What’s After H1B 2015 Lottery ? FAQs – Receipt Numbers, Processing Times?

As you know, USCIS conducted a lottery on the 172,500 H1B Visa petitions filed for FY 2015 quota and did a press release indicating that the 85,000 petitions selected will be notified with receipt numbers and those not selected will be rejected and returned. I have seen many of our readers asking questions on variety of topics like below.

What are the Next Steps after H1B Lottery by USCIS ?  

  • USCIS notifies selected Premium Processing  applicants about their receipt numbers
  • USCIS then notifies all selected non-premium/regular  processing  candidates about their receipt numbers through postal mail
  • USCIS completes all premium processing applications adjudication by May 12 (15 calendar days from Apr 28)
  • USCIS continues to process non-premium processing cases once their premium processing applications load is down
  • USCIS starts sending out rejection letters to non-selected candidates

Some of these steps may happen in parallel, while some may happen sequential. Also, the timelines are based upon historical data and it is not possible to predict actual dates for this year.  For general info, you may also read  USCIS Processing time for Regular vs Premium

Who will get the case number ? Employee or Employer ?   Do I get an email ? Will I get a hard copy ?

Usually  the employer/ immigration attorney, who filed the H1B petition would receive the receipt number.  The employee will NOT get any email or hard copy of the receipt number from USCIS.  For selected premium processing petitions, an email with receipt number will be sent to the attorney and then followed by a hard copy in mail. For selected regular processing petitions, a hard copy of the receipt notice with receipt number is sent via standard mail.  Either case, nothing will be sent to the employee, it will always be sent to the employer/ immigration attorney.  Read about What USCIS H1B Case number means

Who will get the rejected application, not selected in lottery ? Employer or Employee ?

The employer/immigration attorney will get the rejected application that was not picked in the random computer generation process/lottery.  It should include the fee you sent as well, unless it was a duplicate filing by the employer for the same employee.

Did anyone receive H1B receipt Numbers for Premium processing ?

Yes, some of our readers have indicated that they received Premium processing case receipt numbers on Friday, April 11th, 2014.  Check the sample USCIS H1B 2015 email receipt.  There is no guarantee that everyone, who filed under premium processing, should receive the case numbers right away this week or in the next week. They may start to receive the case numbers anytime from now, nothing to panic that someone got it and you did not.

USCIS said April 28th  is when they will start the premium processing, How come some are receiving the case numbers and emails  ?

Here is the exact USCIS statement  “While the Form I-797 receipt notice indicates the date USCIS received the premium processing fee, the 15-day processing period set by 8 CFR 103.7(e)(2) will begin no  later than April 28, 2014. “.  If you read carefully, it says ‘NO LATER THAN April 28th “, which means that they will start the 15 day clock for premium processing by April 28th, does not mean they will start on April 28th.  So, technically USCIS can start the processing and send out receipt numbers for Premium processing any time before that as well. In fact, they have already since Friday April 11th.

When will I receive the H1B visa 2015 Case number, if I am selected ?  Regular vs Premium ?  

The premium processing cases selected, ideally should get receipt numbers by April 28th and a decision (approval or RFE) by May 12th ( April 28th + 15 calendar days)  as they are bound by 15 calendar day time limit.  For regular processing, ideally, you would receive the receipt numbers a little later. Last year, we have seen receipt numbers sent until late June. This year, we can expect it to be around the same or maybe a little late like early July, as the USCIS load has increased slightly ( Denying and returning more petitions )

How many Master’s degree petitions were received  ? What were my odds in lottery ?

Unfortunately, USCIS has not officially released any petition numbers received for the master’s degree quota. They have not release it last year too. If someone says a number, it is pure speculation. To calculate your odds in lottery, just use the 172,500. It may not be accurate, but gives you some baseline to know your worst case probability.

Does USCIS select more petitions than 85,000 as backup for denials ?

[Updated on April 21st, 2014 ]  USCIS did not release any official information for FY 2015 saying that they selected or wait-listed more petitions than 85,000 as backup to account for denials. Previously, in 2008 USCIS mentioned in their press release that they have  “wait-listed” some petitions to replace the denials, withdrawal petitions, etc.  But, for this FY 2015 quota, we don’t know.  If USCIS were to follow the same process like in 2008, they would have some “wait-listed petitions” put aside in FY 2015 as well. We just have to wait and see or hear from our users. No official information from USCIS on this.  

How do I know, if my employer really filed my case ?

Well, you have to trust your employer and get the information from him that your petition is filed. Usually, employers are upfront and keep you posted about this and send you the emails/hard copy scans from USCIS. You need to find this from your employer.

Can I know the details of my case from USCIS ? What are my choices ?

Well, this is a roundabout way. USCIS has Freedom of Information act , which can be used to get information regarding you file/case. This could take few months( 6 months ) as there are many requests.  But, there is no guarantee here as it is at the discretion of USCIS. Technically, the H1B petition filed is the employer property and you may not have full rights until you start to work for them legally on H1B. We have heard that some cases information was not disclosed. Again, it depends. Talk to an attorney for more clarification.

Can I upgrade my case to Premium processing without receipt number?

You need the USCIS H1B receipt number to upgrade your case to premium processing. Unfortunately, there is nothing you can do, you need to wait for the case number.

I have not slept properly in couple of days, when will I receive my receipt number?

We understand that it can be very stressful period waiting for the petition receipt number and then for processing of the application.  Many of us have been in similar shoes and can empathize your pain. Unfortunately, there is nothing we all can do as it is not in our hands.  Please try to stay calm, focus your personal time on something that you enjoy or with your spouse/kids/friends.     • It could be either way, because SEVIS record is not always automatically updated by USCIS. Many times you have to send the receipt # manually to your advisor to update SEVIS.

  2. I believe this in the article is incorrect:

    Do you mean to say “approval” instead of “receipt numbers”? The PP have to be approved by May 12, which means that they should get receipt numbers earlier than that. Also, regular processing should get at least their receipt numbers before July, as a lot of OPTs end in May.

      I have updated the text for PP. They should receive receipt numbers by April 28th and decision within next 15 calendar days from April 28th.

      As for RP, the statement is based on last year’s data when people continued to receive RP receipts through June. As nothing has been published from USCIS, we are guesstimating on the basis of last year’s trend.

  5. Folks, i got my receipt number yday. applied for non AD/PP/EAC. But when ever i apply my case number in uscis tracker it says “Your case can not be found at this time in My Case Status. Please check your receipt number and try again. ” what is happening? Does anyone have this same issue?? 🙁

    • Nadi – also AD/PP here. When did you receive your receipt #? Losing hope here… not sure if they finished releasing AD/PP receipts… 🙁

      • Hi jonathan, i got it yesterday morning around 9:40. I know its very easy to say not to worry but i can understand ur tension as i was in same tension till yday morning. As per my attorney’s advice, we can wait till apr 28th to know the PP lottery results. So till then pray and try to be calm. All the very best for u 🙂

  6. AD/PP/VT just received my receipt number 10 minutes ago from my attorney.
    She sent an email to USCIS asking the update of my case, then USCIS returned a receipt number.
    So do not lose hope for PP until 4/28.

    USCIS H-1B Premium Processing to Begin April 28

    On April 28, 2014, U.S. Citizenship and Immigration Services (USCIS) will begin premium processing for H-1B petitions subject to the fiscal year 2015 cap, including H-1B petitions seeking an exemption from the fiscal year cap for individuals who have earned a U.S. master’s degree or higher. USCIS first announced that we would begin premium processing for H-1B cap cases no later than April 28 in a news release on March 25. USCIS provides premium processing service for certain employment-based petitions and guarantees a 15-calendar-day processing time.

    Do we AD/Premium can still hope of being selected even after 28th April.

    • They (USCIS) stated strongly one more time, that they will start processing h1 fir those who selected and with guaranteed of 15 days of conformation. In fact news was repeated one more time. But just hope until APR 28 if yours is a premium.. all d best. All of us waiting don’t loose hope!

    • As you know, USCIS began sending out email notices with case numbers last week. Normally, if you file a case with premium processing, the 15-day period starts from the day the case number is issued. So some people thought that if you received a case number on April 10, your case would be decided upon by April 25.

      However, because of the immense workload with the lottery, USCIS is basically letting applicants know that the should not expect to get their cases decided upon within 15 days from the date of receipt (case number issuance).

    The email I got from the attorney stated that a decision will be made on the petition within 15 days of the received date ( 11 Apr, 14)

    I just saw the below notice :

    Does it mean that the PP will be done ONLY post 28 April? Any inputs?

      They have published this to buy enough time. Officially, PP SLA has been extended till May 12 (15 days from Apr 28). However, this doesn’t stop them from working on PP petitions even before Apr 28.

    • Non-AD/PP/CA, still waiting…
      My H-1 and my wife’s H-4 are filed at the same time. Today my wife received a receipt number (WAC-14-135-XXXXX) for H-4 with receipt date as 4/10/14 and notice date as 4/14/14.
      Does it mean that my H-1 is also selected but I have not yet received the receipt number?. As H-4 is a dependant of H-1, without H-1 how can the H-4 be processed?.

        • Do H4 applicant need to file petition.
          Or they just need to take copy of principle applicant petition while stamping?

          I don’t understand which application KR is trying to mention here.

            H-4 applicants don’t need any separate petition if they are outside US. They can just go for interview carrying their spouse’s approval document.

            If the dependent is already in US (on F-2 or L-2), then a COS application needs to be filed for them along w/ spouse’s H-1 petition.

  9. Got the receipt from my attorney today evening!
    Folks in my company and my friends in other companies got their receipts by Monday. Reading various blogs and forums I was sure I could be hopeful till April 28. After April 28 is when we should start worrying about being not selected.

    Don’t lose hope now – it is still early!

          • I am not speaking on thr behalf but i had asked them to not seperate the information ……they were of the opinion that it would be a more organized way for regular and non PP people ….but i felt this forum offered more value since a larger user base.

            Is there a way you could track by the names or emails or people here who is in what category and put up that data it would be more helpful and people leaving comments which are difficult to track. It is an excellent place to exchange ideas and I am happy we have this forum however it doesn’t provide us with any concrete data. Like on H1Bwiki they do have a poll going which shows us how many people waiting in which category. If you could have something like that here I am sure most of us will be grateful.

            Unless we ask all users to register on this site, that poll will not help. Anonymous polling will allow a user to vote multiple times and not allow them to change their vote (say from waiting to received when the same is received). So the poll results will not be accurate and not server any purpose.

            We do have a H-1B tracker but it is more helpful once a person has made through the lottery. But you all can repurpose it for your use as well.

            For example, you can select “Case Number Not Received” when you are still waiting for the case, and change it to “Initial Review” once you make through the lottery. It also asks for filing center, processing type etc.

            Hopefully that will solve your purpose.

          • No offence to anyone. We are not Scammer here not collecting any sort of information from anyone who wishes to join. There are about 14 people in this group we are just trying to pacify our anxiety as this seems to be a better way to correspond and keep track. It has given us more clarity of how many people waiting in which category. We are not forcing anyone to join Divya is the Admin for this group. I assure you we are all folks like yourself trying to get answers of when we will be able to hear back about our petitions. Saurab we apologize if this is creating an issue we will be happy to correspond on this website but there are so many people commenting its hard to keep track. I hope you understand !

            In a WhatsApp group, you have to give your phone number. Let’s say you have 15 members right now and one of them happens to be a not-so-good-guy. He will have access to phone numbers of other members of the group and can start scamming/spamming.

            If its a blog or yahoo/google group, you can sign-up with any email address (not your primary one) and even if that gets spammed, you are not flooded with adds serving you cheap viagra. That’s my issue with WhatsApp which requires your primary number for registration.

            Anyways, I have suggested the use of H-1B tracker in another post. Evaluate it if it solves your purpose.

  13. Hi, My HR emailed me saying that we’re still waiting; and I see your check is not been cashed.. Is that mean I m not selected? I am hoping.. I am on regular-AD processing. And this is my last year/chance.

    • I dont think check gets cashed until they open and enter our case…Im also under AD/Regular processing…

        • As far as I know they cash the checks once they enter our case manually into the system…and I think they are right now doing for Non AD/PP…So we shud be hearing soon..Anybody with AD/Regular…please give ur inputs here

    • Guys it’s still early days for regular processing. Premium processing is yet to come to a closure, one cannot assume that it is all over until you hear anything from uscis (good or bad). All the best, be positive.

    I see people are giving out their email IDs and phone numbers. Please beware of scammers. Last year some Indian guy started a scam of calling people from 911 (the ID would show up as 911) and scare the applicants to pay $1400 to avoid a law case from USCIS. This may happen again this year, so do not post your receipt numbers or any other information from where these bloody scammers can track your information. Good luck all.

  18. My firm won’t tell me, but there is really one thing you want to know as an non AD / PP applicant (or for that matter, whichever bucket you fall into). How many did your respective firm apply for and how many have they got receipts for? If they tell you that it will give everyone a sense for how far through receipt processing USCIS is (i.e. in my example 41% was the starting probability. If your firm says 10% then USCIS is likely just starting, if it’s 50% then you’re in trouble). Using one-off examples of people getting approvals is meaningless… Encourage people to ask this question and post responses!!

      • I called the law firm, they told me they have received toughly 50% of PP approvals. That means I am out??? 🙁

        However, they still receiving each day until April 28th. That’s what they told me! Is this true? Please advice

        • Well your lawfirm might just receive more approvals…it is just luck ..if you got selected on the original lottery …not approvals based on your firm ……but i can see why you would think that ..i am as tensed as you are and my law firm has not responded back.

    1. Why USCIS hasn’t provided an option to upgrade from Regular to Premium before they receive receipt?

    If there is such possibility, I could have paid 1225$ now. Coz, in my case, my employer filed my petition under regular by mistake.

    2. If a PP candidate didn’t get through the lottery, Will USCIS return PP charges back to the candidate?

      1. That’s how the process has been forever. In upgrade form (I-907), you need to enter original receipt number which one doesn’t know until receipt has been selected.

      • 1. In that case, I think, they should follow same timelines in releasing the receipts for both PP and regular. Coz, even after knowing the receipt#, a regular candidate is paying the same amount for migrating to PP. But, losing time in waiting for receipt.

  22. One of the person mentioned receiving receipt for non-PP case. However, that is fake. The same person has provided 2 different receipt numbers – WAC1413654370 (claiming it as non-PP) and WAC1413654550 (claiming it as PP)and causing confusion to readers. I will remove those discussions to bring clarity.

    Everyone is suggested to keep fake news away from the forum.

  24. Looks like AD/Regulars have not yet received any sort of confirmations. It looks like only PP are being done for time being. Well that gives a little hope for a sinking boat..:( This will be an epitome of bad luck if I don’t get selected in the lottery this year. Didn’t make t through last year either. This is definitely beyond being stressful. What a pity? our life depends on some freaking randomly selected Lottery. SMH..

    Anyway, to all the Regular Processing people, stay calm. I would say atleast another 10-15 days before we start hearing on regular processing. In the meantime, may all the people who don’t have a second chance get it. I mean no offence we all need it but, some are in a dire situation like me 🙁 Fingers crossed

    • Hey RCS, We have to wait for some more days. I think, USCIS will release ours(non-AD) only after releasing receipts for AD/Regular.

  26. Hey Everyone,
    I have not yet received any notification from my attorney about the lottery selection email from USCIS.
    But sometime back I called my university and I got a confirmation from them that my Sevis record shows “Change of Status Pending”. I also got a receipt number, EAC141315****.
    I think that the ‘131’ in the number means that I made it in the lottery on 11th April itself. But I haven’t heard anything till now. And my attorney keeps saying that they have nothing on me yet.
    Do you guys think they assign EAC number to even those who do not make it to the lottery? if not then I guess I made it through.
    And for others….Please do not lose hope. Everyone around me got their receipts already, so I was really under pressure. I was pretty down and almost lost hope. But somehow I called my university to confirm this due to someone who earlier posted in here. You guys should also do this once.
