  1. Hi Saurabh,

    My H1 visa is pending (221 g case) , now my client is sponsoring new H1 for me. Do i need to withdraw my H1 case which is pending before i attend the interview for my new H1.

    • Raj,
      No need to withdraw it. I have seen cases where subsequent petition/stamping got approved w/ questions asked about pending case. However, there is a possibility that you are asked to withdraw the previous case when appearing for the subsequent interview.

      There are few experiences posted on this blog. The interview can either be a formality or another nightmare. Make sure to carry all the documents including any documents/communication your employer sent to USCIS for the reaffirmation.

    I have sent approved notice I797 to VFS and didnt heard anything from them. 🙁

    shows status like “Your Passport is under process at U.S Embassy/Consulate.”

    Any idea what does this mean ?

      You can contact them again, but they may be waiting for communication from USCIS about the reaffirmation. Other than that, there is nothing you can do but wait.

  4. Hi Saurabh,

    I had my interview on 3rd AUG in Mumbai for H1B category
    The VO asked me very basic questions and then he mentioned that my application is approved but gave me the yellow 221 g form.
    He circled the first category at the bottom of the form and asked me to check on the link.
    The link has CEAC barcodes and i cudn’t find my code till now there.

    I am so worried, any idea if these type of cases take time or if they are quick (10-15 days)

    • Yellow slips will not take more time. Your case should be shown on consulate site in max 1 months 🙂

      Bar code is there on DS 160 confirmation page.

    The VFS website has the following statement “All additional documents and information asked for by the Embassy or Consulate in a 221G letter should be submitted at the nearest VFS Application Center of the Consular Zone, where you were interviewed, within the validity period of the letter. The 221G letter is valid for a year from the date of issue. ”

    Does anybody know what it means that a 221G Letter is valid for only one year? Also, I see cases that are more than a year old. How is this point relevant then?

    • Satish, I guess the validity of 221g is in context of submitting the documents. The response does not come under this. So there is any document pending from one’s side, it has to be submitted within 1 year or with in the time frame mentioned in the 221g (what ever is earlier).

        Thanks for the response. However, the sentence says “The 221G letter is valid for a year from the date of issue”, it does nto talk about submission of documents. Hence, my query again is if there is a timeline for 221G cases and if so what is it?

        • I second Deepak’s views. Generally they make that statement in bold red fonts.
          “You should submit all the requested documents within one year”

      I too agree w/ Deepak. They say that documents need to be submitted within the validity period of the letter. This means everyone has up to a 1 year to respond to 221g (just like they have 60 days for RFE). What time they take after that, carries no SLA or limit.

    • Yes Rajnikant, since you have an approved petition, anyone can file a Cap-exempt petition for you (means you are not subject to the annual cap). New employer has to pay the fees again. The whole is going to be repeated, they are just going to use your approved petition number to make the case cap-except.

      You can even have more than one approved petitions but your visa stamp can be done by only one employer.

    This one of the success story of 221g.

    Interview Date :25-May-2012, issued yellow 221g (Requested all petition documents,Project description,notorised employess list,Project plan.
    Documents submitted: 18-june-2012
    Received mail on 18-july-2012 to submit passport
    Passport submitted: 20-july-2012
    Passport Received: 1-Aug-2012.

    It was happend so quickly and got the VISA stamped.

    my name is smrithi.. i live in the bay area… i am on h4 visa… i would like to work.. i am a software engineer. i learnt that this years quota for h1b is exhausted.. i heard of Employment authorization document … can i apply for that? as in am i eligible for that? thanks

      You are not eligible for EAD unless your husband has filed his I-485. Until then, you have to rely on your own H-1.

    My H1B application is with USCIS pending review under 221g processing from 8 months and case status is not updated.
    I want to know if i can enter US on visitor visa, can I directly work on this H1 approved petition or do I need to file for intended petition and Is it wise to try that?

    Secondly, In your opinion, What are the chances of getting visa showing internal proj with a consulting company.

      I would strongly suggest not to enter on B-1/2 when you intend to work on H-1. You can find another employer and have them file cap-exempt petition. The other option is for the same employer to file another petition, but it can also run into same issues.

      If the internal project is genuine then it may get approved. However, no one can guess the timelines involved. What kind of documentation did you submit to support your internal project?

    My 221g was approved recently.

    Please guide me for below questions –
    1. Is this 221g considered as denial when I file ds 160 say next year ? (Or visa approval after 221g will void it i.e. its not considered as denial) ?
    2. Can the time spent outside USA due to 221g (Kolkata consulate) be counted as part of 6 yr total h1b period or we can reclaim this period ?
    3. Port of entry – I hope there shouldn’t be much trouble due to this 221g and the time spent outside USA approx 7 months shouldn’t be issue at the time of port of entry? Is it safe to have port of entry near to client location or near to employer location (2nd stamping). What all questions I should be ready for ?

    Also, please let me know what all things I should be prepared for before I travel. (Was already there in US for last 1.5 years.

      1. Going forward, you will have to mention Yes in the DS-160 form for the question related to visa refusals/denials.
      2. Only the time spent inside US is counted towards the 6 years cap
      3. There should not be an issue. Carry a recent employment letter stating that employment is still valid. Also carry contact information of your employer/client etc.

          NOIR : Notice of Intent to Revoke the application/petition.

          Once USCIS sends NOIR , employer has to respond with requested documents in NOIR
          after that USCIS takes decision either reaffirms or denies.

          Mine is reaffirmed on 20th Jul 2012. Waiting to hear from consulate/VFS for interview.

  12. Hello All.
    Has anyone who has been referred to 221 G case ( pink slip) in chennai and have re-applied for visa with different employer or went in for different visa type(F1/H4).
    Also -please advice if the petition renewal can be done when one has been referred to 221(g) case.

    All help/advice is welcome and appreciated.

      • Khan,
        There is no guarantee that new visa stamping will not run into issues. You can try, but be prepared that things can go wrong w/ new visa stamping.

      • Khan, if you can have another client (preferably direct), that would be nice. Just file an amendment for that new client along with LCA and you can apply afresh (cap exempt and in premium). LCA takes 7 working days and everything should be done in 15 days or so (reaching the docs to you may also take time).
        Same thing you have to do with new employer. Either ways, if you have a solid case (direct client, all the papers ready), go for it.
        I just have a doubt. Since your petition is expiring within two months, and they are certainly going to issue you visa till the validity of your petition. Would you be able to renew it in such a short?
        But don’t worry, if it is expired and you could not make it in time, you can always apply for extension from here. Than go with the same steps mentioned above.

          Thanks for clarifying. My case is still under processing with chennai consulate.
          Just to confirm – we can file for extension with existing/new client details even when the present petition is under processing and go in for fresh stamping.
          With two months to expiry for present , what are the other options that I have.
          Have there been cases, where the processing was completed post the petition valid date.

          I work for a client through Indian MNC.

            Yes, that can be done. If the processing gets completed after the petition has expired, then it would not help. The stamp expiration date is typically petition expiration date. I think once they are ready to issue visa and realize that the petition has expired, they would ask for extension before issuing the visa stamp (another delay).

    and employer got I797c notice.. its just normal white paper..not like the original watermark letter.

    Employer has sent PDF of it. would it be fine or i need to get the one which Employer got..

  14. My visa was refused under 221g @ New Delhi Consulate for my H1b(EC model). Now, my visa is approved after 3 months. Now, my wife needs to

    go for her H4 visa stamping.

    1.Are there chances she also gets 221g again (I assume my case was already in 221g and got cleared couple of weeks back, there shouldn’t

    be 221g again.)

    2. Currently, I am still in India. What will be the suggestion about when should she go for stamping — if I go to US before her visa

    stamping then there are chances consulate may ask for last 3 months salary slips, which won’t be available if she goes immidiately.

    3. If she goes for stamping while I am in India and what if consulate gives her 221g and keeps original I-797 with them. In that case I

    can’t travel to USA without I-797.

    Please suggest.

      Please send your wife to Visa interview while you are in India and she will definitely get Visa without any issue. My case was similar to you and I scheduled my wife Visa interview at New Delhi while I was in India after getting my Visa. Please attached the photo copy of your I-797 with File while in main folder and ask her to keep the original petition in separate folder in case they ask then she can provide it. But orginal I-797 is not mandatory.

  15. I got 221g white sleep on 24 JAN 2012 from bombay consulate and i submitted all the asked document on 9th FEB. After that i got one mail from bombay consulate regarding sending my document to uscis on 19th MAR. USCIS also confirmed that they received my document on 6th of APR. But still me or my employer have not get any reply from USCIS. so Please assist me in my case. how long should i wait? or do i have any another option?

      1) We don’t know you or your case, try to be elaborate. Explain your case.
      2) Join English coaching classes.
      3) Listen before you speak. In this case, read this forum thoroughly before putting questions. You will get your answers. BTW You have plenty of time now.
      4) India is equally good with opportunities, try finding a better job here (if your present employer is only a body shopper).

      Lastly, good luck for your future endeavors.

          • Sky, give us some details.
            1) What model is yours? Direct? EC?EVC?EVVC?
            2) What documents they asked and what you submitted?
            3) Sending your documents to USCIS means they send your case to USCIS for further review I believe. (It actaully goes to DOS and they send it t your approving USCIS office)

            Now your present situation is USCIS has to review your case and they can either 1) reaffirm (re-validate) your petition or
            2) they may send NOD (Notice of Intent to Deny) to your employer.

            In first case you need to appear for another interview (without taking appointment) and you will go thru same process.
            In second case, if your employer defend your case giving sufficient document, you get go to situation (or permanent rejection) .

            Lets forget case 2 and hope your case will be reaffirmed. but there is no set time line for this. There is ETA and you can not force or influence them (officially). Average time I saw was around 11 months (just my observation).

            So either you have to wait till you hear something from them or you can always file a new Cap Exempt H1B (in premium if you want it fast but sometimes they may issue RFE to buy some time) Go for this step if u feel the your case this time is strong.
            or find a new employer, file New CAP except H1B and start the same process.

            Let us know if you have any doubt. And best of luck my friend. Don’t lose hope.

    I got a letter from consulate stating that the petition was returned to USCIS as the beneficiary of the petition was not entitled to accorded status as per information received during interview.
    Does this mean that the VISA was refused based on candidate’s issues or employer’s issues?
    I was in EVC mdel.

      In Which consulate you attend interview? What was the color of the slip that you received during your interview and now? If you can brief your interview questions that would help.

    • Yes Shweta, sorry to say but unfortunately your visa is refused.
      Good news is your petition is still valid. From your earlier post it seems you were waiting for 8 months. So in this mean time were you working for the client? And what model was it? EVC? EC? Direct?

      In your case, this 8 months is actually too long to decide about your case. Anyway, now either you can wait for USCIS decision and if it is reaffirmed, you can try one more time.
      Another way is find another client and apply one more time. (You may need to file H1b amendment for new client. It takes hardly 15 working days in Premium).

      Alternatively, you can find another employer and do the same process if you feel your employer is not able to find you a better and direct client.

      USCIS will not answer any questions for you, as you are not the petitioner. If you have any questions for USCIS, ask your employer/attorney to contact USCIS and ask them.

    My case details,

    Interview – Oct, 2011 – Chennai consulate
    221G – AAP – Oct, 2011
    USCIS – VSC – received the petition for review – Feb, 2012

    My question is, when I checked with USCIS, they asked my employer to contact after 180days. As of now my case was in review for more than 160 days around 5.5 months. My employer have not received any update from USCIS. Is there any case that USCIS have taken more time than 180 days to respond for a petition? do I have any options at this point to speed up the process?

    • Karthik, there is no fixed time lines. I may take just weeks or may be months. My case took almost an year. and from the cases I was following, it took around 11 months (don’t make it average case, just my observation).
      I would personally advise you to find another client, or employer and file another Cap exempt H1b petition. The waiting is horrible (though you have already seen the worst part, first 3-4 months of waiting) and it is better to concentrate on your future, leaving behind the past.
      If you are committed to go back, there are many employer looking for people who have valid or expired H1b, you can always approach them. That would be faster and safer than this wait-may.be.reaffirm-reapply-re.interview-good.luck case.

      my case is similar to your. My interview – Oct, 2011, USCIS – VSC – received my petition from DOS for review on Feb, 2012. till date no update or even my employer has not received any update from USCIS. waiting for around 5.5months.

    • Sajay, your employer will get new I797 and your data should be updated in PIMS. After this consulate will contact you to reappear for another interview.

      After getting the I-797, you can send an email to VFS for assistance.

    In the FAQ section
    Can I reapply if I was refused a visa under 214(b)?
    If you now have new information, or if your overall circumstances have changed significantly, you may re-apply following the same procedures as any other applicant. Re-applying is the only way to have your application reconsidered.

    so here re-apply is with CAP exemption or with new CAP.

    Status: Refused
    Your application was refused. Please see the letter or other instructions you received at the interview.

    What does this mean? and will I be able to file another visa with cap exemption with another employer? unitl now I did not hear or get any info from my employer.

            Today, I saw Refused status on VFS website.
            “Your application was refused. Please see the letter or other instructions you received at the interview.”

            Question is .. did you confirm that the Refusal Status mean – Rejected/Denial .. through VFS ?

            let us discuss even i am not sure…VFS people told me that it still under admin process..but DOS website showing as refused….here my doubt is
            i received 221 g white with case number on 11 th july 2012 saying” your application is refused still we need AAP before a final decision can me made”.
            i hope that same thing i can see in DOS website. response date : 20th july and showing as refused. if it is rejected we can get an email from the consulate and we will receive a rejecetion letter WHITE saying your employer is not willing to pay blah blah…… so i have contatced my emplyer as well so far my client and employer not received any calls or email from the DOS/CONSULATE/USCIS.
            mines is EC model cap exemption. add my id letz discuss.

            I am also getting the same response when i check my case status thro’ the link. When i saw refused, I was freaked out so I called up DOS and they told me that my case is in administrative process..! Next day when i called up VFS they also said that they do not have any updates on my case, I e mailed VFS to find out my case status and still waiting to hear back from them. will keep you all posted reply i get from VFS..!!!

            I heard the same response too. I left a email describing the same and am waiting to hear the response from them.

            Earlier, when I was checking the website it throwed me some Microsoft database error. But now, it displays – process in progress status. however, DOS website still shows me refused status.

      You must have been issued 221g, which is visa refusal. If the consulate asked you to submit specific documents, you should submit them and then wait for them to complete the processing which can take weeks or months.

  22. Hey Saurabh, I have withdrawn my H1B application which was under 221(g) for more than 10 months at Hyderabad consulate. Now planning to travel USA on H4. After landing in USA, Can I apply for H1B visa on the same H1B petition?

      You will have 2 options:
      1. File COS from H-4 to H-1 using the same H-1 petition and work for the original employer
      2. File COS from H-1 to H-1 along w/ H-1 transfer using the old petition and work for a new employer

  23. Hi All,

    In the DOS website https://ceac.state.gov/CEACStatTracker/Status.aspx, if you track 221G Case status, it shows as rejected. However, when you call up KCC or VFS, they say that the case is in administrative processing. Does every case with a 221G form considered as being rejected in DOS website? I just submitted some documents on Friday that were asked by the New Delhi Consulate. So, something does not add up as it it shows rejected on Monday, with a lapse of one working day.

      it does not mean that your application has been rejected. that is the infomration only after your interview same letter they issue saying your application has been refused and please see the information below that VO tick means it migh be asking for more docs or AAP like that. so even i too shocked by seeing it interview i attended feb 23 rd 2012 showing in DOS 21 st feb 2012 and response date 20th july 2012 . if they refused under 221 g you will get rejection letter saying your applicatio has been susppended and returned to USCIS.
      so letz keep hopes on it.

        DOS is displaying 21 feb 2012, because it was they day you have submitted yout decouments atVFS, not the interview date.

          in my case they did not ask for any documents i have attended for the interview on 23 rd feb 2012 and they kept my docs and passports after 4.5 months i received 221 g white with case number on july 11th 2012 saying under AAP. today i have checked my case number in DOS site mentioned case creation date 21st feb 2012 and response date 20th july 2012 . Status : “Your application was refused. Please see the letter or other instructions you received at the interview”.
          up to my knowledge it is does not mean that rejected.

            i think it is not total rejection..in that case we will get email directy from consulate..
            i think thats the 22 1 g staus already mentioned that application refused might be the same in DOS. because even in my case they issued 221 g white with case number but they didnt tick on “you can track this case no on website” they ticked on AAP.
            hopefully it is not total rejection.

    last week my employer received a call from USCIS and they asked questions for about 20-30 mins regarding the company details, H1 Employees etc etc,. Also some of my friends from same employer received a call as well a email from USCIS and were asked some employer-employee based questions.

    Do you think this a +ve sign for my 221g ? Any such similar case in a white slip under admin processing who got there visa approved after such contact ! I got white 221g on May 14th at Hyd Consulate and I am not able to track my case status online still !!

      This is positive sign and in Hyd you get response pretty fast. I go tthe same verification call and my interview was in Chennai, but in Chennai such cases take more time to get decision, if it is -ve decision after the call Chennai Consulate will post the answer pretty soon. You can expect +ve decision soon from hyd consulate

        I am a H1-B consultant working on EVC model and my Interview questions were mostly based on Employer-Employee relationship scenarios.I was given 221g white slip with no further docs asked and just mentioned we need to do some additional admin processing !

        I called DOS yesterday and they said that my case was pending AAP and they dont have any update yet. When I check in the above DOS link you sent it shows refused i.e. because I think on our 221g its mentioned your application has been refused under 221g INA. So think we dont have to worry about the status on DOS link hopefully.

          Yes even me too thought same. hopefully it was the 221 g case status i got the white 221 g with case number on 11th july so response date they mentioned as 20th july 2012 so this might be the same as 221 g status.
          let us hope the best mines is EC model no docs requested so far no call received either my employer or cleint.

        I looked online and found that many people have received 2 emails on same day from USCIS like us . It is a confusing state.
        But I think my case has not been reaffirmed otherwise DOS, NVC and USCIS all cannot give wrong information. And moreover my employer has not received petition also.

    • Jaya,
      Your best bet is to convince employer to follow-up w/ USCIS. As the 2 emails were received on the same day, it is possible that one of them was sent in error (especially the one regarding re-affirming of the case). I highly doubt that they can review the case within a day, and may have send that email in error.

      If your employer is not co-operating, you can start thinking of employment elsewhere. Based on your current petition, you will be eligible for cap-exempt petition.

    Now, I have joined another largest s/w MNC , they have transferred my visa. But my passport is with US embassy.

    1>Can I request for passport since I need to attend interview from new company?
    2> Without cancelling my earlier petition can I ask VO to send my passport? is it possible?
    3> will it cause any negative impact on revoking passport?

      1. Yes, you can request the consulate to return the passport. Call VFS to know the process
      2. Yes, you will have to withdraw the stamping request
      3. If you go for stamping through new employer, the old stamping will not impact the outcome as long as you submitted valid documents.

      Thats a good sign to get the Visa. You have to submit all I-129 petition documents + client contract document with your employer. Please ask your employer to provide the contract document.

            If they asked the documents through VFS, then drop them at the VFS counter. Make sure to get some sort of acknowledgment from VFS about the submission. Also, keep a copy of documents for your reference (VFS is misplacing documents off late).

      We did tried, but it is not helping much. Senator email helps in getting latest status(the same message that we get from VFS), it does not help in speeding up. In which consulate you attended interview and what was the date of IV? What is the color of your slip?

        • What was the date of IV? Mine is Blue aap in Chennai, we approached VA state senator for which we just got pending status. If it is in completetion status they will post that, if not same pending status message that we get through VFS. Mine is still pending and has ben on hold for last 6 months.

          • If the actual status of your case is about to be approved/denied they will post the same to senator office, if not they will post same pending status to senator office. Senator email is not going to help in speeding up the case, they take their own time:(

          • hmm Passport being with the consulate is a positive sign, in most of the cases you would get your visa stamped.

            Rarely there are even cases where the passport was returned with a rejection letter stating the reason. Unless, you don’t have any fraud history, it shouldnt be a prob to you!

            I am also stuck from New Delhi since dec.’11..! I got 221g green slip, so far they have not rejected my case and my passport is still with the consulate..!!!
            I do not know when this process is going to end..!!! I am positive as they still have my passport or else they would return my passport if they are going to reject it I guess .(????)..! I figured out that usually they reject the case at consulate level and send it back to USCIS in few months…!
            Any comments or advice is greatly appreciated..!!!

            Can you please send me your contact details? Looks like we are in the same boat. I have been in the same boat since Dec’2011. The passport is still with the consulate and about 3 weeks ago, we received a mail to submit DHS Letter, whatever that is. We just submitted all docs received from USCIS last week.

          I have been trying to reach the Local and State Senators for 2 weeks now. Local senators have said that they cannot do anything as this is an immigration issue. The way to reach out to them is to fill up the online form and then keep following up on the phone number given.

          However, success rate I have had is not very positive.

          Anybody has any other ideas, please do suggest.

    I m Rajnikant I went for visa stamping at Delhi ,India and my case was put under 221(g) administrative processing(Green latter). On April 1st 2011, and after that I submit required document to the VFS center Ahmedabad (document required A DHS latter copy and end client contract latter) on 13th April 2011After that there is no any Reply from US embassy till today its pass more than 14 month from interview and my petition is expired after 15 months so in such type of situation what can be expected from US embassy which type of output we expect from embassy in such type of cases. .Plz advice

    • Rajnikant,
      If your 6 years are not yet exhausted, you can apply for your visa extension with in India. Or it is better to file a new H1-B using your old approved petition. (It will not come under 2013 quota).

      Make sure you have sufficient evidence to prove your Employee-Employer relationship and other supporting documents.

        • Rajnikant, there are two possible outcome of this pending admin process.
          1) Re-affirmation: You need to go for another interview to the consulate and have all the documents to prove your case. Make sure you have sufficient document and answers to prove your Employee-Employer relationship.
          2) Denial Letter: Your employer will received a notice for intent of denial and you employer has to establish your petition was righteous giving sufficient evidences. (Your employer might not go for this).
          All you can do, ask your employer to file another petition based on your present ‘pending’ petition and have another shot for direct and different client.
          Or you can find another employer who can file for you another petition using your approved petition.
          Both can be done even in parallel.

    I rec’d email from Mumbai consulate stating that the consulate will contact you once they will receive the reaffirmed petition from USCIS.

    What does this mean ??

    Can i again take new appointment & go for interview in mumbai as i haven’t receive any emails from mumbai consulate for interview it is almost 3 mnths now

      You need to wait until Mumbai consulate gets the notice from USCIS. They will then tell you the further process.

    Attended H1B visa stamping in HYD on Feb 4th 2011
    Given 221(g) yellow slip and asked to submit all the documents.
    Submitted documents at VFS on 25th Feb 2011.
    Till now( 15 months) there has been absolutely no updates about my case. Each time I shoot an email to Hyd US cons, they say my case is under administrative processing. I have now given up hope on my H1B visa .

    A> yes, I have just joined them and plan to work with them if the visa is approved.

    A> yes it was filed by my previous employer and it was approved.

    3> Do you still have a job with your client after 4 months?
    A> I checked with my employer last week and the postion with the client is till vacant.

    4> Are you married ?
    A.> YES

    5>Your visa is approved.
    A> YAHOO

      This is what I received from embassy:

      Based on the documents you have submitted to us, and the information elicited in your interview with an American Consullar Officer, we are not able to issue you an H1b visa because:

      Your Petioner does not appear to be either able or willing to provide qualifying employment in the United states in accordance with appropiate laws and regulations.

      In accordance with united states law and department of state guidelines, action on your case has been suspended, and the I-129 Petiton for a Non-Immigrant worker filed on your behalf will be returned to the united states citizenship and Immigrant services (USCIS) with a memorandum explaning the facts of your case as presented to us at the time of interview. The US Embassy in New Delhi is no longer handling your case, and will be unable to give you any information on the status of your petition.

      For your information, your visa was refused today under section 221g of the Immigration and Nationality act (INA). Essentially, this section states that a visa cannot be issued to anyone whose application does not appear to the consular officer to meet the requirement of INA or of the regulations thereunder.

        This means your petition is sent back to USCIS to revoke it but now all depends on USCIS to take action either they will reaffirm or send a memo to your employer to provide the justification. This proess may take time so either you can wait or file a new petition for fast process. Please keep checking your petition status on below site with the receipt number and you will come to know the USCIS decision.

            As you told me that I can file new petition for fast processing. I would like to tell you that my petition was filed under 2010 quota and this year H1b quota is completed. So, can I use cap exempt to file new petition for my H1b?

          • Yes, If USCIS reaffirm your petition then you have to go for another interview but in that case you schould not have to schedule the appoinment. Yes, it will be better to file a cap exempt petition through different employer.

            I don’t know much about these model. I am currently working in India with MNC. I have explicitly apply the visa with the US based company. I have some doubts also, it would be great if you clear those.

            1) My visa is filed in 2010 with X company, so as you suggested I can go for another employ as cap exempt visa, but I have one doubt in this. What I read about cap exempt visa is “it can be filled by non-profitable or govt based company” which means not every company can file this.
            2) Previous to 2010 visa filing, I have applied my visa with other company in 2008 but at that time when USCIS asked the offer letter to my employer he has withdrawn my application. So, I just wanted to know does it effect on my profile like I have already filled visa with two different company and now I will file with another company.

          • What I know about my case is, I will work for some client there but from my employer’s location itself. Like in India we do.

            1. Cap-exempt petition can be filed either by a non-profit org, or by a for-profit organization when the beneficiary (i.e. you) already have an approved petition. This cap-exempt petition is also loosely referred as H-1 transfer.
            2. The older petition doesn’t impact you. You have an approved petition from current employer and it can be used for filing another cap-exempt petition (aka H-1 transfer). No payslips required as you have never traveled to US.

            Can you please tell me what will happen now, any idea how much time it will take.

            If the petition was re-affirmed then your employer will required reaffirmed 797C copy. You can then contact consulate on when to re-appear for visa interview.

            There are some recent examples when even though the person received 2 emails on same day, the case was still under review. Ask your employer/attorney to follow-up w/ USCIS if the case is really re-affirmed or not.

On April 1st 2011, and after that I submit required document to the VFS center Ahmedabad (document required A DHS latter copy and end client contract latter) on 13th April 2011After that there is no any Reply from US embassy till today its pass more than 14 month from interview and my petition is expired after 15 months so in such type of situation what can be expected from US embassy which type of output we expect from embassy in such type of cases. .Plz advice

        DHS letter means your I-797 petition receipt document that will be one page with your employer name validity of I-94 . EAC xxxxxx etc. So you can submit that.

    Can you please reply to my previous post on what a DHS Letter means. I have recieved a mail from the consulate asking me to submit my DHS Letter. This is in refernce to a 221G that I got in December 2011. Request you response. Exact sentence from Consulate “Please submit your DHS Letter and Rs 183”.

    • Hi Satish,

      DHS means – US Department of Homeland Security. Did you get any letter from US consulate before I not sure if they are referring to your petition. You can call VFS and they will def provide you right info. I don’t have your preprevious e-mail so can not give you the exact answer

        here is my case i been hyderabad consulate on 25th august,2011 VO gave me 221(g) saying that returns from employer and replace damaged passport from my side , i have submitted both on 23rd sept,2011, after ages they return only my passport along with another 221(g) on 15th feb,2012 and didn’t ask any doccs.since no reply yet. is there any way 2 fasten the things please let me know bdw i am on EC model,thanks

  43. I received my passport with VISA yesterday. It was tough time to wait for that much long but finally got it. I hope everone should get the Visa soon who is struck with 221g.

    Special thanks to Saurabh who provided the valuable info and that help a lot.

    Case Details:.
    Dec 18th 2011 – went for H1B renewal stamping at Delhi. VO told will take one week to review and rejected my Visa on 24th Jane due to employee – employer relationship and sent the petition to USCIS to revoke it

    Feb 28th – USCIS reaffirmed the petition and sent the re affirmed petition to my employer and to DOS to process the Visa.

    March 16th 2012 – Appeard for second interview and VO was not completly satsify with answer for E-E relationship and told me that will take one week to review the case.
    April 4th 2012 – Received a e-mail from VFS to submit the document Client letter, Contract etc and I did on 27th April 20122.

    May 2012 – DOS checked with client about my role and validate client letter.

    Jun 29 – Received the passport with Visa stamp.

      US embassy New Delhi issued me a Visa without printing my Employer Name & petition receipt number on the Visa page. This will be issue? does anyone received the Visa without printing the Employer name and Petition Receipt number.

        Many congrats to you for getting visa stamped.

        Please help me with few of things:

        my petition was reaffirmed on 14th may 2012 , however till now my employer has not received the reaffirmed petition.

        How long does it usually takes for Re approved petition to reach to employer.
        Does my employer has to call USCIS and ask for it or USCIS sent it to them any which ways.
        Do you need re approved petition for filing COS .

        That is strange. Check w/ your attorney on this. I think it’s just a printing error and it should be fine at PoE.

      USCIS received Petition to reivew: 12th Dec 2011
      Service Center : VSC
      Employer Got NOIR : 10th May 2012
      Employer Replied : 16th May 2012
      H1b Reaffirmed as per USCIS site : 20th Jul 2012

      My h1b reffirmed and i attended second interview on 16th Aug 2012 @Delhi

      VO kept passport & other supporting documents including Client Letter & Told that “i want to re-evaluate your case and let you know ASAP”

      I’m tensed that what elese they want to re-evaluate as USCIS already reaffirmed..its been more than 9 months now..:(

      Didn’t you submit client letter on your Second interview 16th March 2012?

      i got interviewed on 5th April 2011 in chennai and got 221g blue slip. submitted documents on may10th 2011. I called up VFS to know that my case is in administrative processing. some days later VFS sent a mail saying my case has been refused sent back to kentucky. In USCIS site it says in Feb month…

      On February 10, 2012, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

      For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

      Still waiting for a response, and i have no clue how much time i have to wait.

      Will i get H1B visa, what are the chances of getting approval. Please some one guide me, already more than a year passed.. totally frustrated.

        I m stuck with the same,today i got reply from vfs,that your petition was returned to the Kentucky Consular Center (KCC) on Aug 5, 2011. Once KCC receives a petition, it is returned to the approving office of the United States Citizenship and Immigration Service (USCIS) for review and possible revocation. Please direct all future inquires regarding this case to the approving USCIS office.

        I m also frustrated as its been almost 10 months and not sure whether i ll get visa or not 🙁
