What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.
What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?
- H1B Regular Quota : 65,000 visas
- H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)
Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. When is H1B Visa 2019 Lottery Date ?
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.
How to find H1B visa 2019 Sponsors ?
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor.
- F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
- International Professionals : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. I am also in same situation my STEM OPT ending on 06/30 i got receipt too. to your questions i have below answers
1) Pending status- Your work permit is going to end on September 30, you should stop working after 30 if your status not approved. you will have 60 days grace period to stay in US but not to work with in grace period you can transfer your SEVIS to new univer. if your planning to go for Day -1 CPT to continue your work
2) Rejected:- If your case rejected before September 30 you will have 10 days(you can work) period ** Until you receive rejection letter** after that your 60 days grace period will start(you cannot work)
If your case rejected by USCIS by finding out some frad or illegal stay you wont even have grace period should leave the country immediately – this is the deal with CAP GAP period.

USCIS won’t be happy if you try Day 1 CPT after Sep 30th. There are a number of cases where people have been rejected for that.
Edwards, i am not going to join college if its pending or in Rfe. I was thinking in case if it’s rejected. Anyways my company doesn’t have any denials from last five years. Hopefully this year too.

Whenever the check is encashed by USCIS after selection in lottery, they will put the receipt number starting with WAC/EAC on the back of the check. Ask your employer to confirm if receipt number is present. Check the status of receipt number on USCIS website.
Could be anything from postal delay to that USCIS didn’t send it out until yesterday.

Data entry means that the receipts have been generated and sent. Now, the delay is upto the postal system. I would say max 1 week.

DSO can confirm change of status by checking your SEVIS, if no change of status pending (even after completion of data entry) then its almost certain that you didn’t make it in this year’s lottery. I hope everything works out for you, all the best!!

Need suggestion. As I have a stamped H1B VISA from a reputed Indian MNC, but I had to move out of company due to downsizing. What all option left for me to travel?
1) Some Consultancy say as they conduct interview in India from actual client, once interview is throgh, they will get my client letter and initiate transfer process. The appication number for initating transfer process is enough to travel they say.
2) Some comnsultancy say, they would initiate transfer without any actual client showing their own in-house project. But for this take around $4500. Once we land there , they will start marketing profile.
3) The other consultant say, travel with previous VISA petitioner docs, Once we reach they initiate transfer process.
Confused, need your suggestion.

Yes. Also create an account on https://myaccount.uscis.dhs.gov/, my case was just updated as case received. Then when i registed in the above account and added my case – it showed that it’s approved. Hope this helps!

Hi Non AD here, my lawyer told me my check is not cashed yesterday (US time 05/15). Does that mean I have no hope anymore since the data entry is completed?

There are people like that, bit I don’t think you have much chance now, after data entry completion.

I know. I’ve been crying a lot. It’s so unfair especially when you think of all the hard work you’ve done in the past. I feel like the lottery based system is total crap and unjustified. Like why should they think it is ok for someone to build a career and end up leaving their chances up to lottery. I’m even more pissed than anything.

Yes I see changes in SLA. Likely completion date for petition acknowledgment is updated to 16th May from 11th May and overall process end date is updated to 31 jan 2019 from 29th Jan 2019

Check encashing has been completed. Not sure about SEVIS updation, but pretty certain that is done too. Your only hope is delayed postal mail.

in US, the check en-cash takes up to two business days depends on the bank. so there is a little hope for those application data entry completed today.

What it means is that they have sent out 85k+15k odd receipts. Any rejections in excess of 15k from these will be added in next year’s lottery.

Yes. USCIS does not really differentiate that these are buffer applications, they just process all of them normally.

For those that didn’t get it, don’t loose hope until you receive rejection letter or return packet. And don’t worry too much, there is always next year! It took me 4 years, but finally selected in lotto. Jeeze!
