Green Card On H1 B Time Required in EB2

Thanks a lot Saurabh for answering my previous questions.

Now I am thinking more towards my green card. My consultant has told that he can apply my green card as well because I would be completing around 4 years in US by Oct-13. Have following questions regarding that:-

  1. Is there any restriction that after joining any consultancy they cannot apply for a green card until a peroid Or is it like they just want to take safe route that once employee work with for few months then only they can apply for green card. Desi Consultancy is telling me to wait for 1 year before they apply my GC.

  2. Does that help from USICS perspective that if I stay with desi consultancy and create some employment history and then apply for GC?

  3. Would that be safe to apply for GC through desi consultancy or I should switch to US based company and then apply for GC, I heard there are some restrictions that if you switch to other company and you applied GC through previous company then your GC process gets reset and you have to apply for processing again. Is that true, do you have any set of rules for GC processing that how such problems happens.

  4. Normally how much time it takes to get I-140 approved as we can keep on getting extension after that. My 6 years would be completing in Oct-15 and my green card would be applied around Jan-15, is that sufficient window i.e. of 9 months to get I-140 approved in EB2 category.

    No, actually companies can apply GC even if you dont currently work for them.

    If you get till I140 stage you can carry your priority date otherwise you will lose that too.

    To get PERM it takes atleast 6 months…placing ads, dead time etc. I140 if done in pp will take 15 calendar days. so 8-10 months if PP otherwise 1 year plus
