USCIS released their latest update on H1B cap count today that were received as of May 21st , 2010. Here is an update since previous cap numbers :
- New 600 Cap eligible H1B visa petitions were filed for Regular Quota
- New 100 cap eligible H1B petitions for Advanced degree cap

H1B cap count update Analysis and Prediction of petition filings for FY2011
This week updates seem to be lower than last week May 18th H1B Cap count. Regular cap petitions filed last week were 1000, but this week it declined to 600. Similarly, the advanced degree cap experienced the same and even sharper decline i.e., last week they were 500 filed, but this week it declined by a big volume down to 100. Overall, last week (week of may 14th ) there were 1,500 H1B petitions filed for FY 2011 cap, but this week (week of May 21st) only 700 petitions were filed. Does this mean anything ? We expected last week for the Advanced cap count H1B filings to increase with May graduations of MS students. Let me explain, the reality not all schools have graduation ceremony in the week of May 14th. Also, it is not that once you graduate you are done, You need to wait for the finals grades to be submitted by professors, it takes a week or two for the final grades to be posted. After the grades are posted, then the students have to get the final transcript for filing H1B petition. So, it may take at least two to three weeks to see the surge in number of advanced cap. Also, it takes a week or so for LCA to be processed. That adds another week of delay. As far as the trend is concerned, it looks similar to last week. The projections did not deviate much.
On the other hand, just an update on job outlook is, consumer confidence index rose to highest levels since march 2008. Advisors say, “consumer confidence index reflects the consumers’ impressions of the direction of job market”. So, jobs might increase and expectation is more H1Bs petitions to be filed.
