My H1B expiry date was Feb 09 2017. Extension petitiion was filed on Jan 06 2017.
for unklnown reasons my extension petition was denied on July 26 2017 and i travelled back to india on Aug 22 2017(my employer never told me the reason for denial).since i have I140 approved . i found a new employer who filed for my new H1B under cap exempt and now the petition is approved.now my question is am i eligible for visa interview waiver program as my previous H1B expiry date falls under 1 year and the new visa is also H1B.
Please advise.
