Hi Ankit...I have applied for H1B last year and got visa stamped for one year only till Nov 30th 2017...Due to personal reasons I cannot travel this year...My questions are:
1.As per current rules can we apply for cap exempt visa next year if I have a sponsor
2.Somewhere I read we need to travel atleast once to US before H1B expires to apply for cap exempt visa transfer.Is that true?
3.Is there a chance that USCIS does not allow cap exemption as I did not work for my employer in visa period
4.Will answers to above questions hold good even if my current employer revokes visa

HI Ankit,

My employer has filed for amendment processing in normal mode. Mine is a new H1B Visa and yet to get stamping. Can you please let me know whether it is possible to convert it to premium processing after filing in normal mode? Please help.

Hi Ankit,

Thank you for the answer given to my following question.


I got  my H1B approval in Oct 2006 . My H1B visa stamp shows issue date as 09 JAN 2007 and expiration date as 30 SEP 2009 From A company.

I entered US on this visa on 17 MAY 2007 and returned on 7 SEP 2007 because of some family obligations and could not return back to US.

Can I refile my H1B under exempted cap from B company and  how long will it take ?

Your Answer:

Yes you can file under cap exempt. The normal processing time is anywhere from 3-5 months. Premium processing would still take 1 month starting from LCA step.

Now I want to know upto what date I can re-file my application from B-company ?
