H1b Motion To Reopen - Processing time & Result

I applied H1b visa for 2018 fiscal year. i got picked by End of April . I got a RFE on September.
since i dont have Bachelor degree. i have done 3 years Diplomo Engineering and I have 10 years Experience . Additionally i have already been in USA for 1 years 8 months on H3 Special Training at our US Head Office

My Attorney replied to my RFE with credit evaluation report from a evaluating Agency / university.

my application denied on oct 15th . the denial reason stated as : “ you did not submit evidence that the University of Arizona has a program granting college level credits based on training or work experience.”

My attorney and employer are applying for MTR. with additional document from the evaluating agency.

i really worried what would be the result of MTR and how long it would take

is there anyone went thru similar situation. please respond

Why is University of Arizona mentioned in the denial letter? What statement have you made regarding the combination of education and work experience? USCIS looks at this detail very closely. All denial cases can be appealed if you have substantial new information not previously provided.

when i get RFE my attorney submitted my 3 years diplomo certificate and my Experience letters (12 years experience letter + employment verification letters from past companies for 9 years and my H3 period training lettrer) to a evaluating agency to get certification that my experience is equivalent to Bachelors Degree . assuming they might have a tie up with the Arizona University for the certification.

For My RFE . i submitted all the above said documents and the attorney added the documents received from the evaluating agency. since my employer dealing my visa i dont know the exact words what they said in the RFE response.

Now My attorney requested back to USCIS… like the below.

"We believe the denial of this H-1B case was clearly erroneous.

To save the client time and money and the government resources in formally appealing the denial to the AAO, we would kindly request you reconsider the decision.

The sole denial reason is regarding the sufficiency of the professor-issued credential evaluation, specifically, the adjudicating officer concluded that there was no evidence to show that the University of Arizona has a program granting college level credits based on training or work experience."

This conclusion is wrong because the letter from the Vice President and Registrar of the University of Arizona confirmed the evaluator confirmed that:

• The criteria for granting credit is determined on a student-by-student basis; academic policies are set by the faculty members of the University.

and some more in detail.

For that we received a Email from USCIS
“I must request this file to address your concerns. This review is a courtesy review. Please note that the review of your denial does not stop the clock for the 30-day motion/appeal period.”

Now My attorney Preparing for MTR.

from the above communications do you see any hope for me…?
