What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.

What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?

  • H1B Regular Quota : 65,000 visas
  • H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)

Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. When is H1B Visa 2019 Lottery Date ?
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.

How to find H1B visa 2019 Sponsors ?
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor.

  • F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
  • International Professionals  : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. Read comments on this H1B Companies Reviews article  to get an idea and  beware of such consulting companies to avoid fraud.

  2. Hi guys,
I got a receipt from my employer showing that my H1b got picked but I found out from my DSO that there is no change of status in my SEVIS ID.
Is this normal or should I contact USCIS and get it fixed ?

    • How come immigration girl has not seen a single Non AD is kinda freaking me out. Last years receipt % for AD and Non AD around 4th week of April were hand in hand.

      Reply
      • Not because of profiling….
But due to increase in number of applications for AD…
And AD floks participate in lottery twice.. number of AD application are above total number of Visas available(85,000)

If you understand how lottery works.. there is no need to “Just Ask”

          • I feel the frustration and I am Non-AD too..

Is everything in the world the same as last year or previous year ?

Things change every day.. its a bloody manual process.. there is no set date for them to finish all applications… no more premium processing…

Its not necessary that USCIS will follow the same sequence or flow to process applications… or they might be short of resources this year…

The lottery is done and they are going to send out reciepts as they progress through the selected applications…

All we can do is wait until they announce something…

    • I feel like he is the one who is from verizon Pune ? He said he got the confirmation that he was selected yesterday. If thats the case why are you still checking this forum ? This looks like a troll to me.

All you have to do is do everything you can… its better to have no regrets that you didn’t try everything … if I had resources could come to the US for MS and could apply under AD…

Cant change the way this system works.. so be it..

I understand the pain that we have invested some money to root ourself in this country for last few years… but stress would not help resolve…

So just prepare yourself for the worst case.. and try to minimise the impact if you were to leave this country….

Oh please… I’m not denying that being rich matters, but you have loads of scholarships and bank loan options. I came to the US on a combination of multiple scholarships. If you want to come, you can come too.

I meant my personal situation, my inclinations at that time… not just my financial situation…

There is no limit to education… would go to any extent, if I really become passionate about a particular stream… but wouldn’t waste money and time to live in the US but no passion for what I am studying…

          • Not correct.. you can continue with A .. you can not leave A, join B and come back to A. But as long as you were working with A while your transfer was approved, you can continue with A despite your approval.

          • @H1breeze – Read my second comment – I assumed that A will revoke previous petition. Agree with you if A does not revoke the previous petition.

    • until unless employer revokes the petition,
i have a chance to choose the employer for which i want to work?
      am i correct?
multiple switches can be possible between A and B? is it?

  16. Its very well proven. For those whoz end date is less than 9/30, sevp portal update means lottery selection. This is 100% true.

    Reply
  17. Oh jeez, stop asking if game is over for AD applications.

Correct me if I’m wrong, but I’d say AD have more chances because they go through 2 lotteries, 1st the 20k selected for only AD, and then all of them that weren’t picked go to the next lottery, where the rest of the applications are. So even if you weren’t picked in the 20k slots reserved for only AD, you might still be picked from the general pool, so there’s still hope until mid-May, even later because some applications that get picked might be rejected, and yours could be one of the lucky ones that is selected to fill that rejected slot. The thing is that after May chances are tiny miny.

At least this is my understanding of the process.

    Reply
    • your understanding has some gaps. As Mr PM (Namo) said they dont fill rejected slots. they would have already picked a few extra to account for these rejections. But if the rejections are higher – tough luck. they are not going to pick more.

For AD – its not over. But as the focus from USCIS is on OPT (cap gap) cases, it is almost over for AD OPT cases – those with OPTs ending before 9/30. These cases have been handled with priority this year. Only a few lucky ones, who were originally picked in lottery as buffer to fill those rejected slots could still have chances.. but chance is very very teeny tiny small.

      Reply
      • But those slots that were picked in the lottery as a buffer, in case there are rejected cases, they are not notified with a receipt from the very beginning, right? They are just waiting, like in a limbo, and if a case is rejected, then they entered the status of “a receipt is on its way”. That is what I meant.

This would explain why there’s always someone that gets the receipt in June or later.

        Reply
      • Are you saying the OPT people that have dates expiring this year got priority in the lottery? That doesn’t make sense. The lottery is a general lottery.

        Reply
        • i think what he is saying is that the OPT people with dates expiring before 9/30 got priority in the data entry. this make sense because they want to update SEVP portal this year which is open for access for the first time this year

          Reply
          • I just called USCIS and they said there is nothing like that. It’s all random. They are not looking at OPT dates and picking people.

          • he he.. have u talked to your management team. how they always give generic answers.

customer service rep usually have scripts which they use to give same answers

        Reply
        • You still have time. wait till USCIS declares that the data entry is done. usually mid may is good point to call it a bad luck.

          Reply
        • Hi raj I don’t think the AD is over. Last year when I was waiting two of my friends got receipt after mid-May. So just hold on and don’t listen to anyone is saying its all over. Although I would say that if you are AD and you haven’t seen an update in SEVP chances are getting slimmer and slimmer as days go by. I think next Friday would be the last for those kind of people. I say this because most of the time USCIS is done data entering by first week of May.

          Reply
        • Till now only 26% of total cases has been processed in both the centers. You still have hope. It will take upto 3 more weeks.

          Reply
          • Last year the data entry was completed on May 3rd. So, am guessing this year it will complete on May 4th or next Friday.
All the people that I knew, got their receipts by 30th April. Only read on forums that some got receipts in May. So not really sure if there is any hope. This is my fourth time by the way!
Guess its time to look for other options.

    • I think ADs with OPT end date before 9/30 is almost done. I am in that category and I know it’s hard to accept the bad result. But this year is different from the past, because we have the SEVP portal. For those received receipts in Mid may last year, they probably received SEVIS update before may

  21. Update:

Got another receipt from the 25 petitions I filed this year, so currently I’m at 6/25.

This may imply that USCIS has mailed out ~24% of all cases.

All 6 cases are from WAC.

  23. Hi all,

I was going through all the comments so far. But did not get advise/comments for my case.
I am AD, No SEVP update till date, OPT end date July,2018.

I have requested DSO to issue today a new I-20, to check if the dates are updated for cap-gap. Dates are not changed, they are still the same with July,2018 as my Sevis expiration date in my new I-20.

Does this mean I did not get selected in the lottery since the Sevis is not updated yet?
Will Sevis be updated all at once after the lottery or one after the other based on the data entry ?

Comments on this case are appreciated.

If my H1B gets picked and I select counselor processing, should that be a problem?

    Reply
    • I am sure you got no idea how this works and councelor processing is just a fancy word you learned from this forum but let me lay this out for you buddy.

For CPT with 2nd masters – If you are selected and you go for councelor processing that means that you visa will get approved but the COS will totally depend on the counslate you application is sent to.

In councelor processing you just have to sit back as your documents and passport is sent to a counslate in your country thus saving you a trip abroad but the draw back of this system is you won’t be there to answer questions or convince them. A bunch of my friends got their denied last year and there are people who got it approved with 2nd masters CPT but i personally don’t know any.

Just apply for Canada and do your self a favor. You can always come back here but with CPT which is a grey area you might mess your chances for ever.

      Reply
      • There are a few problems in the response above, probably typed in a hurry.. In case you applied for consular processing there is no change of status instead you are getting a new status.

Second, the sit back option mentioned above is actually change of status option not consular processing. If you applied for change of status, your status will automatically change from old status (say f1) to h1.

Agreed with rest of it though. tons of CPT people were denied COS last year.

        • Just to add.. In consular processing you have to go abroad (home country) to a consulate for the visa stamping and have to face interview/questions

          • Thanks man. I am at work and my sole intention was to give some insight to “Hope” so he can make an informed decision about CPT. Appreciate you clarification on the subject.

    • Bro you will not see a change if your opt or stem is expiring after 9/30. If thats the case then you can still wait until the completion of data entry announcement from USCIS. Its only been 14 days since the lottery happened. I believe everyone still stands a fair chance. Not really sure if this will be of any help to you or not. Ask your employer to see if your check was processed or not ? Also Don’t you have access to SEVP portal since you said you are asking DSO for sevis changes?

  28. Any idea if the game is over for AD applicants? I was informed by DSO that as of today there is no change of status pending on SEVIS.

    • I have friends (AD) who have been seeing SEVP updates till yesterday. So I wouldn’t lose hope yet. Also note that SEVP is not a mandated change that everyone sees as indication of lottery selection. Just FYI.

These are uncertain and frustrating times I understand. Hang in there and hope for the best.

A question of my own: Have any current Day 1 CPT students receive a lottery confirmation? (trying to gauge if the USCIS is indeed tightening the leash)

      Good luck!

      • Day 1 cpt will not affect getting selected in the lottery. It will come into play when the visa goes into processing stage. It will not hurt those people who jumped from Bachelor’s to masters and have used cpt for 1 year only and for the first time given that it was a requirement for the course work you took so far.

If you are on second masters and using cpt then you are in trouble because even with the proof that CPT was an integral part of the curiculum you are going to get COS denied (not the visa) given the fact that CPT is a traning program and you need training when you jump up a level in your education.

        Hope this helps.

      • Thanks for giving me some hope!!

Regarding your CPT question, i know few of my seniors currently enrolled in CPT colleges have received receipt notices. For day 1 CPT applicants, the real challenge will be to get H1B approval. It depends on case to case basis though.
