Yet another Monday of the H1B visa 2013 season…Only thing is that we are inching towards the finish line…USCIS updated H1B visa 2013 cap count numbers earlier today, the numbers include all the H1B petitions that USCIS received until Friday, June 1st, 2012. Below is the summary of the count updates:

  • 7,200 new H1B petitions were filed under Regular quota
  • 1,200 new H1B petitions were filed under Masters degree quota

H1B Filings volume UP Again ! Prediction moved to June 11th, maybe June 8th ?

Believe it or not, we are almost coming towards the end of H1B Visa 2013 season…I still remember, couple of years ago, H1B visa 2011 lasted until January 26th, unlike, this year the demand for H1B workers has been significantly high and we are running out of cap almost 7 months before…It is great news for highly skilled workers ! Anyways, lets do the cap count game….

The volume of H1B visa petitions filings increased yet again this week…No slowdown in filings despite long weekend break last week…As we compare the current cap count numbers with last week, May 30th H1B cap count update, regular quota filings were up by 800 from 6,400 last week to 7,200 this week, which is a 13% increase in filings volume…Unlike the Masters quota filings dropped slightly by 300 from 1,500 last week to 1,200 this week… Overall, the total cap count increased by 500 from 7,900 last week to 8,400 this week. The regular quota filings pace is on a continued uptrend since May 15th…on an average there was about 20% increase in volume every week…We are still left with about 9,400 regular quota H1B slots and 1,300 masters degree quota H1B slots. We are assuming that only limited visas ( may be few hundreds. Only 450 were used in FY 2010 quota) were used out of the 6,800 set aside of US – Chile – US Singapore Free Trade agreements under H1B1 Program.

Now comes the most interesting part…What are the  predictions of H1B 2013 cap completion dates ? …Instead of linear regression, I did polynomial regression this week for better accuracy, mathematically excluding other factors, the H1B cap completion date for  Master’s degree quota is around June 10th and for regular quota it would be June 17th, 2012. But, this cannot be correct as we have to include other factors into consideration like the continuous uptrend of 20% increase in filings, last minute rush factor by employers, high demand for H1B workers this year, etc….If we include all of these factors, below are my predictions:

  • Masters degree H1B quota can most likely be complete by June 8th
  • H1B Regular Quota can be exhausted by June 11th( conservative prediction). This can move up by couple of days to June 8th, depending on last minute rush factor by employers to file petitions.

We are very close to the finish line of H1B visa 2013 season. If you have everything setup and ready to file, just do it today or tomorrow…But, If you think you cannot make it for this season, you can try your luck with H1B visa 2014 season.

Looking at US economy, we do not have any good news to share…The US Labor department released unemployment rate and jobs added in May…The unemployment rate inched up slightly from 8.1% in April to 8.2% in May…49,000 fewer jobs were created in last two months. Analysts are afraid about the World’s economic outlook as the US economy indicators are not good…We had similar news last week with very low consumer confidence index…All in all, the job outlook does not look great as CEOs are holding back and consumers are watching their spending…More college grads are set to enter the workforce after this month, which does not help the current situation…Despite all these, the demand for advanced skilled workers to work on H1B visa in America is all time high and we are experiencing high volume in filings….We can expect the demand for H1B workers to be high as the startups ecosystem in Bay Area is hot with lot of capital…

    Hi Saurabh,
    I am on L1, applied through a consulting company for H1B without COS. (asked for without COS but not sure whether it was done in that way)
    Is there any way that I can confirm that my petition was without COS after getting the receipt #. I would like to make sure there are no surprises later after getting the petition approved.

      Sreenivas,
      From the receipt number you cannot know whether it was filed w/ COS or w/o it. Once it gets approved, you will definitely know if the COS was approved or not.

    Hi,

    I know H1B cap reached now and there can not be further processing. I just want to know my employer has intiated my H1B visa two times . But they could not even post my LCA. However documents were sent to them in April end only. What could be the possible reason ? Is my employer not interested in processing my request or there can be any other data validation issue in my processing. Is there any hope when window will open for petition approval to proceed pending request ?

      Sunny,
      I can only guess here. They might not be confident of getting the H-1 approval and so lingered around w/ the LCA, or the LCA would be getting rejected or they were never interested in filing the petition but couldn’t say No.

      Again these are just guesses, and if you want the actual reason it’s better to talk to your employer.

    Good job!!! I was one and half day late…

    Now, is it possible to ask company to convert my job offer to post graduate internship? I am sudent in Europe and currently with J1 visa in US doing student internship. What is visa type of post graduation internship in industry? Am I eligible to get that?
