What’s After H1B 2015 Lottery ? FAQs – Receipt Numbers, Processing Times?

As you know, USCIS conducted a lottery on the 172,500 H1B Visa petitions filed for FY 2015 quota and did a press release indicating that the 85,000 petitions selected will be notified with receipt numbers and those not selected will be rejected and returned. I have seen many of our readers asking questions on variety of topics like below.

What are the Next Steps after H1B Lottery by USCIS ?  

  • USCIS notifies selected Premium Processing  applicants about their receipt numbers
  • USCIS then notifies all selected non-premium/regular  processing  candidates about their receipt numbers through postal mail
  • USCIS completes all premium processing applications adjudication by May 12 (15 calendar days from Apr 28)
  • USCIS continues to process non-premium processing cases once their premium processing applications load is down
  • USCIS starts sending out rejection letters to non-selected candidates

Some of these steps may happen in parallel, while some may happen sequential. Also, the timelines are based upon historical data and it is not possible to predict actual dates for this year.  For general info, you may also read  USCIS Processing time for Regular vs Premium

Who will get the case number ? Employee or Employer ?   Do I get an email ? Will I get a hard copy ?

Usually  the employer/ immigration attorney, who filed the H1B petition would receive the receipt number.  The employee will NOT get any email or hard copy of the receipt number from USCIS.  For selected premium processing petitions, an email with receipt number will be sent to the attorney and then followed by a hard copy in mail. For selected regular processing petitions, a hard copy of the receipt notice with receipt number is sent via standard mail.  Either case, nothing will be sent to the employee, it will always be sent to the employer/ immigration attorney.  Read about What USCIS H1B Case number means

Who will get the rejected application, not selected in lottery ? Employer or Employee ?

The employer/immigration attorney will get the rejected application that was not picked in the random computer generation process/lottery.  It should include the fee you sent as well, unless it was a duplicate filing by the employer for the same employee.

Did anyone receive H1B receipt Numbers for Premium processing ?

Yes, some of our readers have indicated that they received Premium processing case receipt numbers on Friday, April 11th, 2014.  Check the sample USCIS H1B 2015 email receipt.  There is no guarantee that everyone, who filed under premium processing, should receive the case numbers right away this week or in the next week. They may start to receive the case numbers anytime from now, nothing to panic that someone got it and you did not.

USCIS said April 28th  is when they will start the premium processing, How come some are receiving the case numbers and emails  ?

Here is the exact USCIS statement  “While the Form I-797 receipt notice indicates the date USCIS received the premium processing fee, the 15-day processing period set by 8 CFR 103.7(e)(2) will begin no  later than April 28, 2014. “.  If you read carefully, it says ‘NO LATER THAN April 28th “, which means that they will start the 15 day clock for premium processing by April 28th, does not mean they will start on April 28th.  So, technically USCIS can start the processing and send out receipt numbers for Premium processing any time before that as well. In fact, they have already since Friday April 11th.

When will I receive the H1B visa 2015 Case number, if I am selected ?  Regular vs Premium ?  

The premium processing cases selected, ideally should get receipt numbers by April 28th and a decision (approval or RFE) by May 12th ( April 28th + 15 calendar days)  as they are bound by 15 calendar day time limit.  For regular processing, ideally, you would receive the receipt numbers a little later. Last year, we have seen receipt numbers sent until late June. This year, we can expect it to be around the same or maybe a little late like early July, as the USCIS load has increased slightly ( Denying and returning more petitions )

How many Master’s degree petitions were received  ? What were my odds in lottery ?

Unfortunately, USCIS has not officially released any petition numbers received for the master’s degree quota. They have not release it last year too. If someone says a number, it is pure speculation. To calculate your odds in lottery, just use the 172,500. It may not be accurate, but gives you some baseline to know your worst case probability.

Does USCIS select more petitions than 85,000 as backup for denials ?

[Updated on April 21st, 2014 ]  USCIS did not release any official information for FY 2015 saying that they selected or wait-listed more petitions than 85,000 as backup to account for denials. Previously, in 2008 USCIS mentioned in their press release that they have  “wait-listed” some petitions to replace the denials, withdrawal petitions, etc.  But, for this FY 2015 quota, we don’t know.  If USCIS were to follow the same process like in 2008, they would have some “wait-listed petitions” put aside in FY 2015 as well. We just have to wait and see or hear from our users. No official information from USCIS on this.  

How do I know, if my employer really filed my case ?

Well, you have to trust your employer and get the information from him that your petition is filed. Usually, employers are upfront and keep you posted about this and send you the emails/hard copy scans from USCIS. You need to find this from your employer.

Can I know the details of my case from USCIS ? What are my choices ?

Well, this is a roundabout way. USCIS has Freedom of Information act , which can be used to get information regarding you file/case. This could take few months( 6 months ) as there are many requests.  But, there is no guarantee here as it is at the discretion of USCIS. Technically, the H1B petition filed is the employer property and you may not have full rights until you start to work for them legally on H1B. We have heard that some cases information was not disclosed. Again, it depends. Talk to an attorney for more clarification.

Can I upgrade my case to Premium processing without receipt number?

You need the USCIS H1B receipt number to upgrade your case to premium processing. Unfortunately, there is nothing you can do, you need to wait for the case number.

I have not slept properly in couple of days, when will I receive my receipt number?

We understand that it can be very stressful period waiting for the petition receipt number and then for processing of the application.  Many of us have been in similar shoes and can empathize your pain. Unfortunately, there is nothing we all can do as it is not in our hands.  Please try to stay calm, focus your personal time on something that you enjoy or with your spouse/kids/friends.     • Its not over until the package is sent back. So waiting patiently (without spoiling our personal and professional life) is the only thing we can do now. Good Luck.

    • I have not given up yet. But yes anxious. USCIS should atleast let us know, in advance of the non selection, which helps us plan, the next course of action. I do not want to give up on opportunities in India either.

  5. Ad/PP/XX Still waiting. Sad, Dishearted and Dissappointed. Especially knowing that almost half or more applications were from consultancies/ bodyshops with people no real job to begin with. Oh well, life is unfair at times.

    First of all heartily congrates to whoever received their receipts.
    I am still waiting like watchman. I m RQ/RP Fragomen is attorney My employer is not saying . I dont know what is status of my application . may Fragomen would have received my receipt . is there any way so i can enquire directly at Fragomen .
    Please let me know , i have been already unlucky 2 times ,

        • WAC-14-143-5XXXX. Attorney didn’t inform me. I asked the employer today then they shared me my receipt Number.

    I got receipt today from lawyer. Mine is Non Ad/Reg/CSC. Th receipt no. is
    WAC 14 145 5XXXX

    I had lost all hopes and looking for alternative paths as my attorney didnt receive any receipts on Tuesday and Wednesday. So, pls do hang in there..

    AD/PP/CA service center.

    Good luck everyone. I wasn’t selected last year and I know how it feels, I’ve been there. Trust things will work out for the best, even if you’re not selected this year. The universe has better plans than you. I’ve always thought everything was in my control but after this H1B experience I know some things are not but they work out for the best. Cheers

        I know it doesn’t depend on the petition date /time it took to receive, just looking at good fortune(Optimistic).

        At least by looking some other receipts i am able to control by eagerness/frustration of this waiting.

  21. I had just emailed my lawyer and she said they received only one receipt notice today which was of a premium processing. She further gave me indication that I don’t have much chance as she said late receipts will be a few….Don’t know what to do and how to overcome this situation.

            I sometimes feel I am dreaming about this whole thing. Worked so hard getting Masters, got directly placement from college is one of the Big 4s, and now stuck in a stupid lottery which will decide my career……………. Well what can we all do….maybe god has better plans for us…..

          • I hear you, I am in the same boat. AD/PP/VT my lawyer said that I don’t have any chances now and that I was not selected. I have no plan B, the company I work is just awesome with great boss and colleagues. It is what it is….Only God can help us now, nothing will do can chance it

          • Big 4 in my field are: Deloitte, Pricewaterhousecoopers, Ernst & Young, and KPMG. As they are Professional services mainly Accounting giant and I got hired as an Auditor in Deloitte.

    I`m sick and tired of this wait….how could we all work so hard and then depend upon a random generation to decide our fate………every single minute …refreshing your mailbox…constant praying…constantly planning next moves…..hoping for a miracle ….gosshh…i have never felt so insane….in mylife…never have things gotten so out of control ….I feel bad for each one of us that is in the situation because i understand how hard it is …to be concentrating and giving your best at work but at the same time having this constant lingering feeling …of uncertainty .. may god listen to this rant ….and please have mercy on all of us …please put an end to this misery and please send us the receipts 🙁 🙁 Please PLease Please

          • For me it looks like it’s all over. Ten of my friends applied along with me and all of them already got their receipts. I am the only one left out. I am looking for other options. No hope left anymore.

            4 of my friends – AD/PP/VT- All got receipts, few have their H-1 approved
            6 of my friends – AD/Reg/VT- They all got their receipts by last tuesday,

            Options I am considering
            1. Pursuing Masters again or if possible a PhD.
            2. Going back to my home country and applying for an H-1 again next year.

    • I’ve been waiting for a receipt for days. As most of the people on the forum I check my emails every 15min…I spent the last few days unable to sleeep, eat, and unable to be happy. It’s sad and deplorable to see talents and skills being subject to the luck of lottery when we have completed all the requirements (degree, found a job, paid taxes,…)…it sound’s unfair.
      We are people and other than being born in another countries we’re all the same…we deserve to be treated fairly. Few years when back in my country I would have never dreamed to make it this far and by the mercy of God/Allah I made it. Even if we don’t get selected in this lottery, we need to keep our heads up, we need to keep our hope and pride as high as we can. If you can go back to school…go back to school and try again next year. If you have to back to your country it’s fine too…keep working hard, keep being humble…in this life there’s always a way! If my ticket doesnt come in, I will certainly have to go back to my country…some of you may have families who will come to meet you..my reality is that I don’t even have a family that will be there to meet me. Right now all I have is Me against the World. I also know that God/Allah has cared about me and that he loves me; therefore, no matter the outcome I will keep living and I will keep my head up.     • Things have come this far (lottery) mainly because of the following.
      1. Paying for multiple H1 to increase the chances if there is a lottery (and this is the main reason for the lottery at first)
      2. Read #1 above.

      While paying for application itself is illegal why in this world its tough for USCIS to check the multiple applications categories and reject all of them once and for all permanently.

      • Its is legal to apply mutilple application if they are from different employers. people doing it to increase chances as we are having lottery every year and we are having lottery every year becuase of mutilple application. it a infinte loop. anyway mutilple application is very very small in number compared to dumping of h1b from top 10 indian consulting companies

  23. I’m sick and tired of refreshing my mailbox every single minute during the entire day since the past so many days. Everyday I wake up with the hope that today I’ll get my receipt only to realize at the end of the day that it wasn’t my lucky day afterall. When will this end. This is getting so depressing day by day.

  24. there are not many receipts coming in last two days it doesn’t mean its over…USCIS clock for premium process has started and USCIS might be busy processing…nothing official yet but i guess its worth waiting till May 3rd week.

  28. when will this come to an end? Refreshing my email account every 5 min for a message reg receipt, refreshing redbus2us.com to know whether some one on boat got a receipt.. Frustrating, sleepless, unable to concentrate, depressed and what not.. Non-AD/RR/CA. missed by few days to file last year and afraid to sweat for another year…
    My sincere prayers for receipts to unknown faces– saisri, JK, jk..and others especially waiting with Advanced degree.

          • I asked them to give me more info. But they denied telling more. But my attorney mostly sends the application to CSC. Mine was also sent to CA.

            Until day before yesterday they were telling if they don’t receive it by April 30 then I should assume it has been rejected. But now they asked me to wait little more as they received 3 more receipts yesterday. Means they are hoping to hear back on my case also in a week time.

  30. Did anyone from Regular Quota received any receipt today from California Center?

    Is this over for Regular Processing / Non-AD or still there are chances to get selected in lottery? Till what date we can have some hope? As USCIS will start sending package by mid or end of May?

      i am guessing we can wait till this friday…. next week looks bleak to me …. sigh

          I am on h4.
          I am having two things in mind. Either get into university for MS( for this I need to appear for gre asap inorder get myself enrolled for fall sem)
          the other thing is looking into certification courses which are semester wise and require f1 status. after 9 months one is allowed OPT. no extension allowed… this is the info i have.

          • ohh..I was not aware of certificate courses….
            I am checking for Fall semester but deadline is July End for submission of application..which looks tough….btw college rule says if GPA more that 3.0 then no GRE required…i tried using WES website but it is not working …
            not sure right not preparing for IELTS…another hurdle would be though i have 7 yrs exp in IT my engineering is in mechanical…so not sure how my application will go through…..

            but overall doing MS looks like money consuming (from my spouse pocket) but i hope good in long term….

        • I have a family and I am doing my Second Masters. I am not going to spend money for college tuition again. I have reached a stage where I have to earn and not keeping money on tuition.

        • Believe it or not, for some people money is the least concern. They are from rich families and even 100K per year tuition is nothing to them. They are here in the States for better quality of life or education, driving Porsche, living in $5000/month apartment in NYC etc. I know a lot of my friends are in this situation. Some of them are even investment 500K or a million in those EB5 program to get green cards, because they have wealthy dad. The world is unfair and money can literally solve anything.

        • I think …cap gap initially is only till June 1st ….and only October 1st .if your case gets selected or something of that sort

          • Actually asked my Attorney, about this. You get a CAP GAP extension till Oct1 only if your petition gets selected. Else it is till our EAD validity.

          • Sonal I guess not. The rule is if your OPT end date is later that April 1st and your employer has filed for a H1B petition before your end date and in that case you can get a grace of 60 days added to your OPT.

        • Sonal you can request your DSO to go into SEVIS (This is not a sure shot method though as USCIS sometimes does not request a change) ….and see if any updates are done

  39. Current status of my application is “Post Decision Activity”.

    It says “On April 29, 2014, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice.”

    My application is change of status from H4 to H1. Currently i am in USA and need to travel outside USA because of some emergency. Is it safe to travel at this time ? What would be consequences if i travel now ?

    • Its seems you applied in PP process. Yes, you can travel outside but you need to go for stamping in India to come back again and make sure you have all required documents. I can say it is tough to get stampped in India(expect if you are lucky). if you employer is in good books of usics and if he really maintians inhouse project then it wont be a big issue. or if he just apply your visa showing or planned on some future employement, then you will be in trouble. you need to submit client letter, purchase ordere and also pay stubs(not in your case as employement startes from OCT 2014)

    • i want to take my comments back. by searching online i came to know that if you have valid h4 visa and if you h1b was approved before you travel outside, then you can come back in again with your h4 visa and it will not effect your h1b status. Please check this with employer and also let me know on this. I am also in same boat. my wife want to goto India before she starts employement from oct 2014

          I am also in the same situation and i spoke to my employer regarding my travel to india using H4 visa. He said like i can very well travel to india using h4 visa but my i94 form remains the h1b (i mean recent visa) so i need to change my status in i94 form as h4 from h1b which costs around 4500$ 🙁 so if u r ready to spend 4500$ just like that then u can very well travel to india using h4 visa.

          • $4500! is that COS fee. so we need to change from h1 to h4 before travelling and after coming back we need to again change from h4 to h1.?

            While leaving US you can travel with any visa but while coming back from india and to avoid stamping you need to use COS

          • I am reading online that COS is like only $300 even we add $500 for attorney fee, that is not getting matched with $4500 what your employer said

  43. RQ/RP/VT – My employer told that he got Check En-cashed. 50% Relieved from Anxiety. Good for you guys.

    Can anyone tell me how long will it take from the date of check en-cash to physically get the receipt?

  44. current number EAC14149519XX and reciepts are still generating.. but the difference i see is very few petitions are new petitions. So i believe 148 series (yesterday) looks like the last day… So guys should wait 4 more days to get their receipts mailed.

    I’ve asked my lawyer for some news and she told me to wait up to the end of May and that sometime they received some receipts also in June. I’ve sees many people from my same category who have already received their confirmations, so I don’t think there are no hopes, but I think they are getting tinier.

    My application was the only one sent by my company after 1 yr and half of hard job with them. They usually don’t sponsor people but they did an exception for me.
    It’s my only possibility because if it doesn’t work out,they will be forced to find someone else for my role.
    This system in just unfair.

    • Yesterday Apr 30th is the 144 th day & from last yearI know few NonAd\RP receipts with that series. So lets hope for the best to happen today.
