Apply L2 Visa EAD card – Documents Checklist, Sample Cover letter

One of my very good friend Babu applied to get EAD Card for his wife, who is on L2 Visa and got it successfully without any issues.  One of our blog readers asked few questions regarding the same. He was kind enough to answer them and share the sample cover letter template. Thanks to Babu for taking time to answer and letting us share it with our readers !

1. I would like to know the list of forms to be filled for EAD on L2 Visa. Apart from  I-765, do I need any other form ?

2. Checklist of the supporting documents for applying to EAD on L2 Visa :

– Filing fee – Currently $410 (Please check on USCIS site for latest fees)
– I-765 form
– L1 approval notice of spouse
– Copy of Passport
– Copy of I-94
– Two photographs
– Copy of SSN (If you have)

3. Should it be e-filed or sent through regular mail? Which would be processed faster ?

Both of them take same time. If you do e-filing, you would have to send your docs by regular mail later. So, it is preferred that you send all the documents through regular mail at once, it will be easier instead of e-filing.

4. Is a covering letter required? If so what should it contain?

Nothing in specific. Just the list of documents. Download it from link below:

5. Its been a week since I’ve come , Can I apply immediately or should I wait for a specific lead time?

We can apply immediately.

6. How long is the L2 EAD card valid?

As long as your spouse L1 is valid.

7. In case I go back to India before I receive the EAD , can I ask someone to pick it up? Will I be able to use it when i come back again?

EAD card comes by mail, so anyone can receive it. Yes, you can use it after coming from India.

Hello Everyone,

This is the timeline of my application

1. USCIS accepted the application on June 28th 2016
2. Received the acknowledgement # for tracking on 1st July 2016
3. Case status changed to ” Card sent to production” on August 5th 2016 – in the morning
4. Case status changed to ” Application is approved” on August 5th 2016 – in the evening.
5. Case Status changed to ” Mailed the card” on August 9th 2016.

Now i’m waiting for the card , the entire process completed in 42 days. I followed the same document which was shared by Saurabh in this page with some small addition to L1 beneficiary document. Hope this helps!!

    Do we need to file EAD thru Attorney ?? please help I see in the i765 form there is a column to be completed by an attorney, all the above-listed documents are Duplicate copy not the original.

    Please note that there is new format of the i765 application starting from Aug 25 2020, please make sure to use the latest format of the application form else the application will not be considered.

    Check the USCIS website for latest format.

    on 3rd Feb and it has reached the respective address on 5th Feb 2020.

    I have not got the receipt number still to track the status. How long I can wait? is there any contact number or email which we can contact?
    How to know whats happening with my Application?

      Give it a week or 10 days, you should get it. You can call the customer service, that is listed on their website, they will say the same too…

          • Dears, I’m currently working in my home country from a local company and I’ll move together with my wife (she’s moving under L1 visa) to US at the same time.

            So she’ll have a L1 and I’ll have L2.

            If I apply to EAD on my arrival on US , can I keep working remotely to on my company in another country until receive the EAD confirmation by mail? Any barrier or restriction to keep working to a home country company?

    My company is filing for my H1b to L1A conversion. I submitting L2 application for my wife along with it through i539 form. Can i fill in i797 for EAD also along with it or should i wait for our visas to be approved before taking it forward.

    • Well, not may do this as most of them do it the other way around…you maybe able to do apply it in together. Speak to your attorney and double check. Also, do update here for everyone benefit.

  5. Hello all,

    I am on L2 and my spouse’s employer had filed EAD for me once we came to USA and the application was received on 7th Oct in California Service center. I have couple of questions.

    1. While checking processing time for California center, it says 5 to 7 months. Is it really so long? When can I expect my EAD to be processed realistically?
    2. Based on the processing times for other centers, I see Potomac is pretty fast. Can we select the center based on the processing time or is it based on my current location? (I know that my application cannot be changed now but am trying to understand why my application was sent to California)
    3. If my spouse’s visa changes from L1 to H1, can I continue to work on my L2 EAD or does my L2 + EAD gets void the moment my spouse’s H1 gets stamped.

    • Hi Supratik,

      Last year late September my wife applied for EAD and yes, it did take them 5.5 months in the California Service Center… so I wouldn’t get my hopes up that it will be much quicker now. The estimation back then was 5-6 months…

      No, you cannot apply to another center, it’s based on where you live. Nothing you can do about that.

      From the EAD my wife had it just has an expiration date for her, I don’t believe it’s linked to my L1 VISA at all. It’s her EAD that comes with her VISA. I also believe her L2 VISA stays valid as well if I would get another one. But I’m not sure and it also doesn’t matter much as we moved back to the Netherlands last August. The very long processing time for an EAD was one of the reasons to not stay in the US…

        Yes it’s pretty sad to see the ETA for a EAD processing, given than it should have been a simplier case than giving a L1/L2.

        I assume that when spouse’s visa status changes to H1 from L1, and since L2 is a dependent on L1, it should get revoked automatically. Not sure though. Just my assumption.

    • 1. Yes, it is that long. The processing times you see on the site kind of real…for some it took longer too…
      2. No, you cannot. It is usually based on certain criteria such as spouse’s receipt number, office location, etc.
      3. No, you cannot as you will not have L2 at that time, you will be on H4. Yes, both will get void as you will not be in that L2 status.

Hi Prasad here , I am on l1 visa , my wife is on l2 visa , we Both have visa till 2021 (stamped on passport) , I got my approval notice last month till 2021 , now I want to apply for my spouse l2 ead, only problem is her l2 extension is pending approval and I 94 is in expired , so can I apply her l2 ead with my latest I-94 And her l2 extension request receipt number ?

    Or i94 for dependent is mandatory document?

      Yes, you can apply for sure. If they give RFE, you need to send them the L2 approval notice…hope your L2 gets approved before they get to the L2 EAD application.

  7. The “eligibility category” for renewal of L2 EAD is still (a)(18) right? I am confused if it should be (a)(18) or (c)(35)/(c)(36), when you’re renewing the EAD. What did you guys fill?

  8. Hello everybody,

    My wife had applied for her L2-EAD. The application was sent to USCIS Dallas Lockbox. We got the confirmation that USCIS has received the application on 25th Jul 2019.
    But even on 4th Oct 2019 the application has been displayed as Case Was Received.

    While browsing through certain websites, we found that the current processing times as high as 6months. Does it really take that long?

    We would be really interested in knowing, if someone has received their EAD faster.

    Have a question: I am an L2 dependent
    I have my Ead expiring in August… since mine and my husbands visa is expiring in August too.. but now my husband has got the extension for 2 years and his visa is stamped ..i dont have visa stamped for myself after August but i have i94 valid until Next year march . So is it ok to apply for ead extension without my visa getting stamped..or is that a mandate for EAd extension

    • Sure, you do not need visa stamp. Your EAD will arrive until the L2 is valid. You could apply or L2 extension and EAD together based on L1 approval.

    • I am on L2 Visa and my VISA & EAD is expiring on Oct 2019 (duration was 3 yrs), so my spouse company will apply for extension for next 2 years but i want to know that Can i apply and get EAD extension on Extension File Receipt of L1B Primary VISA Hodler?

      • See, if you can bundle L2 EAD together and file it along when your employer files the extension. The issue with applying L2 EAD with only L2 receipt is that, it may get delayed as they will give RFE asking for approval…it will cause delays. Either you wait for approval and then apply for apply it together.

  11. Hello All,

    I have a situation that I dont have a last name on passport and on my L2 visa My name is listed as FNU ( First Name ) and my entire name as my last name on my I94 my first name is listed as EG: Tomantonyfield & Last name is listed as Tom Antony Field .Please advise how should I fill my EAD application form in the name section ( Pls note that the name listed is a sample and not real name )

    • You should fill the way it looks in your visa. If your last name is blank in passport, usually it is FNU situation and usually your first name is FNU. If your I-94 is not listed in such way, you should go to CBP office and get it fixed before you file your EAD to avoid issues.

  12. Hi Sandy,

    Just wondering which centre did your application get processed? I’ve also sent my L2 EAD to the Dallas lockbox and it was received January 16, but now it’s been sent to the Vermont centre. For that centre the online processing time says 5.5 months…which is scary!! Hoping that it’s just a rough estimate of time, and that some ppl have received their EAD much earlier than that.

    Any insight into this would be greatly appreciated!

        I am currently on l2 ead and it expires on sep 2020. My husband visa has expired and he has valid i94 till dec 2020. I have i94 till june 2021. Now if I need to apply for ead renewal, can I apply only with my i94 alone? Or we need to start extension for my husband visa? If so, only extension filing is enough by the time I apply for ead? Please let me know

        • Gd,
          You should use your spouse’s I-797 approval notice and not just the I-94. Your visa validity in passport is . not relevant after you enter US. Read US Visa vs Status You should have extension filed and you can submit in parallel as well for the same. Talk to your spouse’s attorney on this.

  13. Hello! This might seem like a silly question but I can’t find information anywhere about it. Must I physically be in the US (and stay there) in order to apply for the EAD or can I do it remotely? I currently work in Ireland and wouldn’t like to quit in order to move.

    • I’m afraid that won’t work as you have to include your I-94 and your spouse’s I-94 as well. If that doesn’t show that you are in the US yet, I won’t be surprised if they won’t process it. The instructions say you need to supply:

      Proof You Are in the United States in E-3, H-1B, H-1B1, O-1, or L-1 Nonimmigrant Status. For initial
      applications, submit a copy of your Arrival-Departure Record (Form I-94) showing your admission as an E-3, H-1B, H-1B1, O-1, or L-1 nonimmigrant, or a copy of your current Form I-797 Notice for Form I-129.

      Also, you would need to have a US address already, although that could be a company address for the company your spouse would be working for I guess.

      It’s really bad though, because when you will get here and apply then, it can take a long time… we’ve been here for 4 months and my wife still can’t work, she hates it. And it can take another 1.5 months according to USCIS (2-5 months processing time), but we’ve heard of people already waiting for 6 months now…

    You do not need to have SSN prior to applying for EAD, you can apply for SSN within EAD FORM.

    You will get both EAD and SSN with a same application, see the EAD form for details.

    • Yes, mandatory. The L1 holders documents are critical. How do they even know your spouse is on L1 and you are eligible for L2 without that document ? Think about it.

    I am glad to convey that my L2 EAD got approved.

    Timeline:

    18 Oct – Documents Sent
    19 Oct – Documents recieved by USPS
    23 Oct – recieved receipt number
    5 Nov – Received receipt notice
    6 Dec – Case Approved and New Card Printing
    11 Dec – Card sent
    12 Dec – Card Received

    I am yet to get the SSN which I had applied through the EAD application. It is expected to be received within 7 days of receiving the EAD card.

    • Do you know what service center handled yours? We sent one in for my wife and got the receipt on the 27th of September, haven’t heard anything since… we sent it to the Phoenix lock box and it should have gone to the CA service center as we live in CA. Current processing time is listed at 2-5 months…

      My wife can’t wait to get it, as she got a job already, but can’t start now…

    • When you say visa, do you mean it is expired as per approval notice ? or just visa stamp on passport ? In general, if your L1 approval notice is expired, you should get your extension done first. Also, you may apply for her L2 extension and her EAD along with the extension. Speak to your attorney.

    • Looks good. Maybe it does not hurt to attach, your spouse’s L1 pay stubs, L1 Visa, L1 Approval notice, I94 and tax forms(if there are any from previous years) including offer letter in US.

        • No, it is the approval notice that your spouse gets for his approval to work in US from USCIS. This is what the company sends to your spouse and would have been used by your spouse to get L1 visa stamping.

    Your answer to Question 6 is not correct, You will see the validity on the card you receive and then have to apply for renewal based on L1’s validity.

      The above answers are not for renewal. The context of the question is different, it just means, how long would the L2 EAD card be given validity from USCIS. It is not explicit, so maybe confusing.

    2. Can we send Money Order instead of check as my husband does not have any bank account yet?
    3. Is SSN is required? I heard we can apply SSN only after receiving EAD card as per new laws

    I submitted L2 EAD 3 days back through Priority mail and the status shows Available for Pick up in Dallas in USPS website , should some has to be there to sign and get the documents?

    please let me know what is actually mean by “Avaliable for Pickup”.

    • Vamsee, means you can technically go to the nearest USPS office and pick it up. Usually, you would get a slip to your address with info to pick it up. If you do not get anything from USPS, you can visit the office and show your proof and address proof and pick it up.

    Anyone submitted I765 form after feb 28 2018? the form has expired and in the website they have mentioned that we can use the form till a new form is available. But i read in the comments for someone the application was returned back saying the form is not up to date.
    I wanted to know whether anyone submitted the I765 after feb 28th and it got accepted.

    While collecting my documents to be send along with the form i 765, i came across just one i-94 form available, on top of which is written “Most Recent i 94”. But only the arrival date is mentioned there .
    I am not sure if this is the one that you guys are talking about.
    Please do let me know if there;s something else i am missing out here and from where can i get that?

    • Hi Mamta,

      I have answer to few of your questions.
      1. I think you should include I-129S . I forget to include and later confirmed with attorney and he suggested that I should have included to avoid RFE. I would suggest there is no harm in including the I-129S.
      2. I have filled the paper based application and not online.
      3. I have mentioned the category a-18 as I was working as a software developer. So, it depends what kind of job you will be holding.

        that was really helpful. I am also sending the paper-based application but I was trying to fill it in adobe and then taking the print out. Have you filled it with a pen then? I wasn’t sure actually, is it a better way?what do you suggest?
        Also, if you can remember if you have left blank or written “N/A” in the last fields on the form which were not applicable to us people.
        I am lil confused on this as the instructions manual says answer all questions accurately and state that an item is not applicable with”N/A” or none. but i have read somewhere that we shall leave them blank.

        • I have filled the paper based application with pen. I have done this before and there was no problem. So, its perfectly fine to fill with pen.
          Also, I have not mention N/A or none in any of the fields. The reason is- All the fields description already said that “fill this in case if it is applicable”. As far as I know the last time I filled the form I never mention N/A or None in any of the fields if not applicable to me and it got approved. This time I am still waiting for the approval.

    I have applied for L2 EAD renewal. We already had a valid visa till March 2020 however petition got expired. I forgot to attach I129S in the documents. Is it important. If yes, how can I submit the additional document to avoid the RFE.

      i have submitted application for L2 EAD renewal. i got I-797 C with receipt number and it is mentioned that “you do not receieve your renewal EAD before your current EAD expires, then this notice of action automatically extends the validity of your EAD for up to 180 days from the expiry date printed on the card” my category is a 18 so is my category is eligible for 180 days extension to work?
      Please clarify?

    My L2 EAD case was received on 2nd Jan. Yet to receive any further communication apart from receipt acceptance notice in Jan28.Any idea what to do or how should I proceed? Anybody on same boat??

      My EAD has been approved. Thanks for all the info you shared. I believe I did not get an RFE due to all the documents mentioned here was sufficient. Hope my Card gets delivered soon. Wish you luck and all the very best whose EAD are yet to get approved..
