Parents Rejected Visitor Visa. Want to Reapply

I am on H1B status since 2011 with approved petition till 2020 and GC is under process (I-140 Approved), also I have stamping done last year in India. I am currently in California.

My parents visa got denied on 05-April-2018 at Mumbai consulate, India. I was sponsoring the trip and I have enough balance in my US bank account. The reason we showed for their visit is tourism.They got rejection with 214(b). They didn’t ask for any document. Without asking how you will you prove your ties. According to 214(b), applicant should have ties to their home country and have reason to come back to own country.As my parents have their own properties in India. They have 2 kids and grandkids in India. Now I want to re-apply for their visa but this time the situation is totally changed, my wife was critically ill and passed away in mid of May-2018. So, me and my daughter (9 years old) want my parents to stay with us in USA for few months so that we get emotional support and help us to overcome grief and depression.Any suggestion on how to reapply for my parents’ visitor visa?

They dont need to look into your documents, the key lies into what your parents answered to the officer during the interview. Please check as to what they answered. If you apply as tourism, and they say they are coming over to take care of the children, then it looks like your bringing your parents as baby sitters, which is a direct rejection.

Sorry to know about your wife and may her soul rest in peace. I can understand your situation, but from USCIS point of view they will always think about their best for the country. Most of the times it will be easy to get one of your parent is governament employee and that gives assurance (No Objection Cert) that they will leave the country by end of their stay.

In your case there is no need to panic and try to eloberate more for your parents responsibility back in india, so that they can definitely go back to take care of the properties and relatives. But at the same time make sure they will not be considered as “Potential nonImmigrant” (By showing more properties etc.).

Also you need to train then well interms of where they are going (Complete USA Address and Contact numbers of your’s) and what places they are going to visit during their vacation time.
If you are financially well established then make them aware that you are going to take the complete responsibility of their Travel & accommoidation expenses.

As I said my father is a farmer, he possesses own lands and house. Even I have one brother and one sister who are staying in India. Both are married and having kids. So, my parents have strong ties in home country. Why they will want to stay in US?

But the question is how to show the strong ties because most of the time VO even don’t ask such details.

Even in DS-160 they don’t have question where we can describe that my parents have land and house in India.
