What’s After H1B 2015 Lottery ? FAQs – Receipt Numbers, Processing Times?

As you know, USCIS conducted a lottery on the 172,500 H1B Visa petitions filed for FY 2015 quota and did a press release indicating that the 85,000 petitions selected will be notified with receipt numbers and those not selected will be rejected and returned. I have seen many of our readers asking questions on variety of topics like below.

What are the Next Steps after H1B Lottery by USCIS ?  

  • USCIS notifies selected Premium Processing  applicants about their receipt numbers
  • USCIS then notifies all selected non-premium/regular  processing  candidates about their receipt numbers through postal mail
  • USCIS completes all premium processing applications adjudication by May 12 (15 calendar days from Apr 28)
  • USCIS continues to process non-premium processing cases once their premium processing applications load is down
  • USCIS starts sending out rejection letters to non-selected candidates

Some of these steps may happen in parallel, while some may happen sequential. Also, the timelines are based upon historical data and it is not possible to predict actual dates for this year.  For general info, you may also read  USCIS Processing time for Regular vs Premium

Who will get the case number ? Employee or Employer ?   Do I get an email ? Will I get a hard copy ?

Usually  the employer/ immigration attorney, who filed the H1B petition would receive the receipt number.  The employee will NOT get any email or hard copy of the receipt number from USCIS.  For selected premium processing petitions, an email with receipt number will be sent to the attorney and then followed by a hard copy in mail. For selected regular processing petitions, a hard copy of the receipt notice with receipt number is sent via standard mail.  Either case, nothing will be sent to the employee, it will always be sent to the employer/ immigration attorney.  Read about What USCIS H1B Case number means

Who will get the rejected application, not selected in lottery ? Employer or Employee ?

The employer/immigration attorney will get the rejected application that was not picked in the random computer generation process/lottery.  It should include the fee you sent as well, unless it was a duplicate filing by the employer for the same employee.

Did anyone receive H1B receipt Numbers for Premium processing ?

Yes, some of our readers have indicated that they received Premium processing case receipt numbers on Friday, April 11th, 2014.  Check the sample USCIS H1B 2015 email receipt.  There is no guarantee that everyone, who filed under premium processing, should receive the case numbers right away this week or in the next week. They may start to receive the case numbers anytime from now, nothing to panic that someone got it and you did not.

USCIS said April 28th  is when they will start the premium processing, How come some are receiving the case numbers and emails  ?

Here is the exact USCIS statement  “While the Form I-797 receipt notice indicates the date USCIS received the premium processing fee, the 15-day processing period set by 8 CFR 103.7(e)(2) will begin no  later than April 28, 2014. “.  If you read carefully, it says ‘NO LATER THAN April 28th “, which means that they will start the 15 day clock for premium processing by April 28th, does not mean they will start on April 28th.  So, technically USCIS can start the processing and send out receipt numbers for Premium processing any time before that as well. In fact, they have already since Friday April 11th.

When will I receive the H1B visa 2015 Case number, if I am selected ?  Regular vs Premium ?  

The premium processing cases selected, ideally should get receipt numbers by April 28th and a decision (approval or RFE) by May 12th ( April 28th + 15 calendar days)  as they are bound by 15 calendar day time limit.  For regular processing, ideally, you would receive the receipt numbers a little later. Last year, we have seen receipt numbers sent until late June. This year, we can expect it to be around the same or maybe a little late like early July, as the USCIS load has increased slightly ( Denying and returning more petitions )

How many Master’s degree petitions were received  ? What were my odds in lottery ?

Unfortunately, USCIS has not officially released any petition numbers received for the master’s degree quota. They have not release it last year too. If someone says a number, it is pure speculation. To calculate your odds in lottery, just use the 172,500. It may not be accurate, but gives you some baseline to know your worst case probability.

Does USCIS select more petitions than 85,000 as backup for denials ?

[Updated on April 21st, 2014 ]  USCIS did not release any official information for FY 2015 saying that they selected or wait-listed more petitions than 85,000 as backup to account for denials. Previously, in 2008 USCIS mentioned in their press release that they have  “wait-listed” some petitions to replace the denials, withdrawal petitions, etc.  But, for this FY 2015 quota, we don’t know.  If USCIS were to follow the same process like in 2008, they would have some “wait-listed petitions” put aside in FY 2015 as well. We just have to wait and see or hear from our users. No official information from USCIS on this.  

How do I know, if my employer really filed my case ?

Well, you have to trust your employer and get the information from him that your petition is filed. Usually, employers are upfront and keep you posted about this and send you the emails/hard copy scans from USCIS. You need to find this from your employer.

Can I know the details of my case from USCIS ? What are my choices ?

Well, this is a roundabout way. USCIS has Freedom of Information act , which can be used to get information regarding you file/case. This could take few months( 6 months ) as there are many requests.  But, there is no guarantee here as it is at the discretion of USCIS. Technically, the H1B petition filed is the employer property and you may not have full rights until you start to work for them legally on H1B. We have heard that some cases information was not disclosed. Again, it depends. Talk to an attorney for more clarification.

Can I upgrade my case to Premium processing without receipt number?

You need the USCIS H1B receipt number to upgrade your case to premium processing. Unfortunately, there is nothing you can do, you need to wait for the case number.

I have not slept properly in couple of days, when will I receive my receipt number?

We understand that it can be very stressful period waiting for the petition receipt number and then for processing of the application.  Many of us have been in similar shoes and can empathize your pain. Unfortunately, there is nothing we all can do as it is not in our hands.  Please try to stay calm, focus your personal time on something that you enjoy or with your spouse/kids/friends.     Got through with the lottery finally !! Got an email from my attorney 12 hours ago. I didn’t get through with the lottery last year, so I understand the frustration and anxiety of all my friends here, but still would suggest you to have some faith as a lot of receipts are still to be received.   3. My petition was filed in Premium and Masters quota, the attorney hasn’t received anything yet as of today.
    Do you think I still has time to wait or I can assume its not picked in the lottery ?

    • Not really, USCIS went through PP/AD, PP/non-AD and it’s now at non-PP/AD – so maybe…but you should not bet on it

    • Do not lose hope already. There are a few PP receipts that have been received even today. Wait till the 28th and keep praying 🙂

    • I think it’s a matter of days until all PP are notified – if you do not get anything this week – it’s time for plan B. Most of PP – AD or non-AD have received the receipt – I did more than 1 week ago for non-AD/PP and this week mostly AD/non-PP are receiving notifications – so I would start with plan B if I were you, unless you suspect your lawyer to be really slow in fw an email.

    • There has been no update on Non AD / Regular processing. USCIS is currently sending out receipts for PP and AD/Regular processing.

  5. For all PP applications that were chosen – did anyone received a decision? It’s hard to think that USCIS will judge all PP applications starting 4/28 and I think they will start sending the approval / denial notices earlier…since we cannot check our cases online (mainly if it was applied to Vermont) – people, please if you received any sort of decision – let us know. I understand the frustration everyone that was not chosen has, but even for the selected petitions – we are not 100% done yet…

    • Ya my company applied mine through Seyfarth Shaw… I am AD/PP/VT. I have not received anything yet. I had emailed my primary attorney yesterday and she just replied saying that Last year they did receive a few late receipted cases so she would not give up hope until they receive my rejected package in the mail from USCIS.

    I guess Modi, AK and other politicians in India might be experiencing similar amount of anxiety as many of us. I think we all might also get results by May 16-17 i.e. the results of elections are declared in India …

    Can any one let me know the approximate wait time to know if we are picked in lottery or not? Do we get the case number and lottery result together? Or we will know the lottery result first and then get the case number.
    Regular Quota and non premium processing.

        • Yes, some petitions take longer than others to get notifications from USCIS. I think if your application is wait listed (neither picked nor rejected), it takes longer time to get any kind of notification… Last year, some applicants got lottery rejection well before I got and some got lottery rejection after I got. On the same forum last year, I had seen people getting packet returned in June 2013…

  12. AD/PP/VT..Anybody thinking about getting a CPT and reapplying next year? Anybody know of a school in Texas where this might be possible?

      • You know, I am a Drilling Engineer and if i go back then i am pretty sure i won’t make it back here. I would probably end up somewhere in the Middle East. I think I am gonna go for broke. Does anybody know of such a school in Texas? Please suggest.

    • Egan suc*s. Last year I wasn’t selected and I emailed them several times before I received ANY answer. I was refreshing this website every minute and knew people were getting receipts but they refused even to confirm that. This year, they told me right away I was selected.

      I guess their policy is: is there is no receipt, don’t say anything at all.

      Most likely they haven’t received a receipt for your case yet, which if it’s a premium processing case, might mean you were not selected. But again, you should wait until the 28th to be sure.

      It was Non AD/PP/Vermont I guess.
      Receipt date is April 10th, but seems they recieved e-receipt today.

    • I have serious doubts about SEVIS update and getting slected in lottery – the relation between these two.

      My SEVIS was updated on April 15. DSO gave me a receipt number. but i have not got the notification from USCIS
      I am PP (Very sure) / AD/ CA

      Its been a week since SEVIs was updated.

      I have serious doubts if update in SEVIS means I got it. As with PP i should have got email by now!

      • I am confused about the sevis update status. Could someone please explain what sevis update means? What does is it show or what is it updated to?

        • SEVIS is a international student database. If you’re on student status such as F1, your immigration status is kept up-to-date is through this system. Therefore, for example, if you applied for H1-B this year and are currently on F1, you can get your results that way. If you have a DSO who is willing to check your record for you, then the DSO maybe able to tell you if there have been any recent updates made to your immigration status. Again, that depends on DSO to DSO. Keep in mind, SEVIS isn’t updated in all cases. Last year, there were several people whose status wasn’t updated in SEVIS but they did receive a their notices stating they got through the lottery.

  14. Dont know what happens to my petition. But, This April month is full of mixed feelings for all of us.

    If we see this blog,

    * Some people have posted their receipts n enjoying.
    * Some people are about to lose hopes, but still looking for their last chance.
    * Some people like me, 🙂 , still waiting for USCIS to announce the results.

    • Yup I agree. AD/PP myself, still waiting. Not much remaining to hope for in my opinion. Better prepare yourself mentally for what is to come and not fool yourself. Be realistic not optimistic is my opinion.
      But, think about it, around 87500 ppl did not get through the lottery. My guess is that about 7-10K AD applicants didn’t make the cut either. That’s a large percentage of people who have worked hard towards the degree. Keep in mind that you have earned the degree and its yours for life. Take this as an opportunity to introspect on what your priorities are in life. Making a living in the US is in no all there is to in life. I am sure most of you have loving family and friends back home who would be delighted to have you back! If not this year, there is always next year. Do not waste time and energy in lamenting about fate. Apart from realizing that you have very little control over it, there is not much useful there. Use your time and energy to build good relationship with employers and friends you have come to known in the US. They will last a lifetime. Begin finding alternatives or strengthening your resumes or taking courses that will give you a better chance at getting a good job back home. If you have an advanced degree, chances are that you are already in the top 10 percentile of all people. Consider yourself fortunate that you got to enjoy the good things here. Avoid the hedonistic treadmill. All good things must come to an end. Nothing is permanent. Enjoy it while it lasts. Change what you can change, accept what you can’t. Make life worthwhile wherever, however you are! Cheers to all the good people on this forum!! The internet is a wonderful place!

    • Their is no last date for Regular, USCIS started sending receipts for selected applicants, If you want to no more about yours contact your school and see if any SEVIS update taken and (or) contact your HR if check got cashed. This another way to keep you relief. Good luck. don’t loose hope!!

  15. Damn feeling like people who got it are lucky and feeling very low that I am unlucky. When I see people getting it I skip my heart bit. The chance I am gonna go through is totally low 🙁 Not able to concentrate in work, eat, sleep or do nothing. Getting angry and frustrated with everything 🙁 AD/Regular

    • I just got a mail from my attorney that my receipt number is received. My case is Non-AD/PremimumPrcoessing/CA.
      I wish good luck for all others who are still waiting. Hang in there and don’t lose hope. As the receipt notices are being received by USPS mail, it may take upto 3-5 days after it is dispatched. In my case, the receipt notice was sent by USCIS on 4/16 and received today (4/22) by attorney. As the notices will be sent till Friday for PP, you may receive the notice next week as well.

        Thanks for sharing the information. It’s funny to see that PP receipts were sent via USPS but not email..How is that even called PP? USCIS must have messed up with the process. Some PP were sent through email while some are through mail…Anyway, Congrat on the notice and wish everyone else luck here (include me) :).

        • Yes, it is confusing that some PP receipts are sent by Email. As per the process they are supposed to be sent by the USPS mail only. Please read below the USCIS process on the “Acceptance” phase of the petition. At this phase, it will be thru USPS mail only irrespective of type of processing. After a decision is made, the final approval notice can come thru Mail\Email. Even I was panicked as I was not getting Email and it should come quickly.

          “Acceptance”
          During the acceptance step USCIS reviews newly received applications and petitions to ensure that they are properly filed (i.e. signed by the applicant, appropriate fees, etc.) USCIS issues a receipt number for the application or petition, and sends a receipt notice to the applicant or petitioner.

          Applications and petitions that are not properly filed are rejected with an explanation of why the application is rejected and the corrective action needed. Rejected applications or petitions do not retain their filing date.

          The acceptance step is typically completed within 2 business days of when the application is received. With mail time it may take several weeks for you to get the receipt or rejection notice in the mail. If you do not receive your notice within 30 days of mailing your application, please contact our national customer service center at 1-800-375-5283.

  17. All Non AD/Regulars,

    It seems, some one has misleaded us y’day saying that, he/she already received receipt via mail. coz, if thats true, we could have heard some more success cases. But, it was not happened.

    It’s true that AD/Regular are getting receipts this week. We have been seeing many ppl are receiving receipts under this category.

    But, I think, we(Non-AD/Regular) has to wait for few more days – atleast early next week. What do you say???

    • yea JK… it looks like that.. but that guys were so damn confident that uscis is fast and stuff… buts thats the only one saying that and it looks fake…

      hoping that all PP will get by 28 april… and our will start after that and we may hear few cases next week

        Its none other than USCIS. why would they make things faster in the case of Regular when they simply postponed the processing date for PPs to 28th. Simple logic! 🙂

    • It would be the best if USCIS can publish the lottery results in the website so that all applicants can go and check their application status in a single shot without waiting and tensed up and wasting lot of time.

      Current system should change.

  22. Someone from my company got their e-mail today. She was AD/PP. I haven’t heard anything yead as Non-AD/PP, but with that being said, as of the 22nd of April, there are still AD/PP people hearing back, which in my understanding ought to mean that Non-AD/PP people still have a chance, as well as all AD or Non-AD that went through regular processing. Keep the faith, folks!

  24. To all, someone in my office just now received their response, and she was AD / PP. With that being said, if you are Non-AD / PP (my case), I think it is fair to say that you still have a small chance of being picked. Unfortunately I haven’t heard anything yet but I am just trying to be positive.

    With that being said, all AD and non-AD on Regular Processing really should not stress out too much, I am sure most of you will really start hearing something back either next week or the one after that. Keep the faith, folks.

  25. This wait is killing me, literally. So unfair, Indians contribute so much to the research and economy of USA, and we have to get grilled like this, I am AD/PP/VT, and I am still waiting, no news from lawyer or employer no checks cashed yet….. And to watch others get receipt end one by one in an endless wait, till finally I get to know I have a 50% chance, in other words, I could very well get rejected or receipt end after this grueling wait, crying myself to sleep every night, god please need this is a make or break situation for me…. God please, pray for me guys, I pray for all of you here…..

    • Yup, how true. We come with dreams, spend on our masters and then finally the lottery decides it all.I have friends who came on dependent visa (Non AD)and they applied and they have got their visas through consultancies.
      Not complaining, but yeah I am firm believer of whatever happens, happens for a reason! My OPT ends next month but yeah I am finally accepting the truth and learning to move on. AD(with 2 Masters)/Regular

      • Especially when most of the visas are taken by fraud consultancies, that fake peoples resume. It is unfair for people who graduate from here with advanced degrees and get a job over here, to throw them out and invite someone from abroad getting their visa sponsored by a fake company is just …. so wrong.

        • I can relate. Did my masters from UT Austin, I worked hard for last 2.5 years on OPT, got numerous certifications and asked my American employer to sponsor me which he gladly did. But was equally surprised that some of my friends who faked experience with 7 years etc got through the lottery got notified etc…. While I am left in the lurch…. anyways I have decided to head to Europe…

I did my Masters in Professional Accounting from UT Austin, and got hired as an Audit Associate in one of the Big 4s, Still no response yet 🙁 I lost all hope now because mine was applied PP and I think most of the PP have already received theirs. I think I will go back to UT for PHD.

        • Oh…come on now…everybody knows how you got those “advanced degrees”. And btw i shall not discuss how u faked your SOP or your LOR’s or your financial statemet..shall i? You faked it then, got into the US , did your advanced degree(lol..advanced…) by copying assignments and now talk of hard work? The only hard work you hae done is type those non sensical comments.

          Stop cribbing about others and instead believe in yourself.

          • MS in US is hard work. Nothing fake we really have to pay to learn and have to do real research. We invest ourselves financially, mentally and emotionally. We deserve better treatment.

          • oh,yeah? it is so because you become so greedy that you get into a part time job and do Masters along with it. It looks hard because back home you had your mom cooking food for you and your dad providing financial support. here theres nobody except yourself.

            so please hold that thought of MS being very hard nut to crack. If you had been to CMU like me, you would understand the real Masters degree and what hard work is.

BTW how much did u pay for u’r consultancy to FAKE your resume. We are waiting for our receipt notice since 10 days…All thanks to people like YOU!!!!

      I can emphasize with your situation. I think a Charles Darwin quote might help you cope.
      It is not the strongest of the species that survives, nor the most intelligent that survives. It is the one that is most adaptable to change.
      In the struggle for survival, the fittest win out at the expense of their rivals because they succeed in adapting themselves best to their environment.

      The Lottery outcome may not be favorable to you and to many others , but crying yourself to sleep is not going to help. Try and think of other alternatives if this one doesn’t work out. All the best!

      Indians take like 70% of all H1-b visas, so to be completely fair, there should be a per-country (or per region) quota, just like for green card. Luckily, they compensate that with higher refusal rates (both L1b and H1b) for people applying in consultancies / body shops.

      To be clear, I’m not against Indians, I’m against massive number of Indian applications in companies like TCS, Wipro, Infosys and similar. It’s sad to see Indian people who spent 5+ years on BSc and MS here in the US studying STEM and then they don’t get visa because of “consultants”.

    • I hate this feeling of entitlement some Indians have. Your country is not relevant in a lottery selection. Many other countries are working in the us also so please stop this feeling of entitlement.

          She has a fair point though it was bluntly stated. Its perfectly fair to say that the present lottery system is FUBAR. But I see no preference based on nationality. If Indians see higher H1 rejection rates its purely because a greater majority of Indians seem to go for the body shop/consultancy approach.

  27. I just wanted to wish everyone the best. It is painful to see people who have invested time and money into an Advanced Degree and then encounter a lottery for their future. Someday the rules might change.

      • I know right…while hoping for getting picked in lottery, we still have to prepare ourselves to go back to India and get started there…it may not be fair or its not our first choice but it is what it is. Its always more difficult to go back than to get denied before entering in US. But no one seems to care about that.

  28. AD/PP/VT . havent received any response.

    Checked with school DSO today and she told me that no update in the sevis. I completely lost hope now.

    • Im in your boat too, it sucks for US grads. I wish they first let US grads take all the seats first and then others that are not present in the US.

      • dont lose hope …sometimes they dont update SEVIS till later…but its very rare ….its hard for me to say that …since i havent received mine either but just hoping that i get and so does everyone on these forums ..would hate to hear about rejected cases ..arghhh another 10 hour gruesome wait

    I applied under AD/PP/VT and still waiting for an answer. Even though many PP applicants received receipts last week, there were few who received receipts yesterday. Hence, we (PP) still have hope. Let’s retain hope until Apr 28.

    Let’s see how many PP applicants are still waiting for an answer. Please reply.
