H1B Amendment denied but Transfer pending. Can I still work and stay in US?

Hi. I applied for a transfer from employer A to B in July 2017 and is still pending. In Aug 2017, I got a project in NY so applied for H1B amendment in Aug 2017 from TX to NY. It got denied on Jan 15th 2019. My initial employer A applied for revocation of my H1 with them and got successfully revoked it on January 2, 2018. My I-94 expired on Oct, 2018. But I was working on the pending H1B transfer and pending H1B amendment. Now as my amendment is denied but my transfer is still pending.

  1. Do I need to leave US? If needed how will I know when to leave?
  2. Can I work on pending transfer case?
  3. My Labour for GC process is approved. Can I go ahead and apply for I140 even if my both H1transfer and amendment is denied?

I think your employer B petition was revoked and you are getting confused between employer B’s petition amendment while in the pending approval state.

  1. Do I need to leave US? If needed how will I know when to leave?
Check the status of your employer B’s pending H1 status, if its REALLY in pending state, you can continue to work.

  2. Can I work on pending transfer case?
    See my above answer.

  3. My Labour for GC process is approved. Can I go ahead and apply for I140 even if my both H1transfer and amendment is denied?
Yes, the H1 issue has nothing to do with your GC process.
