September 21th,  2018 ( Official ): DHS filed response to the motion filed by SAVE Jobs in court requesting to hold the case as it is as they are working swiftly and said they would very likely submit the proposed rule to OMB within 3 months. They contest all the claims by SAVE jobs as not true and it is process that they need to follow and give them some more time.

September 11th,  2018 ( Official )SAVE Jobs USA has filed a motion in court asking the court to conduct briefing and oral argument very soon. It is pretty lengthy 11 page document submitted by SAVE Jobs USA that highlights the delays and says nothing has moved in the last year and half and if it goes at this pace, it will take years for this case to be closed and they say “Justice Delayed is Justice Denied”.

August 20th, 2018 ( Official ) : Latest court update submitted by USCIS on the H4 EAD. USCIS stand does not change on publishing the rule, it is under review by OMB, can take around 30 days or more for the next steps.

May 23rd, 2018 ( Official ) : Court update filed by DHS that they are in final clearance and will be sent to OMB for review and their plans remain unchanged for publication of NPRM for H4 EAD Removal   Below is  the official document filed with court.

February 28th, 2018 ( Official ) : Court update filed by DHS that tells that they need to do more revisions and  cannot submit the  regulation on time. They anticipate that it will be June 2018, when they can submit the proposed regulation to Office of Management and Budget for review and clearance  in time for publication.  Below are the two documents.

February 21st, 2018 ( Official ) : Court Order for the motions filed. Bascially, court ordered to keep the case in abeyance and asked DHS to report status in 90 days and denied motion by SAVE Jobs for oral hearing. Original court  document

    is wrong,
    1) It is initial or proposed rule, not final!
    2) “anticipated” is the word used in the filing, does not mean “will” for sure.

    Please correct the misleading info, thanks.
