What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.

What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?

  • H1B Regular Quota : 65,000 visas
  • H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)

Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. Will there be Lottery for H1B 2019 season ? Lottery Predictions ? Filing Numbers ?
Update : USCIS had lottery for FY 2019 quota and received 190,098 petitions.

When is H1B Visa 2019 Lottery Date ? 
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.

How to find H1B visa 2019 Sponsors ? 
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor. 

  • F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
  • International Professionals  : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. What is H1B 2019 Filing Fee ? 
H1B visa petition filing involves USCIS fee towards certain things and attorney fees, which varies by company size, and attorney involved for the case.  As of FY 2018 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee.  In year 2016, for FY 2018, the H1B base filing fees, increased from  $325 to $460.   2. Guys by end of next week i.e 11’th May, game will be over for All (AD & NonAD). I am surprised that so far nobody has shared the receipts yet for non AD. I confirmed with my Attorney according to them they are receiving some receipts for non ad candidates. But chances will be very slim after next week

    • I actually called USCIS to ask this question. They said data entry complete doesn’t mean you got the letter in your hands. That can take a few days. What I still don’t understand is has ANYONE gotten an EMAIL notification at all? Not SEVIS updates.

      • there are no email notifications since premium processing is suspended. USCIS is sending receipts by postal mail.

        but you are correct in saying that receipts will still be delivered after data entry is completed as there could be delays in mails and the cases that were picked as buffer for rejections will also come later.

      • There is no standard answer for this question, Let me tell you my story here

        Lottery Result: April 11,2017
        RFE1 : August 21 2017
        RFE2: Feb 26,2017
        Final decision: Denied – Mar 23,2017

        So, i would say there is no specific time window for approval after picked up in lottery. If you’re lucky no RFE’s then you may get approval in a month.

  3. data entry complete question. once USCIS says data entry is complete does it mean that everyone was already notified and if you have not received notification by that time you are out? so last year it was may 3.

    • I think it means they have inputted all the information in the system for the candidates that have been selected in the lottery. But that does not mean that all those candidates have received notification about the same. for example if you are a Non-AD candidate then you may or may not have received the receipt notice form lawyer. Or if you are and AD you may or may not have received the notice or any SEVP updates. The receipts keep coming at least couple of weeks after they have declared that the data entry is complete.

          My personal conclusion is that the check should be cashed by then. But I could be wrong as there could be some outliers. What I mean is I have read so much for last three years and most of the time they cash the check almost along side putting your information into the system. There could be some lag between the two but not too much. So safe side I would give a maximum of a week after the completion of the data entry to get the check cashed. But again I am no expert.       • R@j- Thats not true, if they had entered information for all the selected candidates in the system then it should reflect in SEVIS no matter if you are on OPT or STEM or any other work authorization. There will be a change of status so i don’t think its done yet but around may 7 or may 8 it will be. My guess is next tuesday.

        • Yeah I agree regarding SEVP with you that if the data entry is complete then the selected people should get the SEVP updates. My bad, I was more trying to talk on the receipts part. But thanks for the correction.

    • The notice from USCIS seems to sound that way –I am not sure tho about it.

      From last year —

      “USCIS announced on May 3, 2017, that it has completed data entry of all fiscal year 2018 H-1B cap-subject petitions selected in our computer-generated random process. USCIS will now begin returning all H-1B cap-subject petitions that were not selected. Due to the high volume of filings, USCIS is unable to provide a definite time frame for returning these petitions.”

    • The day USCIS announces the completion of data entry you can ask your dso for a new I-20. There should be a ne sevis # on that and change of status as well. This is a sure shot way to know instead of waiting for the receipt. If the entry is not there, i am sorry to say this but the rejection notice is on its way.

      • you are right. Receipts and checks getting checked is not a part of data entry which you get to hear from your lawyer or employer. Data entry only means updating sevis account of the selected candidate.

        • Also by Sevis account i mean getting a new sevis# alloted and not the cap gap thing. Cap gap thing is i guess just a bonus for those whose got lucky with stem and opt expiring between april 1st and sept 30th

          • Know it all-Point out one thing in my statement that is false. Fact is you guys just don’t want to face the reality.

            Been in the game for 5 years with no luck which is kinda sad. Most of the things that i comment are 99% accurate given 1% might not be accurate as new things keep getting introduced like sevp every year.

          • There are several inaccuracies. Lets start with recent ones-

            You claim data entry means updating Servis account and then clarify that a new sevis number is alloted.
            You also claim that on the day of data entry completion there will be a new sevis number and change of status.

            Just FYI – your sevis number is not changed as long as you maintained your F1. If you lose your F1 somehow and request for F1 status again but joining another college/program only then you get new sevis number. Second, change of status doesnt happen by the time data entry is complete. H1B is not even approved by the time of data entry – change of status comes after H1b approval.
            Last but not the least, data entry doesnt mean updating sevis account. Lot of applicants dont even have sevis account on account of never being on F1.

    I’m a Non Ad.

    Regarding Non Ads. I’ve seen a lot of rumors being spread (AD chosen over Non Ads on common Pool), I’d like to know why you think this, especially if in this same site there was the speculation that only 150K would apply this year.

    Also, I read a comment about the whole “data entry complete official statement by the USCIS”. Does this mean that when this statement is issued, and we check with our attorneys/companies and our check was not cashed we’re out of the game?

    Seeing a lot of 2nd timers, 3rd timers, do you remember if last year notificacitions (check cashed, SEVIS update, etc) were done basically at the same time for AD than for Non-Ads, or did it follow the same trend as now (a lot of ADs getting notified that they were selected, and a couple of weeks after that Non Ads notified)?

    • 1. There’s no solid reason for believing that. My personal interpretation is that: in previous years, Non-AD has come after AD with a delay or 1-week or so. This year, due to USCIS being slower overall, this delay got amplified. So people only see AD getting notices, so they think it’s because of all (or most) reg lottery going to AD.

      2. No. It merely means USCIS has entered all the case information into their system. We don’t know how their timeline works for cashing checks, issuing SEVIS updates, etc. In previous years, a significant amount of receipts come days after the completion day, and small amounts trickled weeks after.

      3. You can go to ImmigrationGirl’s blog and find her updates about receipts (she provides a % of receipts she get from all the cases she filed), it will give you a good idea about the timeline. In short, yes, we do generally see AD first, followed by a mix of non-AD and AD, then finally a last batch of non-AD only.

      • Brother – What source or information do you have about USCIS bing slow. What makes you think that ? This is kinda crazy because a lot of people are saying that but i don’t see any difference in the processing time ?

        Just because you don’t see non AD does not mean the system is slow.

        Now you will ask how can i say this – reason is Lottey happened around the same date as last year, the announcement for “receiveing application to fill quota 198k something happened at the same time as it was last year and year before that. (give or take a day or two before or after).

        Could someone please provide me some solid evidence of system being slow ?

          • USCIS Insider – have non-ADs been picked in this lottery? Should one, as a non-AD, assume that it’s almost over, or should they still keep hopes alive?

          • You shouldn’t. We are ~60% done and just started on non-AD cases in the regular cap. Expect a bunch of non-AD receipt in the following days.

          • Does that mean you guys have finished the data entry for AD petitioner in the regular filing? Or AD petitioners can still have hopes?

        There has been no solid proof for you to say USCIS was slow in processing this year. Everyone’s been thinking so just based on the numbers immigration girl has been giving out.

        Note that the numbers on her page is partial to the whole pool. Not seeing any non-AD receipts in her numbers does not mean they have not been sending it out.

        I have seen a few of my friends that got the non-AD receipts.

        From what it looks like, I think it’s much safer to conclude that more ADs got selected over non-ADs, or non-ADs are not posting on the forums we follow.

  5. Folks, can someone confirm of their lawyers received an “EMAIL” receipt notice from USCIS or via paper mail? FRom what I read the emails were stopped for this year. That would mean mail will take longer to reach everyone. I know many AD’s found out by SEVIS updates, and some by seeing their check’s cashed but I am really looking to see if anyone got an EMAIL from USCIS with receipt notice.

    • What would happen if i got my receipt number but my H1b does not get approved until next year (october) and my opt and cap gap end by sept 30 this year.

      In this case, i am spending 1 whole year with RFE’s let’s say.

      Can i stay in the country?

      What do i do when it gets approved after a year?

      What about stamping? Interviewer might ask questions related to this?

      • Yes for regular processing. They also had an option of premium processing where a company could pay extra fee to receive email notifications and processing within 15 days window. However due to the volume of applications USCIS suspended the premium processing during H1b lottery window in recent years. So its only regular mail now.

  6. First of all congratulation for getting through the first phase.
    My SEVP portal got updated on 20 Apr, when I got my STEM I-20, I saw receipt number on that and I got I-20 on 17 APR. But my employer hasn’t heard anything from attorney and when I try to enter receipt number on the portal to check status it shows validation error. Do I need to worry about or this process takes time.

    • Sometimes it takes time for the receipt notice to get into their database- I’ve heard it from a lot of people. Don’t worry and congratulations for getting through.

  7. As of May 3 last year, the USCIS completed their data entry. I guess chances are very slim now. I guess I’ll accept my fate and move on.

    • Let me answer this becuase no one will. Putting big firm and consultancies in the question is ditect implication that you work for one which in turn implies that you think you are deserving. Next time just post general question and not the one in which we can all see you cry.

      But yeah the answer is only 2 person on this forum got the news (one got the receipt and one got the SEVP cap gap extention).

      Also since you already work for big companies, you should go for masters too. That way with masters and a BIG FIRM you can be the next presidential candidate of US.

      Or may be ask USCIS to grant slave status for H1b who got picked in the Non AD category.

  8. Finally received Receipt Notice from my company’s law firm. ReceivedDate: 4/12/2018 // NoticeDate: 4/25/2018. This was my second attempt, AD – STEM OPT ends on 5/31/2019. No update on the SEVP portal and I also checked with my university’s DSO yesterday, no SEVIS update from their side either (no CAP GAP situation yet). Application packet was sent to Laguna Niguel, CA center if anyone wants to know.

    Good luck to anyone who’s genuinely waiting in this not-so-straightforward and mindf*cc process. There’s still time!

        I’d say hang in there. I know how it feels, I was in the same situation till this morning. But if it helps, I remember some of my friends getting their receipts around the 15th of May last year, so I was kinda prepared to wait for another 2 weeks.

        • Yes but this time its different as ppl who got picked up know the result already (OPT expires before Sep 30) since the SEVP portal got updated. So I don’t think there is any luck for us 🙁

            It’s fairly reasonable to wait at least till USCIS officially makes an announcement that they’re done with the data entry process.

  9. I can add my two cents and agree that most of the picked up cases are AD. I know of 9 AD people who applied this year and 5 already got the SEVP update out of which 1 got receipt(me) and the remaining 4 are still waiting to hear as there portal wont update due to not eligible for Cap-Gap. I was the only one among all with last attempt this year.
    P.S. I heard somewhere that Universities are lobbying the USCIS to pick up more AD due to decrease in the student admissions compared to last year. Funny but something to think about. lol

  10. Seems like Non ADs have been given the snub this year. No updates still! That’s surprising… Folks from Infy/TCS/CTS/Wipro generally Non ADs would be very active otherwise.

  11. @Just Asking, Ur points seems to be valid. Actly my friend from GSU confirmed that about 90% of his classmates filed this year received the receipt already. So i think there is something to take it from ur assumption.

      Nah man something is fishy about this years lottery. 20K are definitely ad and out of remaining 58.6 k (i guess 6400 i believe is reserved) lets say half of it goes to AD as well that means 29.3K + 20K = 49.3 K are AD. Lets assume AD are all pretty much done by now which means in 18 days they processed 49.3K receipts. For the past few years data entry completion happened in the first week of may which means sometimes during next week data entry will be complete.

      I just feel like they won’t be able to process the 29.3K Non ad’s in that time frame. Which suggests that most of the H1b Quota went to AD this year.

      This is just a speculation but it kinda scary. Not sure why people are saying that h1b is slow this year. Not sure what is this based on.

      Don’t get started, this is just something to think about. I am not saying this is accurate or true just some thought based on numbers, dates and history of H1b.

    • Exactly, I know its USCIS but its pretty much run by humans. They do things the same way we do things at our company. Data entry and stuff is pretty similar to how we meet our targets and prepare data bases and stuff. There is no rocket science going on. Its a hype because its a government organization.

      Numbers talk for themselves and how maths and equation comes into play. But you know what lets hope for the best, i am a bit scared now but lets hope for the best.

    Anyone/or your friends recently transferred H1B VISA in India and traveled successfully to USA with consultancy?
    1) When they say they offer in-house project and provide their own projects in USA and provide client letter in India? How safe is this model.
    2) Generally how much they take as security deposit ? They say they will refund once you work with them for 3 months?

    Please let me know ASAP.

    • Bro whole situation seems to be a big scam:

      First of all “transferred H1b visa in india” is not a thing.

      Second – The model is also messed up. Model is a thrid part may be 4 intermediate party involved which makes it difficult because you will need to have client letters from every party this will stand in the way of “Bonafied relation netween employer, employee and the direct reports.

      Third “security deposit to hold a job” is not a thing if anyone is asking you to do that. Ask them for documents and why they are asking money for you. This is not just wrong it sounds illegal as well.

      Pick the right battle ma man. Hope this helps.

    • I know you might be tempted to come to US for whatever reason. But I agree with the above comment – this sounds like a scam or at the very least an indication of extremely terrible consultancy. No company should ever ask you to pay a deposit for anything, if at all they can ask you to sign a service agreement for you to work a set number of months with them..

      In the hope of greener pastures dont lose what you already have. Be careful not desperate.

    My guess is close to 20 K AD receipts are already allotted. Do unselected ADs also get selected with Regular (65K) processing or pretty much game over for ADs?

    • I am on OPT extension. It was my 3rd and last attempt , I got my receipt notice later in the evening today. It was shared with me by my employer.

      Details:
      OPT end date: February 2019
      Center for processing: Vermont USCIS center

      My DSO refused to entertain any requests for SEVIS updates. No SEVP updates in history tab or otherwise, maybe it’s because I don’t belong to CAP-GAP as pointed out by many knowledgeable people here.

      My request to all of you is to not loose hope. Hope is a good thing, it never dies. I hope all of you get good news soon.

    • Baba Ram dev Bro – Total Ad petiton and non AD petition are almost same (dont have the exact number but close to 94K and 94K each for this year). AD gets into the lottery twice and 20K are reserved for them so from the numbers there will be more AD petitions than non AD in any given case thats why i said half.

    4/25 check cashed
    4/30 receipt arrived

    Notification time: 4/24

    AD. SEVP already updated from previous petitions.

  16. Does anyone know if all the AD receipts come before the Non-AD ones or do they send the first lottery results out first and then the second? Looks like right now both kinds are getting receipts.

  20. Hi, Anyone aware what “Relation To Field” update on SEVP portal by SEVIS mean? Is it updated for everyone or is there any criteria?

      • Hey , I just received the receipt. You also better cheerup. For me the only update in sevp was in Relation to field on 04/20. And my receipt notice also says “04/20”. So guys ..it does mean something.

    • Yeah I have it too. My assumption is that is update that happens for the people who do not qualify for the Cap Gap but still get picked. Maybe a good news for you! I have got both but one of my friend only got one update and he is not eligible for Cap Gap and that is Relation To Field.

  21. AD 3rd attempt, my SEVIS just got updated today to 9/30! Huge sigh of relief.

    My OPT is expiring 6/29. Have not gotten receipt yet.

    Hope updates happen soon for more among us 🙂

    I have a question , I am on F1 visa and my husband was on H1. This week his extension got denied and he is out of status now. His company has suggested that he go back to India , apply for F2 and when he comes to the U.S a different company will apply for his premium h1b.
    Is this the right thing to do. This is off the group posts here but we really need to take an action soon. Please suggest!!!

    • As you are currently in US, Simplest thing will be to try to get h1b transferred to another company .

      Given the current situation of rfe and denials, Proposal to come back on f2 and trying to find another employer might involve lot of issues like stamping & transfer

    • Your spouse is out of status currently. Its better to leave the country and return on F2 or H1B(apply from India, get it approved and stamped) .

  23. Can anyone please clarify …. does the SEVIS record only get updated for people who’s OPT is expiring before 9/30? My opt date is 2020 so I’m trying to understand does the status on SEVIS change no matter what or only if the date is this year?

      • This is not correct. SEVP is updated only for OPT expiring before 9/30 but SEVIS is updated for everyone on F1 status.

        I know of a college whose DSO added a list of all SEVIS updates last year.

        • One more thing – just so people understand, SEVIS and SEVP are related but different systems. SEVIS is applicable for all F1 student and carries information about your F1 status (school information, CPT, OPT statuses, EADs etc). SEVP portal is something that USCIS introduced this year only for people on OPT. Again – they are related but different systems.

        • Just to clarify, SEVIS OPT end date changes to 9/30 only Cap Gap Students, if they are picked in lottery…Also, in general, if you are not on cap gap and if you get picked in lottery, the SEVIS record is updated with H1B info in it..but it does not reflect in the OPT end date change, you will need to ask your DSO to share that details.

  24. Opt End Date 06/11 Updated to 09/30 saw it today. It has a date 04/25 as the updated date. I had applied for OPT STEM ext and the application was received before the lottery. Hope it helps for people who are in the same boat waiting anxiously. Good luck for everyone.

  25. Are they updating SEVP alphabetically by country? I had two people with the same first country letter get receipts at the same time! Thoughts?
