Does tenure with the firm make any difference while applying for L1B?

Hi

I am an actuary working in the India office of a US based company. The actuarial team in US wants me to move to the US and hence was considering L1B visa for me. But as I have been in the company for only 13 months, the legal team suggested that I should wait for another year as my application would most likely get rejected. What are my options now? Request them to apply anyway (will that affect my future chances?) or request them to consider H1B (is that an option at all) for me or wait for a year?

I have 5 years of work experience in total.
