What’s After H1B 2015 Lottery ? FAQs – Receipt Numbers, Processing Times?

As you know, USCIS conducted a lottery on the 172,500 H1B Visa petitions filed for FY 2015 quota and did a press release indicating that the 85,000 petitions selected will be notified with receipt numbers and those not selected will be rejected and returned. I have seen many of our readers asking questions on variety of topics like below.

What are the Next Steps after H1B Lottery by USCIS ?  

  • USCIS notifies selected Premium Processing  applicants about their receipt numbers
  • USCIS then notifies all selected non-premium/regular  processing  candidates about their receipt numbers through postal mail
  • USCIS completes all premium processing applications adjudication by May 12 (15 calendar days from Apr 28)
  • USCIS continues to process non-premium processing cases once their premium processing applications load is down
  • USCIS starts sending out rejection letters to non-selected candidates

Some of these steps may happen in parallel, while some may happen sequential. Also, the timelines are based upon historical data and it is not possible to predict actual dates for this year.  For general info, you may also read  USCIS Processing time for Regular vs Premium

Who will get the case number ? Employee or Employer ?   Do I get an email ? Will I get a hard copy ?

Usually  the employer/ immigration attorney, who filed the H1B petition would receive the receipt number.  The employee will NOT get any email or hard copy of the receipt number from USCIS.  For selected premium processing petitions, an email with receipt number will be sent to the attorney and then followed by a hard copy in mail. For selected regular processing petitions, a hard copy of the receipt notice with receipt number is sent via standard mail.  Either case, nothing will be sent to the employee, it will always be sent to the employer/ immigration attorney.  Read about What USCIS H1B Case number means

Who will get the rejected application, not selected in lottery ? Employer or Employee ?

The employer/immigration attorney will get the rejected application that was not picked in the random computer generation process/lottery.  It should include the fee you sent as well, unless it was a duplicate filing by the employer for the same employee.

Did anyone receive H1B receipt Numbers for Premium processing ?

Yes, some of our readers have indicated that they received Premium processing case receipt numbers on Friday, April 11th, 2014.  Check the sample USCIS H1B 2015 email receipt.  There is no guarantee that everyone, who filed under premium processing, should receive the case numbers right away this week or in the next week. They may start to receive the case numbers anytime from now, nothing to panic that someone got it and you did not.

USCIS said April 28th  is when they will start the premium processing, How come some are receiving the case numbers and emails  ?

Here is the exact USCIS statement  “While the Form I-797 receipt notice indicates the date USCIS received the premium processing fee, the 15-day processing period set by 8 CFR 103.7(e)(2) will begin no  later than April 28, 2014. “.  If you read carefully, it says ‘NO LATER THAN April 28th “, which means that they will start the 15 day clock for premium processing by April 28th, does not mean they will start on April 28th.  So, technically USCIS can start the processing and send out receipt numbers for Premium processing any time before that as well. In fact, they have already since Friday April 11th.

When will I receive the H1B visa 2015 Case number, if I am selected ?  Regular vs Premium ?  

The premium processing cases selected, ideally should get receipt numbers by April 28th and a decision (approval or RFE) by May 12th ( April 28th + 15 calendar days)  as they are bound by 15 calendar day time limit.  For regular processing, ideally, you would receive the receipt numbers a little later. Last year, we have seen receipt numbers sent until late June. This year, we can expect it to be around the same or maybe a little late like early July, as the USCIS load has increased slightly ( Denying and returning more petitions )

How many Master’s degree petitions were received  ? What were my odds in lottery ?

Unfortunately, USCIS has not officially released any petition numbers received for the master’s degree quota. They have not release it last year too. If someone says a number, it is pure speculation. To calculate your odds in lottery, just use the 172,500. It may not be accurate, but gives you some baseline to know your worst case probability.

Does USCIS select more petitions than 85,000 as backup for denials ?

[Updated on April 21st, 2014 ]  USCIS did not release any official information for FY 2015 saying that they selected or wait-listed more petitions than 85,000 as backup to account for denials. Previously, in 2008 USCIS mentioned in their press release that they have  “wait-listed” some petitions to replace the denials, withdrawal petitions, etc.  But, for this FY 2015 quota, we don’t know.  If USCIS were to follow the same process like in 2008, they would have some “wait-listed petitions” put aside in FY 2015 as well. We just have to wait and see or hear from our users. No official information from USCIS on this.  

How do I know, if my employer really filed my case ?

Well, you have to trust your employer and get the information from him that your petition is filed. Usually, employers are upfront and keep you posted about this and send you the emails/hard copy scans from USCIS. You need to find this from your employer.

Can I know the details of my case from USCIS ? What are my choices ?

Well, this is a roundabout way. USCIS has Freedom of Information act , which can be used to get information regarding you file/case. This could take few months( 6 months ) as there are many requests.  But, there is no guarantee here as it is at the discretion of USCIS. Technically, the H1B petition filed is the employer property and you may not have full rights until you start to work for them legally on H1B. We have heard that some cases information was not disclosed. Again, it depends. Talk to an attorney for more clarification.

Can I upgrade my case to Premium processing without receipt number?

You need the USCIS H1B receipt number to upgrade your case to premium processing. Unfortunately, there is nothing you can do, you need to wait for the case number.

I have not slept properly in couple of days, when will I receive my receipt number?

We understand that it can be very stressful period waiting for the petition receipt number and then for processing of the application.  Many of us have been in similar shoes and can empathize your pain. Unfortunately, there is nothing we all can do as it is not in our hands.  Please try to stay calm, focus your personal time on something that you enjoy or with your spouse/kids/friends.   2. I am Non-AD/RP/VT – still waiting. If I dont hear anything from my attorney by this week, are my chances gone?

    • yes. USCIS has started processing Non-AD/RP applications from last friday.
      No one has received receipts but checks are deposited.
      So if ur check is not deposited by end of this week then very low chances that you made it through lottery.

        • In case of regular processing, receipts are sent via standard mail not email.
          Fastest way to know is check otherwise painful wait for 2 weeks to receive physical copy of receipt or return package. All the best. I am also in the same boat… waiting…

    My application for COS from L1 to H1 was approved yesterday (notice date from Vermont center being 04/15) . But I know how anxious I was till I got my notice. So could definitely understand what you are going through…if not feel it actually.

    Its sad to see so many talented individuals suffering just because of ‘broken’ immigration system. I for one feel that USCIS should introduce a screening stage before H1B ‘lottery’ to screen all the fake applications. In this way only deserved candidates will benefit from the ‘lottery’.

    Today got confirmation mail from WIPRO GIMS that my H1B application got selected in H1B lottery, haven’t received the receipt number yet.

        I checked with one of my friend in GIMS, he informed me that till now WIPRO received receipt information of only 2200 people still they don’t received receipt information of more than 6500 more employes, it is not over yet.

        • oh so they intimated all 2200 today only ? and rest might be rejected as the uscis told that it has done data entry ..

          • Data Entry is completed by USCIS but for regular processing cases USCIS intimate employers by normal post, this year WIPRO policy is very good as an when they receive the post mail of specific employe they inform the employe. Wipro received 2200 post mails till now so they trigger bulk mail to all 2200 people at 4:22 PM IST.

            For remaining 6500 people even WIPRO don’t have any information until they receive receipt post mail or rejection package.

            Rejection packages will reach late by end of may.

          • Hi JK/Fresher – Can you please me know the current status displayed in IMS? For few,it got changed from ‘Filed with Authorities” to ”Filed with Authorities (LCA Status – Valid Utilized)” . Not sure it’s on a positive note.

  7. i got my receipt no from my employer today, does it mean that am selected in lottery ?
    my no start with EAC***** and i can check the status on USCIS site, its showing in initial review state. What exactly it means ? i still have to wait or i cleared the lottery ?
    Please let me know in case anyone knows the answers.

    • Congrats. That means you got picked up in lottery. Could you please post the first 8 digits of the receipt number so we can know when the receipt notice date was? It should be EAC-14-???- You can share upto 8 digits as it is common to all. Only last five digits are unique to you. Please share the first 8 digits and your receipt notice date. Thanks

          • What I know is GIMS is consolidated all the receipts before sending. Are you sure the GIMS has started sending receipts to employees?

            now i dont know if they will consolidate or not.. but they might be updating in the Immi system to trigger this email.. today he got at 4 pm IST..
            check around your group if someone got… as in that email they wrote like do not inform yr collegue to avoid any service connect and they will inform all in 3-4 weeks rejected / selected all cases

  10. I lost all my hopes after 5th of May.

    But I know I should wait for the return package !!!

    ( though I never expected it back to me)..
    I was positive, but it is hard to be positive when the time is up, we can’t be holding on to the same thing.

    We should move on against the winds.

  12. I am very disappointed with the US government right now. The USCIS system is the most inefficient system on earth. How come a guy from a fake company, with a fake resume, who applied 10 times gets the visa. How come they do not research these fake companies? It is a shame on what they are doing to honest people who are talented. Its a shame… However, they will see the impact on the near future… all the fake applicants will show their colors – and the development will diminish… I am very disappointed with every action from USCIS. Research guys… Research these fake companies and fake resumes…Companies are paying numerous dollars on the visa fees, lawyer fees, and are doing everything just to keep the real talent, therefore, they deserve a fair treatment for all the people. How come a random lottery is able to distinguish who is good and who is bad.

    I am very disappointed with USCIS… I achieved to have the best GPA in my major, got first place in many competitions, did summer research, president of many organizations at my university, got the job before i graduated, and now my dream is getting turned down because of a random lottery how come?

    I am very disappointing…. I and many people do not deserve such treatment.

    • I think we should write a letter together to USCIS and white house to fight for our rights. But nobody agree and will answer the call.
      The fraudulent consulting clients and multiple application must be disqualify for the h11b and give the quota to those honest people with real jobs.

      If USCIS doesn’t address this issue, things will turn worse. Since when if you are honest, and the world let you down and you get punished.

        • complaint will not help. Actions helps. Look at American fighting for their civil rights. Black people, gays fighting for rights. The system was not fair for them, they fought to address the system.

    • Every one understands your anguish. Even US want to retain you.. the best talent; hence you have the additional 20000 H1b just for ADs.

      But don’t get dejected, H1b is not end of the world. You have dozens of countries, Canada for Example who donot have a cap on the Visas. I’m the companies out there will be more than happy to welcome you. Get over it.. you deserve something better.

    April 10th, 2014: Receipt Date
    April 28th, 2014: Notice Date
    April 30th, 2014: Checks Cashed
    May 1st, 2014: Employer notification to me
    May 5th, 2014 (10:45am): USCIS receives PP paperwork and fees
    May 5th, 2014 (7pm): USCIS updates case to: “On May 5, 2014, your Alien Registration Number was changed relating to your I129, PETITION FOR A NONIMMIGRANT WORKER”

    This is my 2nd time through the lottery. Both times were Regular Quota/Regular Processing/Vermont.

    i was on h4 and recently my h1b visa got picked in lottery and approved. So its valid from oct 2014. My husband’s h1b and my h4 will be expiring on sept 30th. I hav 2 queries.
    -Can i travel to india on h4 now and come back before oct ?
    -Also,as my husband’s h1b is expiring,is it fine if he applies only his visa extension now and not mine.
    Do anyone have any idea about my queries .?

  15. Guys i am sooo soo happy that my visa is approved. got my receipt on apr 17 but still 5 mins back uscis website says case not found. But now it says post decision activity ( approved).

    Thanks to god and thanks to each and every one who worked for my visa just a great great relief cant explain it in words 🙂

  19. For some reason, my first attempt to post this went to “awaiting moderation”. I am trying again. Sorry if this is replicated.

    I have a Ph.D. from a top school. I am currently a senior researcher in machine learning/artificial intelligence at a top 1 school in the field. This year, I applied for the first (and possible last) time for an h1b through a top private company. I really liked the offer and I wanted to try working at a non-academic environment. It is very likely now that my case was not selected. I am very disappointed. It reminds me again that hope is the worst strategy! After seven years of hard work in US (with many publications and awards), I may now have to go back to Europe to pursuit other opportunities. I am on academic H1b and cannot stay at a university anymore.
    I also remember seeing a comment from a guy who applied through five consulting companies. I think he said he won 3-4 of them.
    I also found this comment from someone named Srini a few hours ago at another website:
    “Hi guys,
    Bachelor and Regular fee here.
    I apple 10 applications and I got 7 receipt numbers from my consilting lawyers. I sill weight on the other tree. My questions is
    1. Since I will only work one h1b, can I transfer my others to my friends and sell them?
    2. When I can transfer my visa to my other boss? Do I file now or after I get to American.
    3. Do they ask technician questions in the visa interview? I have many job deceptions.
    Thanks guys! God bless! :)”
    Ten applications? And won 7? This is so wrong!!! The system is completely broken! I just cannot express the anger that I feel.
    On the other hand, though, I now also think that “any crisis is an opportunity” and I will get to work at another country with a smarter immigration system (or work in my own country)
    Good luck to all the guys who are still waiting anxiously for their results through honest applications! And try to stay positive regardless of the outcome! Maybe nature has bigger plans for US! Every crisis could be turned into an opportunity, right?!

    • Well, there is nothing we can do about it and I am in the same boat as you, though certainly not as academically endowed as you. Karma is something I believe in and hope that falls through in the days to follow.

      • And to be clear, I am neither blaming nor angry at those poor folks who applied multiple times through consulting companies. It is not their fault. I would probably have done the same if I was in their situation. All they want is a better life and more money to support their families. I am also not blaming the consultancies. They are just being creative and using the opportunity. Again, I can totally understand that as well. We always try to find ways. The only thing I am angry at is the lottery system. A fair system that has been around for a while should not have such obvious exploits. It must be fixed! It is just too bad that we cannot do anything to change it.

        • On top of being so unfair, it also very disorganized and frustrating. Couldn’t the USCIS just enter all the data first and send out receipts for selected cases at once? They don’t have the technology to send mass emails/notifications? 🙂 I am just not seeing any logic in the way it currently works. Or maybe the system works the way it works by some “hidden” design that I don’t seem to comprehend.

          • System is broken for sure, and agree I must. I am an AD Applicant too, and have been awaiting my chances. The feeling is something other than frustration when, all my friends have received his/her receipts, with me waiting the eternal wait… I know for sure, that all is not too well, yet I have still anchored onto something called hope.

          • Future, I have 4 months on my current contract. I will have to leave the US after that. I am currently trying to convince my future employer (the one who applied for h1b) to apply for a green card through EB1 or EB2 as my country’s priority date is current in both categories. If that does not work, I will consider moving to UK or Belgium.

            With the education and skills and work experience in US, we should be able to get quick answer from application.

        • This is the best post. I have seen people blaming on consultancies, Non-AD people, and other factors for their non-selection. But remember guys, its the system that is wrong. Some people and organizations are just making opportunities out of the system’s malpractices, and these peoples are not wrong, but smart people. If you want to raise voice, then it should be against the system and not people.

    • Most of these consultancies are fraud. Putting fake experience and I am sure if you see their resume they would probably be more qualified then your Phd. These mushroom growth Indian consultancies are one way free ticket over here and they have nothing to lose as they will charge some poor Indie for visa applying fees make some money on top of it (that what they even do with Indian students over here on F1).
      I am not an Indian, and I don’t consider all Indians doing wrong but they need to address this image issue there people have developed by putting fake resume, fake payrolls and even fake phone interview done by some one else rather than original candidate.
      With all these I can simply say you and all other including innocent Indians which only applied one application are lucky otherwise these pony consultancies they would easily applied 20 to 30 applications per person.

    • Well, welcome to the real world pal. You focused on getting your PhD while others on grabbing an H1B. You got your degree and they got their Visas. So I guess, their is nothing wrong their. The system works that way and allow those scheme hence we cannot blame them. Hard truth, man. Good luck to all of us.

      • I understand that. But H1b is never an ultimate goal. For most of us who work hard, it is just one of the tools we use to accomplish other goals. And the tool is obviously broken and unfair.

    • dont worry about such comments. you know, people can do anything to grab some attension. i am sure the above is one of them. he didnt write good english how can you expect 10 employers will apply for him. if you people accept it or not there is no one who apply with employer fee even thought its illegal (expect if the person is on h1b already then employer will be willing to transfer with their own expenses). so this guy is just fake and want to have some fun out of all non-selected people frustation.

    Got my receipt on April 23rd and the case wasn’t found on the website until May 02. I happened to check on Sunday, May 03 and whoa!, post decision activity-

    “On May 3, 2014, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice.”

    I couldn’t believe it & another of my friend in AD / REG / CA confirmed that he received an approval too. I saved on the premium cost but the processing time is pretty unusual.

    I am sure there would be lot of receipts which wouldn’t have been sent out or they are getting processed haphazardly. For me, all this H1B experience has been full of surprises.

    Lesson learned – DO NOT wait until all of your OPT is used up. As soon as you get an employer, get yourself into the H1 status. OPT has to be used a fall back option and not THE option.

    • Same thing happened to me . I am Advanced quota/regular Application and My case moved to post decision activity on May 2nd and it is approved.

    • doesn`t really matter if anyone else has…all this means is you have a RFE coming your way …answer it carefully and hopefully you get cleared. Good luck.

    • Do you know what is in your RFE? What are they asking for? I transfered from Non-IT to IT and I have related certifications along with 2 years of experience in IT. Even then I got an RFE.

          • there is no point in asking who is waiting. there will be 175000-65000 = 110000 people who will be waiting.

            Lets just ask who has got the receipt today.

          • First of all the number of people who are waiting are 175000-85000= 90000 Aprox ….and secondly ..it helps knowing you have fellow members on this forum who are still waiting …helps us hang on to some hope…that hopefully some of us might get lucky….

            And lastly it might not be useful info to you …it might be useful for the rest of us..i agree those who got it ….is useful as well infact much more useful…but for some of us this might be useful too.

          • honestly no point going by last years stats…last year USCIS dint even post on twitter that data entry is over ..and this year things are looking like they are moving faster from what i have seen…again we can only hang our hopes by a single thread.

          • One good thing is USCIS is cleaning up its house. My friend who put in 4 applications through 4 different companies all owned by the same owner, though different got rejected. His petition shows denied. Though I should not revel at his misery, I am happy USCIS is at least cleaning up its act.

  24. My employer received a letter on April 24th with a case number. Case shows on “Initial Review” on USCIS website, however attorney firm told me they haven’t received any notification about my case. It has been more than 10 days now. Should I be worry about it?

    • I wouldn’t be concerned. I got my receipt on 14th dated 10th.

      Mine is still under acceptance. No updates to my attorney.

      • I am in the same situation..got my receipt date Apr 10th
        Still shows in acceptance status.
        I checked for the numbers before and after mine and they either in decision or post decision stage since last week..
        I am not sure if I have to be worried. I was told that the receipts are not processed in order..

  25. My notice date is April 11 and as of today I still cannot track my case online.
    AD/PP/Vermont Center (EAC)

    Anyone else like me? Or for those who get approved already, did your case just jump from “case cannot be found” to “approval”?

    • In my case, petition got approved. I could not track for all those days…got approved on May 1st. Also now I can see the same in USCIS site. Hope this helps… Keep calm.

  26. Just Came to know from my employer that my application got selected in lottery.
    Lawyer informed my employer on Friday but as it was weekend, employer informed me today.

    Special Thanks to all of you guys, your comments and updates helped lot.

    Congrats to all selected people and for those who won’t get selected, I can say only one thing which I told to my employer also when they were showing concern as my application was not getting picked up, “Skilled in USA is SKILLED in complete world” . . . . so be strong and move forward, I followed this so I was kind of neutral considering H1B lottery selection.

  28. Is the game over for non ad / PP guys . My employer put for 6 members non of them received yet . Y is it so?I never saw much of non ad PHP getting. Can we wait or is everything over
