L1b extension denied, old petition and visa still valid for one more year

Hi,

My L1b extension was applied to get I94 extended, I94 expired (June 2015) with passport expiry and i renewed my passport in March 2015. My L1b visa and old petition (petition with which I got L1b visa) is still valid for one more year (till Nov 2016). After RFE, today my extension application got denied.

Please let me know whether I can still be in US as my old visa/petition is valid and travel to India and come back to get my I94 renewed.

You need to have a valid I-94 to stay in US. As I-94 expired in June 2015, you should leave ASAP. You can return to US w/ valid L-1 stamp and petition to get extended I-94.

So you mean that my existing L1b visa/ petition which are valid till nov 2016 will not be affected by the denial of the L1b extension.

Yes, it doesn’t impact already approved petition. However, like I said before your I-94 is in jeopardy and you need to leave US immediately.

I was able to successfully re-enter with valid visa and petition in 2015 and got new I94 stamp.

I filed L1b extension in april’2015 to get my I94 extended, my visa/petition was valid till Oct’2016, My extension application got denied in Nov’2015. At the same time I had to travel to India because of demise of one of my family member, I was able to re-enter US with valid visa/petition after two weeks, at that time I got new I94 which is valid till Nov’2018…
My L1b visa stamp got expired in Oct’2016, Can you please tell if I am legal to stay and work in US till my I94 expiry. My I797 has no expiry date but my I129s expired with my visa.

For L-1, you can stay and continue to work based upon the expiration date in your I-94.

My family went to Canada and could also re-enter US with the valid L1/L2 visa.
The new I-94 stamp has the same date with my L1 visa expiration.
