What’s After H1B 2015 Lottery ? FAQs – Receipt Numbers, Processing Times?

As you know, USCIS conducted a lottery on the 172,500 H1B Visa petitions filed for FY 2015 quota and did a press release indicating that the 85,000 petitions selected will be notified with receipt numbers and those not selected will be rejected and returned. I have seen many of our readers asking questions on variety of topics like below.

What are the Next Steps after H1B Lottery by USCIS ?  

  • USCIS notifies selected Premium Processing  applicants about their receipt numbers
  • USCIS then notifies all selected non-premium/regular  processing  candidates about their receipt numbers through postal mail
  • USCIS completes all premium processing applications adjudication by May 12 (15 calendar days from Apr 28)
  • USCIS continues to process non-premium processing cases once their premium processing applications load is down
  • USCIS starts sending out rejection letters to non-selected candidates

Some of these steps may happen in parallel, while some may happen sequential. Also, the timelines are based upon historical data and it is not possible to predict actual dates for this year.  For general info, you may also read  USCIS Processing time for Regular vs Premium

Who will get the case number ? Employee or Employer ?   Do I get an email ? Will I get a hard copy ?

Usually  the employer/ immigration attorney, who filed the H1B petition would receive the receipt number.  The employee will NOT get any email or hard copy of the receipt number from USCIS.  For selected premium processing petitions, an email with receipt number will be sent to the attorney and then followed by a hard copy in mail. For selected regular processing petitions, a hard copy of the receipt notice with receipt number is sent via standard mail.  Either case, nothing will be sent to the employee, it will always be sent to the employer/ immigration attorney.  Read about What USCIS H1B Case number means

Who will get the rejected application, not selected in lottery ? Employer or Employee ?

The employer/immigration attorney will get the rejected application that was not picked in the random computer generation process/lottery.  It should include the fee you sent as well, unless it was a duplicate filing by the employer for the same employee.

Did anyone receive H1B receipt Numbers for Premium processing ?

Yes, some of our readers have indicated that they received Premium processing case receipt numbers on Friday, April 11th, 2014.  Check the sample USCIS H1B 2015 email receipt.  There is no guarantee that everyone, who filed under premium processing, should receive the case numbers right away this week or in the next week. They may start to receive the case numbers anytime from now, nothing to panic that someone got it and you did not.

USCIS said April 28th  is when they will start the premium processing, How come some are receiving the case numbers and emails  ?

Here is the exact USCIS statement  “While the Form I-797 receipt notice indicates the date USCIS received the premium processing fee, the 15-day processing period set by 8 CFR 103.7(e)(2) will begin no  later than April 28, 2014. “.  If you read carefully, it says ‘NO LATER THAN April 28th “, which means that they will start the 15 day clock for premium processing by April 28th, does not mean they will start on April 28th.  So, technically USCIS can start the processing and send out receipt numbers for Premium processing any time before that as well. In fact, they have already since Friday April 11th.

When will I receive the H1B visa 2015 Case number, if I am selected ?  Regular vs Premium ?  

The premium processing cases selected, ideally should get receipt numbers by April 28th and a decision (approval or RFE) by May 12th ( April 28th + 15 calendar days)  as they are bound by 15 calendar day time limit.  For regular processing, ideally, you would receive the receipt numbers a little later. Last year, we have seen receipt numbers sent until late June. This year, we can expect it to be around the same or maybe a little late like early July, as the USCIS load has increased slightly ( Denying and returning more petitions )

How many Master’s degree petitions were received  ? What were my odds in lottery ?

Unfortunately, USCIS has not officially released any petition numbers received for the master’s degree quota. They have not release it last year too. If someone says a number, it is pure speculation. To calculate your odds in lottery, just use the 172,500. It may not be accurate, but gives you some baseline to know your worst case probability.

Does USCIS select more petitions than 85,000 as backup for denials ?

[Updated on April 21st, 2014 ]  USCIS did not release any official information for FY 2015 saying that they selected or wait-listed more petitions than 85,000 as backup to account for denials. Previously, in 2008 USCIS mentioned in their press release that they have  “wait-listed” some petitions to replace the denials, withdrawal petitions, etc.  But, for this FY 2015 quota, we don’t know.  If USCIS were to follow the same process like in 2008, they would have some “wait-listed petitions” put aside in FY 2015 as well. We just have to wait and see or hear from our users. No official information from USCIS on this.  

How do I know, if my employer really filed my case ?

Well, you have to trust your employer and get the information from him that your petition is filed. Usually, employers are upfront and keep you posted about this and send you the emails/hard copy scans from USCIS. You need to find this from your employer.

Can I know the details of my case from USCIS ? What are my choices ?

Well, this is a roundabout way. USCIS has Freedom of Information act , which can be used to get information regarding you file/case. This could take few months( 6 months ) as there are many requests.  But, there is no guarantee here as it is at the discretion of USCIS. Technically, the H1B petition filed is the employer property and you may not have full rights until you start to work for them legally on H1B. We have heard that some cases information was not disclosed. Again, it depends. Talk to an attorney for more clarification.

Can I upgrade my case to Premium processing without receipt number?

You need the USCIS H1B receipt number to upgrade your case to premium processing. Unfortunately, there is nothing you can do, you need to wait for the case number.

I have not slept properly in couple of days, when will I receive my receipt number?

We understand that it can be very stressful period waiting for the petition receipt number and then for processing of the application.  Many of us have been in similar shoes and can empathize your pain. Unfortunately, there is nothing we all can do as it is not in our hands.  Please try to stay calm, focus your personal time on something that you enjoy or with your spouse/kids/friends.     My receipt number is WAC-14–142-53551. Applied for NON AD/RP/CA. My application got picked up yesterday.

    So, don’t loose hopes. Just wait for few more days for California.

    Hope this year will be better, Last year also I got selected in the lottery, but got screwed because of documentation and got rejected.

  4. How many checks are added to the application?. In my case one with the fees from my attorney and one for Dpt. Of Homeland Security ($750) from my employer. Are they cashed at the same time?.
    I’m non-cap, reg, Vermont and still waiting. Application arrived April 1. The $750 check from my employer has not been cashed yet and I have no news from my attorney and his check….

Hi all, I have been monitoring this site since my Petition been submitted on Apr 3rd, just got the confirmation from my Attorney mail in US with scanned soft copy of my Receipt number EAC14142XXXXX that mine was picked up in lottery .. Non-AD / Regular .. seems Im kinda lucked out at least on through on initial stages..

  8. The uscis case status check is down, I think they are updating the website!! Reciepts that says case not found may be updated soon I guess!

  9. AD/RP/Vt, no response yet, and this morning the Attorney said that the check has NOT been cashed as of yet. Today is 30th April, so that means a definite lottery reject, right? What do you guys say? Anybody have any idea/experience from previous year?

      • We all are RQ/RP only…I am not sure how the location(CA/ VT) is decided in our case..But no one seem to have heard anything in our company…except the 1 case I heard last weekend(on 28th)

    I’ve been following this forum since the lottery is done, today I got my Receipt No WAC141435****. Last year I missed in lottery, this year I am almost lost my hope. I also seen many ppl asking for FRAGOMEN, mine is filed through them and they have updated receipt no in their site. Please keep checking their portal if you have applied through FRAGOMEN.
    I know how hard it is to wait for the lottery results..

        No updates watsoever from my employer…

        even though its lottery there is one little feeling somwhere down there that you are gonna make it and it doesnt happen that way. so damn frustrating..losing it…

        • What is more frustrating and sad thing is USCIS not putting up list of rejected candidates..So at least will know to wait or start working on plan B.

  11. Non AD/PP/VT, this is my second and last time to apply H1B. I was not selected last year , and haven’t heard anything from my employer. I have been in states for 6 years, study hard ,work hard, I guess it is time to end my journey ?

    Last year wait till end of May to get the rejection notice, not sure about this year. Maybe mid of June? It is just a game that organized by someone, we (foreigners) are the players , the person who approved this lottery decision is the boss.

    My application is got selected and now it is in “Post Decision Activity” Status.

    “On April 29, 2014, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice.”

    My application is change of status from H4 to H1. Currently i am in USA and i need to go back to India because of some emergency. Is it safe to travel at this time ? What would be consequences if i travel now ?

    • Congrats on getting selected. It is actually not safe to go out of the country when your visa is in-processing. Consult with your consultancy on the same, and also better speak to your lawyer. But from my opinion don’t take the risk of travelling.

      Guys let’s all keep our hope’s high and try to help each other out here, rather than just lementing. Just remember “everything happens for a reason in this world”

This page has people falling in different category, One side there are people waiting for their receipts desperately, other side though people have got there receipts they dont see any updates in the website, one more people have both but scared where they will go till the end, one more getting RFE’s and finally the luckiest people who have got their approvals. Wish I fall in the last category by god’s grace this year..

    • My DSO does not cooperate with me. She says she will only give me my SEVIS status if I provide her with a receipt number.

      • Arpita, same with my DSO. But in my case, even though I have received the receipt from USCIS, my SEVIS still isnt updated yet. So, I guess checking with your DSO isnt a sure shot answer to verify.

  17. Guys I am following this website from the last 1 month. I have seen many Emotional & Happiest comments that i have never seen before in my life

    Congrtas for the one who went through lottery and All the very best for the one who didnt.

    Coming to the point Me & My friend applied H1B this year (AD/PP/VMT). He is lucky and went through lottery and got approved with out any RFE. Every minute i refresh my Outlook to see whether i can get a good news from My HR. It would be great that from next year USCIS will start sending the Packets who didnt go through the Loterry first.

    Any ways we all decided to stay in USA. Lets face the worst situation. Nothing will be worse than this.

  19. To everyone who sees their status as ‘case not found’, I just managed to access my case and it has been approved. Seems like USCIS is going straight from nothing to approvals/RFEs, so hang in there!

    Google applied 500 odd apps this year and all are picked up.

    So, can’t agree with it being only a Luck Factor

    • How do you know google applied 500 and all are picked in lottery? Source of information? I also feel there might be at least some thing in lottery but no one has ever proved it

      • I and my consultant discussed about the same topic last night. and most of the employers feel its not really Lottery. They are separting application first per employer basis and then picking applications on some percentage basis.

          • Reality will only come after discussing on opinions. This is not unrelated. if some one know that his\her employer already got 50-60% of total visa applied then the fact is, it is almost done for that employer. and this comment could really give some hope to some one and vice -versa too

          • I can tell you for fact that what he said is bullshit. As a matter of fact most of companies like google, amazon, microsoft etc are opening offices in other countries and/or sending people to existing offices just to be able to apply again for both l1b and h1b a year later. Why would they do that if everyone gets visa as you claim?

            I can’t tell the numbers for obvious reasons but i assure you that they have acceptance ratio similar to other companies. The only kind of companies that do get somewhat biased approach are consultancies like tcs, infosys, wipro and cognizant, but again for a reason as most of people who try to trick the system apply there so they get a lot of RFEs and refusals.

            Bottom line is – system is fair

          • This is a typical case of just believing what your told without actual evidence. There is not much transparency about how the USCIS conducts business, so no one can say for sure it’s fair or not

            I work for a company (name not disclosed for the best reasons) who applied 821 h1bs last year.
            And 23 were not picked up.

            So the success ratio is 97%

            Which “lottery” on Earth gives such an outcome????

    Waiting for the receipt number. Was not tensed until last Monday. Now after seeing so many people getting receipt in regular quota I’m getting anxious.

  23. Just got an update from one of the guys applied thru my employer. He got reciept today. RQ/RP/VT.

    When I checked with employer, I didnt recieve any update yet. It brings back those anxious memories fromk my last year attempt where it miised in Lottery. Waiting (with a Struggle to control anxiety).

    • that chance is always thr…rejection due to error in petition or after RFE. So getting selected is like winning 70% of the battle …the rest 30% still needs to be fought.

        (I calculated probabilities using worst case of 40k applications for AD and it still works out to 72% chance).

        • Yes the chance of getting rejected in lottery with worst case of 40,000 applications is 0.302.
          (20,000/40,000)*((172,000-20,000-60,000)/(152,000))=0.302, hope the odds are in our favor. All ADs in this forum should get through.

          • though it is a chance thing but here is the probability calculation so our mind kinda sees thing clearer:

            (20000/40000)+{[1-(40000-20000)]*65000/152000} = 72%

      • Save some money for return flight. Try for other visas. EB2/EB3 GC may not be an option now (to maintain work status) unless you are qualified for EB1.

    JetStar Airways computer failure brings down Christchurch airport on 9/17/11. JetStar is owned by Quantas – which is know to have outsourced
    to India, Inc.
    JP Morgan – Outsourced subsidiary & IT integration to India in 2009 for $400 million, lost $2 billion in 2012.
    Kodak: Outsourced to India in 2006, filed for bankruptcy in Jan, 2012.
    Lehman (Jasjit Bhattal ruined the company. Spectramind software bought by Wipro, ruined, trashed by Indian programmers)
    London Olympics 2012 Security – Botched by India’s G4S
    Medicare – Defrauded by Indian national doctor Arun Sharma & wife in the U.S.
    Microsoft – Employs over 35,000 H-1Bs. Stock used to be $100. Today it’s lucky to be over $25. Not to mention that Vista thing.
    MIPS – Taken over by Indian national Sandeep Vij in 2010, being sold off in 2012.
    MIT Media Lab Asia (canceled)
    MyNines – A startup founded and run by Indian national Apar Kothari went belly up after throwing millions of America’s VC $ down the drain.
    Nomura Securities – (In 2011 “struggling to compete on the world stage”). No wonder because Jasjit Bhattal formerly of failed Lehman ran it.

    PeopleSoft (Taken over by Indians in 2000, collapsed).
    PepsiCo – Slides from #1 to #3 during Indian CEO Indra Nooyi’ watch.
    Polycom – Former senior executive Sunil Bhalla charged with insider trading.

    Quark (Alukah Kamar CEO, fired, lost 60% of its customers to Adobe because Indian-written QuarkExpress 6 was a failure)
    Reebok – Massive fraud and theft in India second in size only to Satyam fraud
    Rolls Royce (Sent aircraft engine work to India in 2006, engines delayed for Boeing 787, and failed on at least 2 Quantas planes in 2010, cost
    Rolls $500m).
    SAP – Same as Deloitte above in 2010.
    Singapore airlines (IT functions taken over in 2009 by TCS, website trashed in August, 2011)
    Skype (Madhu Yarlagadda fired)
    State of Indiana $867 million FAILED IBM project, IBM being sued
    State of New York – Hired Indian-infested CSC in 1998 to build a new system, was 33 months late and $166 million over budget, a cost
    overrun of 47 percent. And then the system failed. So much for “they can do it better, cheaper, faster”. CSC also holds the sole contract for
    NC’s Medicaid system redesign. That project is hundreds of millions over budget and years late. India, Inc. is taking its time to maximize the
    amount it can grift out of America.
    State of Texas failed IBM project.
    Sun Micro (Taken over by Indian and Chinese workers in 2001, collapsed, had to be sold off to Oracle).
    UK’s NHS outsourced numerous jobs including health records to India in mid-2000 resulting in $26 billion over budget.
    Union Bank of California – Cancelled Finacle project run by India’s InfoSys in 2011.
    United – call center (closed in India)
    US Navy F-18 jet crashes into Virginia apartment building on 4/6/12 after outsourcing F-18 work to India’s Tata.

And moreover one cannot simply write all kinds of unrelated rubbish in this page, which by the way, is managed and maintained by an Indian just to help people like me and the hundreds others who are benefitting.

    • I doubt you are a true American by posting hatred here. Remember, even your forefathers were immigrants and so were mine. I am a US Citizen married to an Indian, and he is far more faithful than an average Caucasian here.

  25. I applied for PP/AD/Vermont and got my case number on April 15th. but when I track it online and by the phone it say: your case can not be found at this time in my case status.
    My employer called USCIS today and talk with one of the customer service, they say it’s normal and it takes time to upload the info. So we should wait! I hope all of us get our result soon!

  26. Received my receipt on apr 17 but till now uscis website says case not found. Soo soo worried and started the second round of tension.. 🙁 all PP guys started getting approval mails. Waiting for mine 🙁 non-AD/PP/EAC)

  28. AD/PP/CA. The USCIS website shows approved. I am strongly praying that others, apart from duplicate applicants and bodyshoppers/consultants, sail through this smoothly.

  29. Still waiting, heart in mouth now. Every day that passes has me more and more worried, but great to see others are getting theirs through. Isn’t it amazing how one small email/piece of paper can mean so much?
