As you know, USCIS conducted a lottery on the 172,500 H1B Visa petitions filed for FY 2015 quota and did a press release indicating that the 85,000 petitions selected will be notified with receipt numbers and those not selected will be rejected and returned. I have seen many of our readers asking questions on variety of topics like below.

What are the Next Steps after H1B Lottery by USCIS ?
- USCIS notifies selected Premium Processing applicants about their receipt numbers
- USCIS then notifies all selected non-premium/regular processing candidates about their receipt numbers through postal mail
- USCIS completes all premium processing applications adjudication by May 12 (15 calendar days from Apr 28)
- USCIS continues to process non-premium processing cases once their premium processing applications load is down
- USCIS starts sending out rejection letters to non-selected candidates
Some of these steps may happen in parallel, while some may happen sequential. Also, the timelines are based upon historical data and it is not possible to predict actual dates for this year. For general info, you may also read USCIS Processing time for Regular vs Premium
Who will get the case number ? Employee or Employer ? Do I get an email ? Will I get a hard copy ?
Usually the employer/ immigration attorney, who filed the H1B petition would receive the receipt number. The employee will NOT get any email or hard copy of the receipt number from USCIS. For selected premium processing petitions, an email with receipt number will be sent to the attorney and then followed by a hard copy in mail. For selected regular processing petitions, a hard copy of the receipt notice with receipt number is sent via standard mail. Either case, nothing will be sent to the employee, it will always be sent to the employer/ immigration attorney. Read about What USCIS H1B Case number means
Who will get the rejected application, not selected in lottery ? Employer or Employee ?
The employer/immigration attorney will get the rejected application that was not picked in the random computer generation process/lottery. It should include the fee you sent as well, unless it was a duplicate filing by the employer for the same employee.
Did anyone receive H1B receipt Numbers for Premium processing ?
Yes, some of our readers have indicated that they received Premium processing case receipt numbers on Friday, April 11th, 2014. Check the sample USCIS H1B 2015 email receipt. There is no guarantee that everyone, who filed under premium processing, should receive the case numbers right away this week or in the next week. They may start to receive the case numbers anytime from now, nothing to panic that someone got it and you did not.
USCIS said April 28th is when they will start the premium processing, How come some are receiving the case numbers and emails ?
Here is the exact USCIS statement “While the Form I-797 receipt notice indicates the date USCIS received the premium processing fee, the 15-day processing period set by 8 CFR 103.7(e)(2) will begin no later than April 28, 2014. “. If you read carefully, it says ‘NO LATER THAN April 28th “, which means that they will start the 15 day clock for premium processing by April 28th, does not mean they will start on April 28th. So, technically USCIS can start the processing and send out receipt numbers for Premium processing any time before that as well. In fact, they have already since Friday April 11th.
When will I receive the H1B visa 2015 Case number, if I am selected ? Regular vs Premium ?
The premium processing cases selected, ideally should get receipt numbers by April 28th and a decision (approval or RFE) by May 12th ( April 28th + 15 calendar days) as they are bound by 15 calendar day time limit. For regular processing, ideally, you would receive the receipt numbers a little later. Last year, we have seen receipt numbers sent until late June. This year, we can expect it to be around the same or maybe a little late like early July, as the USCIS load has increased slightly ( Denying and returning more petitions )
How many Master’s degree petitions were received ? What were my odds in lottery ?
Unfortunately, USCIS has not officially released any petition numbers received for the master’s degree quota. They have not release it last year too. If someone says a number, it is pure speculation. To calculate your odds in lottery, just use the 172,500. It may not be accurate, but gives you some baseline to know your worst case probability.
Does USCIS select more petitions than 85,000 as backup for denials ?
[Updated on April 21st, 2014 ] USCIS did not release any official information for FY 2015 saying that they selected or wait-listed more petitions than 85,000 as backup to account for denials. Previously, in 2008 USCIS mentioned in their press release that they have “wait-listed” some petitions to replace the denials, withdrawal petitions, etc. But, for this FY 2015 quota, we don’t know. If USCIS were to follow the same process like in 2008, they would have some “wait-listed petitions” put aside in FY 2015 as well. We just have to wait and see or hear from our users. No official information from USCIS on this.
How do I know, if my employer really filed my case ?
Well, you have to trust your employer and get the information from him that your petition is filed. Usually, employers are upfront and keep you posted about this and send you the emails/hard copy scans from USCIS. You need to find this from your employer.
Can I know the details of my case from USCIS ? What are my choices ?
Well, this is a roundabout way. USCIS has Freedom of Information act , which can be used to get information regarding you file/case. This could take few months( 6 months ) as there are many requests. But, there is no guarantee here as it is at the discretion of USCIS. Technically, the H1B petition filed is the employer property and you may not have full rights until you start to work for them legally on H1B. We have heard that some cases information was not disclosed. Again, it depends. Talk to an attorney for more clarification.
Can I upgrade my case to Premium processing without receipt number?
You need the USCIS H1B receipt number to upgrade your case to premium processing. Unfortunately, there is nothing you can do, you need to wait for the case number.
I have not slept properly in couple of days, when will I receive my receipt number?
We understand that it can be very stressful period waiting for the petition receipt number and then for processing of the application. Many of us have been in similar shoes and can empathize your pain. Unfortunately, there is nothing we all can do as it is not in our hands. NOpe need not worry sometimes the processing time may different based on their busy schedules.
I am rd/rp/ca still waiting for the receipt, my employer has received 14 out of 25 receipts and said he may not receive anymore, however my husband has received an email yesterday from his company saying, they hav received Rfe for his dependent h1’b petition…. Check with your employer if check is encashed then on the back of check scanned image they will mention your WAC number.. Ask him to cross check it once again.

So if they apply for my green card and an EAD on green card, i understand that i cant leave US and come back, unless i get a travel parole.
But what would be the other consequences of applying for green card on F1 visa?

Not sure what you are saying. Did you not get an H1 this time? Green card is for future employment so your current status does not matter. However with EB2 an EAD is anywhere between 5-10 years aways if you file today.
To clarify the 5-10 year period holds if you are from India and China only.
This is a good question, and as far as I can tell, does not have an obvious answer. I myself am in this situation.
What I don’t understand is the following. Suppose my OPT is valid until December 2015, and further that my employer successfully completes the labor certification process, and concurrently files I-140 and I-485 (ROW). If the application is for some reason rejected, can I still continue using the OPT until it expires? Or is it the case that because I declared immigrant intent while filing for I-140/I-485 the entire F-1 status becomes invalid?
I suspect your problem is slightly more complicated than mine by the fact that priority dates for Indian EB-2s are not current.

First check with your hr and they will show the right way to jump the boat 🙂
In many cases the contract between your employer and client will make it hard. Your employer may ask for a payout from the client. Also if this is a desi consultant, he might hold on to the approval notice…or do you have it in hand? Per USCIS I believe you can do this.

Yes you can, no issues.
Actually they wont accept your old passport, cause your passport should have six months validity beyond start date.

there is still hope till june 1st week for RP, receipts are trickling very slowly this year, i got an update from my attorney asking me to wait till then
1. You have to digest the truth. Its done. If you believe in miracles then wait and watch
2. That depends on your opt expiration. If it is getting over you have to plan right now. Want to stay in US then go for another degree.
3. If you want to work & Study then you have to choose a college which will give you CPT from the beginning. (definitely not less than $5000 per semester )
4. Depends on your employer & your skills.

Did anyone get receipt notices after May 10 in PP category? I think chances are lose to zero now, and the USCIS is just waiting to send all packets back after they process selected candidates. I asked my lawyer, and he confirmed this with “99.99% surety” verbatim. Not trying to discourage anyone, but just sharing what my lawyer told me.

Can anyone tell me what a form I797C is? My OH company received one saying “petition opened” or something like that (not sure if there was a number) but we cannot figure out what this is (Perhaps just a receipt of the application?) and we don’t want to get too excited. Internet returns only epic legal jargon…
That is your receipt with your case number. If you look up to the left on top there should be a Receipt number that starts with either EAC or WAC, that’s your case number. I-797C is notice of action.

Im very happy and so relieved – the form is indeed the receipt!! So we got our receipt (OH applied, I will be H4) on 14.05.15. it was applied for as Non-AD/Reg/EAC

USCIS and US Govt has basically thrown an open challenge out to all the rejected H1 aspirants that they are most welcome to try to go ahead and leave US…but such is their desperation to stay in US most will not do so…even if they have to work in 7/11 illegally.
I would rather go home to my own country and get a decent job there and try again for an H1B to the US to maybe apply to another country.
There is no pride in lowering your standards and working at a 7/11 illegally especially after earning a college degree.
He talked like a real man. I dont know why people are too scared to go home and try again next year if you have no options left. Thousands of students who studied outside USA are applying h1b visa and also succeded in it( i myself did masters in one of top university in Ireland but i have to wait 1 year in India before coming to USA). it wont hurt if you stay with your family at home country for one year. dont start all those stories of Loan, car, apt, books etc.. you should be in position to support yourself or should have some backup plan for loans.

The 15-day period for premium processing refers to 15 calendar days, not business days.

You are right. It would be humane if they just let us know the results, we can plan much ahead of time, taking up jobs elesewhere. In my case I got a job offer in the 3rd week of April the joining date being May 19th, and I do not even know what I should do as the company is not at all, ready to move the joining date further. And here my current Employer is asking me to hold on till 30th of May.

I’m simply amazed by the number of people claiming they have a God-give right to get the H1b just because they have a masters degree from a US college.
The fact is – you’re not better than people filing multiple applications, and most of you just abuse the system (eg. OPT) the same way they do. When you interviewed for you F1, you explicitly said you would go back to your country once you finish the studies. Also, no one forced you to invest in anything, like buying a car, it’s your own fault you did that on non-working/non-immigrant visa.
You are one of those people who filled multipule application and you just want to justify your act

Well . I am sure even all our coveted Advance Degree friends applied to multiple colleges when they wanted to come to US to study. So what’s wrong even if anyone applies for multiple H1s through multiple consultants…..It’s well within the rules of the game. Why lament about it ! And USCIS gives you extra privilege to be in first 20k lot and then in another 65k lot. What more do you need. Everyone wants to come to US and work……irrespective of he/she studied in India or US……and don’t think quality of Indian graduates/post graduates is any less than you people……just studying from a US university does not make you people a genius…..you yourself know that getting admissions in reputed Indian universities is much tougher than getting admissions in second grade US universities !!
Dude Cool it. Empathize but do not lambaste with such ill conceived notions. While true a section of people go after and 2nd grade Universities not all of us are in the same league.
Also reservations prohibit most of us from going to Universities, which we can very well be in in India. So no comparison about the admission procedure of American Tier 1 Universities can be done.
Universities like Stanford, Duke, Cal Tech, Georgia Tech are not 2nd rung and there is a sizable chunk of us who hail from it. And to get into these Universities is no laughing matter as you are competing Internationally.
Sometimes silence is Golden and when people vent their anger it is best to be silent, rather than be Gung ho about it. I am sure All he/she meant was ends do not justify means. All the best to you.

I think you are being a little unfair in your comments here. Nobody is asking for a God Given Right here. They are just lamenting their fate.
Also F1 Visa Interview if at all you have attended one, never a Visa Officer asks a pledge whether you will go back, etc.
Based on random cases the way an applicant conducts himself/herself during a VISA interview, does only a Visa Officer pose such a question.
Similarly H1 is a non-immigrant Visa too…. 🙂

I mean after deriding common Indian IT/Tech folks attempt to garner a US work visa; after venting the anger of your hard luck on to your fellow country men who also have the american dream in their eyes; now even to talk/reply in this forum.. you need their credentials?? I have been a silent observer of this forum for quite some time and to an extent i understand the frustration of the Masters folks who didn’t make the lottery. But their conduct in this forum has been extremely offensive. If this is what the coveted US education has given you, a right to demean others, then perhaps you really don’t deserve anything better. Personally i feel applying multiple H1 visa is not ethically correct. Not only because it affect the Masters folks chances but because everyone and I mean everyone deserves a fair chance in the lottery. As for masters folks, I think the extra 20,000 cap, the OPT option are more than the cushion you deserve. I am a telecom professional and lead the RF-Opti team working for a US operator. I have a guy in my team from Virginia tech who has returned to India after a year’s stint in US. And another guy a pass-out from god-knows-which engg college but with 5 yrs of experience. The guy with 5 yrs experience can run circles around this Virginia Tech guy in his sleep. My point is.. a fancy University education doesn’t give you – “Skills” and if Skills and experience are stacked together, you might find yourself wanting in many regard when put out there in the real world with your US degree stuck to your sides. So stop demeaning others, if that fancy education didn’t give you compassion, patience and tenacity to make the best of what you can, it is unlikely that it will bring you any luck either.

For ADs who are not selected/still waiting, if you guys think your situation is very critical and you do not have options to legally continue in US then think about people who are well settled with their family and when them come to India for visa renewal they put on hold by giving a 221G. I have seen few cases whose visa renewal is not done and few are waiting for more than a year to clear the 221g process.
Thank god you guys at least have chance to sell the things before you packup.

What problem have you against US Grad Students from India? Generalizing your comment against all Grad. Students from India, just reflects your inferiority complex.

IMHO:
– Some of those who applied under AD category may feel that they deserve more quota when compared to others, because they have spent time and money, besides getting a M.S./Ph.D. degree from the United States.
– Some of those who applied under non-AD category may feel that they deserve more quota than AD because they have more skills/experience.
– Some of those who applied under non-AD category may feel that they deserve more quota when compared to other non-AD with less skills/education/experience.
– Some of those who applied under non-AD category may feel that they deserve more quota when compared to others with non-AD or AD with more skills/education/experience (to improve their profile).
– The USCIS decided to allocate H1B visas purely based on randomness instead of selecting people based on certain criteria.
– However, the USCIS also has some other visas and GC (EB1) options where they select people based on certain criteria.
– The USCIS allows a person to file for two or more H1B petitions from different employers (not same organization knowingly applying using different names or using other fraudulent tactics). Hence, there is no point in showing dissent against a guy who has filed more than one legal H1B petition.
– In case of H1B visa, the system is not robust enough to identify all fraudulent activities. Hopefully, it will improve soon.
– Even though, F1 visa is considered as an non-immigrant visa without dual intent, the USCIS still gives OPT, STEM extension, advanced MS quota and so on. Hence, it appears that they seem to give dual intent.
I am also waiting under AD/PP/VT. The last few days (45 days) have been the most difficult time in my entire life time. I feel the same pain as others who are waiting for the receipt. Every day, I wake up with hope and finish the day with disappointment. Thankfully, I have a small toddler at home who will rejuvenate me, when I go home after work. I applied for H1B, since it is the easiest visa to get as long as you have a degree, skills and an employment offer. The downside for being so easy is the “luck” factor to get selected through lottery. “Timing” is also another factor. Those who applied for H1B during 2009, 2010, 2011, etc. did not have to go through a lottery.
I came here with 100 pounds of stuff in two suitcases. I came here immediately after my Bachelors. I did my Masters and Ph.D. As mentioned earlier, I have a small toddler. I built my life here by working in non-profit R&D org. Due to Government budget cuts, I need to leave this non-profit org. I applied for H1B in Apr 2014 through a private company. Now it appears that I may not get a H1B.
Now my options are to apply for other visa (not as easy as H1B as mentioned earlier) or GC or find another job in another non-profit org. I feel that my “luck” and “timing” ditched me now (H1B visa). Hence, I have to look for options that will evaluate me without the “luck” and “timing” factor. I am ready to face it and I am preparing for it for the past few days.
If nothing works out, I will have to sell all my stuff and go back to my home country with 100 pounds. The plus points would be: (a) I got two free degrees, since I got full scholarship (b) Gained great experience (c) My toddler is a US citizen. He/She can choose citizenship when he/she is 18 years old. He/she don’t have to suffer and he/she can come here later for studies or work, if needed without any hassle.

I just had 3 points to make –
1. Everyone deserves a fair chance AD/Non-AD Indians/Pakis/Somalian/Whatever.
2. While a Masters from US is a solid credential, it does not necessarily means you are automatically more worthy. Experience and skills count for a lot, So be humble.
3. Be respectful of others and don’t blame others for your own hard luck. Yes multiple H1 applications for one person seems unfair but one should have the patience and tenacity to overcome such odds.

I do understand this H1B visa lottery is a big mess for AD and well as non AD guys . But if you are that smart like the way you act , why dont you look for other visa options . You can try for O1 visa ( extrodinary alien ) or even apply for a EB1A green card . Both of these does not require an employer and can be easily obtained provided you got a world class stuff . Otherwise , you are just another over educated guy . Life is not fair and lets face it . Grow up !!!
If you have followed my posts, you will have noticed that I have never said anything against honest people looking for honest work. Although I am unhappy at the system being abused the way it clearly is. I was simply replying to trolls who are harassing people for no reason.
Also, I’m well aware of EB-2 and NIW options; but it’s very unusual to apply for those from a nonimmigrant visa. The lawyers I have talked to say it’s technically possible but highly inadvisable.

I am pretty aware of the abuses happening with H1B and L1 visas . Also there is a huge % of abuse happening with EB1 C green card especially with Indian outsourcing companies and personally i know 3-4 guys who have got their green card in less than 6 months . But the bottom line is the US system is not gonna change just like that , as long as there is a long Mexico border and around 11 million illegals . Sometimes i believe America has the most outdated public policy making system in the developed world .So we need to think out of the box and try other options . Look for cap exempt H1b with some research university . All the best of luck for your future !!!
Those idiot scientists with “fancy” educations do not need to rely on H1-B to push their lives ahead. H1-B program is for regular people, getting a so called advanced degree does not make you special candidate atleast in the eyes of USCIS. People have a hard time understanding that getting a PhD/ Masters is not going to make then any different that others . They like others are also going to work for some employer 8 hrs a day , 5 days a week to make ends meet. You got a “advanced” degree, may be your hourly rate will be a little better but that too in very few circumstances. And so if you think your “advanced” degree will some day get you patents/nobel prize/ownership of multi-billion dollar corporation then do something better than getting into this H1B mess or else shut it up.

Here is the information obtained from Immigrationgirl. I don’t think she will reveal sample size.
– The numbers seems right for the AD category. My attorney said that it was about 90% success last year and he predicted about 80% this year. I too believed that it would be about 80% success for AD (FY2015).
– We all know that the success rate for non-AD would be about 40%.
– I think those who applied directly through company/company attorney would have received receipts by this time. There is no hope now. We just need to wait for returned package (just like hitting a final nail in the coffin)
– Those who applied through MNC could wait for few more days. I heard that MNC’s generally delay communicating the information to the employees.
BTW: I am assuming that the number of AD applications were 25,000-35,000. Hence, 20% unluckiest means 5000-7000. I am one of those unluckiest ones (5000-7000) who applied under AD/PP/VT category and haven’t received a receipt yet. Philosophically speaking, to be really unlucky, one is sufficient to be kicked out. Here we are talking about 5000-7000. Right now, I am actively working on Plan B (other visa), C (other job) and D (going home).

****Update 5/13/14, here is where we stand today: no new receipts, no rejections. The percentage of our selected cases are as follows:
Vermont, Premium, Masters cap: 80% of cases were selected
California, Premium, Masters cap: 86% of cases were selected
Vermont, Regular, Masters cap: 75% of cases were selected
California, Regular, Masters cap: 75% of cases were selected
Vermont, Premium, Bachelors cap: 38% of cases were selected
California, Premium, Bachelors cap: 33% of cases were selected
Vermont, Regular, Bachelors cap: 48% of cases were selected
California, Regular, Bachelors: 33% of cases were selected
The discrepancy between Premium and Regular receipts for masters cap cases may indicate that more regular processing receipts could be on the way. Fingers crossed!

For the AD/PP petitions, if the sample size is even just 20 cases, then the estimate should have an error of just around 5% either way. So it seems like the situation for AD was pretty good this year — and people like me who seem to have not won the lottery were simply unlucky to be in the bottom 15-20% 🙁
One more question: I assume these numbers were collected by a law firm that was keeping track of every application they filed?
If these data are self-reported, then I would expect them to be biased, since I think no one yet knows for sure that he/she has been rejected.

I joined a Product Company, start-up which makes Mobile Apps.
This year they applied for H1 for just me alone, after evaluating me for the last 18 months on OPT.
Going by Royal Enfield’s observations, is it true, that Only Large Corporations get a monopoly over H1 slots?
Cause this piece of news is very disturbing.
I am a little worried and enrolling again at a University is out of Question.

It’s a fact that a developer in a 5 people start up has the same chance in the lottery as a developer in a 150k people company, provided they both are from the same category and had a single petition in the lot.
Now if you compare tow companies, the equation changes. They moth have the same percentage probability for the number of petitions they file, but obviously if BigCo files 2000 petitions and UpComingCo filed 5 petitions, BigCo will end up with more successful petitions than UpComingCo.
You did the best thing you could, you were in AD category with max chances of getting an approval. If it is a small company, you could even try working remotely from your country of residence (I know more start-ups are okay with it if they like the candidate), or you could try Europe (e.g. Germany/Berlin start-up scene is pretty good).
@ Scientist: I got the numbers from a website called immigrationgirl. You can google it and find the link. She is not my attorney. I filed through a different firm. I came to know about her recently.
Today, I asked about the sample size in the comments section. She replied back as follows: “we filed close to 600 H-1B petitions on April 1st so I think our sample size is big enough to give us some accurate data.”
Feels sad to be a part of 5000-7000 in a pool of 25,000-35,000. As mentioned earlier, to be really unlucky, one is sufficient to be kicked out. Here we are talking about 5000-7000.
Nothing can be done now. We just need to move on and find alternate paths to success. It is easy to say but tough to practice.

I think this page provides a great argument for people who are campaigning against the H-1B program in general. These activists claim that the H-1B program in large part imports people who are far from being the “best and brightest.”
I have disagreed with this idea, obviously; but now that I’m suddenly interacting with the general H-1B population, I think the activists have a point.

Nonsensical comments like yours make me A) laugh, B) shake my head at the notion that you and I that we’re in the same visa pool, and C) above all, feel sorry for you; if you GENUINELY think that the randomization advertised by the USCIS is not how they conduct the lottery, then you need to get treatment for paranoia.
And you’re not the only one who has this attitude. So many people are posting questions like: “How do I know my employer really filed the application?” Well, if you can’t even trust your employer with that, then you should not work for him/her at all!!!!

I am an account manager for such a company and almost 1000 people in either H1B or L1B/L1A report to me (to be precise 1073)
So, its natural to have sources.
This year for my account, 47 petitions were filed, and 46 already went thru.
So the probability of hitting the jackpot (if any) is almost 1.
I follow this blog and some other blogs time to time, to check the pulse of H1B market (part of my job).
My intent was to more of creating awareness among people on how we tend to bend the rules and now have started getting answers, than creating a big debate.
Not only me, but a few of my coworkers think that our basic approach towards H1B Visa program (or for that matter L1B or L1A to an extent) is not very honest.
There’s no harm to file multiple applications thru different employers, but in the process I’ve seen many people taking dark routes, like paying the consultants, generating fake client letters, creating a$$ SOW.

Also, you seem to not have a great grip of the 1,000 people you claim to be managing (right, 1000, yet you can still find time to troll online…). If your company really did file 40+ petitions, and all of them were subject to the cap, then there is no way in hell that 46/47 would go through.
You, and countless others like you apparently don’t know simple math. Let’s be generous and say that each petition has a chance of success of 86%. Of course, this number is insanely high, but let’s grant that. Even under this ridiculous assumption, the chances of you getting 46/47 approvals is 0.7%. In fact, using these statistics, companies can easily sue the government for the lottery not being the same as advertised…..note that people get convicted of major crimes with much better odds.
So yeah. Learn some math. And logic. And English.

I have a question, if anyone applied 2 hib pititions from 2 different companies is it possible that both get selected, if so whats next.
Note: I only applied 1, I know people are very worried about there H1’s same as me.
Basically the employee gets to choose which one he/she wants to join. The other petition goes waste.
does it really goes waste or USCIS pick people like me who is waiting.

Technically its the employer’s petition so remains valid and open. The employee can always go back to the employer and join them. But only the particular person can work and the petition is not transferred to another employer or another person.
This is really unfair for all of us who are waiting.
There will be couple of thousands H1’s which are duplicate (applying more than 1)
There will couple of thousands whos visa gets rejected at consulate.
There will some who don’t show up to this country.
There will be some who are sent back at port of entry.
Hope USCIS does the lottery again after these all and pick among us.

I think it will remain open until company “A” informs the USCIS, right ? Is there any time limit ? May be this vacant slot will be added to next year’s quota ? Unfortunately, it will not help us who are waiting for a receipt. Can some clarify this ??
AFAIK once a petition is cap counted ,it can be used anytime in the next 6 Years. I dont think USCIS releases revoked/unused H1s back to the pool.
To all those who didn’t get selected in lottery – have patience and stop whining.Only because you did MS/MBA from US universities doesn’t make you top notch candidate! You knew that you will have to go through lottery for getting H1,you knew that getting selected in lottery is luck, you knew that there will be hundreds of petitions filed…yet you blame the USCIS system! If you are whining, then you shouldn’t have filed a petition in the first place.Secondly, there are many MNC’s in other countries as well! If H1 doesn’t happen for you, then why not try in other countries? What’s the obsession with US? I understand that you have put in lots of money and hard work, but there are many like you in the same boat! So stop whining and start looking for options everywhere!As far as multiple petitions for same candidate from different employer is concerned , then it is legal as per USCIS.In case you want to raise your voice against it, then do it with the local senator/attorney etc.Once you have done it then encourage others to do it as well.But for God’s sake stop criticizing the system and accept your fate and atart planning for future ahead.Channelize your energy towards positive things.

AD/PP/VT..well smarta$$ the problem we are facing is leaving our entire life that we built over time through a lot of hard work and dedication. A lot of us have a lot of money invested here in cars, houses, loans etc. don’t try to tell me its fair because it aint. Some of us plan to go back but with a little planning and not like this. You’d never understand what its like to see all your hard work go in vain due to this random lottery.
Hard work will never go in Vain. Try for H1b while you are in USA, if not then go back home and try next year from your country. you may miss one or two year at the max. when you went for your student visa stamping visa dont forget that you convinced visa officer that you will come back after masters. as i said all this happening becuase people abusing both OPT and H1b. Just dont blame desi consultants and others.
Krishna, I guess you do have a point that, people do abuse the system of OPT as well. As, multiple applications just does not take place in general quota of 65,000 but in the AD quota of 20,000 as well. This I am saying from my experience, as I am working full time with a Retail Company, and the contractors working with us have indeed done the same.
Anyways the angst expressed by many AD applicants here is justified as they also are looking forward to building a career in their chosen fields of study. They have stayed away from their family, most have decided to switch careers and pursue their dream.
Let us be honest, India is not exactly a place where one can switch careers from (say) Computer Engineering and switch to a Career in Biomedical Engineering. They look for experience, nepotism etc.
So a person say, who has decided to a pursue a career in Energy Management, with just 24 months of experience will not exactly looked as a viable candidate, say in a Company such as Suzlon, India. Also the compensation is no way commensurate with the rising inflation. The system of Lottery while in general quota is justified but not in the AD quota.
I think weeding of the applications is necessary before, a lottery is conducted. Also any spillover of applications beyond AD quota should be accommodated in 65,000. The residual slots, left in 65,000 should then be open for lottery. Many Big IT companies just apply for H1B VISAs in anticipation of Projects, and not an ongoing project as such.
Anyways, this are just my thoughts and are no way meant to alarm or foment ill will towards others.

anyway, we can do anything at this point no matter what we discuss and who we blame. just hang tight till next year as new H4 EAD rule will be live and it will take out very big number from total application next year. Also in other way it is bad to us mainly IT peopla as i read some where that 100,000 h4 are ready to qualify for this rule. so Just imagine how much competition we will have next year even if half of them decide to take the jobs. But it is good for them as we cant explain the pain for some H4 candiates who are just sitting at home and watching for thier spouses allday without any work to do for years.
Does companies in India know anything other than IT? There are some fields for which there are no opportunities in India. How many google and microsoft have come up from India? Look at the R&D spending of these abusive IT companies. All they want is make money by renting bodies. there are people who are working in such fields that they cannot go back. You will never understand until you are in that situation.

OK, people did lie and many of them do during interview. But they are contributing with hard work. People make decisions and they do change over time. People like you not only lie but abuse the system to such an extent that genuine people also suffer (including people who did not come on F1).

You came here in the US to study on F1 visa, which is *not* a work visa. What part of that you don’t understand? You’re not entitled to getting a job here, so stop whining. You were well aware of this scenarios when you came here, and no-one forced you to invest anything here when you’re not a permanent resident.

Yes, we knew that, we are trying to say it is not right. Do you think getting a visa in other countries is like a cup cake? we spent money and hard work and do you want us to start everything from scratch? Of course, we will move on, but try to understand others efforts too.

The people you may work with may not be “top-notch” candidates, but the ones I work with, are, by any measure. These are people with doctorates from literally the best institutions in the world, and unlike the majority of H-1B applicants, have expertise that is genuinely hard to find elsewhere.
The stated goal of the H-1B visa program is to enable high-skilled individuals to work in jobs that there are not Americans available for. However, this has been turned into a mockery, almost single-handedly by Indian outsourcing companies.
I have no problems with honest people looking for honest work, regardless of their qualifications. But the possibility of having to abort a career for which I have invested more than a decade of hard work, SIMPLY because of Indian body-shops abusing the system, is infuriating. So, again, sorry if my “whining” annoys you.
The widespread abuse in the H-1B program affects not only new applicants, but also foreign workers in general. People who aren’t as skilled as their H-1B petitions would have you believe contribute to this impression that all foreign workers are gaming the system and stealing American jobs. This creates a stigma from which we all suffer.

LOL, one must laugh on your post. If you’re so good and have “expertise that is genuinely hard to find elsewhere”, they you wouldn’t need a H1b visa in the first place, you would qualify for a GC directly, under E-1 category. But you don’t’, and you have too high opinion about yourself.

People you work with are NOT top notch candidates. I love how you assume things here. Getting a PhD degree doesn’t make someone a top notch candidate.
On the other hand, I agree with your point about the outsourcing companies and how they are abusing the system.
System sucks. Period. Government should fix it. Bodyshoppers will always look for a loophole given the system has it. The system should be fixed so these consultants can sit home or have a proper employment relationship and compete on common grounds

USCIS calls it a random selection process, but they never disclose the selection algorithm set.
There might be many factors which USCIS takes into consideration for selecting an application.
They have concept of Business Partners.
USCIS is no fool to hand over H1 to any tom d**k harry thru any xyz desi consultancy.
I’ve atleast 2 frenz who applied thru 5 to 6 consultants and 1 filling each done by a reputed firm.
Only the application thru the reputed firm got chosen and all 5 to 6 packets were sent back.
Its we who have abused the system so much that now we are getting it back.
From what I’ve seen, the system is pretty robust.

Think about a scenario where big companies like CTS, TCS, IBM, INFY etc. where the rejection rate is as low as 5 to 10% and for the small as$$ consultancies its as high as 50 to 60%
Facebook this year filed about 400 odd applications with 0% rejection….wow what a awful lottery then, if probability of winning lottery is 1?
Its we who have abused the system, that we now have reached that break even point when the system has started hurting us.
Its we who want to go to USA and lead a better life there, so we need to obey by their law of the land.
I am sorry if I’ve hurt anyone’s sentiments, but this comes from mouth of a person who has 8 different work permit visas stamped for different countries on his passport over the last decade, and never had to take an interview more than 5 mins. (including L1A during top recession in 2008, when rejection rate was close to 75%).
For someone who worked in 6 different countries your comment is very incompetent.
You have no idea what you are talking about because you are confusing rejection rate with the chance of not being picked in the lottery.
The rejection rate refers to an application being rejected AFTER it has already been picked in the lottery. This of course isn’t random. Bigger companies have higher chances of approval.
But before you can even make it to that stage your application needs to be picked for review first. And that’s where the random process kicks in. You need the receipt notice before anybody will ever look at your application.
That said, I know numerous cases from folks who work in Facebook who did not get picked in the lottery.
Once they make it, they get approved of course. After all, they have legit jobs and good attorneys.

@slayer and the rest trying to poke the bear…it is easy to point fingers saying people are whining and you may in fact succeed showing off that you are mentally capable of handling anything life throws at you. Well yes for now because you might be in a very safe position right now whwne compared to others but I am sure that when it comes down to you who sqeals and whines more than us. And did I hear you saying obsession with the US? and also about other countries where you can land a job easily? If that is the case why don’t you come up with a suggestion to all of us of just two countries which are economically sound and you can land your dream job very easily. If you can name just two foreign countries we will not discuss anymore and agree with what you have to say..no more!
And in case you fail to do so we dont want to hear anything more from you and conclude you might be a big squealer than the rest of us. We are not obsessed with the US and we have given a thought about other options too, there is no country which is economically sound to welcome a US grad with a red carpet and give a job and good pay. I know it will also be easy for you to point out what about your home country, patriotism and what not…some of us here are not in the IT field and imagine having to go back and work in IT and get trained in some random progamming language and only to find out that you will be placed in a different domain. Try to come with explanations before jumping the gun and drawing swords.

I have tried the FSW program from Canada and yes it is point based and also yes the points is calculated based on how many years you have stayed in the US. Can you please tell us the success rate w.r.t the same?

I am following this blog site for some time now and seems that every now and then someone gets excited how he is more justified to get visa than others and a bunch on Non- Advance degree candidates start to chase his tail. This is stupid on side of both parties. This is beyond question that stakes are higher for people who are already in USA( they spend money, have a house or Car) but you can’t vent it on others. Similarly, guys who are not in USA, can not relate to situation of those in USA. Once you wear the shoes, only then you will know where it bites.
So, please stop being vicious and post only what is relevant to the forum
Cannot agree with you more. It was always frustration vented against the 1.system 2.people cheating the system some of them who comment here on both sides simply don’t get it.
They comment some nonsnese and abscond…there was one yesterday (holding on to not bring names to the table as it is in the past now) and one today. Have some sense, think about what you are typing before posting. After those comments were up we have asked for a response on what the intentions were and clearly we have not recieved any respose yet. Anyone who had a clear intention and a legitimate explanation would have bothered to respond without irking others.
I Know last year wives applied for h1 visa via COS and got selected in lottery Till now they are not working . I have seen who had jobs but not selected lottery. I feel system works that way you like or not .we should prepared of result whether selected or not. We should never think i am out of box and brilliant. Frankly speaking if you are brilliant you can sustain any where in the world.Might be for short term you might face huddle. For a company like APPLE without Steve jobs they are moving forward we are nothing. Like h4 to ead MS candidate might have asked for changes last year or early As they burnt finger they started asking now. During MS you might have fought taking help of all MS studying students but now as you left in this position you will show all your frustration. Brilliance to me especially in IT sector is one who developed/conceptualized some thing new in his area
Due to the consultancies and multiple filing by d**k outsourcing companies we are suffering who spent more money to study here and boost US economy. First of all there should not be any lottery for AD people. Second i dont trust these attorney’s
If we can write gre/toefl and apply universities by ourselves why we need some third party attorney to do the filing.
f1 visa applied in India in 2012 is 24k and in 2013 is 37k(these are only from India and think about other countries). so you can see how much increase in demand in 1 year in your own field. dont think USICS will come you all every year at the entrance of airport. you have to accept the facts and it all happening because of demand and no one to blame. Mutliple filings will be in very less numbers.
How do you know how many account for duplicate filing?!
Most of these visas go to IT consulting body shoppers. Those guys usually file through multiple employers. I wouldn’t be surprised to see one out of three guys doing that.
When you applied for F1 you said you will go back to your country once you finish your studies, so USCIS is already doing you a favor by having a separate quota for you. Stop whining, you’re no better than any other people waiting for their receipt, including all those Desi consultants applying through 5 consultancies.

I agree it should be a merit based system. But how will USCIS decide merit? Its impossible for US govt/system to compare different individuals with different capabilities. Currently, lottery seems to be the correct system according to me.
However, I agree that if an individual applies via multiple firms, he should be punished by putting him in blacklist(for future denial) and the information should be sent to all those companies via which he applied so that such companies can take appropriate action against such individuals.

Sure there is a way to introduce objective criteria. Other countries use those point based systems as well. You need to find objective criteria you can use to determine, which individual benefits the US economy most. If a US company wants to hire someone, it should be prioritized. It can’t be that most of the visas go to NON-US companies.
That’s an easy fix. After that we can worry about other criteria.
The bodyshoppers as many people call these companies, are also working for a company in US. And possibly improving the US economy.
And the objective criteria you are talking about can further lead to debate that the criteria itself is biased. A person not selected in such criteria is bound to say so.
Also, AD applicants are already having a separate quota of 20000 visas. People should also be blaming the substantial increase in the AD based H1B applications.

You deserve the visa. Tell all these mess to them. They can ask USCIS to change the rule.

I’m AD/PP/Vermont, still waiting for receipt. I have a Ph.D. from an ivy league university, have been here for a decade.
I won’t try to get into the heated debate here, but I strongly feel the following needs to be said:
– First, there are quite a few people who are openly admitting to having multiple employers file H-1Bs from them. In fact, on some forums, people genuinely thought it odd that I was disgusted at those who accept more than one offer of employment.
– Second, yes, there are many bad actors involved in this yearly game, but the onus is on the government to make sure the system does what it is supposed to do: bring in needed talent, and protect the American worker. Of course, with more than 50% of visas going to Indian outsourcing companies, these two goals are jokes.
– Third, it amazes me that so many H-1B holders and aspirants cannot compute basic probabilities on the odds of making it through the lottery!!!
