Got RFE, presently working in UK

Hi,
I applied for H1b in March 2015 through a Indian Consulting company and got RFE recently. I continued to work in my present company and am now posted in UK. In case my RFE is cleared, can I attend my visa stamping here in UK?

Also, the status of my case on USCIS site says that it is waiting a response from my employer and that the rfe was requested on 9 july.
Is it common for Consulting companies to wait for that long to reply to USCIS?

Any help will be greatly appreciated.

I attended the stamping interview in January 2016 and got the ‘recommendation to revoke’ email few days back. I will like to know from the more experienced members here -

a. Can my H1b sponsor help ahead now in this case? what help can be provided?

b. Can I switch employer now and still hope for an H1b? Am I cap exempt?

Companies are usually give 60 or 90 days to respond to RFE. Check w/ your employer if they plan to reply to it. At times, employers don’t have enough information/documents to respond to RFE and just sit over it.

If petition is approved, you can appear for stamping in UK. However, check US consulate in UK’s website to know about their policy on TCNs (Third Country Nationals).

Update - My employer has replied and the status is changed to Reply received.
Waiting for the next status. It is a normal application and not premium processing.

How much time will it take for the next status?

There is no SLA. It can take anywhere from few weeks to several months.

Pls share some light for UK stamping possibility and if any experience.

Check US consulate in UK’s website to know about their policy on TCNs (Third Country Nationals). If they allow you to appear, then you can appear for stamping there. If not, you have to return to home country for visa stamping.

> The petition has been sent back to USCIS for reconsideration. They would review the case and either reinstate the petition or revoke it. Your employer may be contacted for information, and that’s the only time he can help you.

> Yes, you are cap-exempted as the petition is still valid and has not been revoked by USCIS. But you must hurry.
