My Visa got stamped last year and is valid thru 2014, I got an offer from other company and they are transfering my H1 and will be joining the new firm by late June.I want to travel to India before I Join the new company.The H1 may get transfered when I am in US or may be when I am in India. Please let me know if I would get any issues while comming back to US once my H1 has been transfered to the new company. And what new documents do I need to come back to US.

I have valid H1b Petition form company B, Company B is planning apply for COS after 2 weeks.

My question is

1. Is my stay will become illegal because of already I resigned to Company A ? ,

Or I can stay until new I94 based on H1b visa ?

No Update On Status of H1B Admin Processing with White Slip at Hyderabad

Hello friends,

After I one year of wait and obstacles finally I attended PA on 3rd April,2013 at Hyderabad.Officer asked me few questions like salary, client,work and I gave right answers but she gave me white slip crossing the section saying like "you will get an email..".

She did not tell anything why you had been refused to give visa.On evening of 3rd April I got email asking CV,invitation letter and some personal info.

My company comes under BEP category and also is one of the major IT MNC.Let me describe my entire case for yours better understanding:

1.For Client A my company filed petition on FY 2013.I got RFE and around 16-20 Novemeber I responded to RFE submitting SOW, BRM letter,Agreement Letter and Orgnization chart.

2.Finally got Approved petition.

3.But my client had got changed even before the RFE response time.I filed LCA for new Client B and also got LCA.

4.Then on 3rd April I appeared for PA.

On 17th April I have replied to their email(admin processing) with Agreement Letter and BRM(My company and client relationship manager)

But still there is no update.I am not getting what might be the reason behind this White Slip? How does it differ from Pink or other colored slips? Does it worth to wait for it or it might also get rejected at the end...

Please suggest over it.

Hi, I got a H1B visa stamped in 2001 validity for 3 year in passport, and due to some unavoidable circumstance I was not able to go to US and work for my employer and the initial visa stamping expired after 3 years . And now Im trying for H1 job again, Should I apply for a new H1B visa or can I transfer the Old H1B visa to my new employer?can it be cap-exampt FY2013-2014? Please let me know.

Can any friend confirm whether I am qualified to apply for the Cap-Exempt H-1B Petition/Visa now?

Coz one company offering me for H1 Transfer on cap exampt against fees.

Hi, I have filed H1b and got through lottery. My husband is in US and we were thinking of processing H4, to have a short one month visit to US before h1b stamping process starts from October. Now I have question that, stamping H1b and H4 both from India, is that a good option? Does H1b stamping get affected, since u r having H4, in India? I don't think so, I will be needing COS. But still could u plz confirm.

Hi All,

I am currently on a L1(B) Visa. Due to some unexpected reasons, I had to travel to India for 3 months. Meanwhile my US employer already filled my H1 and it has come up in the lottery. I have following questions.

1) Can I travel back to US on my L1 or do I need to wait for my H1 to get stamped?

2) Does it impact my petion that I am travelling outside US, which my H1 is in process?

3)As of now I dont have a permanent or temporary address in the US, I have read somewhere that it is important to notify them about the change of address. For which I need to fill my AR11 form. Now I provide them of my India address or does it have to be US address? Also, I dont have an address in the US now, so can I give the address of my emplyer?

I am in U.S on H4 and recently filed for H1 in regular processing. I am through the lottery and would like your precious advise on my following queries:

1. I have submitted my I-94 scan copy to my employer during my H1 filing but I am not sure whether he has applied H1 with or without COS, when I verified with him he has not replied me on that so can you please let me know on how the employer would have filed the H1 (i.e. with or without COS) in my case as I have submitted I-94 copy.

2. I have to travel to India and would be back in U.S. well before 1st October 2013, I am worried if my H1 processing would get effected due to my travel but I cannot avoid my travel. So please let me know if in case my H1 is filed with COS then what I have to do if it gets approved while I am in India. Does the COS still hold good even after I return or do I need to make any amendment to my H1 for COS

3. If in case H1 is not filed with COS or if my approved COS ( while in India) get invalid after my return to U.S then what would be essentially the safest time for me to be back in U.S to get my COS done so that I can be on H1 starting 1st October 2013.How much time generally only COS filing would require with a valid H1 as I have to leave U.S by end of may 2013.

4. if in case I am not able to make it within enough time before 1st October, say I return by 20th september 2013, can I file for my COS/COS amendment even then after (Sept 20) or will it cause any problem with my approved H1 (just in case it gets approved while I am in India).

5. Do we have any option to file COS in a premium mode as like the H1 petition to get it fast.

hi this is raju and i applied for admission in Gannon university Usa and i am from india.

my query is....

when i was applied to the university.In application form i wrongly mentioned i was an experienced person for 3 years. why because i have three years gap from completion of my B.Tech. that to i mentioned one company name which i did not know anybody in that company. know i got I-20 from that university and i am preparing to go for visa with that I-20.

as a documentation part i need to provide experience letter from that above mentioned company but i am not able to get it know.

my friends said that there is no problem with experience letter from above mentioned company you may get fresh experience letter from any educational institution it will not a problem and visa officer will not find your previous company which mentioned at the time of admission.

but recently i came to know that USA Consulate and Universities both together maintaining SEVIS database and all the information at the time of admission will be available in that website.

so please tell me is there any such thing is going on now a days (or) can i take another experience letter from different institution other than mentioned in application at the time of admission...

Hi all, I would like to know if it is possible to apply for a fresh petition under cap exempt quota with an expired unused H1B visa. Also I have never travelled to US. I need suggestions to deal with my situation. My current h1b visa expires on 30 September 2013. I will be applying for an extension in the first/second week of June with the same employer. I need to travel out of the USA to India for 2 weeks in the month of August (travel on 10 August and return to USA on 23 August). I am thinking of applying for a premium processing during second week of June. Although my visa expires on 30 September, is it possible that I will get my extension approved before August so that I can travel without any issues? If there are any other options I need to look to have my visa extended and also do the my travel without immigration issues please suggest. Thanks for your help In advance.

My petition was applied and approved in the financial year 2011-12,and was valid till may-13.But i went for stamping last month only and the stamping is valid till 31st may 2013. Can i still travel before 31st may considering the validity i might get on I-94.

I am from Dhaka, I had my F1 visa interview on 2nd May 2013. My visa interview was like this:
VO: Good morning! can I see your I-20?
Me: Sure, here you go.
Vo: thanks, how did you manage to get all these money?
Me: I was in UK last few years, i earned these money while i was in UK.
VO: Great, where did you use to work?
Me: replied,
..... VO started typing, she did not see a single document, after about a minute, she said your visa has been approved, congratulations. She gave me white paper where its instructed to check the update, VO (she) told me that when you see the status 'issued' then come to collect your passport. she kept my passport.

I was so happy, but after one day i track the CEAC website, it says administrative processing, ok fine. I was tracking everyday, even every hour sometimes. After 10 days they update the date, but still administrative processing. after two days of last update on 13th may, they again changed the date and says administrative processing. I am now really worried, they update the date twice. Can anybody please tell me why its still administrative processing? When i was in UK, i was on appeal against a visa refusal. and UKBA banned me for 10 years. I came back to my countru willingly though i had the right of appeal. Will it be a problem for getting the visa? as far as i know US, UK, Canada they share fingerprints. Please give me some suggestions, I am going mad.

I have H1b Visa with a small desi consulting company A. I got it on Jan 2012 for until May 31, 2013(was an L1b to H1 transfer, leaving 1.5 years available to me). My employer has filed for H1b extension today(yet to receive the receipt) but I have an emergency travel to India for a short visit. I dont have stamping so I might have to stay in India until, get any update on my current case.
Though I hope that I might just able to cancel visit, but in case I couldn't and travel outside without getting decision(lets say on 21st May, following can occur.

1) How does it impact my Visa review. - Will it continue in the same way or it will be converted to consular process.

2) If I get the approval, I have to get the stamping done. How many does it might take to get stamping done?
2.1) If Stamping is approved I can travel on the newly issued and stamped H1b.

3) In case my H1b is approved but stamping is rejected- What options I have to travel back?

4) In case my H1b itself is denied what are the options? - Can same employer or any other employer file for me from India as Cap Exempt.

Please let me know your thoughts on that.

I am working with company A and my H1B Visa is stamped. The stamp is expiring in Sep 2014. I have not travelled to US yet.

Now I have got an offer from Company B. They say that they plan to send me to US but they don't want me to travel on H1B Visa. They want to apply B1 Visa for me.

1) Will my H1-B visa automatically get cancelled if I go for B1 also?

2) Can H1-B and B1 be valid together at the same time?

3) Can I travel on my existing H1 B also after my travel on B1?

Is this really the case??

H1B pitition - spelling mismatch in passport and education docs

My h1B petition has been selected in the 2013 H1B lottery. currently it is in "initial review" state.

My concern is, all my educational certificates have my name as "SUJOY MAJUMDER", where as in my indian passport, voter ID card it is mentioned as "SUJAY MAJUMDER".

This issue is a manual error by indian govt, during my voter card ID generation and rest all the docs followed the same name. The educational ones are erlier than that.

during my singapore EP processing the gov of singapore asked for an efidebit stating that both are same person. So, as a precaustionary measure, During the pition filing i have submitted an efidebit stating both are the same person.

can this difference in name spelling cause any concern for my H1B approval ?

I am currently working on Employer-Client basis. I applied for H1B this year and is not picked in the lottery. Since my Opt is going to expire on Feb 25th, I understand that I have 60 days grace period and I can apply for H1B and get the response within 60 days. I like this optionvery much, however when I submit my petition to USCIS, I'm confused whether I can submit my client letter stating that it is an ongoing project or submit as an in house project. Since I could not find a job opening at US , I had to quit my job and got h4 stamping as my hubby is on h1b and planning to travel in h4 visa immediately. I am currently in US on H1B visa and working for an Indian IT firm. I have been here last 4 months. I have around 8 payslips. Next month I am going back to India since my project is getting over. I planning to change my job and I have also identified a Consultant. The consultant has started marketing my CV. But I will not join the new consultant unless I get the right project. I will keep giving interviews.

My question is that incase I dont get a good project and I return to India and continue giving interviews in US and once I get the right project. Can I travel back to US with my new petition? Do I need to go for restamping? If not then will I face issues at POE.

What are the challenges I will face in this scenario?

I have a question regarding H4 stampnig of my spouse. Below is the typical scenario:

• Her passport was issued before marriage, hence her surname there is as before marriage and DOES NOT have my name endorsed. Her name is mentioned there as XXX YYY and her father’s name as AB CD EF.
• Our Marriage certificate has her first name only and no surname. Her name is mentioned there as XXX and her father’s name as AB CD GH.
• In my passport, her name is endorsed but with her surname as after marriage. Her name is mentioned as XXX ZZZ.

Can you please advise if that shall be fine when we go for stamping or I need to get some corrections?

Employer not disclosing H1-B receipt details

I have an approved H1B. Due to internal policies, my organization is not disclosing the H1-B approval notice or receipt number. I want to travel on H-4 and then do a COS through employer B. If I call USCIS customer care and provide first name and last name, will they priovide the receipt no. What are the alternatives that I have.

Hello...I have an approved H1-B. Since I could not find a suitable project that can initiate H1-B stamping and send me to U.S, I am planning to stamp H-4 and travel to U.S and then look for project through my company and do change of status to H1-B. My H-4 interview is scheduled for 21st May.

What can I expect during H-4 visa interview since I have an approved H1-B?. What should I prepare for to ensure that H-4 is not denied ensuring that my H1-B is safe as well? I got inputs from a friend that if I say to consular officer that I want to be with my wife for few months, he/she may question the intent of using H-4 as I can go on a visiting visa. If I say that I am not going on H-1 because currently there is no project for me, he/she may revoke the H-1. What will be the best way to convince the VO? Does anyone in the forum have similar experiences? Appreciate your help.

I have applied for H1B when I had a CPT.Now, I have applied for CPT for a second semester but right now my university do not want to give me a CPT.Currently I am working in xxx company.Can you please give me a suggestion that Is it impact to get approval for H1B.

I got a RFE that they want a Evedence letter from my university because I got a CPT on first day on f class. :

Evidence letter that CPT was an integral part of the Student's Degree Program

Evidence letter that immediate participation was required for Student's Degree Program.

My CPT has expired so, there is no Work authorization right now. How can I reply to USCIS??

Let me make this question as short and detailed as possible.

I'm currently working as an creative in an advertising company in Los Angeles and my company would like to keep me employed. My 12 month J-1 Intern Visa expires in October 2013. We applied for an H-1B visa this year but I didn't get through the lottery so I'm looking for other options. I have a Master of Arts obtained in Sept. 2012.

- Green Card through employer? Is this realistic in my situation?

- Take courses related to my job at an US university and go on a F-1 visa CPT and keep working at my company? And apply for the next H-1B

- I am in contact with attorneys about my eligiblity for an O-1 visa.

- I hear they can extend J-1's in some sitiuations, what are those?

I have L1 VISA with company A.

I have applied for H1B VISA with company B. It's still under process. I have filed as consular processing and not COS. I might need to travel to US in next few days (while my H1B is still under process) on L1 VISA with Company A.

I have following concerns:

Can I travel to US on L1 when my H1B is under process or petetition is approved before I travel?
Can I resign in US on L1 VISA? (My company India's policy states that I cant resign on L1). Will that India policy valid in US? Can my company refuse my resignation or refuse giving me experience letter?
Can I choose to continue with L1 employer even after my H1B petetion is approved? What's the time limit for me to convert to H1 status (to use my approved H1B petetion)
Can I amend my H1B application (once petetion is approved) to be COS instead of consular processing?

h1b first time; administratively closed

I've applied in premium processing. I got receipt on 8th of April 2013.

There was no updates on my case from 8th of April. I haven't got RFE.

Now when I asked my employer to find out about my case.He called USCIS.
And my employer told that they said my case is closed administratively.

USCIS told that it was an error in sending receipt notice(i got both mail and email receipt notices). my case is not selected under cap.

But my employer said checks were cashed. Emp, has sent those proofs that checks were cashed to the uscis officer. those are forwarded to some other unit which deals with these kind of issues.

I don't know what happens now.

Hello i have applied for h1b visa under premium category, but still i did not got any information regaring my application acceptance or rejection. When ever i contact with my employer about the status he says that there is no reply for your application. Is this normal because I heard that premium applicants are the first to know about there results. And also what is the last date for announcing the results.

My H1 petation is approved and it is valid until 2015 ,and my current company has no projects and they are not sending me for stamping ,now iam looking for change and new company want to transer the petation ,if new company transfer the petaion will the current company will come know

I have decided to move out once every thing is fine with new company once i was stampled i will put the paper ,My concer is my current company should know this ,once i regined will they cancel my petation ,pls guide me my current comapny should not know that i have done the transfer .

In the Visa payment process there a section which is asking my mailing address,

My current address and passport address are different, what address should I mention there also

Do I need to submit DS 160 before making a visa payment or it can be done without completing the whole form

Now a days most of airline allowd MAX 158cm baggage while traving to USA but I have 159cm size bag (as specified by bag manual).

Will they allowed my bag as free check-in ?
