Am I eligible for filing H1B for H1 B visa cap for 2013?

Dear Sir/Madam, I from India, got H1B sponcership from a company in 2008 and applied for H1B. I went for stamping in 2009 Feb, got 221G. Company had to submit many documents, and finally stamping was done in 2010 March and it had validity till November 2010. I could not travel for 2 month becuase of my family issues and then the time was not sufficient. So I never travelled. I want to apply now, Am I eligible for 2013 Quota?

H1B quota for FY2013 has reached its cap-limit on June 11th and hence you cannot apply for FY2013 quota.

However, you are eligble for cap-exempt petition filing since you had an approved H1B in the last 6 years. Cap-exempt petitions can be filed at any time of the year.
