT WORKER. Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance.

      • I don’t know about that. Today morning, I checked the attorney’s portal for update and I see the recipes number updated. When I check uscis website, I see the above message.

          What exactly has changed there? Which fields? Is that inside Project List link?

            2. Click on the “H-1B Petition (Consular) CAP-SUBJECT” link
            3. You should see your receipt number updated against the filed “Receipt #:”, if they received your receipt. I did not receive any email from BAL Global.

    i was on h4 and recently my h1b visa got picked in lottery and approved. So its valid from oct 2014. My husband’s h1b and my h4 will be expiring on sept 30th. I hav 2 queries.
    -Can i travel to india on h4 now and come back before oct ?
    -Also,as my husband’s h1b is expiring,is it fine if he applies only his visa extension now and not mine.
    Do anyone have any idea about my queries .?

    • Nav,

      With H1B expiring on Sep 30th, its best practice to apply renewal before July 31st. I would not prefer travel outside US during that time(though he only applies H1B alone). If extension is approved and then you plan to go India, you need stamping to come back.

    Still case not found… has anyone got any updates on EAC-141345XXXX. I received this receipt on April 14 but I am sill not able to track the case on website. The website shows that case is not yet found. Really getting nervous now.

        • It’s exactly the same!! If you had cared to read some posts and comments in this forum, u would have understood that there are lot of ppl who received the receipt from their employers/attorney’s, but not able to track it (EAC receipts) online. Once your case is adjudicated, then you will be able to see the status online. I was just asking you to read other posts instead of just asking questions.

  33. Hello – I am in Non-AD/RP/Vermont

    My checks have been encashed by USCICS on 4/24, but I haven’t received the receipt yet. I was thinking that I am selected on the lottery.

    My employer tells me that just because checks have been processed, does not mean that USCIS will process my H1 application. That statement made me really nervous.

    What is your take on this?

            Coming to your original question. If they withdrew the checks, they would process. May be your employer meant, USCIS need not “approve”, which is true. If you already know this, just affirming.

            This is not a forum that is easy search and go to the old conversations. Especially when you hear something like that, you would not want to wait so long and instinctively want to ask someone – many time this is faster. Whoever has the patience to answer, will do so. By the way, I do not think that “S” kept quite after posting it here. He might have searched all over in parallel. It is a good suggestion, but, asking again is not a mistake as he is not spamming it.

  34. Is the game over for non ad / PP guys . My employer put for 6 members non of them received yet . Y is it so?I never saw much of non ad PHP getting. Can we wait or is everything over

    But how would you explain that my status changed in few hours from post decision activity to decision? It still says: “On May 1, 2014, this I129 PETITION FOR A NONIMMIGRANT WORKER was approved and we sent you an e-mail notice.”

    By searching through the web it looks like I’m not the first one who had this strange behaviour.

  36. Hi, My H1 case status is showing as’Your Current Case Status for Form CRI89, PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED’ What does it mean? It is in initial review.

    • You probably have the wrong case number, or there is some error in the system.

      This type of message is probably for someone who has a green card through marriage, and is applying to remove the restrictions after the probationary period.

    • Once you have “Approved” as a decision, USCIS sends 797B, Notice of Action to employer and then employer needs share that 797B form to employee so he can actually schedule and appear for interview at the consulate specified in the 797B form.

This is extremely helpful, but USCIS doesn’t always follow its own rules…on this H1B season, I went from “case not found” to “post-decision” without even an email notification sent to my lawyer (as it should have been, since it was a PP application). who knows when we I’ll actually get the paperwork, as USCIS is known to be late in actually mailing them

    • me too same case.. went from not found to Post decision activity, but Mine was not Premium, but regular processing….
