What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.
What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?
- H1B Regular Quota : 65,000 visas
- H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)
Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. When is H1B Visa 2019 Lottery Date ?
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.
How to find H1B visa 2019 Sponsors ?
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor.
- F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
- International Professionals : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. How can you say that this might be the last week for ADs ?
My application reached USCIS on last day of deadline. I have the tracking number provided by my employer.
If mine was picked in first 20K AD applications, I would have received the notice much earlier in APRIL.
I guess it got picked in 2nd round.
Also USCIS should assign some type of numbering for all petitions to conduct a lottery. Commonsense is, they will start assigning the numbers to applications as soon as they start coming. As my packet was reached on last day afternoon, it should be somewhere in last 5K or 10K applications.
Also, I heard non ad people started getting receipts. So this should be the final week and chances might be slim after . This only a prediction.

The order of receipts doesn’t matter. USCIS collects all the applications in the first 5 days. I know people whose applications reached the last day and they got receipts a couple of weeks back.
I don’t agree with your conclusion ( you might be right, but doesn’t make sense in my opinion). No one knows how the lottery is conducted.
If an AD application is sent on last day and the result that it got picked up comes in early april, it means that it got selected in 20K round.
I’m sure USCIS should assign a TEMP SERIAL NO to all applications to conduct lottery as soon they arrive and keep a record of total numbers. I don’t see any other way. If someone knows more about this, i would appreciate if they share their views.
As I have received mine yesterday, there are high chances that mine got picked in 2nd round.
And coming to Non AD’s and AD’s , data entry for AD applications will be done first for almost all applications because lot of us will be in cap gap. Non ad’s have sufficient time as most of them will not fall in cap gap. Once USCIS completely done with AD’s data entry, they start non ad’s.

I feel your H1 got picked in 1st round itself, if it was second round last day batch we would have heard my Non-ADs getting picked before you even had yours..
receipt number is assigned once the application is picked in lottery. Data entry, dispatching notice and processing happens in the order of receipt numbers.
There may be delay in mails due to distance, backlogs, weekends and other factors that result in notices reaching to lawyers in different times. There are differences in processing depending upon which application requires more time to review etc but the order in which these are picked is always the receipt number.
I also agree with edwardss that time when your application reached USCIS doesnt matter. It could be the last to reach on friday evening but if it is the first one picked in the lottery you will get early notification as I described in the above comment.

by picked in this line i mean picked for processing after data entry (not picked in lottery. )
I know people are still getting receipts but does anyone know if all the sevis updates at university has been completed for AD? This was my last attempt and I checked with my DSO yesterday, no luck so far.

Finally got the receipt this morning. This was my 4th attempt (AD) and the wait was crucifying. I had already almost given up on this year’s dream and was already making a list of backup options.

Once you have done a Masters or higher, you are always eligible for AD regardless of OPT status or not.

I guess H1 visa notice has been delayed due to CW-1 Cap Lottery. Last year CW-1 Cap was not lottery, and it finished after H1b visa notice, but this year it is. USCIS completed the process of CW-1 today. USCIS should have notified to both applicants in H1b and CW-1 at the same time. I guess that would be the reason the process got slow.
Whatever reason, i am so frustrated now

It seems another empty day today for Non-ADs…. Will wish again for the next day to be THE day.
The wait is killing. Zero non-ad updates in my team.
Same same, waiting is killing me. But no one who applied that I know has received any updates (all non-ADs), so that makes me think we are ok. Immigration girl says in the site that AD applications are processed always 1st, no matter if they are picked in the 1st 20k round lottery or in the general 2nd round. So I guess as far as no non-ADs get news, there’s still hope for us.
Also, some people is saying maybe this year USCIS is reviewing picked applications more closely before sending receipts, and maybe some picked applications are being rejected (for dupe’s and invalid applications) before receipts are sent? This could explain the delay. I think in general for AD applications this year is taking longer too, it’s just we see every day someone saying he/she got picked and he/she is AD and we think it’s going faster but in reality maybe in past years AD receipts would be done by now.
I don’t know, I am just trying to convince myself we non-ADs will be ok, thinking for the best so I don’t go crazy, haha. Let’s see how it goes today.

When you buy flight ticket to travel, the airlines will conduct a lottery process to select passengers.
For ADs, you will be in the 50 first/business class quota.
For un-selected ADs and Non-ADs , you will be in the 150 economy class quota.
check-in process on the day of travel is the final approval process, you are likely to be refused to check-in if something wrong with your application.
You can purchase multiple tickets, but if more than one tickets are selected in the lottery, you will be deplaned from the airplane during boarding.

And I see most of Stem-1st attempt candidates getting through lottery. While I am not against them, i just feel its a waste of their OPT period (3 years) which could have been utilized even without a h1b. Instead, why can’t USCIS give Stem Candidates 2 years OPT during which they cannot file for h1b and then during the 3rd year and 4th year they get 2 lottery chances. This would improve the odds for everyone. #Random

I am just a little bit confused what’s the significance of the notice date. Is it just merely a date that they sent your mail out?
Ex. – What’s the difference between someone having the notice date and the received date as April12th versus someone having the notice date say 16th April and receive date as April 12th. Does that just indicate that the first guy was picked up sooner in the lottery and will be processed first than the other guy? Just curious.
notice date is the date when they would have mailed the letter out. i would ignore that april 12 thing. i am confused also but i am sure notice date is when they mailed it. losing my mind here when i will get mine.
April 12th is the date when the application was accepted in the service center post lottery. Those not selected in the lottery will receive rejections.
April 16th is the date when data entry is complete for this selected petition and notice sent out to the employer/attorney.
PS: Note rejections mentioned in the first para above is different from the denial that happen after review of selected petitions/RFE.

Notice date – April 16th

EAD valid till November 2019

My husband got receipt today. He is in AD category. This was my husband’s last attempt (3rd attempt). His OPT expires in early 2019. We were losing hope but just got email from his attorney this evening in which we received his receipt notice. Thanks to god!! I hope everyone gets relieved from this tension as soon as possible!!

No, we did not see any update on SEVP. His case was not subject to cap gap as his STEM-OPT extension expires in early 2019 so we were not even expecting any update on SEVP portal.
Also, it took almost a week to receive the receipt from the notice date mentioned on the receipt notice. Since, all the receipts come by standard mail (which is slow), I would recommend people wait for 1-2 more weeks atleast before loosing hope.
I just confirmed with my firm and they said that what they are receiving right now are ALL ADs.
With that, there’s still a ray of hope indeed for us non-ADs… (fingers crossed)

AND they added that based from couple of years, in their firm at least, that that the situation right now is normal…
Given that USCIS has processed ~60% of the cases, the rest should be mostly non-ADs.

No updates for non-AD in my company even today. I know 15 other non-AD colleagues who have applied this year.
SEVP portal updated on 4/23. Obtained my case number from the cap-gap I-20 that DSO sent me. Tried tracking it online.. looks like USCIS sent out the receipt notice on 4/12 but the lawyers haven’t received it yet. I guess they will receive it sometime this week?

They won’t let you back in if you leave now. So if you want to enjoy a year off, feel free to do so.
Assume you are picked in the lottery. Your departure prior to adjudication will NOT affect the approval, but the request for “change of status” is considered abandoned. So you will have to wait until you have the approval letter in order to apply for an H-1 visa at the consulate.
You can’t ..until you’ve got a status change from F-1 to H-1B. Otherwise your H-1B application will be considered void.

I strongly sense this year, USCIS is weeding out duplicate petitions picked in lottery prior to sending out receipts. Probably why non-AD notifications haven’t started yet. Good for the system !
Not true. i know some frauds who filed multiple petitions and have received multiple receipts. I am hoping that these get rejected during approval process but USCIS is not weeding out any kind of duplicate application prior to sending receipts.
just to give an example – EAC1814152718, WAC1814752926, and WAC 1814952434 belong to one person who filed through multiple consultancies.
As you already know the numbers and the person why don’t you report it to USCIS for h1b fraud ? It will be beneficial to some genuine applicants!
Can you report this to USCIS. Folks like this guy are making it difficult for everyone and forcing administration to take extreme steps.
looks like USCIS has started rejecting duplicate receipts from same center. One of the WAC case here is giving validation error.
Anyway I am going to report it with the limited information i have got!
unfortunately i dont know the name of companies that have filed these petitions. h1babuse email requires that information.
Dude are you out of your mind. Don’t post personal information on forums. Do you know if those are from consultancies, he could be genuine and those petitions might be from 3 FT companies.

Duplicate petitions rule is for petitions from same employer and for same position. USCIS allows you to work for multiple employers at the same time if you have approved H1B for both.
how naive are you? everyone here knows how people pay consultants to file multiple petitions. Also this might benefit you- paying an employer for visa fee is also illegal.
I know AD-applicants as well who have filed multiple and got picked up multiple times.

Yes, that’s what is happening.
Lottery is conducted on one day.. not on separate days. Then in the order of the picks USCIS sends out notifications. (you may notice that the receipts are sequenced. )
Since AD are part of the first lottery, the receipt notifications always start with the AD, and when it crosses those 20,000 slots, they start sending mixed receipts for Ad and non-Ad from general 65000 slots.
Her numbers are based from the number of petitions her firm had filed…
Dont lose hope. Immigration girl had vast majority of AD applicants ( 80% or so by her own admission). Her Non-ad pool this year is very small and statistically may not be representative of a good sample.

Mate, I am in the same shoes. My only hope is that our SEVIs aren’t being updated properly, as just like some cases where where SEVIS wasn’t updated but they got their checks cashed.
My firm’s lawyer got my receipt on Monday, but no update on the SEVP portal. OPT expiring in June 2018. So portal update may not be a fool-proof indicator.
I was surprised to know this blog/website, it’s like a real time chat room. I’m a first time non-ADer. Happy to see so many people in the same situation and even a guy was in lottery for six times. good luck to everyone.

Applied in 2000 as non-AD, didn’t get selected so I gave up
12 years later I came to the US and did my Masters
Applied 5 times and never got selected

Well, given no non-AD reporting updates at all, we should assume USCIS has been processing AD cases first. That’s one reason to not lose hope (yet).

Stem is an extension for OPT thats why its called STEM-OPT. It will update if your stem expires between 04/01 and 09/30. Hope this helps.
