What’s After H1B 2015 Lottery ? FAQs – Receipt Numbers, Processing Times?

As you know, USCIS conducted a lottery on the 172,500 H1B Visa petitions filed for FY 2015 quota and did a press release indicating that the 85,000 petitions selected will be notified with receipt numbers and those not selected will be rejected and returned. I have seen many of our readers asking questions on variety of topics like below.

What are the Next Steps after H1B Lottery by USCIS ?  

  • USCIS notifies selected Premium Processing  applicants about their receipt numbers
  • USCIS then notifies all selected non-premium/regular  processing  candidates about their receipt numbers through postal mail
  • USCIS completes all premium processing applications adjudication by May 12 (15 calendar days from Apr 28)
  • USCIS continues to process non-premium processing cases once their premium processing applications load is down
  • USCIS starts sending out rejection letters to non-selected candidates

Some of these steps may happen in parallel, while some may happen sequential. Also, the timelines are based upon historical data and it is not possible to predict actual dates for this year.  For general info, you may also read  USCIS Processing time for Regular vs Premium

Who will get the case number ? Employee or Employer ?   Do I get an email ? Will I get a hard copy ?

Usually  the employer/ immigration attorney, who filed the H1B petition would receive the receipt number.  The employee will NOT get any email or hard copy of the receipt number from USCIS.  For selected premium processing petitions, an email with receipt number will be sent to the attorney and then followed by a hard copy in mail. For selected regular processing petitions, a hard copy of the receipt notice with receipt number is sent via standard mail.  Either case, nothing will be sent to the employee, it will always be sent to the employer/ immigration attorney.  Read about What USCIS H1B Case number means

Who will get the rejected application, not selected in lottery ? Employer or Employee ?

The employer/immigration attorney will get the rejected application that was not picked in the random computer generation process/lottery.  It should include the fee you sent as well, unless it was a duplicate filing by the employer for the same employee.

Did anyone receive H1B receipt Numbers for Premium processing ?

Yes, some of our readers have indicated that they received Premium processing case receipt numbers on Friday, April 11th, 2014.  Check the sample USCIS H1B 2015 email receipt.  There is no guarantee that everyone, who filed under premium processing, should receive the case numbers right away this week or in the next week. They may start to receive the case numbers anytime from now, nothing to panic that someone got it and you did not.

USCIS said April 28th  is when they will start the premium processing, How come some are receiving the case numbers and emails  ?

Here is the exact USCIS statement  “While the Form I-797 receipt notice indicates the date USCIS received the premium processing fee, the 15-day processing period set by 8 CFR 103.7(e)(2) will begin no  later than April 28, 2014. “.  If you read carefully, it says ‘NO LATER THAN April 28th “, which means that they will start the 15 day clock for premium processing by April 28th, does not mean they will start on April 28th.  So, technically USCIS can start the processing and send out receipt numbers for Premium processing any time before that as well. In fact, they have already since Friday April 11th.

When will I receive the H1B visa 2015 Case number, if I am selected ?  Regular vs Premium ?  

The premium processing cases selected, ideally should get receipt numbers by April 28th and a decision (approval or RFE) by May 12th ( April 28th + 15 calendar days)  as they are bound by 15 calendar day time limit.  For regular processing, ideally, you would receive the receipt numbers a little later. Last year, we have seen receipt numbers sent until late June. This year, we can expect it to be around the same or maybe a little late like early July, as the USCIS load has increased slightly ( Denying and returning more petitions )

How many Master’s degree petitions were received  ? What were my odds in lottery ?

Unfortunately, USCIS has not officially released any petition numbers received for the master’s degree quota. They have not release it last year too. If someone says a number, it is pure speculation. To calculate your odds in lottery, just use the 172,500. It may not be accurate, but gives you some baseline to know your worst case probability.

Does USCIS select more petitions than 85,000 as backup for denials ?

[Updated on April 21st, 2014 ]  USCIS did not release any official information for FY 2015 saying that they selected or wait-listed more petitions than 85,000 as backup to account for denials. Previously, in 2008 USCIS mentioned in their press release that they have  “wait-listed” some petitions to replace the denials, withdrawal petitions, etc.  But, for this FY 2015 quota, we don’t know.  If USCIS were to follow the same process like in 2008, they would have some “wait-listed petitions” put aside in FY 2015 as well. We just have to wait and see or hear from our users. No official information from USCIS on this.  

How do I know, if my employer really filed my case ?

Well, you have to trust your employer and get the information from him that your petition is filed. Usually, employers are upfront and keep you posted about this and send you the emails/hard copy scans from USCIS. You need to find this from your employer.

Can I know the details of my case from USCIS ? What are my choices ?

Well, this is a roundabout way. USCIS has Freedom of Information act , which can be used to get information regarding you file/case. This could take few months( 6 months ) as there are many requests.  But, there is no guarantee here as it is at the discretion of USCIS. Technically, the H1B petition filed is the employer property and you may not have full rights until you start to work for them legally on H1B. We have heard that some cases information was not disclosed. Again, it depends. Talk to an attorney for more clarification.

Can I upgrade my case to Premium processing without receipt number?

You need the USCIS H1B receipt number to upgrade your case to premium processing. Unfortunately, there is nothing you can do, you need to wait for the case number.

I have not slept properly in couple of days, when will I receive my receipt number?

We understand that it can be very stressful period waiting for the petition receipt number and then for processing of the application.  Many of us have been in similar shoes and can empathize your pain. Unfortunately, there is nothing we all can do as it is not in our hands.  Please try to stay calm, focus your personal time on something that you enjoy or with your spouse/kids/friends.   1. Another weekend in between.. Not sure if I need to keep my hopes up after April 28. Since USCIS has said pp processing will be from and not by april28, I hope this means they are not done with sending all pp receipts. All the best to ppl still waiting. My mind is not ready to search for other options till I am sure I am rejected.

  3. The whole thing the whole process is so stupid! People spend all the sleepless nights to get a degree, to look for a job, prepare for interviews, and hard working. Everything now riles merely on a “COMPUTER” ! how interesting!

      I am so eagerly waiting for mine. My lawyer replied this when I enquired with him the first time

      “We have not heard anything from USCIS regarding your petition and anticipate that it could be several more weeks or longer until there is news. Until then, we will not know whether your petition was selected in the lottery. Unfortunately, there would not be any information in SEVIS regarding your H-1B. Please let us know if you have any additional questions.”

      I do not know whether to be optimist or pessimist with this bit of news.

    I just received an email from the HR that my petition has been selected in the lottery. Got the receipt number which cant be tracked at the moment on the website.

    I just cannot imagine how relieved I am. A big thank you to the admin of this group for helping totally unknown strangers on such a virtual platform.

    Check with your attorney guys. I got snapped by my attorney for being impatient. In my case, they had hired a new para-legal who thought she would convey me only after the H1B is accepted (WTF, I wouldve been a schizophrenic by then).

    I really wish everyone gets their receipts and approvals. Especially the AD guys. Nothing against REG but I can feel the pain, anxiety, struggle, investment etc that we AD guys put in here only to be determined by a lottery.

    • No, this is my first time. I couldn’t do my H1 in 2012 (When it was a cake walk) because the company that I was interning almost got closed because of financial crisis. I didn’t do it last year because I still had OPT Extension and didn’t want to ruin someone else’s chance 🙂 ……My HR was amused when I told her this 🙂

      But, good luck guys. I am sure the AD ones will get their receipts. I cant ask you to be patient because I was a walking dead until I got the news.

    • ME TOOO, I’m so happy!!!

      This morning I went on this forum and started crying. GUYS DONT LOSE HOPE. After reading all these comments I took action.

      I asked the company manager to check the bank account and she saw the checks for homeland had been cashed!!!!!
      Then I contacted the friggin’ lawyer (who had also snapped at me for being impatient) and this time her assistant answered with the receipt notice!!!!
      It’s dated April 16, but it probably just got to the lawyers office (Miami, FL) through regular mail.

      My case is AD/ RP/ VT.

      Guys dont lose faith.

    Not sure whether USCIS started releasing receipts for Non-AD/Regular or not. One/two persons per day are posting their receipts here. But, when we check with employers, they are saying that, Non-AD/Regular has not yet been started!

    Petitions that have been filed and receipted:
    ———————————————
    If your H-1B petition has been filed by your employer and receipted by USCIS, you are eligible for an automatic cap-gap extension I-20 through September 30th.

    Petitions that have been filed but NOT receipted
    ————————————————-
    If your H-1B petition has been filed by your employer but not receipted and your OPT expires before June 1, 2014, you are eligible for a preliminary cap-gap extension until June 1st, 2014.

  9. can you get picked in the lottery but not have your SEVIS updated…since i have not heard anything back from my attorney but my DSO said no update in SEVIS….so i am not sure if its over …or if i still have hope

    This has been a very helpful forum, and I have been tracking it for along time.
    Any and Every Who follows these posts has an unsaid responsibility of posting any news that you have. You never know how many people are getting benefited by ur comments/discussions.
    My Employer received a 2 page snail mail today morning which had the receipt number, and it said
    Received Date: April 10, 2014
    Notice Date: April 17, 2014.
    My case is AD/RP/WAC(California)

  14. so our regular NON-AD cases …only processed after Regular AD cases have been processed …or does that not matter…and any can be sent a receipt anytime??

    • Not over yet, it just started in Vermont. To get the receipt notice to attorney, it’ll take atleast 3-5 days. So hopefully by May 1st week/2nd week.

    I have followed the comments on this website for long, and I think everyone who does that has a duty to report the news as and when it comes.

    My Employer received the snail mail today with the receipt number, it was sent on the 17th April.

    My case is AD/RP/WAC(CALIFORNIA)

  18. Can someone try to confirm something to me? Is it true that I can continue working until I receive the “no” letter? If so, does anyone know what I have to do? My OPT expires May 3rd, but I feel like I won’t know the outcome of this lottery for sure until a little after that (and I love my job, so I would like to work for as long as I can before my life is potentially ruined by this lottery).

    • You can work until Sep 30 (if H1B is approved) or until the date you get reject letter through postal mail (if not selected/rejected), since you are eligible for Cap Gap Extension.

      • This cap gap will be DSO based. You need to show alternative proof of filing. This extension needs to be applied for now o else if your opt expires you cannot apply for cap gap. Because you have nothing to extend

    • My friend who works in the school DSO told me that if you have filed H1B in a timely manner (which I guess is April 1) then even if you dont have a receipt, you can get an initial extension until June1. No idea what happens next. Ofcourse, If you get the receipt, it gets extended until Oct1.

      Please confirm with your DSO.

    • Hope, act quickly.. your i20 has to renewed before may 3rd.
      I just did that. contact ur dso, ask what docs he/she requires ( mostly timely filed proof ( fedex receipt)) will be asked. Do it right away. Get it extended upto June 1st.

  19. Non-AD/RP/VT – My Company confirmed that i got selected in the lottery and the receipt will be shared next week(that’s what i was told). One of my colleague also got selected in the lottery.

    Relieved of the pressure – which was there for few days. New pressures to be handled in the coming weeks.

  21. Lottery is a chance but you Advanced Degree candidates may calculate probability of getting picked in the lottery through this formula assuming total applicants in AD is nearly 35K or more.

  22. What is the last date to know whether our application is selected in lottery or not for Premium processing?

    Came to know that from 28th April onwards processing will start for Premium applications, so is 25th April is the last date to receive the receipts for PP people?

    • Hold onto your horses mate. Spoke to my lawyer this morning, receipts come in as late as June 1st week irrespective of premium or regular. He told me his clients though premium received his receipts late last year, but the processing was done quicker. The reason being, mere issuing of receipts is no guarantee of a visa, and quite a number gets eliminated by RFE’s and insufficient paper proof and the failure to establish Employee-Employer Relationship, and mere payslips are not the supporting documents.

        People who file multiple petitions / fake companies, you will be found and you will be denied. Laugh all you can now and let’s see what will happen. People who truly qualified will get it eventually.

      • Yes, good to hear a rational comment from someone with their head screwed on. PP processing BEGINS on the 28th; they will almost certainly drip feed PP receipts alongside other approvals after this point. For all the people getting stressed out; just try to remember that your chances haven’t changed since the 10th when the lottery was determined. You’re just in a queue. I say this as an non as/PP applicant.

      • Then when does the 15 day clock start for premium processing? If he got it in June last year then was his PP fee refunded??Because USCIS started adjudication on PP on April 15 last year? 15 days frm there would be May 1

        • USCIS will not begin processing all PP apps on the 28th, they will simply begin. There is a difference. The 15 day clock begins from when they first begin processing your case which could be on the 28th or some time after.

          • Really? Comforting to hear but where exactly is the advantage of PP based on ur explanation?? And do you know of someone who got it like that?

          • The advantage is the 2 week clock. An RP app started at the same time or even a month earlier than a PP app will take significantly longer. Read all the statements from USCIS; they are extremely careful with the language published. There is no way they would legally back themselves into the corner of needing to have all PP apps wrapped up by the 12th of May. Many may be approved or RFE’ed by then but not all as it wouldn’t make legal sense for them to guarantee that.

            Chris above is not the first person to have posted news supporting this from their respective attorney.

          • Excellent explanation Maravin, My attorney told me it’s an on-going process and things happen all the time. Imaging that how is it possible for USCIS to start approving / looking at all thousands of PP applications on one day and have everyone approved in 15 days? They only guarantee when to start, not when to finish.

            Again, everything is possible until you receive cold rejection. Let’s hope that does not happen. Now we need to get back to our normal life, work, study, family. Worrying does not change anything. Cheers

          • Strictly in the sense, premium processing would begin post 28th April. It does not meant those who applied under PP segment should lose hope. I was a non AD/PP Canadian applicant last year and received my receipt on May 23, 2013. And June 11 it was approved. So until you receive your rejection packets from your lawyer, nothing is certain yet. Also if this helps, you a little, higher scrutiny is being placed on Employer-Employee Relationship since last year. even during the stamping people do face a hard time explaining that to a VISA Officer. I work for MS full time, and we do hire contract employees, 2 of them had to leave, as USCIS refused to acknowledge, Client-Vendor-Sub Contractor-Employer relationship. Feel bad for them, but merely stressing a point.

          • @HOPE, Yes, it was a hard time for me then and this year one of my Asian friends is in the same situation as you all. People around me were getting their receipts. Some Asian contractors in our company got it a month before me. I know the feeling, but just carried on with my work as usual.
            Channelize your mind to positive thoughts. You guys are from Asia no? You guys have such good Yoga exercises which helps. Take a long walk it helps.

          • @ HOPE: You mentioned that your attorney is waiting for about 40 cases. Are they all AD/PP ? How many AD/PP receipts did he/she get as of now ?

        • She is just saying her attorney’s client got it last year, not herself.

          Anyway, even she got it already, we should still be appreciating her will to give information and help. I’m not saying what she said was completely right. But at least it”s something we can think about and use our judgement if it makes sense.

  24. I think it’s time to face the truth – all PP applications are done from both VT and CA – they’re sending only regular ones now. Start thinking of plan B – especially if you’re US – CPT, cap-exempt companies…. Right now, unless you got wait-listed (and you might replace a selected petition) or your lawyer/HR forgot to send you the receipt – there are no more chances.

    • My employer decided to move to Plan B, since they have not received receipt for my PP application yet.

      Plan B is to work at their office in UK for a year and apply L-1 visa after a year. This is easy choice for us since we are citizens of European Union and can move there without visa.

      • A lot of companies do that, true… However, be aware that L1b visa refusal rate is MUCH higher than for H1b (almost 60-70% last two years) and it’s generally hard to get it, especially if you’re a new grad and doing a common profession such as software engineer. Also, processing times for L1b are now much longer than it used to be, so unless your company qualifies for a blanket L1b (only a few of them do), you application can take up to half a year to approve. In that case (if it gets approved at all), your wait time is actually 1.5yrs.

        • I’m not new grad but have masters degree and 15 years of work experience. I’m not living in USA at the moment, so instead of moving to USA I will be moving to UK now. If I don’t get L-1 visa I can continue my work in UK.

          Of course I wanted to get my H1b but it is not end of the world for me if I my application is sent back.

      • This was my Plan B as well, but I got selected.

        I was always telling myself that opportunity to work in London is very cool too. Since you can travel all Europe and explore the world. Its definetelly much better then no Plan B at all and you have to go back to the home country without any job.

  25. I haven’t received any receipt from USCIS, but I’ve got a mail from my university that my Sevis is not updated when asked regrading my Sevis status. Does that confirm’s me that mine is not picked in the lottery?

    • The SEVIS status change is only applicable for those whose OPT will expire before this Oct 1 (cap gap). If not, there won’t be any changes to your SEVIS.

      • This info is wrong. Sevis will always show h1b pending whether or not on opt. Only difference is it will not include an extension of opt.

        • As soon as you get picked in the lottery and its becomes an accepted h1B application, SEVIS Student request section will have a “Change of status request” in Pending. if you are a recent graduate and have just applied for the OPT, you will also have the OPT request in Pending status too. If you already have the OPT approved it will not show under your student request tab. (See below… Tried to print screen but my PC wont allow, sorry)

    • A delayed change in status does not mean you have not been picked necessarily. It may be a delay in entering it on the system esp if its not been filed as advanced degree. That is usually a possibility even if you did an advanced degree in the USA but have not graduated yet, or doing your commencement/graduation ceremony after April 1st, 2014. If that is the case you may have been counted under regular degree.

Its getting harder and harder to face this rejection due to luck…..Had a headache all day…think this stress has started affecting my health…must not allow it to do that…have to have faith in god and take each day as it comes….i still believe god will do justice and ill get the news soon …even though my hopes hang by a thin thread now

          • I did not get picked last year in the H1 lottery Non AD/RP. Don’t have any hopes for this year as well from the broken system. I learned to not care about it. That is my advice that life goes on. So treat it like a lottery which it is and don’t get your hopes high since it is nothing more than a chance factor now.

  27. Two out of my five applications got selected so far, non-AD/RP/Vermont. Now just to pass everthing else and not getting RFE 🙂

          • 5 Applications? Instead of petitioning USCIS for more VISAS we should petition them to ban multiple filings for the same person. All H1s filed should first have a SSN/ ITIN. This would check illegitimate con artists like the one who proudly posted 5 appln…

Think about it, you have to declare when submitting a petition if you are a H1B depended company, how hard it is on the US govt to put separate quotas on those companies?? The problem with body-shoppers, “consultancy” companies has been here for soooo many years, no one wants to take care of it (you won’t find separate quotas for those companies on any immigration bill) because those people – like “consultant” Kumar are profitable, they cheap, US companies will like that

    • Y dont uscis just remove all the duplicates before processing lottery? Some Ppl are soo soo selfish to file multiple petitions. Even i heard that one of my friend’s friend filed for 2 petition and she got selected in lottery too 🙁

    • Just because you have a US degree it doesn’t mean that you are entitled to get a US visa. You are a foreigner just like the rest of us, and we all have the equal rights. You could have applied for several companies to increase your chances.

        • Yes its a common practice by the body shoppers. They have branch offices of the same company and each are papered into a different company with ingenious names. E.g. Kaka LLC, F**KU LLC, MAMU LLC etc…

Since we studied in usa ,we were given opt for which during that period you dont need to pay taxes after that your equal to all the other people in the world.         • They might not be equal in terms of academic achievements, but let’s not forget that H-1 B is an employment based visa… For whom the employer is willing to pay extra for. Sathya might be just as important to his employer as some guy is to Intel… Also, people from a variety of fields are applying. USCIS can’t favor one employer over another…

  31. Finally received confirmation that my H1B petition is picked up in lottery. I had received H4 receipt notice couple of days back. It looks like my attorney delayed in sending the confirmation. It was my last chance as I was not picked up in lottery previous year. It is not really good to go through all this after earning MS and PhD degree here. Good luck to everyone on this site.

AD/PP/CA…..No waiting I gave up… searching for universities………..lottery is deciding our future…this is like playing gambling at vegas for them….For all master students..my small request, please don’t apply duplicate petitions here after…..that’s the reason our cap is getting more applications….please don’t be selfish, by eliminating duplicates lot of people can get H1B’s…everybody are here to support families back in India…no body wants to be away from home and live a lonely life…the situations are like that we cannot go back……I am writing this with tears in my eyes….all worked hard to get here…

      University said no updates on sevis and it is not a good sign.
      Even I have started looking for universities as my opt ends in 40 days. I have never been lucky, guess that is why I never got thru the lottery..

        • 1- Seriously, if all the fake consultancy visas were withdrawn, I’m sure most of us would get a visa.
          2- People who are already living here and working on OPT deserve more to be here, they have cars, apartments and what not. Sending them back and making them lose their jobs is just wrong, you’re firing them from their job.

          • You are right bajaa. At least the Master’s Students who have worked hard to get their degree, and have maintained status, working for legit organizations should be given their due. Not ones who are working with companies, who just have a PO BOX as address. My room mate got through, and he has not even seen his employer nor his office. …………I guess I will take up PhD, as I did my Thesis from U Penn. I do not want to study the same thing over and over again by taking up the same Masters program again…. just for a lousy lottery made H1, who knows there could be 250,000 applications next year……

    • Sam, Same here. At first I struggled to get a Seat through GATE and even with 99 percentile did not make it through IITs as 50% of the seats were not for me to take just because of reservation and even then most of the seats were lying vacant.
      With 99 percentile in GRE made it to a top 3 University in US, I secured a dream job in CA. Now I am hanging by a thread, just for this H1 VISA, as this is what will stand in between my future, career aspirations and my obligation towards my family. I read some of the posts about people filing multiple applications through overnight body shops, and declaring it proudly. I am confused, tired and nothing left to cheer about. Indian Companies with whom I interviewed a couple of days back deem me as overqualified. Gone are the days of Merit, Education and Sincerity. And the best part I am not an IT professional and just a humble Aerospace Engineer.

      • Very well said Arkansas. I got visa last year thru lottery but i still check on this forum to get the idea of how many AD guys got picked.
        I feel for all of you guys. we guys have what it takes to be a successful person. None of us here are afraid of struggle but lottery is not a way to decide that. AD guys shud get priority for H1 visa. Guys from indian IT companies can apply for L1 and if they really r worthy their L1 will be approved. AD guys dont have other options.

          • Before i answer that question , if your a AD student and your asking me that question means either your working for some body shoping consultancy or your lazy to find a job which is out there waiting .

            The US has 2 different taxes. Income and payroll. The income tax applied at both federal and state levels.

            Income tax is something which cannot be enviable .You have to pay it for working in US.Then comes social security tax and medicare ,which are based on payroll tax ,those are the taxes which you get exempt from .

            AD students these days…..becoming disgrace day by day 🙁

          • well most of the genuine companies do it .But half of them fail to get into the genuine companies and go the consultancies where they kinda train ,spoon feed and show them the path to get job and finally body shop them ……. even after that they fail … so when they have to apply for h1b is in the hands of that consultancy dude…not in these guys hands because they forgo a chance of showing their talent . why would the person who is earning on others skills and effort apply those many times ..every time they apply they got to pay attorney fee ,irrespective of lottery is picked in or not .

    • Best of luck to people still waiting with hope and also to those searching other options. Agree with Sam, that it’s like a gamble. We fight with all our might to get things right in life. Nobody wants to be away from our loved ones and we have situations that we have to stay back and work in US. After leaving my job and joining my husband in the US, I managed to get a job in a reputed company of my choice here instead of opting for an easy job with consultancies. Now this lottery has ruined everything. I too have parents n siblings who have to be supported back in my country. Here single income is not sufficient to even take care of us and our kids. Now it’s either a cursed h4 for me or doing master’s as I can’t go back. Still wondering if doing master’s is useful at all, since after all that time, money and effort, all our fates are finally decided by lottery.
