What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.

What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?

  • H1B Regular Quota : 65,000 visas
  • H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)

Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. Will there be Lottery for H1B 2019 season ? Lottery Predictions ? Filing Numbers ?
Update : USCIS had lottery for FY 2019 quota and received 190,098 petitions.

When is H1B Visa 2019 Lottery Date ? 
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.

How to find H1B visa 2019 Sponsors ? 
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor. 

  • F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
  • International Professionals  : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. What is H1B 2019 Filing Fee ? 
H1B visa petition filing involves USCIS fee towards certain things and attorney fees, which varies by company size, and attorney involved for the case.  As of FY 2018 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee.  In year 2016, for FY 2018, the H1B base filing fees, increased from  $325 to $460.   2. I got the receipt number from my employer. When I checked the status in uscis website , it gives validation error saying invalid number. Does envy one faced the same issue?

    • Non-AD ppl itself are losing hope anf moving on.. I hope u shud also do the same..if AD gets receipt now.. its definitely a miracle….big miracle

  3. What does it mean if my SEVP portal got updated with, especially the history part was empty as of today morning. Out of blue I got an email from SEVP saying that my employment end date has been changed, so I logged in to SEVP portal to check whats going on. I see that there are two entries of my previous jobs as of today afternoon. Yet, I have not received any communication from the company attorneys or the receipt number. So I am wondering if this change in my SEVP history mean something? I appreciate if anyone shed some light on this or share their similar story.

      • My previous employment details. It was empty as of today morning since I have been checking very often to see my if anything has changed. Today afternoon, there are are two entries of my previous jobs.

    • USCIS has already announced the completion of data entry somewhere around 11th May. Lot of Non Ads have already been informed by their employers. I was informed on 11th May about my selection.

      • Thank you H1baspirant, but your company is one of the big 4 (PwC, Deloitte, EY, Kpmg? I heard that these companies release the information later (at the end of May) Therefore, I would like to know if someone here hired by these companies has heard something or not yet.

        • Where did you hear that? I think they communicate as soon as they receive receipts. Doubt they wait until end of May.

I was just told to wait until end of May but was also told that they’ll inform me as soon as they hear back from USCIS(which means they haven’t heard about my case) Has anyone from your company heard back lawyers? I really hope what you have heard is very true.

          • Thank you for your quick answer AlmostJune. Nobody from my company heard anything either positive or negative from the lawyer. Nothing at all. The smartest thing would be to be informed as soon as they know from USCIS. I do not know why we have to wait until the end of May 🙁

    His H1 transfer application is got deny and his employer forced him to quit the job.
    What is the grace period for him?

    • I believe it’s 60 days or his I-94 end-date whichever is nearer. Check with a qualified immigration attorney.

    How long should I wait?

  8. Dear Friends – Thank you all for your comments and sharing the information. I have been checking the information on daily basis and applying H1B from last 6 years and I had given up my complete hope and was discussion with employer for back up options. Received email(Today Morning) from my employer immigration team about selection in lottery. The wait of 6 years is really painful and I can understand the situation for everyone waiting. Just wanted to inform you all that receipts are still coming.

    Non-AD, Vermont.

    I have not got other details like receipt date and notice date. Will post as soon as i get it.

    • All this time I have been simile this observer. This is my 4th attempt and I am trying to keep hope but I am losing it day by day. This wait game is killing me. Non Ad California do we still have any hope. Cheque not en cashed yet

      Notice date: 05/04
      Received Date : 04/12

      My company does not share the detail on when the cheque was cashed. Not sure why there was so much delay in sharing the receipt number and dont know when the mail was delivered.

  9. I read one comments said that the last receipt came on mid of June last year. How come the receipt which was registered on 3rd of May came around June? Is it a delivery issue or USCIS picked up extra for rejection?

    • As per immigration girl lawyer Facebook live, this year USCIS has selected all your petition if you have filed more than one and they are going to scrutinize if filed multiple petition.
      Though couldn’t believe how they can do that when it is a random lottery.

    • This is just a start ! Still long way to go . Even if the case get selected in lottery, the next tension is where it will be approved directly or will go in RFE. I heard the RFE is another pain area and waiting may continue upto March.
      Even if the case is approved, their is still chances of getting stuck in Visa interview. I dont understand what skill level America is expecting ! 🙁

    • The wait is killing everyone! Its May 23 and haven’t heard anything from my employer yet. He has asked me to wait till the end of May. God knows whats my destiny here. I am so irritated by this entire process. If I dont get H1, I will have to join college for CPT which will cost me so much more.

    The checks are not en cashed yet.

    • My attorney is still receiving receipts and also checks are even cashed after receipts notice so I don’t understand why people cry.

        If you buy a lottery ticket you would wait until lottery company announces the winners!

        So just stay tuned… if you are getting stressed that’s your problem… may be one on the rocks would help to distress… but keep the hopes alive… it’s a f***ing lottery !!!

      • This week the notice day of receipts are 14th or 11th of May. Only receipt we can receive from now is the ones registerd on 15th of May. The chance are very slim

    • Given that we have no clue how uscis is operating on cases this year.. wait patiently until your attorney responds..

    • I think it’s better to just assume it’s over. Then if you lose (most likely) you’re already mentally ready. If you win, better.

      In my case, I had already assumed I had lost, when I got the good news a few weeks ago from my attorney.

      Assuming you petition is legit, I’m really sorry about what you’re going through, it’s really not easy and the process is unfair

  14. Has anyone heard about the impact of the recent news of students not allowed to work at 3rd party client locations in stem opt extension? Is there any direction from USCIS on how its going to interpret this rule?

    • USCIS has issued guidelines to Universities not to issue I-20s for such students working in third party sites.
      So, Universities have stopped issuing I-20’s for STEM extension to Students working in Third party sites.
      Currently, no idea if USCIS is planning to retroactively apply this rule and deny H1bs on that grounds. My guess is they will not do that. However, with the current puppets dictating stuffs, anything can happen.

    • It is not announced as a formal rule or policy memo, there are debates stating that USCIS cannot do website update silently without announcing…so, it is best to speak to your employer’s attorney or an immigration attorney and make decision on how to proceed.

  17. Is it duplicate filing if someone files two applications from two different employers for same end client for substantially similar position but only one application gets picked up in lottery?
    Will the application picked up in lottery get rejected based on duplicate filing rule of 2018?

    • Absolutely, USCIS will look into all petitions (including the ones that weren’t picked in the lottery).

      If 2 petitions have the same end client for similar job, they will be considered duplicates and both will be rejected. You will not get an H1B, and will probably be flagged.

      • i dont think so if one petition is not picked in lottery they will return that petition how come they will know if its duplicate. it works only if 2 petitions are picked in the lottery. correct me if i am wrong.

          • I am wondering since USCIS has already returned the application fee for the second application there is no way it can forfeit that amount and determine duplicate application? How would USCIS determine if the applications where for same employee? Can somebody shed some light on this? Thanks

        • You are wrong. USCIS looks into every single petition, even the ones that were not picked.

          They will also keep the checks from unselected petitions if a duplicate is found. You should read their memos

          • i know they maintain the data of rejected petition with VRN number but am not sure of holding cheques if petition is returned.

            Check with your attorney they know more. As far i know you should not apply to same client n same position it will become duplicate even though it is different employers as per new policy.

  23. 5/21/18 UPDATE: Receipts came in only for non-AD case today. All of these receipts had a Notice Date of 05/14/18. I think we are getting close to the end.

    • we can wait till this week for the Receipt notices. My employer told me that 4 days might take for the post to reach the attorney. so we can expect few more.
      But by this time, cheques should have been encashed.

  24. I saw one person who said his check was not cashed out until last friday, but got the receipt today. His notification day was 14/05. If my data was registered in the system on 15/05/2018, I could get it by this week. But not sure that I would be that lucky. Can’t sleep at night and so sad all day. Who is with me?

    I m in terrible situation need a help from you.

    Because of unacceptable salary from my employer I have to resign but I heard that if my employer withraw the petition and if I didn’t have any sponsored employer or approved transfer then in India once I back there due to no approved petition I have to go through h1b lottery again ? Is it true ?
    I came month back on H1B here in US and have SSN .
    What if I get new employer / pertion in India post my withrawal will I be a cap exempt ?
    Plz plz give your thoughts / info on this ?

    • Once you are in H1 through either working in US or stamped in consular processing cases (in your case you are) then you can transfer to other companies later. You are eligible for totally 6 years to work. You may transfer to many companies in that time frame even the the original petition is revoked/withdrawn. Only issue arise from this is each new transfer will go through same scrutiny as the original petition but you are cap-exempt meaning you no need to go through lottery. Hope this will ans your query.

    • If your employer withdrew your application, then you never got you H1B… You will have to go through the lottery again next year.

      You cannot transfer using a visa you never got in the first place…

  26. Okay so chance of getting selected in lottery was about 38% (Non-AD). Now that I have been selected, what are the odds I will get the visa? is it 60%? 70%?

  28. I just got a call from my attorney that I was picked at the lottery. They received a receipt today. I was hopeless but still miracle happens.

    • Mine also same later changed to We transferred XXXXXXXX to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case. Please follow the instructions in the notice.

    My lawyer told me that the USCIS took the money by my employers account and I was selected by the lottery without getting an RFE.please guys could anyone explain to me what does that mean and what’s the next step.unfortunately I can’t speak directly to my lawyer(due to personal issues of mine) and I an quite anxious
