Are there still any chances to re-apply for a new visa with the same petition which has sent back to me ?

Filed for my H1B in 2013 (for 2014), Got 221(g) - blue slip in Feb, and Passport was returned wtithout any stamping during the visa interview, later in April i got my petition sent back, with refusal letter… with the below details :

The following remarks apply in your case.

- Action in your case has been suspended under sections 221 g of the INA act pending further administrative procesing.

The petition is being returned to USCIS for review.

Upon completion of the review, uscis will contact your petitioner.

 

My Query :I would like to know, 

1. Does it mean, I cannot get the VISA AT ALL for this petition/employer

2. Are there still  any chances to re-apply for a new visa with the same petition which has sent back to me

3. what should I do with the petition (hard copy), shoud I retain it, or send it back to my employer/ USCIS

4.How likely is it for the petition to be revoked.

 

Did anyone else face the same situation ?

 

Please  advise, I really need some help ASAP.

  1. Its under review, U must wait… Did u get any email or so for 221g to submit and any docs?

  2. U are eligible to apply cap-exempt, U are cap-exempt irrespective of revocation/withdrawl. Find an employer who can file a cap-exempt visa

  3. U can keep it and note the case number in case u need to send to employer. U can use the same case number to file a cap-exempt visa any time

  4. NOt sure, u need to wait and see

Thanks for your reply.,They have’nt asked/mailed me for any docs…however the status still shows Administrative Processing !

Ok. May be they are running a background check on U or Ur Employer. Wait for few days and keep checking the status online

Meanwhile, if u can find an employer who can file a cap-exemption for U, u can go ahead and do that, for fast turn around go for premium processing of the cap exempt

FYI,This is my first H1 B experience-, and im currently working in India(IT),
not in US , and not a student…even
If I apply for a cap exempt does this mean i will endup in a job in either Universities and Colleges & non-profit Organizations…or coult it also be just a regular job in industry as I’m currenty working? any suggestions…

I know ur case… Cap-Exempt is of two types one is for non-profit and other is for the ones who has an Approved H1 in the last 6 years… Urs is the second case, U come under cap-exempt for 6 years from H1 approval…

If my current employer wants to file a L1A visa for me, what would happen to my previous H1 petition, will it be still valid for future use, or will it be revoked…/cancelled…

Its difficult to say… That depends on VO. Sometimes they cancel old stampings, sometimes they dont… This is if stamping is done…
If not, that has nothing to with ur H1… Its valid
