  2. Hi Saurabh,

    I went for H1b Interview today and was issued 221(g) white form where the check boxes against client letter,project detail and tax documents of my employer were checked. Moreover my visa interviewer lady took my passport and said “your visa is on hold.You need to submit these docs.” Moreover my petiotion in USCIS has been transfered to “Acceptance” tab.

    I have asked my employer for all three of them. I want to know how much time such cases take to resolve. I would like to know will I need to go for interview again?
    What does case update in USCIS mean.

    Kindly help me out on understanding this.

      There is no set processing time and can take few weeks to several months to process once the documents have been submitted.

  3. Got a 221g from Hyderabad consulate today.
    VO was not satisfied with the client letter i gave them. its actually a printout of the pdf sent by my client. totally screwed up and lost.. its really horrible to see such things for the FTE with proper employer and a top end client. Dont know how long its going to take now..

      They might do a background check w/ the client to confirm the authenticity of the letter. It can take few months for them to complete the processing. There is not much you can do, except to wait.

      I too was issued a 221g for not showing a PERSONALL client letter. I had a generic client letter addressing the USCIS which confirms the Service Agreement b/w the client & my employer. I emailed them the PERSONAL client letter 4days later and got my visa after 4.5 months.

        I got my VISA stamped today. on 21st Nov my Client got a mail from embassy asking for my position with them. and on 23rd i got a mail from traveldocs to collect my passport. I collected it today and VISA is stamped for 3 yrs

  4. Going for 2nd attempt.. My 2nd H1 initiation..1st H1 suspended under 221(g) blue :Reason: “You do not appear to be academically and professionally qualified for valid visa”

    I’m lil surprised with this reason for rejection as I am fully eligible for the Visa
    Can anybody help me in giving a convincing answer to the consular if he questions about the previous rejection and current eligibility.

    Need help urgently as i am gng for interview next week.

    • Worried,
      Carry documents and information to show that you have necessary education and experience that qualifies you for the offered position. This includes degrees, marksheets, experience letters, training certificates, resume etc.

      What is the offered position, and what is your education and experience? Did you get education evaluation done earlier?

        The position offered is for computer professional and i have 4.5 yrs of related experience. I had Bsc biotech degree when my 1st petition was filed but now i have MBA as well. Although MBA (information system) degree reflects in current I-129 form but the education evaluation reflects only the BSc degree details not the MBA. I have already requested my employer to provide with revised education evaluation report.

        Is everything ok with my quantification and work that i am gng to do in US? will this be a cause of concern? will i get revised petition from my employer? Help!

          It is tough to say how the 2nd interview would go. The officer would have access to previous interviewer’s comments and may form a prejudice. I would suggest carrying detailed resume showing your technical experience and how it matches to the offered position.

    My H1b (Non Masters Quota 2013) got approved last month for the position of an in house Technical Recruiter for a minority owned business in US. I have an MBA in HR/Marketing with an Engineering in Comp Sci Background.
    I need to travel to India during the first week of April 2013. What should be the necessary documents I need to keep for my profile to ensure successful Visa Stamping. Are there any other concerns I should have pertaining to my stamping like, only 5 months of work before stamping and so on.

    Still i see the same status from feb 2012:

    On February 10, 2012, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

    So unfurtunate still, dont know when my case will be reviewed and i will get stamping:(

  7. Here are my case details :
    Interview Date : 21 Aug 2012
    Consulate : Delhi
    All documents including PP returned to me. No Documents asked. No case number given. I’m an FTE. Did MS in comp Science from USA. First Time H1-B and change of status from F1(OPT) to H1B. Been 2 months. My employer has not been contacted.

    • PinkBloom, same thing happened with me. Lady at the counter told me everything looks fine in your case but like to check the TAX docs of your company in detail and didnt give me any slip or case number.
      I even went back again to ask her whether she forgot to give me any of these, but got the same response that we just like to review the docs in detail.
      But than after 15days got my passport back with no stamp & when i sent mail to VFS got standard response that it is pending under “Administrative Processing”.
      I was interviewed on May 18th & since from than no progress they didnt even contact my employer.
      My suggestion is to move ahead & dont just rely that you will get back response in a month or two. It can happen even in two days or it might take 8-9 months.
      I gave interview at Delhi consulate.

    finally after a bit long wait my H1b visa got approved and collected my passport yesterday.

    here is my case history. E-V-C model, no formal client letter but my client provided me email confirmation( which helped me a lot, request them to give at-least email with proper signature which will ease the Embassy to reach client’s)

    31/05/2012- appeared for H1b stamping at hyderabad, VO issued me 221(g) white with case number( wasnt able to track it online) marked with AAP.
    25/07/2012- client informed me that DOS has contacted for verification and they has replied accordingly
    06/08/2012- Dropped passport at VFS for further visa processing as they requested
    08/08/2012- got email to submit “itinerary of services/engagement”, informed to send soft copy via email or submit at VFS
    16/08/2012- send email to consulate with all docs attached
    …. waited …waited….waited… no further communication from them upon checking with VFS on current status after 4 weeks of doc’s submission they informed me that “Embassy is waiting for documents from me”.. I gone mad after knowing my status … (My suggestion even if they ask to send email for documents submission NEVER NEVER NEVER do that, it happened to my friend also).
    16/09/2012- resubmitted the docs through VFS
    09/10/2012- Visa got issued.
    again as there was migration happening in India with new system, there was no communication to me for passport collection, I was constantly checking the VFS track passport site( which was active till last week) to know my status, by the time I reached OFC to collect my passport it was sent back to embassy, with followup and escalations finally received my passport yesterday.

    as others say keep self motivated, dont loose hope, if possible explore options here as backup, if one is lucky convenience client for work from home option!!!

    I am waiting with 221(G) yellow slip since August 1st, 2012 and regularly checking Mumbai consulate website.From last few weeks, i can see that the list is not being updated on a regular basis in weekdays. It’s being updated once or twice in a week. Any comments from you guys?

    My seconf interview has also same result. VO again gave 221G with green slip and asked me to submit almost same documents with additional list of 2 more documents. When I said I already submitted all documents then VO told me that he would like to see again all documents together and he needs to verify. When I said USCIS has alreay verified and I got approval after their verification only but he said I will have to start this process again. In short they want some more doucments and same I will be submitting it this next week. It is so much frustrating and painful.

  11. got a quick question…regarding 221 G and filing new H1 with new employer……

    I came to India in Feb 2012
    got 221G
    it is still under pending process
    I am still in India
    I got a full time job in other companyin USA (thru phone interview)…that company has filed my H1b and it got approved
    Now I need to go for stamping for my new H1B

    my question is….regarding DS 160!!!!!
    What should I write as my current employer
    If I say my current employer as my new H1b comp, then what should be my previous employer end date..??? Should it be H1 approval date (I 797 notice date?) or I 797 validity period start date?

    Please let me know if you have an idea…

    • After receiving 221 G ( it is still under pending process since feb 2012), I have filed new h1 with new employer(full time). it got approved…I need to go for stamping now.

      In DS 160, there is a field for current employer….what should I write….
      my current employer should be… my new h1 employer or old h1 company with whom 221 g is in pending process.

        IMO, it should be the old employer. Although the new employer has approved petition for you, but you will not start working for them until you reach US, right? So your most recent employer is the old one. There is another section asking about H-1 petitioner and there you need to mention new employer details. You can check w/ others as well.

          Which documents should I carry while going for 2nd time stamping after getting 221g…

          From my previous company I have worked till July month. and paystubs got generated till july month. If I go for interview What should I say about the gap of time between July and Till date?…any idea or suggestion what to speak to VO about this…

            Be truthful about the response and if you were searching for another job then mention that. As for documents, you should carry all documents related to new employer. They shouldn’t ask much about old stamping except why it was put into 221g and where that process is right now.

        I guess it should be the New Employer. Though it says “Current Employer”, it logically means “Employer for which you are going to work with this H1”.

        Pls check with others too. You may contact VFS too.

    When i got married my hubby was on OPT. so i gave interview for F2… 2 time rejection 🙁
    once my hubby’s H1 is approved i try for H4 in jul 2012… and got 221(g).. after 3 months i directly went for interview and finally got H4

    *) Petition approved in September 2011.
    *) Visa Interview in India in May 2012.
    *) Since from than “Waiting” & getting standard “Administrative Processing” reply from VFS.
    I see that couple of you have given dates for “USCIS received Petition to reivew”, how exactly you are checking the dates for this.
    If I am using my Peition number with which it was approved by USCIS, it still shows the date of September 2011.

    • The date is when one get an email from counsulate stating their case is sent back to USCIS. Did you get any such email.

      I assume your case is still wit Counsulate? Which counsulate did you attend your interview at? Internal project or EVC model are you in?

      • No mail from consulate, always that standard reply from VFS. Direct employee of that company but this company in past applied for visa under EVC also for couple of candidates.
        My case is also different in one way that during interview VO said i would like to further review your documents & as i was having a big set of document she asked them to give it to VFS counter & told me that they will revert back in few days. No slip was handed over to me & no case-number either.
        but after 3weeks i recieved my passport & when i sent mail to VFS they confirmed my case is under AP but till now they never told under which slip it is.

          • Delhi consulate. Does anyone else face the same sort of issue when no slip is provided and VFS says your case is under Administrative Processing.

            visa interview date : 20 Oct 2011.
            221(g) received with some documents to submit.
            Documents submitted @VFS on 2 Dec 2011.

            Since then waiting for result. Same like you, each time getting “under administrative processing mail” from VFS.

            Don’t know how much time it will take.

            In your case it is close to 1year. Did they give any slip to you.
            During interview my inetrviewer was more concerned about the company as it is small one rather than me.
            But still no query has been sent to my employer and also I am not sure whether they sent my case to USCIS too, as I haven’t got any mail from embassy regarding that.

    VO asked me few questions around 7 to 8 which i replied

    VO than gave my passport back & he didn’t take any documents

    VO also didn’t give me any kind of 221g nor he asked me to sign any memorandum

    At the end VO told me that it will take around 1 till 2 weeks to verify & then consulate will
    contact me.

    Almost more than 2 weeks have passed still no update from consulate but when checked with VFS it says under admin processing

    I even checked with my employer & they say still there is no communication from consulate

    Pls advise & i m worried

      Earlier also your case was under 221g or for something else.
      This is what I understood from your query:
      *) You went for interview earlier
      *) consulate put it on hold
      *) you got reaffirmantion notice & appear for interview again
      *) where u got 221g

        During the reaffirmed interview i.e 2nd i didn’t get any kind of 221g nor any other memorandum

        But the VO said it will take around 1 or 2 weeks for verification & then consulate will contact me.

        VO return my passport to me

        So far consulate has not even contacted my employer ?

        Almost it is more than 3 weeks still no reply ?

        I m so worried & tense

      There is not much you can do except to wait. You can follow-up w/ VFS but it won’t help in speeding up the processing.

    I have been issued a 221g @Hyd consulate, 3 months ago. I am a software engineer with one of the top IT company. Due to some reasons, Iam planning to switch my job to another BIG company. Both the companies are part of BEP list of companies.

    Can my H1 be transferred to the new company? When can this happen. ie Can my new company directly approach the consulate for H1 transfer or should we have to wait for the 221g clearance and then again file for an H1 transfer? What is the avg time for getting an H1 transferred? SHould I have to re-appear for another interview incase of H1 transfer?

      The new employer can file cap-exempt petition (aka H-1 transfer). This can be done in parallel to current 221g processing. It can take 15 calendar days (PP) to 2-4 months (non-PP). If RFE is issued then it can take even longer.

      If the current visa stamping is successful then no new stamping is required, else you will have to re-appear through the new employer. Check w/ new employer as some employers want the visa stamp through them always.

But he hand overed yellow slip. after few days i get letter ( yello slip with barcoide), no documents requested, on 23 May my status changed that my case is sent to kentuchy . Its been almost 6 mth, how long still i need to wait? Are their more chances of rejection. How I can do follow up ? Can someone help me on this?

  18. Hello, the case of my son is similar to that of Sanjay mentioned for H1B visa stamping.
    He had to appear for 2nd interview on 1st June 2012 after reaffirmation of his petition, since earlier his H1B stamping was denied in Nov.2011 and the employer filed review petition.
    On 1st June his passport was retained and asked to submit some more documents, which he submitted on 25th June 2012, after obtaining from his employer.

    Since then, nothing heard and passport also not returned. When my son mails enquiry , there is a reply, that it is under admn.processing.

    What could be possible reasons?

      The administrative process is lengthy process its takes more time. But what are the documents they asked after your son’s petition was reaffrimed.

      • The documents mainly pertain to company related matters, like copy of tax returns for the last 3 years, number of employees working, their designation, salary structure,
        company,s main business and duration of the project for which my son has been hired etc. But my son is not on the project, he is being engaged as a Management analyst to streamline existing systems and procedure, formulate effective policies, as a regular employee.

        All these documents he obtained from company,s office in Newjersy and submitted through VFS to New Delhi counsulate.

    I got 221g about 4 months back. Consulate did client verification quite some time ago and since there’s no update. I have a full time offer from another company and they are ready to transfer my H1. I am sure many of you have done this earlier. Can you please guide me how this works? Anything particular that I have to be careful about?

    • What is the best time to do H1 transfer to another company? I think I should get it done before the case is pending in administrative processing. If it’s sent back to USCIS, then it would be difficult to get H1 transfer. Is that right? Please advise!

    • Hello 221gwait,
      If you have full time offer then it will be easy for you to get the Visa with direct employment. But i would like to what was the reson for not approving your Visa first time?. Normally its take one to two months to get the Visa after client approval.
      If you have valid job with current employer then they will approva your Visa soon.

        They did client verification and it was smooth. Mine is EC model. My case is pending with Mumbai consulate and my observation is that with Mumbai consulate wait time is quite high. While I have already waited for 3 months, I think that chances are very low to hear something positive at this point of time. Moreover, the full time job may not be available for extended period. I can wait for 2 more weeks or so.

          • Thanks Vijay. That’s what worries me. How much longer I will have to wait and I don’t want to let this FTE opportunity go if I am going to get NOIR after 6 months of wait!

            I think if they have decision in 3 months then it becomes clear what to do next rather than just waiting.

      I had similar case as yours, Got my VISA interview in April, put into 221g, submitted my documents in May. Client verification done in July and after that no updates till last week. Last week I received a call from US embassy in New Delhi, where the guy told me that they had sent me an email on 6th August, asking me to submit my passport. I explained him that I didn’t get any email neither from VFS or from Embassy. The guy told me that now VFS is not associated with US consulate and I need to submit my passport to Team Stanley in Delhi.
      Submitted my passport 2 days back and waiting for any communication from embassy.

        My case is also with Delhi consulate .Do you know who was contacted on client side by embassy ?Was it HR or your client manager?
        Embassy hasnt contacted my client yet and i want to make sure client HR knows what to expect since my manager is aware of the situation but HR not.

    It generally takes 4 to 8 months for USCIS to response. Sometimes it takes little longer or less and there is no set patterns.When case is send to USCIS it simply means that there will delay for processing and stamping.my employer file new petition with same client and it got approved.

    I am going for stamping interview very soon. This is my 2nd fresh H1 petition. 1st petition is still under review with consulate after 221(g) for close to 2 years. How is my chance of getting valid visa this time. Will my previous petitions review process affect my current petition. The reason for my previous rejection notice was ” I was not academically and professionally not qualified for valid visa”. I did my graduation in biotech and then did MBA. I have more than 4 yrs of IT work experience. Could you please guide if i am eligible this time. What is the percentage of interview clearance.

      • After 221g i got a letter saying that the case was suspended. Then after couple of months (approx 3 months) i recieved an email saying that the case is reaffirmed and re approved. Then a 2nd email saying that it is under review with USCIS. Since its been over an year with absolutely no updates on the case my employer went for re-initiation. I wanted know how can i make sure that i clear the interview. As far i know i am completely eligible for H1. Please advice

    If you are FTE then even your case is more straight forward. What I understood from various forum(includign this) is that currently USCIS and state department do not encourage vendor based model. But in reality 80 to 90 percent IT compnay and consultants work on client and vendor based model. My case is almost similar to you. I got 221G and now my petition got reaffirmed and I will be going for second interview once I have all updated documents.
    Did Vo asked you about latest pay stub ? client letter ? is there any unexpected questions during your interview?
    They did not keep your passport which makes me think that it will again take little bit longer for any reply from them but not sure about these guys and there is no set patterns for any case.

    This is strange. I am not sure but would like to know that did you have updated client letter ? Still are you working on project remotely ? I have seen previously if project is terminated or do not have updated client letter then VO is suspicous about requirement of non-immigrant worker.

    The visa officer just asked for my resume and gave me a pink slip and told me that my passport will be returned in 4-6 wks. Today I got an email that my passport is being sent back but he online status shows my case is still pending.

    Can anyone explain why?

    I received 221 g white with case number in july 2012 when i checked on the HYD consulate website it shows your case is not find in the system. Today i checked with the same case number it showing ” Your case is currently undergoing processing. Please continue to check this website for updates on the status of your case. Any new information received will be posted to the website.”
    is there any chance to expect the +ve thing on this. 🙂
    first time 221 g blue retained passports and after 5 months 221 g white with case no.
    no docs requested.

      I also attended the interview for H1B in july and i was given a 221g ( White ) , i dodnt see the case number online, I was asked to submit some documents, I would be submitting these documents this week. Do you have any idea when would the case number be reflecting online – Would it be after the submission of documents.Also i havent recieved any email from them.

    H1b Reaffirmed as per USCIS site : 20th Jul 2012

    My h1b reffirmed and i attended second interview on 16th Aug 2012 @Delhi

    VO kept passport & other supporting documents including Client Letter & Told that “i want to re-evaluate your case and let you know ASAP”

    After follwoing up with VFS i got following message

    “Dear Sir/Ma’am,

    As per the US Embassy, they do not require any documents and your application is pending under Section 221(g) of the Immigration and Nationality Act (INA) for administrative processing. Section 221(g) prohibits the issuance of a visa to an individual whose application is incomplete or inconclusive, or whose eligibility has not been firmly established. In this instance, post is attempting to independently verify certain information presented by you at the time of your interview.”

    Is this happened with anyone ? is my case under another Admin process. ?

    Finally…!!!!! on 8th Sep 2012 I got passport Stamped..

      Visa Interview: 15 march 2012, got 221g (green)
      5 july 2012 my case is sent back to USCIS. Now I am waiting for their reply.

      My petition is approved till Oct 2013. Almost one year left, looking to your case it seems I have to still wait for at least 5 months.
      I just wanted to know, for how long you got your visa stamped, I mean how many months still left for your visa expiry.

      Im kind of in similar situation as yours .My case was sent back and recevied by USCIS on March 7th 2012 but havent heard from them yet.
      I was on EVC model and and my project ended on June 15th 2012.
      Not sure what will happen in my case.
      I called USCIS helpline and they advised that my employer need to call them and then they raise a service request for my case since it has been more than 6 months.
      since the project is gone,my employer says it better to wait and let them come back to us becuase if we reach out to them they may ask questions and we will not be able to answers there questions since project has ended.

      If i see your case,it was started from Nov 2011 and ended on Sep 2012. have you been working with same employer/client during this time?
      are you on EC/EVC or direct employment ?
      would be able suggest what should i do ?

        Fortunately i was working remotely during this 9.5 month.

        As i read in blogs that in 221g cases, sometime USCIS Call/Email and confirm with Client about project details and duration. (though in my case USCIS didnt contact my Client).

        Anyway did you submit Client letter , when u attend First Interview ? if so what’s was the project duration ?

  28. Is someone in this forum facing the situation as do I !!!

    Issed 221(g) white with case number 0n 05/31/2012 at hyderabad. unfortunately dont see any update via website.

    around 07/25/2012 – dos contacted end client
    08/02/2012 – asked to drop passport for further process of visa
    08/06/2012- submitted the passport at VFS along with 221(g) slip
    08/08/2012- got email to submit “itinerary of services/engagements”
    08/15/2012 – submitted soft copies via email (as they directed)
    08/27/2012 – send email to make sure they received the copies and they acknowledge with the receipt also mentioned it has been forwarded to the concerned VO

    still waiting today for further update !!!! its been 15 business days since I submitted the doc’s will it take more time to process or can I expect any update in near date ( based on past data).

    my concern here is how long does consulate keep the passport with them? isn’t their any stipulated time to process it?

    hoping for positive outcome soon !!!

    • My passport was on hold for 1month by new delhi consulate. finally got it back after the employers lawyer contact them and pressured them to return the passport.
      under any circumstances the consulates cannot hold the passport more than a week or so.

I guess i could have asked them to return my passport but i thought they will return it with the stamp, so I am still waiting..!!! Did you get 221g ??? Did they refuse or delay to return your passport upon your request??? Please share your case as well if you do not mind..!

          As per my best knowledge any 221g case exceeds 60days of time frame from date of interview can be followed by attorney, follow up with attorney will definitely help you.

            Thank you for your reply. My employer did everything from their end, we even contacted the senator twice (month of May’12 & Aug’12) which did not give any productive reply..!!! My employer verification was done in end of Feb’12 by USCIS officers at my employer’s office and they even said that I should get everything back within few weeks as everything is fine, they did not even ask any further documents after their visit..!!! My HR follow up with those officials after few weeks as we did not hear anything and they said they have already sent the report from their end..!!! And according to Department of State my case is still at the consulate level, it has NOT been rejected ans sent back to USCIS..!!! (surprised..!!!) They are taking such a long time to decide what to do in my case???!!!!! and my employment is kind of direct no layers in between..!!!
            Any suggestions/opinion is highly appreciated..!!!

            221(g) is the test of applicants patience :), I feel they do multiple back ground check against the applicant, as the process is not transparent to us I am in assumption it will take little more time to make a final decision.

            I seen cases which got their visa after long struggle. dont loose hope.

My background is crystal clear man… -:)..! idk what they are looking into..!!!! I hope i should get it now after waiting for more than 9 months..!!! I still have hope because my case has not been rejected and sent back to USCIS, passport is still with the consulate and after my employers verification, they have not asked any further documents… so… lets see…

            Did you send e-mail to VFS recently asking about your status?. Normally they approved the Visa after one month of client/ employer verification. It is really surprized for me why they are holding your case.

            I would suggest please send all the details with imp to VFS and ask the status about your case

            Thanks for your reply…Yes, I did send an email to VFS asking about my status and I got reply on Monday that “its pending under 221g for admin. processing, In this instance, post is attempting to independently verify certain information presented by you at the time of your interview.” My state senator also got the same reply on his 2nd inquiry on 28 th Aug’12…!!! Many of 221g applicants are getting same reply recently i guess… (Generic one..!!!) I am surprised because my employer verification was smooth, no problem at all and that’s why those officials told my HR that your employee should be back soon..!!! So far my case has NOT been rejected and sent back to USCIS so i am still positive that they do not have solid reason to reject it i guess…!!! (being an optimist here..!!!). Lets hope for the best..!!

    • Hi Harish,

      They normally can keep the password till 60 days because most the issue resolved within two months. If you will not get the Visa in one week then they will be validating with client about your role and position so it may take another 6 weeks to get the Visa.
      Please send the polite e-mail to VFS after three weeks asking the status about your case.

        In my case they didnt retained the passport at time of interview, VO kept all the docs and returned passport along with 221(g) white with case number( which is useless), as you said within 60 days they did contacted the client after that with in 2 weeks they asked me to submit the passport, after submission received email to send “itinerary of services/engagements till petition validity” , its been more than a month.

        will there be another client verification?

  29. I also got 221(G) blue today morning and have to submit documents basically for employer and clients.
    But still i dont know is this a genuine way of working or they are just doing ridiculous work because our foreign ministry is not saying anything to them.

    First employer file all papers with his all documents like Tax papers, LCA, I129, Education report and USCIS letter. After verifying they send Petition approval to employer. Then why the hell Consulate guys do “Keedagiri” and ask question regarding Clients and Employee.
    They “Stupid guys” has to only verify my identity and should not ask single question about my employer and client as that USCIS’s task to verify before sending Petition Approval. This is really a frustrating and ridiculous way of giving 221(g) without proper reason. If i got 221(g) and told to submit all employer paper then it means their(US) USICS department is not working efficiently or Indian Consulate guys are treating us like Donkey and doing any shit they want.

    will submit the yellow form, passport and petition I797 form by tommorw.
    They havn’t asked me any other docs.

    • Where is USCIS ..The answer to teh question is simple USCIS is urely not in India ,maybe somewhere in US ..you had a good chance to get the visa Immediately…now I assume you are in the 15 month que. What happen after that u have shared only part of your tragedy.

      I think he was referring to the bunch of documents your employer would have submitted to USCIS. This includes a letter employer sends to USCIS mentioning reason to hire you.

    issued yellow slip. The VO said that your application is approved but needs admin processing.
    Since then i am constantly following up on the Mumbai consulate site for my CEAC code.
    MOre than a month passed ..but i cannot see my number.

    Don’t know how much more delay it will take 🙁

        • I understand what I am trying to understand how can the VO say your visa is approved. Assuming she said so what are the documents asked for in 221g, what were the comments on the yellow slip?
          Did it say your visa is denied under 221 g and to overcome those submit the following documents or no documents were asked for?
          Wish you all the best. As far as time is concerned believe me you cannot do much it can be anywhere from 2 to 6 months or more.

    I was interviewed at Mumbai consulate on 22nd June, and apparently got 221g blue. All documents that VO asked for were very generic ones like client letter, pay stubs, petition with approval, returns, etc.

    Mine is an EC model and H1B Ext was approved with the same client.

    I submitted all docs in about 2 weeks and about a month back my client was contacted by USCIS. Client responded positively.

    I have not heard back from US consulate yet. Any idea on what it might take to complete processing?

    I checked with my employer and they did not receive any call/email from USCIS.

    Any comment/idea is greatly appreciated.

        • Usually it will have a period and yes it is your Hubby/H1 bank statement and pay stubs. because it is marked under visa applicant it should not be difficult. unless you were not paid. If you were not paid to protect your interest the VO will reject your application.All the best.

    I appeared for interview at delhi consulate on 8/14/2012. i got a green slip 221g asking documents from employer. VO kept my passport and I797C. I submitted my documents on 8/21/2012. Since then I haven’t heard anything from the consulate. Does consulate responds to candidates once they receive the documents? I am working full time no client, no vendor. But it’s a small company with 9 employees and I am only the foreign employee. i am supposed to fly back on 1st Sept 2012. I guess I have to cancel my ticket. Could someone what are the chances of getting my visa approved?

    • what are the documents asked for in the slip? It depends on that and how fats your employer and you acn submit the same and the credibility of the same.

        They asked for whole H1B file, internal project description, last 2 years federal tax return, all notarized list of employees. I submitted the documents after 1 week i.e. 21st August 2012. I haven’t got no reply from US consulate as of yet. It seems to me that it might take 2-6 months at least. Since i am a full time employee, I am not sure that my employer can wait that long :(.

        • No Problem , Dont worry the employer will wait more then you if he wants to file H1 for other employees in future. A negative or no reply from him would blacklist him. As far as you are concerned yer 2 , 6 or more months carry on life as if this never happened with you.

            Ans: – No internal project. I get work on time basis from my boss and from different customers who wants additional work in our software. They contact my boss, if my boss agrees I will make the necessary changes.

            What do they need you for?
            Ans: – To create and update in built company software.

            Ans;- Started in 1997

            Are they also into body shopping?
            Ans: – I don’t know what do you mean by this. We make electronics products which require software as well for communication with the electronics.

            Office or place where you will work from?
            Ans: – We have office it is the same as where all the employees work. It is same as mentioned in LCA. We have one another location which is in US itself where only 1 employee work.

            Your role how long they need you for?
            Ans: – I guess they need me as long as I want to work over there. My company will always require at least couple of software engineer full time in-house.

      I was in similar case and my Visa was approved after 2 months the date I submitted the documents after second intervew of reaffirm petition. New Delhi Consulate was not satisfy with the docuemnts and they checked with my client about my position and role after that my Visa was approved. Your case is still in process and if they will satisfy with documents then it will be approved in 25 days otherwise they may check with youtr client about your position & Role.
      I wish your Visa will get approve soon.

        He took I797C ( print out , my employer got it on Plain Paper, From April 2012 USCIS not sending watermarked docs, they just use white Bond Paper)
        Passport,221g pending Letter & asked me to submit supporting documents (i gave client letter, vendor letter,timesheets,LCA,)

        Yes i am under EVC model.

            VO: Is there any other vendor in between ur employer and client
            Me: Yes

            He told i want to re-evaluate your case and let you know ASAP.
            He told they will call/email me.

            BTW , when i was interviewed on Nov 2011 , i was asked about Employer and Employee relationship , as there is a vendor in between. so that time VO gave 221g and sent a NOIR, then after responding. USCIS reaffirmed my h1 petition..

    Status: administrative process, waiting from past 3.5 months

    Now i have got jo in one of the biggest top 5 s/w MNC in bangalore and transferred visa to this company. They are saying me to go for visa interview and get stamped, but I did not inform them that my earlier petition is in admin processing status.

    I want to go for visa interview from new company but my passport is with chennai embassy,

    1) is i possible to go for visa interview without passport? I can say that passport is with embassy during visa interview at chennai consulate?
    2) how to withdraw passport from embassy without withdrawing earlier petition? is it possible to withdraw like this?
    3)when i ask for passport from embassy do i need to say that I will be coming for visa interview from new company or should i say that i a traveling on vacation for some country and will return passport once visa got approved.? which one is better?
    4) how long it takes to get the passport once withdrawn or asked for passport?

      1. You have to carry passport at the time of interview. You cannot appear for it w/o the passport.
      2. Call VFS and check w/ them. They may ask to submit an application for the same along w/ reason
      3. You don’t need to provide all the details. You can give a generic answer like you need it for travel to another country etc (check w/ your attorney)
      4. Check w/ VFS

    Have you submitted original docs or copy of that? Like he asked me to submit 2 yrs company tax return, notarized letter with employee list, Job vacancy letter on letter head. Vo asked for my original or certified copy of academic credentials. I didn’t understand the meaning of certified copy of my academic credentials. Is that mean attested copy?

    • Have they asked you to submit your academic credentials, yes you can get it certified but you ahve to submit only those documents mentioned in the 221G blue slip.

      Have they asked you for your evaluation report that is done by your employer. I guess your employer should help you out with all documents +understand the 221g.

      Please dont give any originals , it can take ages for the process to get over you will be helpess if you get something more fruitful and ready and they ask for the same docs.:)

    Handed over Blue slip, interview was fine.

    Kept looking for my CEAC on website(plesae note blue slips CEAC will not be updated on Mumbai Consulate website)

    There is no standard waiting time for 221g.

    • Thanks Kumar very informative,Was your petitioner big consulting company or mid sized?

      When I was through with my interview the VO asked me did you read the document which they now submit at the counsulate on employees right.Basically they want to protect all employees from harassment and small time agents if I may call them so. In future it will be a standard practise for all visa and employer if he cannot stand the test the visa will be rejected.

  47. Hi Guys,

    I have visited Mumbai consulate on 17th august 2012 and unfortunately received 221g blue slip. below are contents in that:

    “This office has denied your application under section 221(g) of the Immigration and Nationality Act(INA). You may overcome the grounds for the denial of your application by submitting additional documents and/or information.”

    Can anyone please let me know if it is the common statement in all blue slip? What are possibilities for approval? My petitioner is only 1 and half year old company in USA.

      Yes July 27 same blue slip , submitted documents on30th July. Your employer would have to give those bulk documents and wait.your employer did he file it for internal project and wait. This is really a frustrating but very difficult to know on what basis the timeline can be assessed .

      Depends on what documents your employer is able to submit, Was it for an internal project. Yes this is common slip and tradition on at the counsulate.

      I got the same documents submitted now waiting for approval or

    My visa is on process under 221G,

    today i got the reply from VFS

    As per the U.S. Consulate, your petition was returned to the Kentucky Consular Center (KCC) on Aug 5, 2011. Once KCC receives a petition, it is returned to the approving office of the United States Citizenship and Immigration Service (USCIS) for review and possible revocation. Please direct all future inquires regarding this case to the approving USCIS office.

    I want to know the meaning of?

    If any one can explain,pls do so.

    • Atul, unfortunately they have refused your visa and your petition is sent back to USCIS for review. It means they are going to check your case again, and there would be two outcomes.

      One, if they are satisfied with the documents you sent earlier, they will reaffirm the petition.

      Two, they may send your employer an NOIR (notice of intention of revocation) and your employer have to reply within two months to prove your case.

      In either case, there is no set timeline and it may take from few weeks to months. It is case to case and outcome is really unpredictable.

      That is so unfortunate but was your case sent back to USCIS in August 2011??? You have not heard anything after that, Have you??? And when was your interview, which consulate???
      I am waiting since 9 months from New Delhi consulate..!

            But so far no decision has been given for me..! They keep saying its under process/pending.. passport is also with them since the day of interview..! but i can understand your situation as case being sent back to USCIS after such a long time..!!! so frustrating man….

          • Strange so you did not hear anything from December 2011 , which seems to long . Were you able to submit all documents asked for by the vendor.Was it for internal project?

            I submitted all the requested documents in 10 days of my interview in December 2011..!!! They did employer verification at my employers office there on 29th feb’12 and it was pretty fine..! We have not heard anything from them after that, they did not even ask any further documents from my employer or from me after their visit too because as per visiting officers everything was fine..!!! and so far did not get notification case being sent back to USCIS, passport also with the consulate since the day of interview..!!! and i do not have any vendor in between..!!!
            Any opinion/suggestions ??? !!!
