K1 visa denied for previous spouse, Apply GC for current spouse

We married in 2017 and my wife already sponsored someone for K1-Visa in 2008 for an arranged marriage through parents, petition for him was approved but was denied visa in India(Delhi Consulate), so relationship didn’t go on. Then we met and dated for a while and married.

The uscis status for old Case shows as below:

Department of State Sent Case to USCIS For Review
On October 22, 2008, the Department of State sent us your case, Receipt Number EAC…, for review. We are reviewing it, and will notify you by mail when we are done. Please follow any instructions in the notice. If you move, go to How to Change Your Address | USCIS to give us your new mailing address.

What steps we should take to get my GC through marriage now?
We have marriage certificate for our marriage and we want to live together for life.

Congratulations to both of you on a major decision. The older K1 visa denial case has no relevance here. You can ask your wife to proceed with filing your green card papers. Please note that a visa denial is never on the sponsor’s (your wife’s) record, it shows up only on the applicant (the person who tried to get K visa in 2008) file

Thanks for reply but I just checked the visa case status and it says “Returned to NVC”

How we know it is expired and we do not have to take any action ??
