Currently on OPT, H1B is picked, got an offer from another employer? Can I switch with my pending H1B case?

Hello guys,

I am on F1-OPT as of now. This is my first attempt of H1-B visa.My current employer has filed for my H1-B visa and it seems that my case has been picked up in the lottery through SEVP Portal End Date update.

I recently got an offer from a different employer which is a better position, opportunity, and pay. I have one week to respond to this offer and after that probably a month’s notice with current employer. By this time if my H1B is approved, then how can I legally change my employer by June first or the second week (before October 1st) and still maintain my H1B status?

When is your OPT expiring ?

My OPT is expiring on June 18th 2018. I have a STEM Extension from 19th June 2018 to 18th June 2020.

Once your H1B is approved, you need to have a copy of the approved notice in order to apply for transfer. I would suggest that you wait until you get that hold of that copy, before you make any move, given that lottery is getting difficult year over year.

Ask for time until then to join. I believe the immigration team at the new company will understand and support your case.
