What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.
What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?
- H1B Regular Quota : 65,000 visas
- H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)
Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. When is H1B Visa 2019 Lottery Date ?
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.
How to find H1B visa 2019 Sponsors ?
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor.
- F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
- International Professionals : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. USCIS is working at lightning speed. A guy is able to see that his h1b application is approved on USCIS website. Not sure if it’s a glitch in software but if it’s not then you will hear the updates sooner than expected.

I am in OPT-STEM and my visa is going to expire on 12/31/2018. But last friday i got email from my university that they are withdraw from the Student and Exchange Visitor Program (SEVP).So they mention that i can able to stay or work in USA till 6/30/2018.After that my i will be out of status.

If you are selected in H1b, cap-gap will automatically come into play for you. You can then stay until SEP 30.
Cap-gap will be only applicable for active sevis but in my scenario university is withdrawing from the Student and Exchange Visitor Program (SEVP).
But you still have a F1 visa OPT right? Cap-gap applies to F1 visa OPT folks.

Got you. This is a very weird scenario. Not sure how you can get on another OPT from another university immediately after joining. Day 1 CPT anyway won’t provide cap-gap and H1b process will be affected. It seems to me that
the best bet is to leave the country within 60 days of the OPT end date. It won’t affect your H1b approval process. Please contact your company’s attorney to see what can be done

there are candidates like you and then there are 4th, 5th and 6th timers highly qualified individuals. Forgive me for judging but your post shows what is wrong with the H1b process where someone very qualified and smart will have same shot at the h1b visa as you.
i can able.. they are withdraw.. opt steam.. my i will be … below quires need to your advice…transfer..unveristy… These errors and mistakes are not only endless but pathetic and some of my MBA friends from top colleges are still struggling after several years to get the visa. While you coming from a college that is not able to maintain its SEVIS status (and likely accreditation) might get the visa before several of those candidates..

I never thought it will happen like that to our university. It is my bad luck. Abdul Kalam is not from top schools or colleges but still he is a great scientist. Top colleges are not my concern, based on fiancé situation and years of experience what I have. I have chosen the university. When I have applied to university, I have checked the professor background the subjects which I took. They are from Stanford university.
My friendly advice to you, don’t see college or brand. If your good to learn what they give and implement in your current life. You might shine in your life.

the system allows for this arbitrage opportunity where less qualified candidates from sham colleges have equal chances at the lottery as someone coming from harvard/standfords of the world. Heck, sometimes even better if they use consultancies to pay for their fake jobs/visa.
If India think like you top college student should be high priority to get job or business establishment then there wont be any Rilance Ambani.

My checks aren’t cashed yet, my DSO won’t help and my attorney has no information about my application. I cant concentrate on anything else. I got to work every morning, wait the whole day for an email from my attorney. I visit this site, worktheme and immigrationgirl approximately every 30mins. This is my daily routine for past few months. Most of my friends already got receipts and here I am waiting hopelessly. This is getting worse everyday and I dont know what can help me get through this.

I am in the same boat. I decided I am not going to lose sleep over it. All my friends got h1. My friends who work for consultancies also got h1. It’s alright. If it comes down to luck, usually I am screwed. I am not going to let a single visa run my life. If it doesn’t work out, I still got 3 years of work exp and I will go somewhere else. Check “encasement” is not possible because the banks in the US are not equipped to do that. Your application could be from AD or Regular quota, it doesn’t matter.
The check could be “encashed”, that feature is available with all the banks in the US.

U are right, it only applies for Ad pool , not for regular pool they will mix in regular pool so it still flow for Ad for next week guys.

By same time, it means the lotteries are conducted on the same day, one after the other.
They do send AD receipts a little bit ahead, but the is overlap between AD and Non AD receipts towards the end.
Does this mean most of AD is done? What I noticed was that the AD’s that were coming first were the ones who’s OPT was expiring. So may be those are sent first and there is hope for other AD’s?
No it looks like all AD receipts are sent together. There are two people who have recived receipts in my team. The guy with a stem extension, his receipt was received by the company attorneys on 23rd April and the one whose opt was expiring next month, his receipt was received on 25th. However the dumb lawyers didn’t send the receipt of the stem extension guy for 10 days. The opt expired guy got it the next day. Do looks like uscis didn’t prioritize opt expiry within AD.
But its quite possible that ther first lottery receipts come b4 the second. According to immigration girl, AD receipts are sent ahead but when Non AD starts, AD receipts will still come in for a week or more.
How do I find which service center processes my h1b application? My employer is a proper American product based company. They dont share all the details with me.
If my employer is in bay area, does my application go to California service center by default?
yes it would mostly go to the center near to the place you work. Since its bay area i bet it would be California center for you. You can confirm it once you receive your receipt number. For California center the receipt number starts with “WAC”

I heard from my employer that my application got pickedup in the lottery but they are not sharing the receipt number. If I ask they are saying that employees are transfering their H1B after getting in lottery. Is it possible to transfer the H1B with only receipt number?
yes — thats is why small companies/Fake consultancies do not share the receipt

H1b transfer takes time and there is always a chance it will be rejected, so it’s not advisable to switch until it is approved.
After just picked in lottery, its not possible to transfer. It has to be approved first to initiate transfer through another employer.

I am AD 4th timer. Had to go back to school as I used up all of my OPT and working on CPT now. Does our SEVIS also get updated? my DSO told me there is no update and my attorney is saying they would check of encashment only after 15 th May. am I all done and dusted for this year or there is till something left for AD guys?
Well, you are gonna get a RFE anyway, even if you are selected.

I think you can still wait. My employer told me that cheque is en-cashed on Wednesday. So it might take some more time to actually get the receipt. Although the best way to check is ask your lawyer about cheque, you mentioned they are not ready to do that. So only way for you is to wait for the receipt to arrive and for that I am quite sure you can wait for 10-15 mo

Not sure about SEVP update if you are on CPT. Yes it would take sometime for the receipt to arrive. I personally would not rely on SEVP portal update to deduce the outcome of H1b. If the cheque is not en cashed by now, I guess you could still hold on to your hopes for 1-2 weeks.
what exactly Non_AD Means
I am on Stem OPT which expires on 06/18 still i didn’t heard anything. is Non_AD means Regular if its Regular how can they check Sevp Portal.
Non-AD means not masters degree. You can still have SEVP portal if you’re on STEM OPT based on your bachelors degree.

I don’t think AD are done. Those are just stats from IG. How many of the 85k apps does she have? Let’s not go crazy thinking all her numbers are bible.

No update on Sevis, Lawyer not answering my calls/emails, no update from employer, no receipt, DSO will not answer H1B related queries.
