Switch jobs after I140 and go to Stamping

Team,

Request your help

  1. My I140 approved, getting an offer with company B and they will be doing the H1B transfer. My new employer will file PERM after 6 months, is this okay or Is there any dead line to file GC ?

  2. My current company will revoke my I140 within 2 weeks of resignation, will this impact me anyways ? Also, I need to go to India for a vacation in next 3 months. Can i go for visa stamping with the approved H1B petition of company B with revoked I140?

Appreciate your response

Thanks

Raj

You should ideally get your H-1B change of employer petition filed and approved before notifying your current employer if you are seeking H-1B approval based on the I-140 approved petition.

You will be able to capture the previous I-140 priority date.

Thanks for your response. I understand the point that i need to get approval on H1B change of employer petition. Should my GC needs to be filed before i go for stamping or my existing I140 filed with old company would be sufficient? Thanks again
Thanks
