What’s After H1B 2015 Lottery ? FAQs – Receipt Numbers, Processing Times?

As you know, USCIS conducted a lottery on the 172,500 H1B Visa petitions filed for FY 2015 quota and did a press release indicating that the 85,000 petitions selected will be notified with receipt numbers and those not selected will be rejected and returned. I have seen many of our readers asking questions on variety of topics like below.

What are the Next Steps after H1B Lottery by USCIS ?  

  • USCIS notifies selected Premium Processing  applicants about their receipt numbers
  • USCIS then notifies all selected non-premium/regular  processing  candidates about their receipt numbers through postal mail
  • USCIS completes all premium processing applications adjudication by May 12 (15 calendar days from Apr 28)
  • USCIS continues to process non-premium processing cases once their premium processing applications load is down
  • USCIS starts sending out rejection letters to non-selected candidates

Some of these steps may happen in parallel, while some may happen sequential. Also, the timelines are based upon historical data and it is not possible to predict actual dates for this year.  For general info, you may also read  USCIS Processing time for Regular vs Premium

Who will get the case number ? Employee or Employer ?   Do I get an email ? Will I get a hard copy ?

Usually  the employer/ immigration attorney, who filed the H1B petition would receive the receipt number.  The employee will NOT get any email or hard copy of the receipt number from USCIS.  For selected premium processing petitions, an email with receipt number will be sent to the attorney and then followed by a hard copy in mail. For selected regular processing petitions, a hard copy of the receipt notice with receipt number is sent via standard mail.  Either case, nothing will be sent to the employee, it will always be sent to the employer/ immigration attorney.  Read about What USCIS H1B Case number means

Who will get the rejected application, not selected in lottery ? Employer or Employee ?

The employer/immigration attorney will get the rejected application that was not picked in the random computer generation process/lottery.  It should include the fee you sent as well, unless it was a duplicate filing by the employer for the same employee.

Did anyone receive H1B receipt Numbers for Premium processing ?

Yes, some of our readers have indicated that they received Premium processing case receipt numbers on Friday, April 11th, 2014.  Check the sample USCIS H1B 2015 email receipt.  There is no guarantee that everyone, who filed under premium processing, should receive the case numbers right away this week or in the next week. They may start to receive the case numbers anytime from now, nothing to panic that someone got it and you did not.

USCIS said April 28th  is when they will start the premium processing, How come some are receiving the case numbers and emails  ?

Here is the exact USCIS statement  “While the Form I-797 receipt notice indicates the date USCIS received the premium processing fee, the 15-day processing period set by 8 CFR 103.7(e)(2) will begin no  later than April 28, 2014. “.  If you read carefully, it says ‘NO LATER THAN April 28th “, which means that they will start the 15 day clock for premium processing by April 28th, does not mean they will start on April 28th.  So, technically USCIS can start the processing and send out receipt numbers for Premium processing any time before that as well. In fact, they have already since Friday April 11th.

When will I receive the H1B visa 2015 Case number, if I am selected ?  Regular vs Premium ?  

The premium processing cases selected, ideally should get receipt numbers by April 28th and a decision (approval or RFE) by May 12th ( April 28th + 15 calendar days)  as they are bound by 15 calendar day time limit.  For regular processing, ideally, you would receive the receipt numbers a little later. Last year, we have seen receipt numbers sent until late June. This year, we can expect it to be around the same or maybe a little late like early July, as the USCIS load has increased slightly ( Denying and returning more petitions )

How many Master’s degree petitions were received  ? What were my odds in lottery ?

Unfortunately, USCIS has not officially released any petition numbers received for the master’s degree quota. They have not release it last year too. If someone says a number, it is pure speculation. To calculate your odds in lottery, just use the 172,500. It may not be accurate, but gives you some baseline to know your worst case probability.

Does USCIS select more petitions than 85,000 as backup for denials ?

[Updated on April 21st, 2014 ]  USCIS did not release any official information for FY 2015 saying that they selected or wait-listed more petitions than 85,000 as backup to account for denials. Previously, in 2008 USCIS mentioned in their press release that they have  “wait-listed” some petitions to replace the denials, withdrawal petitions, etc.  But, for this FY 2015 quota, we don’t know.  If USCIS were to follow the same process like in 2008, they would have some “wait-listed petitions” put aside in FY 2015 as well. We just have to wait and see or hear from our users. No official information from USCIS on this.  

How do I know, if my employer really filed my case ?

Well, you have to trust your employer and get the information from him that your petition is filed. Usually, employers are upfront and keep you posted about this and send you the emails/hard copy scans from USCIS. You need to find this from your employer.

Can I know the details of my case from USCIS ? What are my choices ?

Well, this is a roundabout way. USCIS has Freedom of Information act , which can be used to get information regarding you file/case. This could take few months( 6 months ) as there are many requests.  But, there is no guarantee here as it is at the discretion of USCIS. Technically, the H1B petition filed is the employer property and you may not have full rights until you start to work for them legally on H1B. We have heard that some cases information was not disclosed. Again, it depends. Talk to an attorney for more clarification.

Can I upgrade my case to Premium processing without receipt number?

You need the USCIS H1B receipt number to upgrade your case to premium processing. Unfortunately, there is nothing you can do, you need to wait for the case number.

I have not slept properly in couple of days, when will I receive my receipt number?

We understand that it can be very stressful period waiting for the petition receipt number and then for processing of the application.  Many of us have been in similar shoes and can empathize your pain. Unfortunately, there is nothing we all can do as it is not in our hands.  Please try to stay calm, focus your personal time on something that you enjoy or with your spouse/kids/friends.     Good Luck everyone, do not get disappointed if you are not picked( i too did not get last time, didnt loose hope and tried this year again)

Just wondering what makes it so difficult for a SuperPower Nation like U.S. to establish a strict process in eliminating the unfair categories of H1 applications (like paying for consulting companies to apply for visa, paying and applying multiple applications to increase lottery chances, fake experiences to make eligible for H1 application, and many more……etc.. etc…)

    Had there been a strict screening like the one mentioned above, many folks may not end up waiting for a lottery results like this to decide their career.

    Just a thought and no offence meant.

          • Hey, I just came know 6 people including one of friends, got their AD/RP/CA receipts today. All of them work for the same Tech Company based out of Sacramento. He says however that hi receipt shows Initial Review, and 25th is dispatch date.

    I just checked my case status and its shows Request For Evidence. “we mailed a notice requesting additional evidence or information in this case I129 PETITION FOR A NONIMMIGRANT WORKER.”
    My Questions are..
    1.how much time do they usually give to respond for RFE?
    2. do they e-mail to my lawyer or send regular post?

    • wow …they are already sending RFE ….what category was your case AD or non AD/ RP or PP …..and finally which center. Finally you have 30 to 60 days to answer RFE from what i have heard.

          • not yet and I’m hoping it won’t be 🙂 … if possible, can you tell us what was your RFE about? there are some sites that predict a high level of RFE for PP applications this year (just so that USCIS will gain some time) – it will be very valuable for us to see if it’s a true RFE or just a bogus one – I’ve read about some very weird RFEs so far…

  7. Passed another day of desperate wait. Wonder how many days I will have to wait like this. Have already waited for 3 weeks. Even Non AD’s have started getting theirs.. AD/RP/VT 🙁

    I got the receipt notice from the lawyer today. I was not selected in last year’s lottery. Am currently on L1 visa.

    This forum is a useful source of information, but one tip from my long (and fruitless) wait last year: I know it is difficult, but try to check only once a day or so for updates, and try not to let something that you cannot control take over your life.

  9. Just got an email from attorney to everyone (all AD’s – 2PP & 2REG) who had applied for H1. He says to hold on until you receive your package back. With the number of applicants being so high, the rejection rate would be equally higher and so would be the time taken by USCIS. The last years timeline of acceptance / rejection / lottery etc should only be taken as a rough reference. The actual dates this year might significantly vary.

          • Hi will our sevis get updated if selected in lottery even if my STEM-OPT expires in Jan’2015 or is it just for the people whose OPT expires before Oct ‘2015??

        MY EMPLOYER HAS A TRANSFER STRATEGY FOR PEOPLE WHO NOT SELECTED.

        BE SURE TO ASK YOUR EMPLOYER IF THEY CAN TRANSFER YOU TO SOME PLACE AND APPLY FOR NEXT YEAR.

Transfer strategy is …between you and the employer ..right…thanks for the tip ..i will work something out with them …but the reason why i asked is because i heard SEVIS changes for those whose OPT is expiring soon.           • I JUST TALKED WITH MY HR, SHE CONFIRMED AND TOLD ME THERE WERE PEOPLE IN MY FIRM HADN’T RECEIVED YET, SHE SAID MORE WERE COMING THIS WEEK.

            I GUESS HR DIDN’T DISCLOSE SINCE PEOPLE WHO HADN’T RECEIVED ANYTHING MIGHT GET EXTREMELY STRESSED IF HEARING OTHER GOT IT.

  12. My employer send this reciept number EAC1414251XXX. and he said cheque was chashed on 04/25. but in website it was showing application received on 04/10 and it was in initial review. so it seems they are even back logs in notifying employers and cashing cheque. so dont loose hopes yet.

    • no he can hope ..not necessarily two people from the same company get the receipt together…but are chances are for sure decreasing …with each passing day ..including mine 🙁

          • Vital inputs are that receipts are for sure being mailed in this week and next.
            check enchantments/SEVIS is a great indicators of selection in lottery
            Many AD candidates are waiting to hear back which is a good enough indicator that notifications are pending because AD hit rate cannot be so low…

          • Yeahhh hopefully the AD hit rate aint that low …just sucks to be waiting till the end but if we get it ..it`ll be so worth it

        • it is a sure shot indicator to the best extent we can guess on USCIS…but whenever it gets en-cashed you are in …did your get en cashed??

          • I spoke to my attorney just now, and he says he is going to check with the bank and let me know. My DSO refuses to check SEVIS status for me unless I furnish her with the H1 receipt details. So stuck in between.

          Somehow my comment a few days ago got deleted. Im in the DC area and I haven’t heard a thing. There are total 6 guys in my office and they all havent heard anything and thats very unlikely. I guess the post office is having trouble. Wish you good luck!

          • Also, my personal mail package which I sent out on the 23rd still has no update on USPS website. So I guess high chance is the post office system is having trouble. Maybe we still have hope 😀

            Thank you so much for replying. I guess we can rest our fears for sometime, as most of us have heard nothing from AD/VT. I am the only one my company sponsored. My Attorney, asked me to wait till May 15th, and he also added that traditionally VT has been a little late for any immigration related processing.

        • I understand. Last two weeks have been very stressful- especially the weekend. But receipts are being sent out till May 2nd week. And I know sooooo many AD guys still waiting that it is hard to believe that the hit rate would have been that low especially for AD guys

          • Yes, the SEVIS gets updated if you are an Advanced Degree. I was notified I was selected in the lottery and got the receipt last Monday for AD, Regular Processing in Vermont. 3 Days later my DSO issued me a new I-20, for the cap-gap extension until Sept 30th, even though my OPT does not expire until late August.

          • from what i have heard it only gets updated for people whose OPT expires before 1st Oct….not sure here

    I am Non-AD/PP and receipt number starts with WAC 🙂
    When I enter my receipt number into uscis website, it says invalid number. I assume that it is because of the delays.

  20. My case EAC14142***** is picked which is regular processing/Non AD.
    I got the reciept from employer today.

          • When there was no news last friday, I became totally hopeless. Spoke to my attorney today morning who says that even AD/PP are getting receipts even now and receipts are expected till May 2nd week. I haven’t received a receipt yet but it is my heartfelt prayer that all students who have made a huge investment of time and money in US and really wish to get stay here should be selected. I don’t believe in god, but I will pray for you guys and wait for my receipt.

  22. Anyone still waiting for a receipt? AD/RP/VT and have not heard anything from my attorney yet. After all we have gone through – top 10% of the graduating class, job hunt (non IT) in the US…and not fate lies in the balance of a lottery.

    Anyone sharing the same boat I hear your concerns. All these people gloating on 5 or 6 applications and the consultancy guys hear me – you guys are demolishing the concept of merit and you will answer for it when time comes.

    • Bharat, Dont think as a demi god if you do AD from America. There are people here who did masters in other countries and in India and they also going through same phase. AD guys have very better chances if they apply for H1b from day 1 instead of wasting time to utilize OPT so they can get tax benefits and trying for h1b in last minute. if you want to blame some one, it has be Infosys and TCS mainly. just dumping application in bulk as they dont has to loose anythng if it didnt get picked (they hire lawers on permanent basis, so nothing to loose in money expect postal charges and they dont bother about client letters etc.. as normal desi-consultant go through)

        Just give a thought to this — I have an education debt to pay like everyone does and we strive hard to repay and whatever that is left we invest in our small dreams like owning your dream car, getting a nice television, furnishing your house so that when your parents visit they have a comfortable life, getting your dear ones what they want and like so. What happens if your application does not get selected you do not go back to where you were but instead your position is even more worsened.

        I have a lot of respect for AD guys here I certainly do, but just give thought to where the AD guys will be if the application does not get picked. Your dreams are shattered.

        • yes, i am on your side fully for espically AD guys, as they do through lot of stress espically to repay 20-30k loan along with intrest and it will take your full 2 year saving to repay it. and i heard uscis know all this and they give full prefernce to AD guys as well and they make sure 80% of them get selected. I am sure they have some kind of tracking to check how many percentile each company is getting or else some one should end up with 0 and some one should by 100% and that is never the case from all these years. only company you can blame is Infosys and TCS. last year infosys raised 15,000 LCA and this year it raised 32,000 LCA. Desi consultant number will be in very small compared to these big firms and person coming through desi consultant is same like you and he hope to settle in usa and so invest time and money same as you here.

        • Hey Bharat,

          F1 Visa is not a working visa. When you applied for this visa, you said after finishing the education, you are going back. So, donot blame anyone but you. If you think you were not financially strong, then you should not have bothered to come here.
          Get life bro and take everything in life as a challenge and just accept it. I did not get picked up last year and this year not yet.
          I did my bachelor in US and guess what spend more money than you in Education.

      • not true. A lot of employers do not want to go through H1B process if they don’t know the person they hire can do good work –> thus OPT.

        • That is making sense, but i know atleast 60% of OPT go through some consultancies on percentage basis to get better pay, they should atleast do that to avaoid competetion amongs AD’s itself. why they are not doing it?

    • Okay, I hear you. But I am increasingly annoyed by the AD applicants who assume they should have the first preference over non-AD applicants. Stop spreading the hate. Everyone here is as annoyed as you and are waiting for the result. If you consider yourself as merit, draw confidence from it and you can stand up to any challenge. Common whines from AD guy – 1. I have a car, apartment, a GF – yeah, these are all first world problems. Guys waiting to come to US on reg. quota have sick mom, loan on sister marriage and a dead dog.
      2. I am on merit – yeah 10% of you. Rest of them came in for that no name university just to get in to US.
      3. I am qualified – again, yeah 10% of you. Rest of you obviously rig your resume with 10 years of experience when all that you have is 2 months training from your employer.

      So, the bottom line is every cart has bad apples. In this case, a lot of bad apples. So keep calm and stop the hate towards those regular guys. We are after all in the same boat.

      • @MAG Completely agree, AD applicants already have 20,000 seats reserved just for them. Applicants in India have done their time and worked hard in order to have someone sponsor them.
        Unfortunately people are abusing the system by applying 3-5 times. I am also an AD applicant and refrained from making any major investments like a car or a long term Apartment lease because I knew my future here in the US would depend on a random lottery.

        Honestly there is no point blaming any one or crying about it here since that will not change anything.

    I would like to send H-4 application for my husband and my son (8 yrs). Do i have to pay only $290 one check or $290 X 2 checks.
    I send $580 one check but it is returned back. If someone can help, will be appreciated.

  24. Anybody from India working in IT organization and waiting for H1B? Mine is non-AD/RP/VT. Asked HR today, said might come by the end of next week. Any updates on this? Heard that TCS and Cognizant employees have got their receipt numbers.

  25. Not gonna lose hope; I have now lived 6 years in the U.S. and this country has never let me down. Keep your heads up; remember that are wait lists and what-not. Mostly important, remember that until you hear the “no”, it is still a “maybe”. Non-AD/
