The Immigration Bill, S 3291, also called “The Equal Access to Green Cards for Legal Employment (EAGLE) ACT of 2023“, which is aimed at removing Green Card per-country caps based on country of birth, was most recently introduced in the Senate on November 13th, 2023. In the past, the same original Bill was introduced in 2021 and re-introduced in 2022 and now again re-introduced in 2023.

Latest News on EAGLE Act 2023 (Bills: S 3291 & HR 6542)

Below are the most recent updates for the EAGLE Act of 2023, a re-introduction of the same bill from 2022 in the House and Senate.

December 1st, 2023: The EAGLE act of 2022 was also re-introduced in the US House with a new number H.R.6542 and shows up as “To amend the Immigration and Nationality Act to eliminate the per-country numerical limitation for employment-based immigrants, to increase the per-country numerical limitation for family-sponsored immigrants, and for other purposes”.

  • House Reps Rep. McCormick, Rep. Krishnamoorthi and Rep. Jayapal introduced the Bill H.R. 6542 in the House on December 1st, 2023.
  • It was referred to the Committee on Judiciary in the House.
  • We do not have the Official Text of the Bill out yet.
  • It is expected to be on the similar lines of what we have the Senate. We need to wait and see.

November 14th, 2023: The previous EAGLE Act from 2022 was re-introduced in the US Senate with a new number S. 3291, and now called the ‘‘Equal Access to Green Cards for Legal Employment Act of 2023’’ or the ‘‘EAGLE Act of 2023’’.

December 26th, 2022:

  • No new developments happened over the last few days and not sure, if there will be any more developments on EAGLE ACT 2022 this year.
  • There is still a lot of activity on Twitter by both sides, the ones supporting the bill and the side supporting the bill.
  • This is not the first time EAGLE Act did not make it. It has been introduced in congress for over a decade now, some times, it went very close, some times, it was not that close. Irrespective of how close or not, it did not make it through the US Congress.

December 22nd, 2022: Below are the updates from today as of 9:30 PM EST

The schedule has already been released for December 23rd, and there is no sign of voting of the EAGLE ACT of 2022. See below screenshot.

December 21st, 2022: Below are the updates from today

  • The House released the agenda for this week, and there is no mention of HR 3648 / EAGLE Act 2022 in the agenda for voting. See the below screenshot of the House agenda
  • It is unclear if EAGLE Act will come to the floor for a vote this week anytime.

December 19th, 2022: Below are the updates from today

As per the House Calendar for this week, there is no explicit mention of HR 3648 in the schedule, if it will come for voting or not. The main focus seems to be on the Omnibus bill. See below screenshot of the schedule from the House website.

There is also support from House Reps like Pramila Jayapal, who supported the bill in the House during the debate as well, including her support online on Twitter. See below.

There is some coverage of the EAGLE Act 2022 on CBS news in the Bay Area focusing on the main aspects of the Bill and how it will help many stuck in the backlog. We need to see if this coverage will help with the voting of the bill or not.


December 15th, 2022: Below are the updates from today until 10:0 PM EST.

10 PM EST : There was no voting on EAGLE Act Today in the House. Rep. Zoe Lofgren has expressed her disappointment and wrote a letter to the speaker raising the issue of not getting the EAGLE Act 2022 on the floor for voting after the debate. She did mention that the votes were close in the letter, indicating less support for the EAGLE Act than before. See the letter below.

11 AM EST : As per the daily agenda for today, the voting of HR 3648 (EAGLE Act 2022) is not scheduled. See the below screenshot of the same.

December 14th, 2022: Below are the updates from today until 10 PM EST

10: PM EST: The House Proceedings officially ended and below is the final update

There was no voting on EAGLE ACT 2022 today in the house. It was supposed to be considered and voted, but it did not happen. There were some instances where there was some hope for vote but did not happen. Below is the screenshot of the official update from the floor that it has been postponed

As per the official floor Summary, it is postponed based on “Pursuant to clause 1(c) of rule XIX”. See the below screenshot from the Floor Summary.

If you look at the actual clause 1(c) of rule XIX, it is understood that the speaker has postponed it as some of the previous question related to the Bill is pending and the speaker has postponed it. See the below screenshot for the actual clause 1(c) of XIX.

As per Greg Siskind, the reason EAGLE Act did not get a vote today is that there were not enough votes on the Floor. See the below tweet.

11:40 AM EST: EAGLE Act 2022 is scheduled to be voted on today in the House. There is no debate as it was concluded yesterday. Votes are likely to happen around 1 PM EST. If that is missed, then it will be later in the evening.

There is an update from Immivoice on Twitter saying that the voting did not happen for another reason related to the signing ceremony of the “Respect of Marriage Act” at the White House. See below tweet.

December 12th, 2022: Below are the updates from today until 12:30 PM EST and over the weekend.

December 8th, 2022: Below are the updates from today and late yesterday evening.

9 PM EST: Final official update for this week. There will not be any voting in the House this week for any bill, including EAGLE Act. The next meeting in House is Scheduled for 12 PM on December 12th, 2022. Once the legislative calendar is released for next week, we will update, stay tuned.

  • As mentioned yesterday, EAGLE Act is not on the calendar for today. No changes to the schedule. So, likely there will not be any vote today.
  • Also, there are some rumors on Twitter that EAGLE Act voting will not happen this week in House. Below are tweets indicating the same from some credible reporters.

December 7th, 2022: Below are the updates from today and late yesterday evening.

  • There was no EAGLE Act voting today in the House. It was supposed to be voted today, it was even on the calendar.

  • There is support for EAGLE Act from many tech companies like Amazon, Intel, etc. This support from large tech companies helps with the lobbying efforts for the passing of the same. Below are tweets from those companies.

December 6th, 2022: Below are the updates from today and late yesterday evening.

  • On December 6th, the White House also released a statement supporting the EAGLE Act of 2022, urging the US Congress to pass the same. Check the below screenshot of the actual statement, and you can check the official document on Whitehouse.gov

On December 5th evening, the US House Rules committee had a discussion on the EAGLE Act, and below is the summary.

  • In the rules committee meeting, when discussing EAGLE Act, there was a lot of discussion around the H1B program, the replacement of American jobs by foreigners, etc. All of them were answered by Rep. Zoe Lofgren. She also highlighted the automatic provision that is part of the current INA to restrict anyone who is part of the Chinese Community Party.
  • An amendment was made restricting H1B visa issuances for anyone associated with the Chinese Communist Party. See the below screenshot
  • The outcome is that the EAGLE Act, which is HR 3648, had an 8-4 vote and advanced to voting the House with a one-hour debate time allocated and controlled by the chair. See the below screenshot on the outcome
  • EAGLE Act is classified as a Structured rule, which means that only certain amendments would be considered during the debate on the House Floor.
  • We may see voting in House anytime in the next couple of days.

December 5th, 2022: There is a lot of activity focused on advocacy around voting of Eagle Act in the House this week. Below are the updates

  • Quite a few groups are coordinating the effort to call up their relevant congressmen, urging them to support this bill. Also, there is a lot of activity on Twitter opposing the same as well.
  • No change in the total Sponsors in Congress for the Eagle Act of 2022 since the previous update, as listed below.
    • Senate (S. 4567): Sponsors are three. Need more support.
    • House ( H.R. 3648): Sponsors are 83. Need more support too.
  • Voting in House: EAGLE Act 2022, which is H.R. 3648, may come for voting in House this week. As per the official House Calendar, HR 3648 is put on a maybe considered list. See the below screenshot and check the official House Calendar link. There are rumors that it may come on Thursday, December 8th, 2022.

  • Voting in Senate: There are rumours around passing the EAGLE Act in Senate using unanimous consent. See below info shared by one of the advocacy groups that is opposing it.
  • No official update on the actual official pages related to the Bills. Most of the activity is around calling senators and House Reps and asking them to support or not support the bill.

November 14th, 2022: Not much has changed in the last few months since the introduction.

  • The total Sponsors in Congress for the Eagle Act of 2022 as of today
    • Senate (S. 4567): Sponsors are three. Need more support.
    • House ( H.R. 3648): Sponsors are 83. Need more support too.
  • We may see some movement in the Eagle Act 2022 Bill in the later part of the November and December 2022 as the mid-term elections are almost done.
  • We may see some progress as it would be a lame duck session.
  • We will update this page as more advocacy efforts are done and something moves.

July 20th, 2022: The EAGLE ACT of 2022 was introduced in the Senate. Below are the details of the same.

  • Senators Kevin Cramer and John Hickenlooper introduced the EAGLE ACT of 2022.
  • The Bill text of the EAGLE Act of 2022 that was introduced in the Senate is very much same as the one that was introduced in House back in June 2022.
  • The Bill introduced in Senate also includes the new provision regarding the “Ending Media Abuse of H1B”
  • No voting or any other details are out yet.
  • There is no bill number assigned yet in Senate. It is not on Congress.gov with the assigned Bill number that starts with S.

June 7th, 2022: The EAGLE ACT of 2022 was introduced in the House again. Below are the details of the same.

  • The number of co-sponsors for the bill has gone up and now stands at 83.
  • Most of the text of the Bill remains the same. There were two changes :
    • The first change is the effective date of the bill, which is adjusted to reflect 2022.
    • The second change in the entire document includes a section on “Ending media abuse of H-1B“, as shown in the below screenshot.

September 15th, 2021 : Below are the updates in the last 30 days or so.

  • In the last 30 days, there were few more co-sponsors who got added. the count stands at 72 co-sponsors now.
  • There has been less focus on this EAGLE Act 2021 as the focus is on the Budget Reconciliation Bill, which has a lot of key immigration related items that are from EAGLE Act.
  • We may not see much progress on this bill until the Budget Reconciliation Bill related immigration bill is finalized and a decision is made on it.
  • As of Sep 15th, the budget reconcilation Bill has passed the House Committe and next will come to House Floor for voting. You can check the text of the Bill

June 22nd, 2021: Since June 14th, there were about 3 more Reps who got added to the co-sponsors. Total now stands at 31 for co-sponsors. See below. The current count of co-sponsors is way lower than what the previous similar Bill HR 1044, which had 311 Co-sponsors. Technically, 10 times more than what we have now for the Eagle Act of 2021. No other major development reported in the social media like events or anything as such.

  1. Why Indian immigrants are in the situation ? Every one know that the per country limit is only 7% from the beginning. But the number of people come from India on H1B are no where compared to the number of green cards available. Most of the H1B guys come here by using H1B sponsored by Consulting firms like Infosys, TCS, HCL, CTS. These consulting firms expect those employees to go back to India after the project is over. And they only sponsor green cards to some of them based on their demand. That is their business model and they are bringing people only on “deputation”. But most of the H1B guys transfer their H1B to the other employer and quit their actual H1 sponsor company, which is not ethical. I am not saying that they shouldn’t join other company if they are getting good opportunity. But they shouldn’t use the same H1B, they should go for a new H1B sponsored by new employer. If this control is kept, the number of I140 approvals will drastically comedown automatically…..

    • why did you come to US Ravi? I’m just curious how you came to US? were you a student? or you came through a h1b or you got the eb-5 by paying half mil or 1 mil?

    • Indians need to understand that pushing zero-sum bills that put the burden on other immigrants will be controversial and won’t ever have a chance to go forward. Maybe channel your energy into pushing for more green cards, reclaiming lost green cards, age-out protections, early EAD etc. Noone is going to fight you for these and you will have the support from the whole immigrant community.

  3. This only benefits indian and it is totally unfair. If someone loves USA then they should say no to this.

    It gradually affect on the population of USA and we can’t see diversity of cultures and people in the USA. what makes USA different is this diversity. We can see people with different colours. There are lots of African, Latin and South American, Russian, European, Chinese, Iranian, Arabs,… in this country and this is make USA unique.
    With this bill, in next ten years, Usa will be full of indian. I like indian people but the longterm effect of this and losing this diversity can have harmful effects for USA future .

    2. Is it require to maintain H1?
    3. Can I leave job if I need to support kids or family and what happens when my date become current and I am not working?

      • I have been actively in contact with my congressman, Eric Swalwell, in order for him to vote no on this bill. My brother has been pushed out into the streets and is homeless because the United States infrastructure cannot house this many people. We are not India. We will not become India.
