Chances of rejection after getting RFE

Hello,

Around 20 H1B visas were applied by the project that I am working. Out of those 6 applications were reverted with RFE queries.

I recieved RFE for my application on 12th July asking for end client letter and few other docs. I replied to the RFE with all the required documents. Again recieved a RFE asking to add a specific clause in my end client letter stating that I am a graduate.

Since everyone provided the same end client letter for RFE and mine is the only one asking for a updated letter ,it is difficult to get a seperate client letter specific to me. I have sent a mail to attorneys specifying this.

What are the chances they agree to this. Will this lead to rejection ?

Yes, this may lead to a rejection if the RFE is specific, please discuss with Attorney/Employer to resolve this issue.

NOT A LEGAL ADVISE

Wow, the employer sent the same letter for all applicants. Does the client has 1 opening or 20 openings?

If I were USCIS, I will be raising red flags left and right over this employer.

No, I meant the format of the letter was same. The names and designation was changed for each candidate. Now the RFE asks for a different format.

That’s strange. Why will a client care if the contractor (i.e. you) is a graduate or not. They need someone who is qualified to get the work done, and it is your employer’s call whether to hire a graduate for the position or not.

However, if they have asked for a client letter w/ that specific language, it is better to talk to the client and try to convince them. Maybe add an addendum to the client letter w/ this clause.

Hi Naveen,

I am in the same situation. Can you please let me know if your application was approved?
