H1B 2016 – After Lottery – Premium, Regular Processing Receipts, Time

As I read the comments on our H1B Visa 2016 page, I can empathize what all emotions everyone are going through…some happy to be picked in lottery, some anxiously waiting for the result, some frustrated with the wait…some upset with the overall system and how it is abused… some swearing at others as they abused the system…when someone posts a comment telling that they have received the case number, the anxiousness or pressure among the ones waiting goes up by a big factor…Let me shed some light on the reality on the premium processing and regular processing times from a historical standpoint, so that all of you have a realistic expectations.

Let’s be realistic about results of H1B Lottery?  About 2 in 3 H1B petitions would be rejected !

I can imagine all the pain everyone has to go through, but let’s be realistic folks…Unfortunately, H1B is a lottery and only 85,000 petitions are selected from 233,000 petitions received for H1B 2016 quota.  Not being too picky on the precise probability…Just about 1 in every 3 H1B applications will be selected in the lottery process. It is very harsh on many who have spent thousands of dollars studying in US and on many who have been working at MNC companies waiting for years to get an opportunity to work in US, including many others like H4 holders who have found a job, sponsor and waiting to work…but unfortunately, it is the truth and reality…so, do not get disappointed with the results, it has nothing to do with your talent or hard work! It is pure gamble and luck…Not getting in H1B lottery is not the end of the world, stay positive…if you get it, great…if not, maybe there are better things that are coming for you in life ! Anyways, enough of the lecture 🙂 …

Keep the above truth in context and read below…

H1B 2016 Premium processing time – Case Receipts, Typical steps.

USCIS originally mentioned that the premium processing for FY 2016 applications will start no later than May 11th, later they issued a news alert that the H1B 2016 premium processing will start from April 27th.   Some of our readers are receiving the case receipts for the premium processing applications. You can check the status of selected petitions in our H1B Visa Case Tracker ….But, if you have not received your case receipt yet, you do NOT need to be in panic…You still have a week or so to get the premium processing receipts.

Usually for premium processing, the employer/ immigration attorney will get an email from USCIS informing about your H1B case with the receipt number. You can use that receipt number to track the status at USCIS site .  Ideally, all the receipts of selected H1B petitions should flow in on or before April 27th, or at least by 30th of April. Having said that, sometimes they may keep coming in the first few days of May too. What USCIS has promised is that the 15 calendar day premium processing SLA or Clock starts from April 27th. What it means is that the premium processing petitions have to be adjudicated by May 11th ( 15 calendar days from April 27th ). Also, one catch is that, if say your petition ends up in an RFE ( Request for evidence) while the adjudication of the petition, this will halt the premium processing clock for your petition and will restart after the RFE response is submitted by employer.

All in all, what I trying to articulate is that, just do not get nervous or more anxious when someone posts a comment that they have got the receipt and you have not. The lottery is done, if you were selected, you will get it…nothing will change that…stay positive!

H1B 2016 Regular Processing Time –Case Receipts, next steps

Typically, H1B petitions filed under regular processing do not have any mandatory SLA from USCIS, unlike in premium processing. They can take their own time based on their work load.  This is one of the most frustrating things many regular processing folks experience as they have to wait a lot of time… Anyways, if your regular processing petition was selected in lottery, your employer/ attorney would get the H1B case receipt notice in traditional postal mail from the USCIS. There will NOT be any email receipt notice. You as an employee needs to be in close touch with your employer/ attorney to know the status of your case.  If you were selected and your employer received the H1B receipt notice, the receipt notice will have the case number, which can be used on the USCIS website to check the status of your case.

As there is NO fixed SLA for the processing of the regular processing petitions, the receipts keep coming in sporadically from USCIS. Typically they would start to arrive from about 2 weeks from lottery date all the way till end of May or maybe even in early June for some cases. Again, this can be very frustrating to keep waiting on this receipts, but there is no choice.

Once you have the receipt number of your regular processing petition, you may upgrade it to  premium processing to get the adjudication done in 15 days…but, unfortunately, now you cannot upgrade the case now…you will have to wait for the receipt number to arrive in mail to take any further action like upgrade to premium processing…!

When you see a comment or status on our H1B tracker that regular processing petition case number received, do not panic and get worried about your case… You just need to wait for couple of months to conclude your luck…Over the years, I have seen the frustration of applicants and can empathize the pain that regular processing applicants go through…it is very tough ! All I can say is, stay calm and keep doing your day to day stuff, do NOT stress yourself.

  1. Anyone waiting for receipt – AD/PP/Vermont? Do the lawyers get notified thru email even if the petition is NOT selected?

      • As per my understanding, for the petitions that were not selected, the rejection (or NOT selected) letters will be sent out via mail not email – either during end of May or early June.

        • so that means v still have hope atleast till end of this week right? 3 of us in my company applied and one got the receipt number. immediately my lawyer assumed that other 2 of us are not selected and he sent an email saying that we aren’t picked in lottery. Not sure if he got any communication from uscis.

  3. How soon can you transfer H1B?
    I’m working on OPT right now but I want to leave my current company. If I hear about the lawyers that I get the visa, how soon can I transfer out to a different place?

    • Sara, you may only transfer your visa can only to be transferred on or after Oct 1st 2015, which is when your H1 is technically active (to be transferred)

        Do I need to keep working for the sponsoring company until Oct1 then? Or I can leave the country and come back October 1 under different sponsor?

        • Sara, I would suggest you continue working as leaving the job or country might make your employer revoke your petition thereby nullifying your H1B. You would not want to get into that scenario. So the ideal thing would be to keep patient wait till Oct 1st and initiate the transfer after Oct 1st. It will be extremely useful to maintain a cordial relation with you existing employer as you might need a document of employment verification as of Oct 1st that can also act as supporting documentation for the transfer petition.           • That is complete nonsense! @SR, please stop spreading wrong information.
            Sara, you can change your job as soon as your H1B is approved. Also, when you change job, only your new company will know till your visa is transferred following which you give a two weeks notice or whatever your employer needs.

It feels so annoying to see 99 stupid comments out of 100.

  9. Guys I filed 3 applications. Got one receipt so far.Very happy !!  Praying god for not to pick other 2 applications.
    So that other guys can benefited from that.

    • Congrats! Are you on OPT/cap-gap? I’m wondering if they have updated SEVIS records for Bachelor cap subjects who were selected. My SEVIS record is the same, so I don’t know whether to keep my hopes up…

  10. Got selected in lot last year. I switched my employer and they had to file a new petition this year outside cap. Even I’m eagerly waiting for the response/case number.

  12. I wonder what happens in this case:
    – Multiple petitions from separate employers got selected. USCIS starts processing them, may be they pass 1st petition. What do they do once they start processing 2nd petition and then USCIS realizes that this person has already been approved. What happens there?
    I’m just curious, Does anyone know?

    btw, I’m still waiting for my 3rd attempt. AD/PP/CSC

  13. I will put as many applications as possible ! Its legal to apply from diff employers! they offered me jobs. I am working in Java development since last 17 years. i m worth to get h1b.

  14. I know almost every multi filing %%% is Indian,I am curious how other indian peopel feel about this? I mean the ones that do it the proper way

    • Well, Feel ashamed of people that are abusing the system with multiple applications. In most cases, such people have fake experience and fake resumes. They will go to any extent to land in the US spoiling deserving candidates’ aspirations.
      USCIS should definitely catch such applicants and revoke all such applications (including the first one) and also not return their checks.

      The justification from such crooks is that they got offer from multiple employers and hence they feel there is nothing unethical. But don’t they know which employer they are going to join, and just ask that one employer to file H1B?

      Almost 100% of such fakes really have no job ready. Once the H1B is approved, they will find some poor client with a goofed up resume and send them to their company.

  17. Mine is AD/PP/Vermont..Found out current SEVIS status is “Active for CAP GAP”. My OPT expires in May and I didn’t/can’t apply for any extension, because I don’t fall under STEM category.

    Can someone help me understand what the SEVIS status corresponds to?

    Hoping for the best. Good luck to ppl waiting for their result.

  18. Disagree here. Not 85 000 will be selected in the lottery. I think it’s 85 000*coefficient that accounts for further rejections. A lot of petitions are rejected after the lottery, so the chance is not 1 of 3. I think it’s 1 of 2 actually (I estimate the rejection rate this year to be extremely high because of lots of cheating and fraud with multiples and so on).

      • He meant to say that lottery will select 1 in 2 applications (meaning a total of around 110,000-120,000 applications selected in lottery.) Then later in the stage 2 of 3 lottery selected applications approved (~85,000 of the 110-120,000 applications).

  19. I have filed my h1 b petition under advanced degree at CSC with premium processing. I still haven’t heard anything on the lottery result. Is this an indicative of my petition not being selected? Would my lawyer get an email with denial if any?Is there a hope for me?

    • There is still hope till 28th. denied petitions don’t get email.

      They will receive the packet in return with the checks uncashed.

  20. About any applications that were denied during adjudication, will USCIS draw one more petition from the complete pool ? or is that 1 H1-B visa gone to waste ?

    If one more petition is drawn from the pool ? will those with premium processing be a part of it ?

  21. Whatever Mr. Kumar said is agreeable but people say when we do something with WILL POWER that wish will be complete and as of I know everybody who applied for H1B has one or other problem and applied WILLFULLY, even though there wish is not going to complete what does that mean.

  22. As I told another friend in this 4rum, just relax.. I missed the chance last year, this year, AD/ RP, I can feel I would go back to my hometown soon 🙂 but I dont care, now, just working and traveling 😀

    I will take a road trip this week to visit my Uni, then taking pictures all the way 😀

    Cheer up guys, for all people who really work, study, without doing something like fake applications and spamming application, we did our best, be proud 🙂

    • Thats the spirit. I wish I could say the same. Although, I am getting there. I am in the same position as you. studied in this country for 8 years, worked hard for 1, filed a petition last year – did not get selected.. For all the hardwork we put in this country, leaving our parents behind for so long.

      The spammers who misuse the system are wrong for sure. But the system – which has no relying on the achievements / qualifications of a person is the one to blame. If you are going to be dealing with peoples lives, let alone one or even a 100. We are talking about 100s of thousands of people. If you have to pick some people over the rest, why not pick the best. Even a child would know that. To rely on luck, that is just plain wrong.

    • I havent heard anything, I guess it would be 1 or 2 more weeks when the RP result is sent out.. And yes, the system is not really good, randomness, nah, they should get something different. Anyway, we live in the world full of uncertainty, so just don’t cry or whine, live and be happy 🙂 You never know, maybe not getting H1B will open another door for your life 😀 keep it up guys 😀

    • Sure. If you are selected, you would get the receipt number. Having said that, to confirm you were not selected, you need to really wait, until you get a rejection notice from USCIS saying that you were not selected. Stay positive !
