H1B 2016 – After Lottery – Premium, Regular Processing Receipts, Time

As I read the comments on our H1B Visa 2016 page, I can empathize what all emotions everyone are going through…some happy to be picked in lottery, some anxiously waiting for the result, some frustrated with the wait…some upset with the overall system and how it is abused… some swearing at others as they abused the system…when someone posts a comment telling that they have received the case number, the anxiousness or pressure among the ones waiting goes up by a big factor…Let me shed some light on the reality on the premium processing and regular processing times from a historical standpoint, so that all of you have a realistic expectations.

Let’s be realistic about results of H1B Lottery?  About 2 in 3 H1B petitions would be rejected !

I can imagine all the pain everyone has to go through, but let’s be realistic folks…Unfortunately, H1B is a lottery and only 85,000 petitions are selected from 233,000 petitions received for H1B 2016 quota.  Not being too picky on the precise probability…Just about 1 in every 3 H1B applications will be selected in the lottery process. It is very harsh on many who have spent thousands of dollars studying in US and on many who have been working at MNC companies waiting for years to get an opportunity to work in US, including many others like H4 holders who have found a job, sponsor and waiting to work…but unfortunately, it is the truth and reality…so, do not get disappointed with the results, it has nothing to do with your talent or hard work! It is pure gamble and luck…Not getting in H1B lottery is not the end of the world, stay positive…if you get it, great…if not, maybe there are better things that are coming for you in life ! Anyways, enough of the lecture 🙂 …

Keep the above truth in context and read below…

H1B 2016 Premium processing time – Case Receipts, Typical steps.

USCIS originally mentioned that the premium processing for FY 2016 applications will start no later than May 11th, later they issued a news alert that the H1B 2016 premium processing will start from April 27th.   Some of our readers are receiving the case receipts for the premium processing applications. You can check the status of selected petitions in our H1B Visa Case Tracker ….But, if you have not received your case receipt yet, you do NOT need to be in panic…You still have a week or so to get the premium processing receipts.

Usually for premium processing, the employer/ immigration attorney will get an email from USCIS informing about your H1B case with the receipt number. You can use that receipt number to track the status at USCIS site .  Ideally, all the receipts of selected H1B petitions should flow in on or before April 27th, or at least by 30th of April. Having said that, sometimes they may keep coming in the first few days of May too. What USCIS has promised is that the 15 calendar day premium processing SLA or Clock starts from April 27th. What it means is that the premium processing petitions have to be adjudicated by May 11th ( 15 calendar days from April 27th ). Also, one catch is that, if say your petition ends up in an RFE ( Request for evidence) while the adjudication of the petition, this will halt the premium processing clock for your petition and will restart after the RFE response is submitted by employer.

All in all, what I trying to articulate is that, just do not get nervous or more anxious when someone posts a comment that they have got the receipt and you have not. The lottery is done, if you were selected, you will get it…nothing will change that…stay positive!

H1B 2016 Regular Processing Time –Case Receipts, next steps

Typically, H1B petitions filed under regular processing do not have any mandatory SLA from USCIS, unlike in premium processing. They can take their own time based on their work load.  This is one of the most frustrating things many regular processing folks experience as they have to wait a lot of time… Anyways, if your regular processing petition was selected in lottery, your employer/ attorney would get the H1B case receipt notice in traditional postal mail from the USCIS. There will NOT be any email receipt notice. You as an employee needs to be in close touch with your employer/ attorney to know the status of your case.  If you were selected and your employer received the H1B receipt notice, the receipt notice will have the case number, which can be used on the USCIS website to check the status of your case.

As there is NO fixed SLA for the processing of the regular processing petitions, the receipts keep coming in sporadically from USCIS. Typically they would start to arrive from about 2 weeks from lottery date all the way till end of May or maybe even in early June for some cases. Again, this can be very frustrating to keep waiting on this receipts, but there is no choice.

Once you have the receipt number of your regular processing petition, you may upgrade it to  premium processing to get the adjudication done in 15 days…but, unfortunately, now you cannot upgrade the case now…you will have to wait for the receipt number to arrive in mail to take any further action like upgrade to premium processing…!

When you see a comment or status on our H1B tracker that regular processing petition case number received, do not panic and get worried about your case… You just need to wait for couple of months to conclude your luck…Over the years, I have seen the frustration of applicants and can empathize the pain that regular processing applicants go through…it is very tough ! All I can say is, stay calm and keep doing your day to day stuff, do NOT stress yourself.

      • Somehow I have a good feeling that this time USCIS did smart work identifying all multiple petitions and rejecting “most” of them right away,During days of AD/PP many guys posted that they got 2-3-4 petitions picked up but no one eversince.So ideally the guys got smart after being bashed up over this portal or the USCIS:)

    • There should be still hope. My checks were cashed by Vermont on April 30, 2015. No receipt yet, but I guess I get through the lottery. All the best!

  9. I have applied through BAL GLOBAL Houston, but I could not able to reach them to get update? Their system still shows no receipt(empty). Mine is AD/RP/VSC, should I move to plan B?

    • For RP ppl we still have hope probably till May 15th or even later, for PP ppl they should start plan B already.

        • Do you know what 11th May is for ? it is to get final result of application after validating all the documents etc. Receipt must have been rolled much earlier. Receipt just says your case was picked. Lottery happened on 13th. Premium must have got receipt already. Picked cases are now actually getting Approvals or RFE.

    Thank God. I finally got my receipt yesterday. This was my third attempt. I was not picked in the lottery for the past two years. It was a tough time. I was a silent follower in this forum around this time every year. Thank you for the people who are behind this website. This is so very helpful.

  16. Question. Realistically, what are the odds of having your h1 granted if you’re picked in the lottery? What are some common reasons for rejection?

    • H1-B approval after selection in lottery depends on documents submitted at the time of filing.
      USCIS is unerring in determining the whether documents are correct.
      My H1 was denied last year because of messed up documents submitted by my employer.
      I was a genuine candidate for the position, with required skill set and qualification.

      Sometimes nothing is in our control.

      To sum-up there is no guarantee that your H1 will be approved once selected lottery.

    • TCS must be banned for life to be eligible for filing H1/L1/B1/GC.
      The worst company ever.

      TCS is major reason for such a huge number of H1B 2016 applications.

  19. AD/RP this was my 2nd year application from PwC US. Last year filed under Bachelors, this year under masters. Apparently, my application was picked on 13th April, just got confirmation from the attorney it was picked. I can understand the extreme pain and frustration for all those still waiting, so hang in there and pray for the best. Instead of fighting amongst yourselves, do something good to channelize your energy and your prayers will be heard !!

  21. I have an interesting scenario. My employer sent the check (includes processing + attorney fee) to the attorney. The attorney cashed it and possibly wrote a check to uscis along with my petition. So I can’t really know if the check is getting cashed or not. Is this even normal?

    • It looks like it is. My employer’s attorney did the same thing. Either they should inform you once the checks are cashed or you can go ahead or ask your employer to contact the attorney via email / phone requesting him to check the status of the checks.

      • I have friends (Non-indians) who work in IT companies.They witness so much stuff where indians get in trouble.Most of them who come to US dont have enough experience or know nothing when they are assigned to a project they outsource to india for help and get it done for couple hundread dollars to get the task done.Some of them got caught by their supervisors and lost their jobs.So those fake resumes and sh’t will end up on the street anyways.The story is real,most of the people they are aware of it but keep these guys because they work for minimum wage also they don’t mind staying 5 people in 1 bedroom house so companies don’t have problem keeping them.they do housing for indians who are willing to live together.

      • For Infylad- Abe I am an Indian only and had never been to US for any bullshit advanced degree we have several best of Engg and business schools in India.About serving in Indian MNC like TCS Infy wipro and CTS so boss I don’t even feel attending their interviews ciz I know their level. in 10 years if my exp I have worked with EDS;Adobe; Thomson Reuters and Oracle and it’s oracle who filed my H1B.Why I said dikha di apni aukat since that guy was using bas words like “kutte” and all in a portal where we have guys from several countries already having a bad impression about India and you guys giving them more reason.sab jagah raita tum jaise hi felate ho aur baaki sab ka impression bhi kharab hota hai.

        • I am an ex-Infoscion and I have a masters too. I bet there are many people in these companies that you call “cheap” who are better than you in all terms. Even after having done my masters from one of the top 10 Universities, I know many people in Infosys that I look upon.
          And FYI I have not got my H1b receipt yet, but even if I wont, I wont blame these companies for making up major percentage of applications. The real cause of your frustration is the broken US immigration system. I cannot resist saying that its not these companies, but the mindset like yours that is “cheap”.

        • @Sandeep: Chill, I was in the same boat but fortunately got H1B this year. At least I expect GOOG is also able to provide a backup plan of relocating abroad and later bring you back with L and finish your GC.

    • Ban those F1 holders who lie to the immigration officers that they would return back after completing their studies. Hold on, rather than banning, confiscate the fake financial bank balance/property they showed trying to convince the officers of their ability to pay tuition and ties to home country. Even better, tax their income twice, one in US and again as deemed fit by their country of birth.

They end up paying third party body shoppers(pimps) to sponsor the visa and eventually get sold out per hour basis to an end customer who uses the “talent” on an hourly basis before throwing you out on the street again for the next customer….

      • And FYI, It is no longer necessary to tell you would return to home country after study. USCIS’s latest memo sent to DHS tells that F1 visa can be dual intent. So, you can’t deport a student just because he expresses his intent to work after study.

        • Do you mean all the 150k applications are filed by these companies? what about those f**kers who file multiple applications from consultancies? If one of these companies file for 30k applications, I am rest assured they can get these many people to US, provided the system allows them to. And yes, if you say system should be modified to give preference to students here, I agree. But as of now, its the system that is broken and no one else can be blamed if students here dont get the H1Bs.

      There is no difference between a Latino who tries to sneak into us from border and Indian guy with fake resume and diploma from an unknown school gets an H1B.
      One thing many people dont understand:
      People in professional major(NON-IT),Engineers,Architects,Financial,Bio-Tech… You cant get more than one sponsor because Your employer will not sponsor you if you are in contact with an another firm also its gonna ruin your reputation in the industry.So its not because we dont get more than one employer to sponsor,Its because its not right also risky for your career and employment.So dont act like you are the sh’t if you have three consultancies sponsor you.They do not because you are the best,they get commision on you.They dont even know who you are.
      We,Engineers get call everyday from recruiters for amazing opportunities.That doesn’t increase our chance in sponsorship because you can f’ck around if you want to have stable career.
      So if you are not in US and have no Idea about employment in the states,DonT talk sh’t when people complain about muLti applications.Because it’s really not fair for someone to be in the same poll with a person outside of US.

      • I agree with you-US should ban all migrants and instead should promote Professional Education in their own home.This way even people from India (I am an Indian) will be recognized in their own country and can do something to create competition to all Western counterparts/Organizations.This will create an opportunity where Western countries will line up to get Indian Visa.

    • The USCIS allows Indian companies from filing H1B visas!
      If it has to come down to blame , then anybody can blame another.

      A Master’s/Bachelors degree holder from an Indian University , working for an Indian company gets an equal opportunity to make it in the H1B lottery as an F1.

      The real problems are the cap and the rule that allows more than 1 application from different employers for a single candidate. Who made these rules? And who can change them?? …

      Would you blame some one for making use of this obvious loop hole in the rule? Who you blame someone for not making use of this loophole?

      It was each person’s choice …. Now lets take the responsibility of the choices we made

      I have an advanced degree and a dream job too.
      But we already get a special preference for lottery.

      I think it’s unfair to say what you just did. There are so many talented people with just a Bachelor’s degree. They need a shot too.

      I am AD/RP/Cali. I know this is a messed up situation. Cursing MNCs doesn’t make the situation any better.

    • @Sandeep ,Rajat and InfyGuy ..I dont know why all of you are fighting and praising yourself working for so and so company .But the real fact is all these are interdependent companies and equally important to sustain a business .If Deloitte etc.. provides consultancy for a problem , services company (TCS /Infy etc)implement the solution and Oracle/Microsoft products get sold . So if you remove any one of those cycle would break .its in the mind of employee only the superiority complex working for them due to common human nature .No one code whether he is in Google etc to take it home and dance on that 😛 . And being an India it a matter of proud that we had made giant companies who are competing at world level so just disregarding due to fact that “ghar ke murgi dal barabar ..” is not good enough ,they have made the lives better and provided employment in our beloved country and help striving the growth ..

  23. I used to think indians are nice when I just came to the states.
    I have indian batch mates and they were really nice and helpful. But then I found they cheated on several things, which gives me really bad impression.
    I have to admit indians are smart, but some times playing tricks makes people don’t trust you anymore.
    Our customer even emphasized they don’t want any indians in our data analysis team.

    let us not discriminate based on country as its not in our hand.

    Its true that some of big companies from India started abusing the system by applying large applications to get their big share. They try to induct cheap labors , that should be stopped by keeping minimum wage restrictions.

  27. Just wanted to let you all know that I was informed by my company that my application was not picked in the lottery this year too. This was my second and final attempt and I am planning to head back to India but I just wanted to say my peace to this process by quoting America is a land of opportunities and we Indians very well know how to trick any system. I feel ashamed that we still carry this filthy mindset where ever we go and try to bend every system which was at some point built to be fair. Lastly I want to give a head’s up for some of you who may be applying next year….don’t be surprised if the number of applications go up to 300,000 and given the elections things are bound to remain the same. Brace Yourself, let luck be with you!

      Big companies are trying to abuse the system by applying more applications which is causing more uncertainty. There is no surprise if next year applications go +300k. Only attorneys and mail system get benefited.

    • Bharat, think in a different way, what would happen to you if you didn’t get F1 visa in the first place. Be happy whatever you do not blame others/system when you don’t get something. Many people are wanting to be in the US. You are a lucky guy, at least you have a good educational degree that too from an American university. You have better chances to try in future again. Don’t lose hope nothing is impossible who knows you will be in good position later. If you are from India and abusing our system then don’t forget you also one of them. Remember,Whatever you think/do your life follows those thoughts/actions.

      • I never abused the system, I never lied on my F 1 VISA, I know many people are waiting to come to the US and there is nothing wrong with that after all this is the land of opportunities all I ask is if you are here doing things the right way then I respect your actions. My advanced degree from a top tier school is no luck I worked my ass off for it…if you are one of them with multiple applications you don’t have any right to throw me under the bus. My F 1, my education, my degree was no luck, filed for H1B with 1 application from legit companies legally..so you can call me whatever you want I know I did it the right way.

  29. What does change of status petition is still pending with the USCIS mean? Is my H1 picked or Am I still waiting to know the decision?

    • Looks like internal status tracking within your company, ask the guys who were approved last year or gone through this process.

  30. Still waiting for attorney to receive the receipt. Stupid attorney is based in Canada. Not sure, if that’s the reason it might take longer. Anyone else here from PwC (PricewaterhouseCoopers) US waiting?

    • Congrats!!! Now enjoy ur next 5 months waiting time… It is going to be very grueling for others..
      I had applied in 2013, the first year after 2008 when there was lottery. I received my EAC no. in May and had to wait till Aug end to get approval notice. What a painful 5 months…

    • So if your case got approved on 30th, does it mean, that they are still sending out approvals for premium processing..? I had lost hope, and didn’t expect premium processing to get approved after 28th.

        looks like ADI application got approved. He probably got his application picked in lottery while ago. He is not saying his application got picked today.

      • I got reciept notice on 20th April. It is PP so I think they started processing it on 27th and I got it approved today. PP applications will be processed till May 11th.
